Summary This bill requires charter school teachers to meet same certification requirements as other public school teachers. It states that all charter school employees will be subject to all provisions of state law relative to background checks that currently apply to employees of other public schools. This bill provides relative to student eligibility criteria for participation in a voucher program for students with exceptionalities and for continuation of the program. Students are eligible for the program if they meet the requirements outlined in the present law, and affords the option to the student to have a plan with the nonpublic school the child will attend, which outlines what services are provided and how said services will address the student's needs. This bill provides relative to employment eligibility requirements for teachers in charter schools. It requires charter schools to only hire teachers who have a teaching certificate from the Louisiana Department of Education, but if no applicant meets this requirement, then the chosen applicant must have at least a bachelor's degree. This constitutional amendment provides for the statewide election of the state superintendent of education, beginning in 2015, and provides that the elected officer will be installed at noon on January 11, 2016. The following proposition would appear on the November 14, 2014 statewide election ballot: Do you support an amendment to provide that the state superintendent of education shall be elected by the voters of the state? (Amends Article IV, Section 20 and Article VIII, Section 2), the options being YES or NO. This bill makes the office of state superintendent of education an elective rather than an appointed office. Provides for election of the superintendent beginning with the 2015 election of statewide elected officials. Requires that the superintendent have the qualifications and salary of statewide elected officials.

This bill provides for additional ethical standards for members and former members of the State Board of Elementary and Secondary Education, the state superintendent of education and the former state superintendent of education, and immediate family members of such persons and specified related legal entities. This bill provides that teachers and administrators who were rated "ineffective" based only on the valueadded portion of the evaluation program conducted during the 2012-2013 school year may be eligible to receive a salary increase, as determined by the principal or immediate supervisor, for the 2013-2014 school year. This bill provides for a temporary cessation of the letter grade component of the school and district accountability system. This bill requires public school governing authorities, including those of charter schools, to provide instruction in sex education each year to students. Specifies that such instruction be medically accurate and developmentally and age appropriate. This constitutional amendment removes the authority of the governor to appoint three members to BESE and provides instead for the statewide election of such members. (1) A teacher who receives a performance rating of "highly effective" for five years within a six-year period shall be granted tenure. (2) A teacher who is not awarded tenure remains an at-will employee but shall acquire tenure upon meeting this rating requirement. (3) Beginning with the 2015-2016 school year, a tenured teacher who receives a performance rating of "ineffective" shall immediately lose tenure. (4) A teacher who loses tenure for receiving an "ineffective" performance rating shall reacquire tenure if any one of the following conditions applies: (a) The "ineffective" rating is reversed pursuant to the grievance procedure established in present law. (b) The teacher receives a "highly effective" performance rating for five years within a six-year period. (5) Provides that a teacher who has acquired tenure before September 1, 2014, retains tenure and is subject to proposed law. (6) Consolidates the tenure provisions for all certified school employees. It also provides that a school lunch supervisor shall not be eligible for tenure on or after June 1, 2014. This bill prohibits a school board from taking or threatening any action intended to interfere with, compel, or coerce any personnel decision by the superintendent or a school principal, including the hiring, promotion, discipline, demotion, transfer, discharge, or assignment of work to any school employee. Provides that the following actions and threats of actions are specifically prohibited when intended to have such effect: (1) Modification of budgets including capital budgets. (2) Shifting of funds or any other resource. (3) Modification of tables of organization or assignment of positions. (4) Modification of or failure to approve job descriptions. (5) Modification of salaries or salary schedules This bill repeals the portion of the present law which says that any educator receiving a rating of ineffective in either the student growth or the qualitative performance component of the evaluation shall receive a final rating of ineffective. This bill requires notification to certain elected officials regarding submission and status of certain charter school applications. This bill deletes provisions in present PreK law relative to income requirements and that provide for phasedin universal access over time, subject to availability of funding, and instead provides that beginning with the 2014-2015 school year, LA 4 (Prek for 4 year-olds) classes shall be provided at no cost, except for the applicable lunch cost, to every eligible child, without regard to income level. This bill provides for public school choice as follows: (1) Beginning with the 2014-2015 school year, the parent or other legal guardian of any student may enroll their child in the public school of their choice, without regard to residence, school system geographic boundaries, or attendance zones, provided both of the following apply: (a) The public school in which the student was most recently enrolled, or would otherwise attend, received a school performance letter grade of "D" or "F" for the most recent school year. (b) The school in which the student seeks to enroll received a school performance letter grade of "A", "B", or "C" for the most recent school year, and has sufficient capacity at the appropriate grade level. This bill repeals the Balanced Treatment for Creation-Science and Evolution-Science Act.
