RIGHT OF ENTRY NO. 5364 (APPROVAL)
The Trust Lands Administration received a right of entry permit application from the Federal Aviation Administration,
AWP, 1601 Lind Ave. S.W., Renton, Washington 98057, for temporary authorization to continue the operation of an
existing communication site for a VORTAC facility, which is a federal government communication site for an air traffic
control site, on the following trust lands on Lake Mountain:

Use of the existing communication site was previously authorized under Special Use Lease 809, which has expired.
ROE 5364 is intended only as an interim permit until the new replacement lease (SULA 1585) can be approved and
executed. The FAA is still reviewing the new draft lease agreement. It has taken longer to negotiate the proposed new
lease agreement with the applicant than was anticipated, but it is in process, and the Trust Lands Administration is waiting
on the FAA to complete its latest review of the proposed agreement. The permittee has a long-term record of satisfactory
performance on the existing communication site with the Trust Lands Administration. There will be no additional
disturbance or changes on the site.
The permit shall have a six-month term, with a commencement date of July 1, 2009, and an expiration date of
December 31, 2009. The charge for this temporary use is $3,000.00 (to be applied as telecommunication rental) plus a
$50.00 application fee and a $50.00 processing charge, totaling $3,100.00. The applicant has agreed to the terms of the
proposed permit and the fees and rental.
Upon recommendation of Mr. Gary Bagley, the Director approved Right of Entry Permit No. 5364 for a six-month term
or until SULA 1585 is executed, whichever is earlier.

On September 8, 2009, the School and Institutional Trust Lands Administration received an application from Book Cliff
Outfitters, 927 Millstream Way, Bountiful, UT 84010, to occupy all trust land located within the State of Utah, except for
those lands subject to existing leases or permits that grant access control, and those lands that have been or may be
withdrawn by order of the Director, to provide hunting guide services for a one-year term.
The fee for this right of entry is $200.00 plus a $50.00 application fee and a $50.00 processing fee, totaling $300.00. This
right of entry replaces ROE 5245 which expires September 30, 2009. Funding: School = 96.67%, USU = 0.83%,

PROPOSED ACTION:
The applicant proposes to construct, operate, and maintain up to four commercial salt water injection wells
("Facility") to dispose of salt water that is produced from gas exploration and development operations. The wells will be
drilled in phases within the NW1/4 of Section 2, with the Utah Division of Oil, Gas and Mining (DOGM) monitoring
and approving each phase of development. The first phase of the Facility will be the drilling of the Westwater
State 4-2-19-25 Well, which will be located in the NWNW (Lot 4) in accordance with DOGMs approved Application for
Permit to Drill dated August 3, 2009. The current oil and gas mineral lessee, Retamco Operating Inc., (ML 49255), was
notified of the proposed action. No comments were received. The mineral lessee will be notified of all future well
locations as to not interfere with future development of their mineral estate. The applicant will dispose of off-lease and
off-unit water. The applicant will also dispose of out of state water. The applicant shall not dispose of any product other
than produced water, as defined in Utah Administrative Code R649-1-1 (2006). The term of the special use lease
agreement will be 10 years.
RELEVANT FACTUAL BACKGROUND:
The application was advertised in a paper of local circulation in Grand County. In addition, Grand County was
notified of the action and a copy of the notice was sent to all lessees, permittees, and adjoining landowners. The required
public notice process has been completed pursuant to the requirements of R850-30-500(2)(d) and R850-30-500(2)(e).
There were no competing applications received during the notice period.
The Resource Development Coordinating Committee (RDCC) review was initiated on February 17, 2009, and
the following comments were received:
Utah Geological Survey:
"Although there are no paleontological localities recorded in our files for this project area, the
Cretaceous Cedar Mountain and Dakota Formations that may be exposed over portions of this project area have

the potential for yielding significant vertebrate fossil localities. The office of the State Paleontologist, therefore,
recommends a paleontological survey be conducted for this project and its easements by a paleontologist with a
valid permit."
RDCCs specific concerns have been passed on to the applicant. The Utah Geological Surveys concerns are
addressed in Article 5.6 of the lease agreement.
A cultural resource inventory has been completed by GRI U-09-GB-0358s with a finding of "no historic
properties affected." Trust Lands Administration's staff archaeologist has reviewed the project and concurs with the
finding of "no historic properties affected."
A paleontological survey was conducted on June 6, 2009, by Joshua Smith - BLM Colorado Permit C-60700. No
vertebrate fossils were discovered during the survey. Abundant invertebrate fossils littered the surface. These
invertebrate fossils were mostly disarticulated fragments from the underlying Dakota Formation. No paleontological
restrictions should be placed on development of the site. Should vertebrate fossils be discovered during construction, a
qualified paleontologist should be contacted to evaluate the discovery.
EVALUATION OF FACTS:
Competing applications were solicited pursuant to R850-30-500(2) and no competing applications were received.
The application was reviewed pursuant to R850-30-500(2)(g) and the applicant was notified of the need to submit a sealed
bid pursuant to R850-30-500(2)(f). The applicant submitted a sealed bid in the amount of $1,000.00 per year for the lease
rental. In addition to the annual rental, the applicant shall pay a water disposal fee equal to 16.67% of the lessees gross
receipts for all commercial water disposed of in the Facility and a water disposal fee of $0.15 per barrel for all noncommercial water disposed of in the Facility. Commercial water means all water generated from operations by an entity
other than the lessee and non-commercial water means all water generated from operations conducted by the lessee. The
water disposal fee payment shall be paid quarterly during the term of the lease, based on a disposal report submitted to
DOGM, on or before the fifteenth day of the month during the term of this lease. Such quarterly periods are defined as
follows: Quarter One, January through March; Quarter Two, April through June; Quarter Three, July through September;
Quarter Four, October through December. Failure to pay the royalty for a period of one month from the date such rent is
due, and upon expiration of a written notice from Trust Lands Administration to the applicant requiring performance
within 30 days, shall constitute a default and entitle the Trust Lands Administration to forfeit the applicant's interest in the
lease and all improvements or to take other legal remedies available at law. A preliminary evaluation of land value
indicated that the minimum annual rental of $1,000.00 and the water disposal fees of 16.67% of gross receipts for all
commercial water and $0.15 per barrel for all non-commercial water will exceed a rental based on the value of the land.
The term of the lease will be 10 years. All activities conducted under the lease will be subject to approval of
requirements of DOGM for salt water injection wells. The agreement will contain a clause whereby the annual rental and
the water disposal fee will be evaluated and can be adjusted at the end of each three-year period. The adjustment will be
made according to Trust Lands Administration Rule R850-30-400(4) and Board policy.
This action qualifies as an exclusion to the narrative Record of Decision process because it does not warrant the
time and expense necessary to complete a full narrative record. Therefore, this summary will constitute the Record of
Decision.
Upon recommendation of Mr. Kurt Higgins, the Director approved the issuance of SULA 1630 with a beginning annual
rental of $1,000.00 and a water disposal fee in the amount of 16.67% of gross receipts for all commercial water and $0.15
per barrel for all non-commercial water disposed of at the Facility. The term of the lease will be 10 years, with a
three-year rental review pursuant to R850-30-400.

PROPOSED ACTION:
The applicant proposes to construct, operate, and maintain a natural gas regulator station. In order to meet the
demands of the residential and commercial growth that has occurred in the past few years in the Vernal area, it has
become necessary to upgrade an existing facility, namely Vernal Regulatory Station #2, VN0002. The term of the special
use lease agreement will be 30 years.
This facility was initially constructed within an existing Questar easement corridor. The upgrades to the station
site will include the piping for a future pig launcher/receiver, a new dual tap assembly, a new regulator station, and a
9-foot by 12-foot building with bypass piping, and other necessary yard feeder line piping. The existing above-ground
facilities will be retired as well as some of the existing feeder line piping to accommodate the new upgrades. Upon
completion of the site upgrades, a new chain-link perimeter fence will be installed around the new facility. The regulator
station facility will be partially constructed within the existing corridor of Right of Way #1404 and Right of Way #1357.
The site will contain 0.099 acres and be located within the SWSW of Section 10, Township 5 South, Range 21 East,
SLB&M, Uintah County.

As the site was previously disturbed during the construction of the above mentioned Rights of Way, it was
determined that this application is exempt from review by the Resource Development Coordinating Committee
("RDCC").
The application was exempt from competitive leasing pursuant to R850-30-500(2)(c).
The Trust Land Administration's Archaeological staff has reviewed the application and, as this is an existing site,
has determined that no further work is required.
EVALUATION OF FACTS:
No competing applications were solicited pursuant to R850-30-500(2), as the applicant requested an exemption.
The lease will contain a clause providing for escalation of the annual rental fee at the end of each five-year period,
utilizing the approved index.
This action qualifies as an exclusion to the narrative Record of Decision process because it does not warrant the
time and expense necessary to complete a full narrative record. Therefore, this summary will constitute the Record of
Decision.
Upon recommendation of Mr. Kurt Higgins, the Director approved the issuance of SULA 1663 with a beginning base
rental of $1,000.00. The term of the lease will be 30 years, with a five-year rental review pursuant to R850-30-400.
SPECIAL USE LEASE AGREEMENT NO. 1009 (ASSIGNMENT)

Pursuant to R850-30-900, Clinton J. Hunt, 560 Cedarwood Terrace, Cedar City, Utah 84720, the lessee of record under
Special Use Lease Agreement No. 1009, requests the Director's approval of his assignment of SULA 1009 to his son,
Terry Hunt, 991 W. State Street, P.O. Box 607, Hurricane, Utah 84737. Clinton J. Hunt properly executed the Agency's
assignment form on October 22, 2002; however, due to the lessee's oversight, neither the assignment fee nor the form was
submitted to the Agency for approval. The $250.00 assignment fee has now been submitted along with the assignment
form. The lease is currently subject to its three-year review, which is addressed subsequently in these Minutes.
Accordingly, the lease will be amended to phase-in an increased rental schedule. Other amendments to the lease will
update the lease to the Agency's current form, establish Terry Hunt as the lessee, revise the lease purpose to include a
residential site, and correct and update the legal description for the subject lands. Washington County. School Fund.
Upon the recommendation of Mr. Bryan Torgerson, the Director approved the assignment of SULA 1009.
SPECIAL USE LEASE AGREEMENT NO. 1009 (AMENDMENT AND RESTATEMENT)

SULA 1009 was originally issued to Clinton J. Hunt, 560 Cedarwood Terrace, Cedar City, Utah, 84720, and, as approved
by the Director with these Minutes, has been assigned to Terry Hunt, 991 W. State Street, P.O. Box 607,
Hurricane, Utah 84737. This lease is for a commercial storage facility located in Washington, County. The lessee and the
Agency propose to amend the lease to update the lease to the Agency's current form, phase-in the increased annual rental
payment, establish Terry Hunt as the current lessee of record, revise the lease purpose to include a residential site, and
correct and update the legal description for the subject lands.

SPECIAL USE LEASE AGREEMENT NO. 1009 (THREE-YEAR REVIEW)

SULA 1009 was originally issued to Clinton J. Hunt, 560 Cedarwood Terrace, Cedar City, Utah, 84720, and, as approved
by the Director in the previous Minute Entry, has been assigned to Terry Hunt, 991 W. State Street, P.O. Box 607,
Hurricane, Utah 84737. This lease is for a commercial storage facility located in Washington, County. School Fund.
1.
ANNUAL RENTAL AND LEASE ACRES:

The three-year review date for this lease is October 1, 2009. The lease is authorized for a commercial self-storage
facility site. Based on a recent appraisal, the Agency has decided to exercise its option to increase the annual base
rent to an amount equal to the fair market value. It is recommended that the annual base rent be increased from
$16,600.00 per year to $28,150.00 per year. However, as per negotiations with the lessee, the Trust Lands
Administration will phase in the annual base rental increase over the next three years as follows:
Year 1 October 1, 2009, annual payment will be $20,600; Year 2 October 1, 2010, annual payment will be
$24,600; and Year 3 October 1, 2011, annual payment will be $28,150.00. A certified notice was sent to Terry
Hunt. However, no response was received.
During the lease review process, the GIS department reviewed the legal description for this lease and found some
typographical errors. At the same time, the lessee identified an adjacent small remnant parcel that would
complement the lease property. The lease will be amended in a separate action to account for the legal description
changes, rental payment phasing, and other minor changes.
New lease fee: $28,150.00 (includes an adjustment for the rental of the additional acres)
Acres in lease: 2.41 (includes the addition of .271 acres - small remnant parcel)
Rental per Acre: $11,680.50

DUE DILIGENCE:
All due diligence has been completed in accordance with the lease.

system (the "Utilities"). Additionally, the City may install, or contract to have installed, other public utilities while the
trench for these improvements is open. All installed improvements shall be known collectively as the Utilities. In
addition to the Utility Easement, the City was granted an easement over an approximately fifteen-foot (15') existing access
road (the "Road Easement") to access the installed Utilities for maintenance and operational purposes.
In consideration for the described Utility and Road Easements, the City has paid the Trust TWENTY-FOUR
THOUSAND EIGHT HUNDRED TWENTY-FIVE DOLLARS and TWENTY-NINE CENTS ($24,825.29), plus an
administrative fee of SEVEN HUNDRED FIFTY DOLLARS ($750.00).

A 50.00 foot wide drainage easement, 25.00 feet on each side, together with a 100.00 foot wide temporary

Meridian; Thence North 8839'30" West along the Section line, a distance of 226.88 feet; Thence South 7459'25"

The project manager has had this legal description reviewed by the GIS Group.

legal description as shown on the lease agreement. The correct legal description is:

along the South Line of the said SNESE 651.37 feet; thence N 0227'22" W parallel to the East Line of the
