PROCEDURE UNDER E-TENDERING INSTRUCTIONS TO APPLICANTS

(Note: RFQ stands modified to the extent required as per these instructions).

DEFINITIONS a) A service provider to develop and customize the software and facilitate the process of e-tendering on application service provider model. (Refer Glossary in the RFQ) b) Tender Wizard: An e-tendering portal of National Highways Authority of India (NHAI ) introduced for the process of e-tendering which can be accessed on http://www.tenderwizard.com/NHAI. (Refer Glossary in the RFQ) Words in capital and not defined in this document shall have the same meaning as in the Request for Qualification (RFQ ). 1) ACCESSING/PURCHASING OF BID DOCUMENTS: (i) It is mandatory for all the Applicants to have class-III digital signature certificate (in the name of person who will sign the Application) from any of the licensed certifying agency ( CA) *Applicants can see the list of licensed CAs from the link www.cca.gov.into participate in e-tendering of NHAI. To participate in the submission of the Application against the RFQ, it is mandatory for the Applicants to get themselves registered with the Tender Wizard and to have user ID & password which has to be obtained by submitting an annual registration charges of Rs. 2,206 (Inclusive of all taxes) through e-payment gateway of Punjab National Bank using Credit Card/Debit Card Master Card and Visa card only - on e-tender portal www.tenderwizard.com/NHAI . Validity of online registration is 1 year. RFQ can be viewed/downloaded, free of cost, till 10.05.2012 upto 1700 hours. Following may be noted(a) (b) Applications can be submitted only during the validity of registration with the Tender Wizard. The amendments/clarifications to the RFQ, if any, will be posted on the NHAI website. ITI Limited:

To participate in bidding, Applicants have to pay a sum of Rs. 60,000/- (Rs. Sixty thousand only) as a cost of the RFQ process (non-refundable) in the form of demand draft issued from a Scheduled Bank in India in favour ofNational Highways Authority of India payable at New Delhi and Rs 12,000 (Twelve thousand only) plus Rs. 1,236 (One thousand two hundred

and thirty six only) as service tax towards Application processing fee (nonrefundable) through e-payment gateway of Punjab National Bank using Credit Card/Debit Card Master Card and Visa card only - on e-tender portal www.tenderwizard.com/NHAI or in the form of Demand Draft in favour of M/s ITI Limited , payable at New Delhi. (Refer Clause 1.2.1 to the RFQ) (v) If the Applicant has already registered with the Tender Wizard and validity of registration has not expired, then such Applicant does not require fresh registration.

PREPARATION & SUBMISSION OF APPLICATIONS: (i) Detailed RFQ may be downloaded from Tender Wizard and the Application may be submitted online following the instructions appearing on the screen. A Vendor manual containing the detailed guidelines for e-tendering system is also available on Tender Wizard. (ii) The following shall be the form of various documents in the Application: A. Only Electronic Form (to be uploaded on the Tender Wizard) (Refer to Clause 2.13.2 of the RFQ) (a) Application in the prescribed format [including Annexures -I (details of Applicant), II (Technical capacity), III (Financial capacity), and IV (Details of Eligible project)to Appendix-I along with supporting documents; copy of Memorandum and Articles of Association, if the Applicant is a body corporate, and if a partnership then a copy of its partnership deed; copies of Applicants duly audited balance sheet and profit and loss account for the preceding five years; Letter of Pre-qualification issued by the Authority in respect of the Applicants who have been Pre-qualified by the Authority at RFAQ stage; and Certificate of Undertaking as specified in Clause 2.25 of the RFQ.

Letter Comprising the Application for Pre-Qualification (Appendix-I) Statement of Legal Capacity (Annexure-V to Appendix-I) Power of Attorney for signing the Application as per the format at Appendix-II; If applicable, the Power of Attorney for Lead Member of Consortium as per the format at Appendix-III; Copy of the Joint Bidding Agreement, in case of a Consortium, substantially in the format at Appendix-IV; Cost of RFQ of Rs. 60,000/- (Rupees Sixty thousand only) in the form of demand draft in favour of NHAI, payable at New Delhi; and Application processing fee of Rs. 13,236/- (Thirteen thousand Two hundred Thirty six only) inclusive of all taxes through e-payment gateway of Punjab National Bank using Credit Card/Debit Card Master Card and Visa card only - on e-tender portal www.tenderwizard.com/NHAI or in the form of Demand Draft in favour of M/s. ITI Limited, payable at New Delhi.

The Applicant shall submit the original documents specified above in point no. 2 (ii) (B) together with their respective enclosures and seal it in an envelope and mark the envelope as APPLICATION. The said envelope shall clearly bear the name of the Project and name and address of the Applicant. In addition, the Application due date should be indicated on the right hand corner of the envelope. The original documents should be submitted before [11:00] hours Indian Standard Time on the Application due date i.e. 11.05.2012, at the below mentioned address in the manner and form as detailed in the RFQ. The Applicant shall upload scanned copies of the documents as specified in point nos. 2 (ii) (A) & (B) above on the Tender Wizard before *+ hours Indian Standard Timeon the Application due date. No hard copy of the documents as specified in point nos. 2 (ii) (A) above is required to be submitted. In the

event of any discrepancy between the original and the copy (in electronic form), the original shall prevail. (v) It may be noted that the scanned copies can be prepared in file format i.e. PDF and/or JEPG only. The Applicants can upload a single file of size of 5 MB only but can upload multiple files. 3) ADDENDUM TO THE RFQ: Any Addendum to the RFQ shall be uploaded only on the Tender Wizard. (Refer Clause 2.10.2 of the RFQ) 4) MODIFICATION/ SUBSTITUTION/ WITHDRAWAL OF APPLICATIONS: (Refer to Clause 2.16 of the RFQ) (i) In the event of modification/substitution/withdrawal of the Application, the Applicant may modify, substitute or withdraw the documents (hard copy) specified in point no. 2 (ii) (B) of its Application after submission, provided that written notice of the modification, substitution or withdrawal is received by the Authority prior to the Application due date. The said notice shall be prepared, sealed, marked and delivered in accordance Clause 2.13 of the RFQ, with the envelopes being additionally marked MODIFICATION, SUBSTITUTION or WITHDRAWAL, as appropriate. The documents specified in point no. 2 (ii) (B) shall not be modified, substituted or withdrawn by the Applicant on or after the Application due date. (ii) For withdrawal of the documents mentioned in point nos. 2 (ii) (A) & (B) of the Application, the Applicant will have to click on withdrawal icon at Tender Wizard and can withdraw its Application. The Applicant may modify or substitute the documents (soft copy) mentioned in point nos. 2 (ii) (A) & (B) of the Application after submission, provided that the Applicant detach the old documents submitted in the electronic form from the Tender Wizard and upload the modified or substituted documents. OPENING AND EVALUATION OF APPLICATIONS: (Refer to Clause 2.17 of the RFQ) (i) The Authority shall open documents of the Application received in electronic form as mentioned in point nos. 2 (ii) (A) & (B) at *+ hours Indian Standard Time on the Application due date, on line, in the presence of the Applicants who choose to attend. The Authority will subsequently examine and evaluate the Applications in accordance with the provisions set out in the RFQ.
