Box 7062 Amagansett, NY 11930-7062 Dear Ms. Tritt: We have become aware that Kathleen Cole of Gym Door Repairs, Inc. is contacting a number of school districts with allegations regarding a competitor, Young Equipment Sales, as well as Eastern Suffolk BOCES. The allegations include misuse of various bids, violations of prevailing wage requirements as well as criminal activity on the part of the competitor. It is also alleged that Eastern Suffolk BOCES has failed to prevent this inappropriate conduct on the part of the competitor. By means of this correspondence, we assure you that Eastern Suffolk BOCES has received the information presented by Ms. Cole on numerous occasions and has taken action which we believe to be appropriate under the circumstances. Although an Eastern Suffolk BOCES Cooperative Bidding Program bid number was reflected on certain invoices prepared by the competitor for services not contemplated by a particular bid, the incidents appear to be isolated and, to our knowledge, do not substantiate criminal intent. As is our standard practice in such instances, we have contacted the competitor to explain the proper subject of the bid number in question. Since that contact, there have been no further allegations that the bid number continues to be utilized incorrectly by the competitor. Further, we have received no complaints regarding the competitors performance. In light of the events described above, Eastern Suffolk BOCES has also reminded school districts that when an item/service is purchased utilizing our Cooperative Bidding Program, the school district should take all necessary steps to insure that the product or service being obtained is covered by the particular bid in question. In response to Ms. Coles allegations of criminal activity on the part of the competitor, we have advised her that should she be in possession of any facts in support of her numerous allegations, they should be submitted to the appropriate authorities in the Office of the Suffolk County District Attorney or the Suffolk County Police Department. Eastern Suffolk BOCES does not have independent investigatory powers regarding criminal activity. We will however cooperate with any investigation by the appropriate authorities. We will continue to work cooperatively with Districts to insure that the Eastern Suffolk BOCES Cooperative Bidding Program is properly implemented.
