JUDICIAL AFFIDAVIT The examination of complainants witness by the name of HECTOR MAYEL MACAPAGAL, of legal age, resident of Angat Bulacan is being conducted or supervised by ATTY. REGINE YU, with office address at 2401 Taft Avenue, Manila 1004, and is being held at said office. 1. Mr. Witness, in your previous affidavit, you mentioned that there were harmful changes in the surrounding since the company moved and began operations? - Yes, I could smell the fumes from the factory. It smelled bad and made me and some of my neighbors sick. 2. How did you feel? - I felt dizzy and had problems breathing. Most especially around the last week of November 2013. 3. Did you seek medical assistance? - Yes, when I felt really sick, I went to San Rafael Hospital to see a doctor. 4. When did you go to the hospital? - At December 1, 2013.

ANNEX F (page 2of 3) 5. Who was your attending physician? - It was Dr Romina Sotto, a pulmonologist in the same hospital. They told me that she specializes in my case. 6. What did she ask you to do? - I was asked to get a blood exam and have a chest x-ray. 7. What did the doctor conclude? - That I had respiratory problems such as chest congestion, difficulty in breathing, excessive phlegm and cough. 8. How much did you spend? - I spent P25,500 for the tests and the professional fees.

JUDICIAL AFFIDAVIT The examination of complainants witness by the name of ROMINA KARA REDIL SOTTO, of legal age, resident of Angat Bulacan is being conducted or supervised by ATTY. REGINE YU, with office address at 2401 Taft Avenue, Manila 1004, and is being held at said office. 9. What is your profession and place of work? - I am a doctor, specializing in Pulmonary diseases. I work at San Rafael Community Hospital, Bulacan. 10. How long have you been practicing as a pulmonologist? - I started specializing ever since I passed the board exams in 2000, so about 14 years now. 11. Do you know the plaintiff, Mr. Hector Mayel Macapagal? - Yes, he was a patient of mine at the hospital on December 1, 2013. 12. Why did he seek you medical assistance? - He was not feeling well. He was showing signs of respiratory problems.

ANNEX G (page 2of 3) 13. What specific respiratory problems was he suffering from? - Respiratory problems such as chest congestion, difficulty in breathing, excessive phlegm and cough. 14. What tests did you conduct in order to arrive with such conclusion? - I asked him to undergo a blood examination and chest x-ray. He took the examinations and gave me the results for my interpretation. 15. In your professional opinion, what could have caused such problems? - Based on the results and interactions with the patient, it could have been caused by something he was exposed to for a period of time. 16. What could he have been exposed to that would cause such problems? - Harmful elements that are airborne, possibly from sources within his immediate vicinity.
