The following are the functions, duties and powers of the Sangguniang Panlalawigan pursuant to Section 468 of the

Local Government Code of 1 1!

A. Approve ordinances and pass resolutions necessary for an efficient and effective provincial government and shall:

"eview all ordinances approved #$ the sanggunians of component cities and municipalities and e%ecutive orders issued #$ the ma$ors of said component units to determine whether these are within the scope of the prescri#ed powers of the sanggunian and of the ma$or& 'aintain peace and order #$ enacting measures to prevent and suppress lawlessness, disorder, riot, violence, re#ellion or sedition and impose penalties for the violation of said ordinances& (pprove ordinances imposing imprisonment not e%ceeding one )1* $ear or a fine not e%ceeding +ive Thousand Pesos )P,,---.--* or #oth imprisonment and fine at the discretion of the court, for violation of a provincial ordinance& (dopt measures to protect the inha#itants of the province from the harmful effects of man/ made or natural disasters and calamities, and to provide relief services and assistance for victims during and in the aftermath of said disasters and calamities and their return to productive livelihood following said events& 0nact ordinances intended to prevent, suppress and impose appropriate penalties for ha#itual drun1enness in pu#lic places, vagranc$, mendicanc$, prostitution, esta#lishment and maintenance of houses of ill repute, gam#ling and other prohi#ited games of chance, fraudulent devices and wa$s to o#tain mone$ or propert$, drug addition, maintenance of drug dens, drug pushing, 2uvenile delin3uenc$, the printing, distri#ution or e%hi#ition of o#scene or pornographic materials or pu#lications, and such other activities inimical to the welfare and morals of the inha#itants of the province& Protect the environment and impose appropriate penalties for acts which endanger the environment, such as d$namite fishing and other forms of destructive fishing, illegal logging and smuggling of logs, smuggling of natural resources products and of endangered species of flora and fauna, slash and #urn farming, and such other activities which result in pollution, acceleration of eutrophication of rivers and la1es, or of ecological im#alance& Su#2ect to the provisions of the Code and applica#le laws, determine the powers and duties of officials and emplo$ees of the province& 4etermine the positions and the salaries, wages, allowances and other emoluments and #enefits of officials and emplo$ees paid wholl$ or mainl$ from provincial funds and provide for e%penditures necessar$ for the proper conduct of programs, pro2ects, services, and activities of the provincial government&

(uthori5e the pa$ment of compensation to a 3ualified person not in the government service who fills up a temporar$ vacanc$, or grant honorarium to an$ 3ualified official or emplo$ee designated to fill a temporar$ vacanc$ in a concurrent capacit$, at the rate authori5ed #$ law& Provide a mechanism and the appropriate funds therefore, to ensure the safet$ and protection of all provision government propert$, pu#lic documents, or records such as those relating to propert$ inventor$, land ownership, records of #irths, marriages, deaths, assessments, ta%ation, accounts, #usiness permits, and such other records and documents of pu#lic interest in the offices and departments of the provincial government& and 6hen the finances of the provincial government allow, provide for additional allowances and other #enefits to 2udges, prosecutors, pu#lic elementar$ and high school teachers, and other national government officials stationed or assigned to the province. B. Generate and maximize the use of resources and revenues for the development plans, program objectives and priorities of the province as provided in Section ! of the "ode, #ith particular attention to agro$industrial development and country$#ide gro#th and progress and relative thereto, shall:

0nact the annual and supplemental appropriations of the provincial government and appropriate funds for specific programs, pro2ects, services and activities of the province, or for other purposes not contrar$ to law, in order to promote the general welfare of the province and its inha#itants& Su#2ect to the provisions of 7oo1 88 of the Code and applica#le laws and upon the ma2orit$ vote of all the mem#ers of the Sangguniang Panlalawigan, enact ordinances lev$ing ta%es, fees and charges, prescri#ing the rate thereof for general and specific purposes, and granting ta% e%emptions, incentives or reliefs& Su#2ect to the provisions of 7oo1 88 of the Code, upon a ma2orit$ vote of all the mem#ers of the Sangguniang Panlalawigan, authori5e the provincial governor to negotiate and contract loans and other forms of inde#tedness& Su#2ect to the provisions of 7oo1 88 of the Code and applica#le laws and upon a ma2orit$ vote of all the mem#ers of the Sangguniang Panlalawigan, enact ordinances authori5ing the floating of #onds or other instruments of inde#tedness, for the purpose of raising funds to finance development pro2ects& (ppropriate funds for the construction and maintenance or the rental of #uildings for the use of the province& and upon a ma2orit$ vote of all the mem#ers of the Sangguniang Panlalawigan, authori5e the Provincial Governor to lease to private parties such pu#lic #uildings held in a proprietar$ capacit$, su#2ect to applica#le laws, rules and regulations& Prescri#e reasona#le limits and restraints on the use of propert$ within the 2urisdiction of the province& "eview the comprehensive land us plans and 5oning ordinances of component cities and municipalities and adopt a comprehensive provincial land use plan, su#2ect to applica#le laws& and

(dopt measures to enhance the full implementation of the national agrarian reform program in coordination with the 4epartment of (grarian "eform. ". Subject to the provisions of Boo% && of the "ode, grant franchises, approve the issuance of permits or licenses, or enact ordinances levying taxes, fees and charges upon such conditions and for such purposes intended to promote the general #elfare of the inhabitants of the province, and pursuant to this legislative authority, shall:

+i% and impose reasona#le fees and charges for all services rendered #$ the Provincial Government to private persons or entities& and "egulate and fi% the license fees for such activities as provided under the Code. 4. (pprove ordinances which shall ensure the efficient and effective deliver$ of the #asic services and facilities as provided for under Section 19 of "( 916- and, in addition to said services and facilities, shall!

(dopt measures and safeguards against pollution and for the preservation of the natural ecos$stem in the province, in consonance with approved standards on human settlements and environmental sanitation& Su#2ect to applica#le laws, facilitate or provide for the esta#lishment and maintenance of a waterwor1s s$stem or district waterwor1s for suppl$ing water to inha#itants of component cities and municipalities& Su#2ect to the availa#ilit$ of funds and to e%isting laws, rules and regulations& provide for the esta#lishment and operation of vocational and technical schools and similar post/secondar$ institutions& and, with the approval of the 4epartment of 0ducation and su#2ect to e%isting laws on tuition fees, fi% reasona#le tuition fees and other school charges in educational institutions supported #$ the Provincial Government& 0sta#lish a scholarship fund for the poor #ut deserving students in schools located within its 2urisdiction or for students residing within the province& (pprove measures and adopt 3uarantine regulations to prevent the introduction and spread of diseases within its territorial 2urisdiction& Provide for the care of paupers, the aged, the disa#led, the sic1, persons of unsound mind, a#andoned minors, disa#led persons, a#used children, 2uvenile delin3uents, drug dependents, and other need$ and disadvantaged persons, particularl$ children and $outh #elow eighteen )18* $ears of age& su#2ect to availa#ilit$ of funds, esta#lish and support the operation of centers and facilities for said need$ and disadvantaged persons& and facilitate efforts to promote the welfare of families #elow the povert$ threshold, the disadvantaged, and the e%ploited& 0sta#lish and provide for the maintenance and improvement of 2ails and detention centers, institute a sound 2ail management program, and appropriate funds for the su#sistence of detainees and convicted prisoners in the province&

0sta#lish a provincial council whose purpose is the promotion of culture and the arts, coordinate with government agencies and non/governmental organi5ations and, su#2ect to the availa#ilit$ of funds, appropriate funds for the support and development of the same& and 0sta#lish a provincial council for the elderl$ which shall formulate policies and adopt measures mutuall$ #eneficial to the elderl$ and to the province& and su#2ect to the availa#ilit$ of funds, appropriate funds to support programs and pro2ects for the elderl$& and provide incentives for :G;s to support the programs and pro2ects of the elderl$.
