DearMr.ChapmanandMs.Gonda, Asyouknow,GoodPointRecyclingwasaregisteredCollectorEW#withtheECyclesProgram onOctober10,andhasbeenonesincethebeginningoftheprogram.FromtheECycles Website,thefollowingactivitiesareincludedasacollector:

YouareaCOLLECTORasapublicorprivateentitythatreceiveselectronicwastefromcovered entitiesorfromanothercollectorandthatperformsanyofthefollowing: (A)arrangesforthedeliveryoftheelectronicwastetoarecycler. (B)sortselectronicwaste. (C)consolidateselectronicwaste. (D)providesdatasecurityservicesinamannerapprovedbythesecretary.

TheseactivitiesarealsodescribedunderthedefintionofCollectorin10VSA7559. FromOctober11throughDecember31,GoodPointwasnotallowedtochargemanufacturers undertheIndependentOptOutPlan.Theparticipatingmanufacturerswerechargedbythe StateofVermonttocoverthepoundscollected,undertheAgencys$720,000flatfeepayment withCasellaWasteSystems.Wewerenottoldwecouldnotaccept,arrangefordelivery,sort, orconsolidate,orprovidedatasecurity.Theonlyactivitywebelievedtobeatourriskwasthe DorsetSchoolevent,whichhadbeenregisteredbutwas(improperly,wefeel)deregisteredby ANRtheweekbeforethescheduledevent.Collectorscanholdeventsiftheyareregistered.

WeareaskingyoutoreconsidertheinstructionstodoublechargetheseOEMsformaterial collectedinthelastquarterof2013.WetriedhavingCasellapickitup,wetrieddeliveringitto Casella,wetriedgivingittoanotherCollectortodelivertoCasella,andwetriedtoinvoice Casella,asasubcontractor,tomanagethematerial.Therefusalofthematerialiscompletely separatefromthesingleschooleventheldatGPRsrisk,andcompletelyseparatefromour requesttobepaidthetransportationfeeof5centsifwedeliveredFOB. Tobeclear,wehavecollectedcovereddevicesfromcoveredentitiesasaregisteredcollector, followingonlytheactivitieslistedontheECycleswebpage(A,B,C,D).Wefinallytried deliveringmaterialwehadactuallycollectedfromCasellasownNorthshireTransferStationto theAddisonCountytrailer,sevenunitsatattime,andeventhatmaterialwassentbackatour cost.Mr.Chapmanhassuggestedweturnitinas2014material,buttheOEMsinthe IndependentPlanwerealreadychargedforthismaterialunderthe$720,000arrangmentthat wasinplaceatthetimethiswasconsolidated. EachpalletwastrackedbyEWlocationnumber,weighedaccordingtoANRsinstructions,and hadnolocalreuse.Weknowtherulesandfollowedthemtotheletterinfact,itwasour trackingpaperworkwhichCasellasvendorusedtorejectmaterial(thesamepaperworkthat showeditwascollectedandnotchargedfor). Thisrefusalofthelastquarter2013createstremendoushardshiponthefamiliesofworking Vermonters,constitutesanticompetitivebehavior,andIamrequestingthatyouragencyseek anindependentreviewbytheVermontAttorneyGeneralsofficewhetheryourstaffare colludingwithCasellainviolationofC&ACarbone,Inc.v.Clarkstown,511U.S.383 (1994),andinviolationofCasellasanticompetitivebehavioragreementwiththeState ofVermont. Ihavehadtoterminatemostofouremployees(includingonesyouprefertocommunicatewith) andamunabletopaytaxesandpayrollbecauseoftheCasellarejectionofcoveredelectronic devicesconsolidatedfromregisteredcollectorsandVermontcoveredentities,duringtheperiod priortotheMOUrequirement(whenCasellascontractstatednotwithstandingtheMOUsithad tocontinuetoacceptcovereddevicesfromregisteredcollectorssuchasGoodPoint).
