Subject: Petition against baseless charge sheets and grant of service benefits regarding. Sir, Under Article 161 of the Constitution of India, the Governor of a State has the power to grant pardons, reprieves, respites or remissions of punishment or to suspend, remit or commute the sentence of any person convicted of any offence against any law relating to a matter to which the executive power of the State extends. General public and employees of the State Government can submit Petitions / Complaints / representation / memorandum to HE the Governor for redressal of their grievances. In Rajasthan, retired State Government Employees may petition the Governor against the orders passed under rule 7, the Rajasthan Civil Services (Pension) Rules, 1996 for seeking relief. Besides, Petitions under Rule 34, the Rajasthan Civil Services (Classification, Control and Appeal) Rules, 1958 are Submitted to HE the Governor by employees of State Government for seeking relief against penalty orders of Disciplinary and Appellate Authority, might be similar provisions in Haryana also. It is humbly submitted that Naresh Kadyan joined Haryana Khadi and Village Industries Board on April 5, 1984 and he was holding 7 offices of Haryana Khadi and Village Industries Board till February, 2013 and then he was posted at Panchkula under pressure of the Principal Secretary to the Govt. of Haryana, Department of Industries Shri Y.S. Malik, IAS because Shri R.K. Sharma, who was a retired official of the Industries Department, Haryana was given additional charge for the post of Member Secretary, Haryana KVIB and same was opposed by many persons including Naresh Kadyan, later he was removed from this position, during his tenure as Member Secretary , Board meeting was called on December 20, 2012 under the Chairmanship of Shri Y.S. Malik and a resolution passed against Naresh Kadyan sparing another Technical Supervisor (HMP) in the field office as DKVIO but Naresh Kadyan was called at Head Office due to biasedness adopting double standard, where as matter was placed for adjustment as DKVIO, later Naresh Kadyan was placed under suspension, two charge sheets issued for same baseless reasons, two increments were stopped and same order was set side by the Chairman, like wise another baseless charge sheet was also issued for the violation of the MoU signed between CE of Board and supplier, zero FIR has been lodged by Naresh Kadyan for the breach of trust and agreement, Board adopted special techniques, in case of Naresh Kadyan, to harass and mentally torture, because another resolution passed to appoint retired persons to conduct Departmental inquiries, there are nothing to establish and charges are baseless, in another charge sheet Naresh Kadyan performed his official duties, as assigned to him as DKVIO, Faridabad but charges were framed with out giving opportunity to explain and charges were framed on fake and half backed information's, when marketing orders were executed in the month of February, 2007 and some instructions were issued in the month of November, 2007;

how it could be possible to implement these instructions in the month of February, 2007?, then DEEO, Gurgaon was hold guilty by her parent Department and recovered excess payments from her. Like wise Naresh Kadyan has submitted a medical certificate for his sickness, which was issued by a registered medical practitioner but his medical leave was not sanctioned, charge sheet issued for undue benefits, where as sickness is a natural call and no one wants to be sick willingly, in another charge sheet Naresh Kadyan came to Panchkula during sickness at his own cost and risk to ask about his pay, which were illegally with held by the Board but charges were framed. The National Khadi and Village Industries Board (Apex Body of all state KVIB Employees Unions) humbly submitted this petition to pass appropriate orders and personnel hearing may kindly be given, to explain in person: 1. Shri Y.S. Malik, IAS, Principal Secretary to Govt. of Haryana, Department of Industries may kindly be shifted from this position for transparent inquiry and natural justice to Naresh Kadyan. 2. Baseless all three charge sheets needs to be quashed after appointing and obtaining a report from any serving senior officers of the Govt. of Haryana or a siting judge of the High Court because we do not trust on the retired officers, which are appointed as Inquiry officers in case of Naresh Kadyan. 3. Naresh Kadyan service benefits may kindly be given, such as annual increment, which was due as on 14-1995, clearance of EB and then release of annual increments along with second ACP etc., release of pay with held for no reasons. 4. Punish all officers and officials responsible for applying double standards and not stepping up Naresh Kadyan pay, to comply with the instructions issued by the Chief Secretary. 5. Suspension orders of Naresh Kadyan may kindly be quashed and suspension period may kindly be treated as a duty period. Haryana Khadi and Village Industries Board, now Yudhvir Singh Malik working to harm Naresh Kadyan, Internationally renowned figure working as Technical Supervisor (Leather) in Haryana Khadi and Village Industries Board. Y.S. Malik as Chairman, KVIB approved the Board proceeding against Naresh Kadyan adopting double standard because one Technical Supervisor Mahender Chopra allowed to work as District Khadi and Village Industries Officer at Jind, like wise against the law one retired IAS officer deputed to spoil Naresh Kadyan carrier, life, peace, Naresh Kadyan pay with held for no reasons, if Y.S. Malik working as honest officer then he would have been sanctioned annual increment to Naresh Kadyan, which are kept unattended as on April 1, 1995 during up gradation of his pay scale from 16002660 to 1640-2900, many times his pay with held but not released nor he has given second ACP, regular annual increment, which are kept pending due to non availability of annual confidential reports - ACR's. Naresh Kadyan badly harassed by all IAS posted in KVIB, Haryana. Hence National Khadi and Village Industries Board's Employees Federation (An apex body of all India KVIB Employes Unions) demands immediate suspension of Y.S. Malik, removal from the Industries Department and justice for Naresh Kadyan. Very funny things reported when Hon'ble Chief Minister of Haryana passed orders to cancel the posting order of Naresh Kadyan from Faridabad to Panchkula, when his orders placed on file then CM office approved Naresh Kadyan suspension. Yudhvir Singh Malik, IAS will be responsible if any thing happened wrong to Naresh Kadyan and his family members, Y.S. Malik biased role needs attention for good governance in Haryana and Naresh Kadyan needs natural justice.
