AN ACT relating to driver's licenses; creating the limited and restricted driver's license, limited instr ction !ermit; amending "#S#A# 2$12 S !!# %-1&2', as amended (y section 2 of cha!ter )' of the 2$1& Session *a+s of "ansas and "#S#A# 2$1& S !!# %-2&) and %-2'$ and re!ealing the e,isting sections# Be it enacted by the Legislature of the State of Kansas: Ne+ Section 1#-.a/ The division of vehicles shall iss e a limited class C driver's license, limited instr ction !ermit or limited and restricted license +hen the follo+ing conditions are satisfied0 .1/-A limited class C driver's license or instr ction !ermit shall (e iss ed to an a!!licant 1) years of age or older +ho is other+ise eligi(le for a driver's license or instr ction !ermit ! rs ant to "#S#A# %-2&), %-2&1 or %-2'$, and amendments thereto, and +ho satisfies the re2 irements set forth in s (section .(/# A limited driver's license iss ed nder this s (section shall (e s (3ect to all of the re2 irements set forth ! rs ant to "#S#A# %-2'), and amendments thereto; or .2/-a limited and restricted class C driver's license shall (e iss ed to an a!!licant +ho is at least 14 years of age ( t less than 1) years of age +ho is other+ise eligi(le for a restricted driver's license or instr ction !ermit ! rs ant to "#S#A# %-2,1$$ or %-2,1$1, and amendments thereto, and +ho satisfies the re2 irements set forth in s (section .(/# .(/ .1/-The division shall iss e a limited driver's license, limited and restricted license, or limited instr ction !ermit to any individ al +ho0 .A/-5s deemed to (e a resident of "ansas ! rs ant to "#S#A# %2&'a.a/.2/, and amendments thereto; .B/-has not (een iss ed a social sec rity n m(er; and .C/-does not !rovide satisfactory doc mentary evidence of citi6enshi! or la+f l !resence ! rs ant to "#S#A# %-2'$.(/.2/.A/, and amendments thereto# .2/-An a!!licant +ho a!!lies for a limited driver's license, limited and restricted license or limited instr ction !ermit shall !resent +ith the a!!lication a valid ne,!ired !ass!ort from the a!!licant's co ntry of citi6enshi! or a valid ne,!ired cons lar identification doc ment, as defined (y s (section .d/ or other !roof of identity deemed acce!ta(le (y the de!artment#

.c/ .1/-A limited driver's license, limited and restricted license or limited instr ction !ermit iss ed nder this section shall contain a notice on its face that the license or !ermit is not acce!ta(le for any of the ! r!oses s!ecified (y the real id act of 2$$4 .9#*# 1$1-1&/, or for the ! r!oses of voting, the ! rchase of a firearm or eligi(ility for ! (lic (enefits# .2/-Any !erson to +hom the division may iss e a limited driver's license, limited and restricted license or limited instr ction !ermit, ! rs ant to s (section .a/, shall (e s (3ect to any and all !rovisions of the motor vehicle driver's license act and the niform act reg lating traffic on high+ays and any and all r les and reg lations iss ed (y the division to the same e,tent as any !erson iss ed a driver's license, nless other+ise !rovided, incl ding, ( t not limited to, the mandatory ins rance re2 irements and !enalties set forth in "#S#A# '$-&1$1 et se2#, and amendments thereto# .&/-9ossession or !resentation of a limited driver's license, limited and restricted license or limited instr ction !ermit iss ed ! rs ant to this section, rather than a driver's license or instr ction !ermit iss ed ! rs ant to "#S#A# %-2&1, %-2'$, %-2,1$$ or %-2,1$1, and amendments thereto, shall not (e sed as evidence of the holder's citi6enshi! or immigration stat s and shall not (e sed as a (asis for a criminal investigation, arrest or detention# .'/-5nformation !rovided in an a!!lication for a limited driver's license, limited and restricted license or limited instr ction !ermit is not a ! (lic record and shall not (e disclosed (y the division, nless re2 ired (y co rt order# 9 rs ant to "#S#A# '4-221, and amendments thereto, the e,ce!tion to the "ansas o!en records act contained in s (section .c/ shall e,!ire on : ne &$, 2$11, nless the legislat re revie+s and reenacts these !rovisions !rior to : ne &$, 2$11# .d/-As sed in this section, ;cons lar identification doc ment; means an official identification card iss ed (y a foreign government that meets all of the follo+ing re2 irements0 .1/-The identification card is iss ed thro gh the foreign government's cons lar offices for the ! r!ose of identifying a foreign national +ho is living o tside the foreign 3 risdiction# .2/-The foreign government re2 ires the foreign national to !rovide !roof of nationality that is +ithin the foreign government's 3 risdiction and !roof of identity to o(tain the identification card# .&/-The foreign government incl des all of the follo+ing sec rity feat res in the identification card0 .A/-A ni2 e identification n m(er; .B/-an o!tically varia(le feat re s ch as a hologram or color-shifting in<s;

.C/-an ltraviolet image; .=/-encoded information; .>/-machine-reada(le technology; .F/-micro!rinting; .?/-sec re laminate; and .8/-integrated !hotogra!h and signat re# .'/-The identification card incl des on its face the name of the individ al to +hom it is iss ed, the date of iss ance, the date of e,!iration, the name of the iss ing cons lar office or foreign government and the ni2 e identification n m(er# The identification card m st incl de an >nglish translation of the data fields# .4/-The iss ing cons lar office or foreign government has filed +ith the division a co!y of the foreign government's standard cons lar identification doc ment and a certification of the !roced res that are sed to satisfy the re2 irements ! rs ant to s (sections .(/ and .c/# .e/-The secretary of reven e shall !rom lgate r les and reg lations necessary to carry o t the !rovisions of this section# .f/-This section shall (e a !art of and s !!lemental to the motor vehicle driver's license act# Sec# 2#-"#S#A# 2$1& S !!# %-2&) is here(y amended to read as follo+s0 %-2&)# The division of vehicles shall not iss e any driver's license to any !erson0 .a/-@ho is nder the age of 1) years, e,ce!t that the division may iss e a restricted class C or A license, as !rovided in "#S#A# 2$1& S !!# %2,1$1, and amendments thereto, or a farm !ermit, nder "#S#A# %-217, and amendments thereto# .(/-@ho is nder the age of 1% years, e,ce!t as !rovided in "#S#A# %2,1'), and amendments thereto, for the ! r!ose of driving a commercial or class A or B motor vehicle# .c/-@hose license is c rrently revo<ed, s s!ended or canceled in this or any other state, e,ce!t as !rovided in "#S#A# %-247, and amendments thereto# .d/-@ho is a ha(it al dr n<ard, ha(it al ser of narcotic dr gs or ha(it al ser of any other dr g to a degree +hich renders the ser inca!a(le of safely driving a motor vehicle# .e/-@ho has !revio sly (een ad3 dged to (e afflicted +ith or s ffering from any mental disa(ility or disease and +ho, at the time of ma<ing a!!lication for a driver's license, has not (een restored to ca!acity in the manner !rovided (y la+# A!!lication of this limitation to any !erson <no+n to have s ffered any sei6 re disorder is s (3ect to the !rovisions of "#S#A# %-2'), and amendments thereto# .f/-@ho is re2 ired (y the motor vehicle drivers' license act to ta<e an e,amination, nless the !erson has s ccessf lly !assed the e,amination#

.g/-@ho is at least 17 years of age and less than 1) years of age, +ho is a!!lying for a driver's license for the first time since reaching 17 years of age and +ho, three times or more, has (een ad3 dged to (e a traffic offender nder the "ansas 3 venile code or a 3 venile offender nder the revised "ansas 3 venile 3 stice code, (y reason of violation of one or more stat tes reg lating the movement of traffic on the roads, streets or high+ays of this state, e,ce!t that, in the discretion of the director, the !erson may (e iss ed a driver's license +hich is restricted in the manner the division deems to (e a!!ro!riate# No !erson descri(ed (y this s (section shall (e eligi(le to receive a driver's license +hich is not restricted ntil the !erson has reached the age of 1) years# .h/-@ho has not s (mitted !roof of age or !roof of identity, as re2 ired (y "#S#A# %-2'$, and amendments thereto# .i/-@hose !resence in the Bnited States is in violation of federal immigration la+s, unless such person is applying for a limited driver s license, limited and restricted license or limited instruction permit pursuant to section 1, and amendments thereto# Sec# &#-"#S#A# 2$1& S !!# %-2'$ is here(y amended to read as follo+s0 %-2'$# .a/ .1/ >very a!!lication for an instr ction !ermit shall (e made !on a form f rnished (y the division of vehicles and accom!anied (y a fee of C2 for class A, B, C or A and C4 for all commercial classes# >very other a!!lication shall (e made !on a form f rnished (y the division and accom!anied (y an e,amination fee of C&, nless a different fee is re2 ired (y "#S#A# %-2'1, and amendments thereto, and (y the !ro!er fee for the license for +hich the a!!lication is made# 5f the a!!licant is not re2 ired to ta<e an e,amination the e,amination fee shall not (e re2 ired# The e,amination shall consist of three tests, as follo+s0 .A/ Dision; .B/ +ritten; and .C/ driving# 5f the a!!licant fails the vision test, the a!!licant may have correction of vision made and ta<e the vision test again +itho t any additional fee# 5f an a!!licant fails the +ritten test, the a!!licant may ta<e s ch test again !on the !ayment of an additional e,amination fee of C1#4$# 5f an a!!licant fails the driving test, the a!!licant may ta<e s ch test again !on the !ayment of an additional e,amination fee of C1#4$# 5f an a!!licant fails to !ass all three of the tests +ithin a !eriod of si, months from the date of original a!!lication and desires to ta<e additional tests, the a!!licant shall file an a!!lication for ree,amination !on a form f rnished (y the division, +hich shall (e accom!anied (y a ree,amination fee of C&, e,ce!t that any a!!licant +ho fails to !ass the +ritten or driving !ortion of an e,amination fo r times +ithin a si,-month !eriod, shall (e re2 ired to +ait a !eriod of si, months from the date of the last failed e,amination (efore additional e,aminations may (e given# B!on the filing of s ch a!!lication and the !ayment of s ch ree,amination fee, the a!!licant shall (e entitled to ree,amination in li<e

manner and s (3ect to the additional fees and time limitation as !rovided for e,amination on an original a!!lication# 5f the a!!licant !asses the ree,amination, the a!!licant shall (e iss ed the classified driver's license for +hich the a!!licant originally a!!lied, +hich license shall (e iss ed to e,!ire as if the a!!licant had !assed the original e,amination# .2/-A!!licants for class A licenses +ho have com!leted !rior motorcycle safety training in accordance +ith de!artment of defense instr ction 7$44#$' .=o=5 7$44#$'/ are not re2 ired to com!lete f rther +ritten and driving testing ! rs ant to !aragra!h .1/ of this s (section# .(/ .1/-For the ! r!oses of o(taining any driver's license or instr ction !ermit, an a!!licant shall s (mit, +ith the a!!lication, !roof of age and !roof of identity as the division may re2 ire# The a!!licant also shall !rovide a !hoto identity doc ment, e,ce!t that a non-!hoto identity doc ment is acce!ta(le if it incl des (oth the a!!licant's f ll legal name and date of (irth, and doc mentation sho+ing the a!!licant's name, the a!!licant's address of !rinci!al residence and the a!!licant's social sec rity n m(er# The a!!licant's social sec rity n m(er shall remain confidential and shall not (e disclosed, e,ce!t as !rovided ! rs ant to "#S#A# )'-2$12, and amendments thereto# 5f the a!!licant does not have a social sec rity n m(er the a!!licant shall !rovide !roof of la+f l !resence and "ansas residency unless the applicant is applying for either a limited driver s license, limited and restricted license or limited instruction permit pursuant to section 1, and amendments thereto# The division shall assign a disting ishing n m(er to the license or !ermit# .2/ !"#$%&cept as provided in subsection !B#, the division shall not iss e any driver's license or instr ction !ermit to any !erson +ho fails to !rovide !roof that the !erson is la+f lly !resent in the Bnited States# Before iss ing a driver's license or instr ction !ermit to a !erson, the division shall re2 ire valid doc mentary evidence that the a!!licant0 .A/!i# 5s a citi6en or national of the Bnited States; .B/!ii# is an alien la+f lly admitted for !ermanent or tem!orary residence in the Bnited States; .C/ !iii# has conditional !ermanent resident stat s in the Bnited States; .=/!iv# has an a!!roved a!!lication for asyl m in the Bnited States or has entered into the Bnited States in ref gee stat s; .>/!v# has a valid, ne,!ired nonimmigrant visa or nonimmigrant visa stat s for entry into the Bnited States; .F/!vi# has a !ending a!!lication for asyl m in the Bnited States; .?/!vii# has a !ending or a!!roved a!!lication for tem!orary !rotected stat s in the Bnited States; .8/!viii# has a!!roved deferred action stat s; or .5/!i&# has a !ending a!!lication for ad3 stment of stat s to that of an alien la+f lly admitted for !ermanent residence in the Bnited States or conditional !ermanent resident stat s in the Bnited States# !B#$'he division shall issue a limited driver s license, limited and restricted license or limited instruction permit to any applicant (ho fulfills

the re)uirements set forth in section 1, and amendments thereto* .&/-5f an a!!licant !rovides evidence of la+f l !resence set o t in s (sections .(/.2/.>/ !b#!2#!"#!v# thro gh .2/.5/!"#!i&#, or is an alien la+f lly admitted for tem!orary residence nder s (section .(/.2/.B/ !b# !2#!"#!ii#, the division may only iss e a driver's license to the !erson nder the follo+ing conditions0 .A/ A driver's license iss ed ! rs ant to this s (!aragra!h shall (e valid only d ring the !eriod of time of the a!!licant's a thori6ed stay in the Bnited States or, if there is no definite end to the !eriod of a thori6ed stay, a !eriod of one year; .B/ a driver's license iss ed ! rs ant to this s (!aragra!h shall clearly indicate that it is tem!orary and shall state the date on +hich it e,!ires; .C/ no driver's license iss ed ! rs ant to this s (!aragra!h shall (e for a longer !eriod of time than the time !eriod !ermitted (y s (section .a/ of "#S#A# %-2'), and amendments thereto; and .=/ a driver's license iss ed ! rs ant to this s (!aragra!h may (e rene+ed, s (3ect at the time of rene+al, to the same re2 irements and conditions as set o t in this s (section .(/ for the iss ance of the original driver's license# .'/-The division shall not iss e any driver's license or instr ction !ermit to any !erson +ho is not a resident of the state of "ansas, e,ce!t as !rovided in "#S#A# %-2,1'%, and amendments thereto# .4/-The division shall not iss e a driver's license to a !erson holding a driver's license iss ed (y another state +itho t ma<ing reasona(le efforts to confirm that the !erson is terminating or has terminated the driver's license in the other state# .7/-The !arent or g ardian of an a!!licant nder 17 years of age shall sign the a!!lication for any driver's license s (mitted (y s ch a!!licant# .c/->very a!!lication shall state the f ll legal name, date of (irth, gender and address of !rinci!al residence of the a!!licant, and (riefly descri(e the a!!licant, and shall state +hether the a!!licant has (een licensed as a driver !rior to s ch a!!lication, and, if so, +hen and (y +hat state or co ntry# S ch a!!lication shall state +hether any s ch license has ever (een s s!ended or revo<ed, or +hether an a!!lication has ever (een ref sed, and, if so, the date of and reason for s ch s s!ension, revocation or ref sal# 5n addition, a!!lications for commercial drivers' licenses and instr ction !ermits for commercial licenses m st incl de the follo+ing0 The a!!licant's social sec rity n m(er; the !erson's signat re; the !erson's colored digital !hotogra!h; certifications, incl ding those re2 ired (y '1 C#F#E# F &%&#)1.a/, effective :an ary 1, 1111; a consent to release driving record information; and, any other information re2 ired (y the division# .d/-@hen an a!!lication is received from a !erson !revio sly licensed in another 3 risdiction, the division shall re2 est a co!y of the driver's record from the other 3 risdiction# @hen received, the driver's record shall (ecome a !art of the driver's record in this state +ith the same force and

effect as tho gh entered on the driver's record in this state in the original instance# .e/-@hen the division receives a re2 est for a driver's record from another licensing 3 risdiction the record shall (e for+arded +itho t charge# .f/-A fee shall (e charged as follo+s0 .1/-For a class C driver's license iss ed to a !erson at least 21 years of age, ( t less than 74 years of age, C1%; .2/-for a class C driver's license iss ed to a !erson 74 years of age or older, C12; .&/-for a class A driver's license iss ed to a !erson at least 21 years of age, ( t less than 74 years of age, C12#4$; .'/-for a class A driver's license iss ed to a !erson 74 years of age or older, C1; .4/-for a class A or B driver's license iss ed to a !erson +ho is at least 21 years of age, ( t less than 74 years of age, C2'; .7/-for a class A or B driver's license iss ed to a !erson 74 years of age or older, C17; .)/-for any class of commercial driver's license iss ed to a !erson 21 years of age or older, C1%; or .%/-for class A, B, C or A, or a farm !ermit, or any commercial driver's license iss ed to a !erson less than 21 years of age, C2$# A fee of C1$ shall (e charged for each commercial driver's license endorsement, e,ce!t air (ra<e endorsements +hich shall have no charge# A fee of C& !er year shall (e charged for any rene+al of a license iss ed !rior to the effective date of this act to a !erson less than 21 years of age# 5f one fails to ma<e an original a!!lication or rene+al a!!lication for a driver's license +ithin the time re2 ired (y la+, or fails to ma<e a!!lication +ithin 7$ days after (ecoming a resident of "ansas, a !enalty of C1 shall (e added to the fee charged for the driver's license# .g/-Any !erson +ho !ossesses an identification card as !rovided in "#S#A# %-1&2', and amendments thereto, shall s rrender s ch identification card to the division !on (eing iss ed a valid "ansas driver's license or !on reinstatement and ret rn of a valid "ansas driver's license# .h/-The division shall re2 ire that any !erson a!!lying for a driver's license s (mit to a mandatory facial image ca!t re# .i/-The director of vehicles may iss e a tem!orary driver's license to an a!!licant +ho cannot !rovide valid doc mentary evidence as defined (y s (section .(/.2/, if the a!!licant !rovides com!elling evidence !roving c rrent la+f l !resence# Any tem!orary license iss ed ! rs ant to this s (section shall (e valid for one year# Sec# '#-"#S#A# 2$12 S !!# %-1&2', as amended (y section 2 of cha!ter )' of the 2$1& Session *a+s of "ansas, is here(y amended to read as follo+s0 %-1&2'# .a/ Any resident +ho does not hold a c rrent valid

"ansas driver's license may ma<e a!!lication to the division of vehicles and (e iss ed one identification card# .(/-For the ! r!ose of o(taining an identification card, an a!!licant shall s (mit, +ith the a!!lication, !roof of age, !roof of identity and !roof of la+f l !resence# An a!!licant shall s (mit +ith the a!!lication a !hoto identity doc ment, e,ce!t that a non-!hoto identity doc ment is acce!ta(le if it incl des (oth the a!!licant's f ll legal name and date of (irth, and doc mentation sho+ing the a!!licant's name, the a!!licant's address of !rinci!al residence and the a!!licant's social sec rity acco nt n m(er# The a!!licant's social sec rity n m(er shall remain confidential and shall not (e disclosed, e,ce!t as !rovided ! rs ant to "#S#A# )'-2$12, and amendments thereto# 5f the a!!licant does not have a social sec rity n m(er, the a!!licant shall !rovide !roof of la+f l !resence and "ansas residency# The division shall assign a disting ishing n m(er to the identification card# Before iss ing an identification card to a !erson, the division shall ma<e reasona(le efforts to verify +ith the iss ing agency the iss ance, validity and com!leteness of each doc ment re2 ired to (e !resented (y the a!!licant to !rove age, identity and la+f l !resence# .c/-The division shall not iss e an identification card to any !erson +ho fails to !rovide !roof that the !erson is la+f lly !resent in the Bnited States# 5f an a!!licant !rovides evidence of la+f l !resence as set o t in s (sections .(/.2/.>/ !b#!2#!"#!v# thro gh .2/.5/ !"#!i&# of "#S#A# %-2'$, and amendments thereto, or is an alien la+f lly admitted for tem!orary residence nder s (section .(/.2/.B/ !b#!2#!"#!ii# of "#S#A# %-2'$, and amendments thereto, the division may only iss e a tem!orary identification card to the !erson nder the follo+ing conditions0 .A/ A tem!orary identification card iss ed ! rs ant to this s (!aragra!h shall (e valid only d ring the !eriod of time of the a!!licant's a thori6ed stay in the Bnited States or, if there is no definite end to the !eriod of a thori6ed stay, a !eriod of one year; .B/ a tem!orary identification card iss ed ! rs ant to this s (!aragra!h shall clearly indicate that it is tem!orary and shall state the date !on +hich it e,!ires; .C/ no tem!orary identification card iss ed ! rs ant to this s (!aragra!h shall (e for a longer !eriod of time than the time !eriod !ermitted (y "#S#A# %-1&24, and amendments thereto; and .=/ a tem!orary identification card iss ed ! rs ant to this s (!aragra!h may (e rene+ed, s (3ect at the time of rene+al, to the same re2 irements and conditions set forth in this s (section .c/ for the iss ance of the original tem!orary identification card# .d/-The division shall not iss e an identification card to any !erson +ho holds a c rrent valid "ansas driver's license nless s ch driver's license has (een !hysically s rrendered ! rs ant to the !rovisions of s (section .e/ of "#S#A# %-1$$2, and amendments thereto# .e/-The division shall ref se to iss e an identification card to a !erson

holding a driver's license or identification card iss ed (y another state +itho t confirmation that the !erson is terminating or has terminated the license or identification card# .f/-The !arent or g ardian of an a!!licant nder 17 years of age shall sign the a!!lication for an identification card s (mitted (y s ch a!!licant# .g/ .1/-The division shall re2 ire !ayment of a fee of C1' at the time a!!lication for an identification card is made, e,ce!t that !ersons +ho are 74 or more years of age or +ho are handica!!ed, as defined in "#S#A# %1,12', and amendments thereto, shall (e re2 ired to !ay a fee of only C1$# 5n addition to the fees !rescri(ed (y this s (section, the division shall re2 ire !ayment of the !hoto fee esta(lished ! rs ant to "#S#A# %-2'&, and amendments thereto, for the cost of the !hotogra!h to (e !laced on the identification card# .2/-The division shall not re2 ire or acce!t !ayment of a!!lication or !hoto fees nder this s (section for any !erson 1) years of age or older for ! r!oses of meeting the voter identification re2 irements of "#S#A# 2421$%, and amendments thereto# S ch !erson shall0 .A/-S+ear nder oath that s ch !erson desires an identification card in order to vote in an election in "ansas and that s ch !erson does not !ossess any of the forms of identification acce!ta(le nder "#S#A# 2421$%, and amendments thereto# The affidavit shall s!ecifically list the acce!ta(le forms of identification nder "#S#A# 24-21$%, and amendments thereto; and .B/-!rod ce evidence that s ch !erson is registered to vote in "ansas# .&/-The secretary of reven e shall ado!t r les and reg lations in order to im!lement the !rovisions of !aragra!h .2/# .h/-All "ansas identification cards shall have !hysical sec rity feat res designed to !revent tam!ering, co nterfeiting or d !lication for fra d lent ! r!oses# .i/-For the ! r!oses of "#S#A# %-1&2' thro gh %-1&2%, and amendments thereto, a !erson shall (e deemed to (e a resident of the state if0 .1/-The !erson o+ns, leases or rents a !lace of domicile in this state; .2/-the !erson engages in a trade, ( siness or !rofession in this state; .&/-the !erson is registered to vote in this state; .'/-the !erson enrolls the !erson's child in a school in this state; or .4/-the !erson registers the !erson's motor vehicle in this state# .3/-The division shall re2 ire that any !erson a!!lying for an identification card s (mit to a mandatory facial image ca!t re# .</ .1/-Any !erson +ho is a veteran may re2 est that the division iss e to s ch !erson a nondriver identification card +hich shall incl de the designation ;D>T>EAN; dis!layed on the front of the nondriver identification card at a location to (e determined (y the secretary of

reven e# 5n order to receive a nondriver identification card descri(ed in this s (section, the veteran m st !rovide !roof of the veteran's military service and honora(le discharge or general discharge nder honora(le conditions, incl ding a co!y of the veteran's ==21' form or e2 ivalent# .2/-As sed in this s (section, ;veteran; means a !erson +ho0 .A/-8as served in0 The army, navy, marine cor!s, air force, coast g ard, air or army national g ard or any (ranch of the military reserves of the Bnited States; and .B/-has (een se!arated from the (ranch of service in +hich the !erson +as honora(ly discharged or received a general discharge nder honora(le conditions# .&/-The director of vehicles may ado!t any r les and reg lations necessary to carry o t the !rovisions of this s (section# .l/-The director of vehicles may iss e a tem!orary identification card to an a!!licant +ho cannot !rovide valid doc mentary evidence as defined (y s (section .c/, if the a!!licant !rovides com!elling evidence !roving c rrent la+f l !resence# Any tem!orary identification card iss ed ! rs ant to this s (!aragra!h shall (e valid for one year# .m/-B!on !ayment of the re2 ired fee, the division shall iss e to every a!!licant 2 alifying nder the !rovisions of this act an identification card# S ch identification card shall (ear a disting ishing n m(er assigned to the cardholder, the f ll legal name, date of (irth, address of !rinci!al residence, a (rief descri!tion of the cardholder, a colored digital !hotogra!h of the cardholder, and a facsimile of the signat re of the cardholder# An identification card +hich does not contain the address of !rinci!al residence of the cardholder as re2 ired may (e iss ed to !ersons +ho are !rogram !artici!ants ! rs ant to "#S#A# 2$1& S !!# )4-'44, and amendments thereto# Sec# 4#-"#S#A# 2$12 S !!# %-1&2', as amended (y section 2 of cha!ter )' of the 2$1& Session *a+s of "ansas and "#S#A# 2$1& S !!# %2&) and %-2'$ are here(y re!ealed# Sec# 7#-This act shall ta<e effect and (e in force from and after its !
