Once was contested over by many other countries by the age of colonialization. As many of their heroes shed their blood to recapture what they think is theirs from the colonialist. It takes approximately 350 years to recapture it. Soon after, Indonesia was born as their late hero, Ir. Soekarno, read the proclamation. By the time Indonesia was born, Indonesia was intended to be a constitutional state. Every country want their country has a working law and have their citizens feel the justice. But as the time pass by, the law is not standing tall and the justice has not been emforced yet. The law that should be the enforcement of justice for every single people in Indonesia is not working as it should be. As everyone can see, the law enforcement in Indonesia is extremely weak in peoples regard, the law could be bought; the law is only for somebody who has money and power, etc. It is true, because There are many negative things that everybody could find in Indonesian law enforcement: bribery, discrimination, corruption in law enforcement force agencies, and so on. These facts leads to one point that Indonesian law enforcement are in the worst shape and it still could be worsen. The manipulation in law has spread extremely wide to every single corner in Indonesia. Everyone know how the law enforcement work in Indonesia. They dont always serve the justice, they only serve it if you pay them enough. Those things is as exact as what Plato described that laws are spider webs, they hold the weak and delicated who are caught in their meshes but are torn in pieces by the rich and powerful. The Old Lady that stolen cacao case is one of the facts, how come an old lady that only stole cacao is being processed by law but a corruptors that stolen trilions of rupiahs is ignored and left free? Another example is the children that stole a perforated sandal, because of it he is being processed with law, how come it could happen meanwhile there is somebody stealing the countrys money? The law seems working well to the lower class society, but on the other hand when the suspected one was the one who has money and power, the process of law suddenly become complex with its bureaucracy and become slower to be solved. For example the Gayus Tambunan case, he corrupted approximately 28 trilion rupiah, but only sentenced to 6 years prison time. Other example is the Century Bank case, the Hambalang Case, and so on. These case has adverse the country and the society so much, but it could never be solved as long as law manipulation is still there. Another point is bribery, bribery has become an ordinariness in Indonesian Law enforcing. If somebody has tripped a case, simply they would bribe the law enforcement bodies such as police or judges. Believe it or not, Indonesia has became one of the country that have the highest rating in practicing bribery. In 2011, Transparency International conducted a survey named Bribe Payer Index (BPI 2011) periodically. By that time, Indonesia has a BPI of 7.1 (average 7.8). The Index ranks Indonesia in 25th out of 28 countries. Countries with the lowest index in 2011 was Russia's BPI (6.1) and China (6.5). Indonesia itself is in the bottom fourth with a score of 7.1, below Mexico (7.0). In addition to reporting on the frequency of bribery, the survey also reported the bribery that occurs in some specific sectors. Bribery committed by entrepreneurs are mostly done in the public sector and construction jobs with a score of 5.3 (average 6.6). Bribery not only performed in a small cases such as speeding fine, but also in a major cases, for example Bribery of judge Setyabudi Tedjocahyono by Toto Hutagalung, ex-mayor of bandung Dada Rosadas man, worth 4.05 Trillion rupiahs to alleviate verdict against seven defendants suspected of corrupting the fund of Social Assistance Bandung in Bandung court.

The next point is discrimination, discrimination is one of forms of injustice. Discrimination is is


the prejudicial and/or distinguishing treatment of an individual based on their actual or perceived membership in a certain group or category, "in a way that is worse than the way people are usually treated." The discrimination itself could happen explicitly or implicitly. In Indonesians Constitution in

28th D article and first verse stated every person has the right to recognition, security, protection, and fair legal certainty and equal treatment before the law. It is clearly stated that there is a law that controls every persons equality before the law, consistent with the principal of law that stated equality before the law. But in spite of the fact that Indonesia has a law that controls every persons equality before the law, the actual practise of the law enforcement in Indonesia could be found that , still, there is discrimination before the law, take the Old Lady case as an example, she only took some cocoas but have to face the law process, another example is the case that involve a man who took a pair of sandal which is belongs to a policeman, ironically he has a heavier sentence than a corruiptor does, he is sentenced to five years in prison while a corruptor being left free. By looking at the facts stated before, law could only be enforced by people if people have money or power. The idea of law itself doesnt come with professionalism of government officials who run the state bureaucracy in achieving justice for all Indonesian people without having to use any form of discrimination in order to avoid jealousy among fellow citizen of Indonesia. It can be seen from how bad the social service system in the middle of the society which reason is because the state apparatus is still showing discrimination in their performance to benefit themselves. The corruptor who stole the publics money away gets special legal services even though they have been in prison. We often hear that they bribed the prison officer so they could live like they are not serving a sentence. The next point is corruption in the law enforcement agencies, the meaning of corruption itself is corruption is spiritual or moral impurity or deviation from an ideal. Corruption may include many activities including bribery and embezzlement. Corruption in law enforcement itself called by Judicial Corruption. The meaning of Judicial Corruption itself is According to International Bar Association, the judicial system may be corrupted when any act or omission occurs which is calculated to, or does, result in the loss of impartiality of the judiciary; Specifically, corruption occurs whenever a judge or court officer seeks or receives a benefit of any kind or promise of a benefit of any kind in respect of an exercise of power or other action. Such acts usually constitute criminal offences under national law; Examples of criminal corrupt conduct are: Bribery; Fraud; Utilisation of public resources for private gain; Deliberate loss of court records; and Deliberate alteration of court records In 2011, Indonesia's score in the Corruption Perception Index (CPI) is 3.0. Together with Indonesia, there are 11 other countries that get a score of 3.0 in the CPI in 2011. These countries are Argentina, Benin, Burkina Faso, Djibouti, Gabon, Madagascar, Malawi, Mexico, Sao Tome & Principe, Suriname and Tanzania. Indonesia and these countries ranks 100 of overall 183 countries. Things that could be learned from the CPI is no significant change in the eradication of corruption in Indonesia. CPI measurement method requires criteria that may show indications of changes in the perception of corruption across years (2010 and 2011) is the change in score of at least 0.3 is supported by consistent changes (unidirectional) of at least half of the index constituent data sources. From the data above, then we can learn that Judicial Corruption is a problem that should be taken seriously and need special treatment to its solution. Judicial Corruption is a problem that affects the system, done by officers because the system itself allows for corruption. The example of this case is the decision trading case which is done by Judge Syarifuddin for Agusrin case in Makasar. Assisted by several NGOs who are concerned with justice in Makassar, there are at least nine launch acquittal handed down to the defendant Syarifuddin alleged corruption in Makassar District Court previously, before Judge Syarifuddin were arrested in his house in Sunter, North Jakarta on on June 1st , 2011. Syarifuddin

allegedly accepting bribe of curator Puguh Wiryawan property settlement related judicial proceedings bankruptcy of PT Skycamping Indonesia. After the arrest, Syarifuddin released from his duties temporarily. If the law enforcement agency does not follow the law when they do their job, how could the law and justice be enforced? Another Corrupt law enforcement agency is the POLRI (Indonesian National Police). POLRI is the institution that have the highest rate of corruption in Indonesia. It has been proved by the Global Corruption Barometer survey (GBC) 2013 by Transparency International (TI). There are many cases of corruption have occurred in this organization. In 2011, there is a case which is became popular about the case broker or legal mafia involving Police Commissioner General Susno Duadji. After making controversial statements about alligator versus lizard and removed as head of the Criminal Investigation Agency (Kabareskrim) POLRI. the nonjob three-star officers went Judicial Mafia Eradication Task Force to reveal information about the presence of tax case brokers in the body of Police Headquarters. The phenomenon of legal mafia and corruption that occurs in the police environment was actually not a new thing and has become a public secret. Before Susno made his statement, it is confirmed by the internal oh the police agency. It can be seen from the results of research on the practice of police corruption made by the students of the College of Police Science (PTIK) class 39-A in 2004. Based on the results of the study conducted, police corruption is divided into internal corruption and external corruption. Internal corruption is corruption that does not involve people outside the police community. For example trading position in the office, corruption in police recruitment process, distribution logistics, and distribution of the police budget. Meanwhile External corruption is a corruption which directly involves the public interest. Such corruption occurs within the scope of police duties related to law enforcement, community service, and abuse of authority. In 2001, Indonesia Corruption Watch conducted a research regarding supervision of Driver License and the patterns of corruption within the judiciary, especially in the police, concluded that corruption in the corps Bhayangkara not just a rumor. Demand for money services, embezzlement cases, negotiation case, and extortion is a common pattern of police officers. How justice isnt served well in this country. One of the way strengthen the law in Indonesia which is increasingly fragile is to nourish all the components associated with the positive things that can recover and take it to the right path. Things that we can start with is by increasing awareness of the law and the public authorities in order to enforce law and good morals. In addition, it is also important to change the law, which is still tend to benefit the political interest interests of the people. Increasing the smooth process of law enforcement by adding facilities and infrastructure has become one of the important components. At the end of it , Indonesia is still not clean before the law. It is a fact that no country is clean before the law.
