WARUM HALOGENFREIE WERKSTOFFE IN DER ELEKTROINSTALLATION?
Drei Problemkreise treten bei der Beurteilung von Werkstoffen immer mehr in den Vordergrund:
TEMPERATURBESTNDIGKEIT
Die Temperaturbestndigkeit liegt wesentlich ber der bisher bekannter Kunststoffelektrorohre, wodurch zahlreiche neue Einsatzgebiete erschlossen werden (Klimatechnik, Beleuchtung usw.)
EINSATZGEBIETE
Der Einsatz von HFT-Rohren ist berall dort zu empfehlen, wo die Sicherheit und der Schutz von Menschen und Anlagen im Vordergrund stehen sowie besondere Sicherheitsmanahmen durch: hohe Personenbelegung, hohe Sachwertkonzentrationen hohe Betriebsausfallskosten erforderlich sind.
Brandverhalten
Das Thema Nr.1 im Hoch- und Tiefbau, in Hotels, Theatern, Krankenhusern und Brogebuden, aber auch in Kraftwerken, U-Bahnen und Flughfen sowie im Wohnungsbau ist das Brandverhalten der dort eingesetzten Werkstoffe.
Brandfolgeschden
Der Brand selbst ist fast zu einem zweitrangigen Problem geworden. Es sind die Nebenerscheinungen von Brnden, die das Problem darstellen. In Statistiken wird schlssig nachgewiesen, da die wenigsten Menschen durch Hitze oder Flammen geschdigt werden. Die meisten Verletzungen und Todesflle werden durch das Einatmen tzender und toxischer Rauchgase verursacht.
Dies ist in besonderem Ausma der Fall bei:

hochtechnisierten Industrieanlagen Kraftwerken und lraffinerien U-Bahnen, Straentunnels und Flughfen, Aufzugsanlagen und Notaggregaten, Krankenhusern, Schulen, Hotels, Warenhusern, Museen, Theatern und Konferenzzentren Rechenzentren, Telefon- und Sendeanlagen, Kraftfahrzeugen, Lokomotiven, Waggons, Schiffen und Flugzeugen Belftungssysteme
Umweltfreundliche Technologie
Die von uns fr die Herstellung halogenfreier Installationssysteme eingesetzten Kunststoffe enthalten kein Chlor und keine Schwermetalle und bieten daher folgende entscheidende Vorteile gegenber konventionellen Systemen: - keine Bildung von korrosiven und surehltigen Gasen im Brandfall, dadurch keine Brandfolgeschden an elektronischen Gerten, Maschinen und Bauwerken - wesentlich geringere Toxizitt und keine tzenden Rauchgase, die Menschen und Tiere gefhrden - Verringerung der Rauchdichte und damit Verbesserung der Sicht auf Fluchtwegen und bei Rettungseinstzen - keine Umwelt- und Entsorgungsprobleme, denn auch halogenfreie Materialien knnen mehrfach wiederverarbeitet bzw. recycliert, gefahr- und problemlos in Mllverbrennungsanlagen verbrannt oder in Mlldeponien abgelagert werden.
In vielen Fllen sind starre HFT-Rohre durch ihre besonderen mechanischen Eigenschaften eine geeignete Alternative zu vergleichbaren Stahlrohren.
WICHTIGE HINWEISE FR DIE BEARBEITUNG/VERLEGUNG

Biegen und Vermuffen Die hochschmelzende Kunststofflegierung erfordert besondere Gerte zur Bearbeitung von HFT-Rohren. Es ist daher auf der Baustelle nicht mglich, HFT-Stangenrohre selbst zu biegen oder aufzumuffen. Ein komplettes Sortiment an Steckmuffen und Steckbgen ist jedoch lieferbar, wodurch eine rasche und betriebssichere Montage gewhrleistet ist. Klebeverbindungen Wasserdichte Rohrverbindungen bei HFT-Stangenrohren knnen durch Verkleben der Verbindungen mit HFTSpezialkleber "HVKS 310" hergestellt werden. Die Rohre mssen dabei frei von mechanischen Spannungen sein und beweglich (Gleitsitze!) montiert werden, um Ribildungen an den Klebestellen durch temperaturbedingte Lngennderungen des Rohrsystems zu verhindern. Bei dnnwandigen Rohren ist die Klebetechnik zu vermeiden bzw. bedarf es besonders sorgfltiger Verlegung. Einziehen von Kabel und Leitungen Werden Einziehhilfen bentigt empfehlen wir die Verwendung eines von uns geprften Kabel-Gleitmittels. Andere Einziehhilfen (z.B. Vaseline) knnen Ribildung auslsen! PVC-Kabel vermeiden (Weichmacher kann bei erhhten Temperaturen ausdampfen). Ablngen von HFT-Rohren HFT-Rohre knnen mit Sge, Kabelmesser oder mit einer Schneidezange abgelngt werden.
Chemische Bestndigkeit:
HFT-Rohre verfgen ber eine gute Chemikalienbestndigkeit, doch knnen einige Stoffe wie Schmierle, Kraftstoffe, Speisefette und Hydraulikle einzelne Rohrtypen angreifen. Beachten Sie daher bei der Rohrauswahl das "Merkblatt zur chemischen Bestndigkeit".

Waste Management and Environmental Issues

Our plastic for use in the production of halogen-free electrical installation systems contain no chlorine and no heavy metals and thus offer the following decisive advantages over conventional systems: - No corrosive and acidic gas formation in fire situations, and giving no secondary damage to electronic equipment, machines and buildings. - No aggressive fumes which endanger the lives of humans and animals. - Reduced smoke density, giving better visibility at fire exits and for rescue teams. - No environmental and waste disposal problems, because halogenfree materials can be re-used and recycled repeatedly, as well as deposited or incinerated without danger to the environment.
IMPORTANT HINTS FOR HANDLING & INSTALLATION

Bending of HFT-conduit Because of the high temperature resistant plastic alloy of HFT-conduits it is not possible to bend the HFT-rigid conduits when being installed by using steel bending springs. It is, therefore, required to use special devices for bending HFT-conduits We supply a complete range of bends and couplers which guarantee a quick and safe installation. Connecting of HFT-conduit Watertight connections can be made with HFT-rigid conduits by using our special HFT-sealing-cement "HVKS310". It has to be noted that conduits have to be installed free from mechanical stresses and flexible. Thus cracks at the bonded areas can be avoided in case the conduit system is expanding or contracting due to temperature changes. Especially in case of conduits with thin walls t is recommended not to use the cement or only when mounted very carefully.

Chemical Resistance:
HFT-Conduits are highly resistant against chemical attack, however, some chemical agents like oils, fats, greases and fuel are capable to cause stress-cracking. Therefore, please observe the memorandum on Chemical Resistance for selecting the correct conduits.
Drawing-in of cables and wires In case drawing-in aids are required, we recommend the use of cable-lubricant (Polywater GL35) tested by us. Other aids (like vaseline) can cause cracks. Avoid PVC-cables, as softening agents in the material can evaporate at higher temperatures. Finish: The Locking Device gives a tight and secure fixing for the box. Fast and efficient fixing of the complete installation system. Suitable for partition board thicknesses between 7mm to 35mm. Conduit entries in variable angles possible due to the special shape of the wall/bottom knock-outs. The box can be removed from the wall to accommodate additional cables and be replaced easily. Virtually everywhere where conventional metal or plastic conduit is used, Supertube is finding its application. The conduit is made of a welded aluminium tube with inner and outer layers of halogenfree polyethylene and combines the strength of metal with the flexibility and insulating characteristics of plastic. Coils can be carried and laid with ease, no bends are required, as it is bent by hand or a hand held bending tool for straight runs on surface. The conduit is flame retardant, halogenfree and has low smoke density and can be used with the HFT-range of fittings.

UNIVOLT OPTICAL FIBRE DUCTINGS LWL from PE-HD acc. DIN 8074/8075
1. Allgemeines Dietzel-Lichtwellenleiterrohre werden aus hochwertigem Polyethylen-hart (PE-HD), welches mittels Ru UV- stabilisiert ist, hergestellt. Infolge der Materialcharakteristik von Polyolefinen mu darauf geachtet werden, da Beschdigungen an Rohren durch Transport, Lagerung und Verlegung vermieden werden. 2. Transport DIETZEL-Lichtwellenleiterrohre aus PE-HD sind mit geeigneten Fahrzeugen (Ladeflche sauber, keine Ngel, Schrauben usw. die aus der Ladeflche oder Bordwnden herausragen) zu transportieren und unter Verwendung geeigneter Hebezeuge und Anschlagmittel (Gurt oder Hanfseil) auf- und abzuladen. Beim Verladen und Transport mit Gabelstaplern etc. mssen die Staplergabeln mit entsprechenden Schutzvorrichtungen (Aufsteckschuhe aus PE oder Gummi) versehen werden um Beschdigungen zu vermeiden. Die Rohrbunde drfen keinesfalls von der Ladeflche geworfen oder ber die meist scharfe Bordkante gezogen werden. Bei ebenem Transport drfen die Rohrbunde keinesfalls ber den Boden geschliffen werden, da mglicherweise an der Rohroberflche Verletzungen verursacht werden, die zum Versagen im Betriebszustand fhren knnten. Die Rohrbunde (Pacable) sollten vorzugsweise auf Paletten transportiert werden. Am Transportweg ist eine Lagerung der Rohrbunde horizontal gestapelt mglich. 3. Lagerung Bei der Lagerung ist zu beachten, da die Rohre keiner unzulssig hohen Wrmebeanspruchung ausgesetzt werden (z.B. intensive Sonneneinstrahlung), um eine nderung des Polymerwerkstoffes sowie der malichen Kennwerte des Rohres durch Verformung zu vermeiden. Die Pacable sind auf einer ebenen, sauberen Flche mglichst witterungsgeschtzt liegend zu lagern. Bei Platzbedarf ist eine Lagerung der Pacable bereinander zulssig (max. Anzahl: 2). Die Rohrenden werden werkseitig mittels Endkappen geschtzt um Verschmutzungen im Rohr zu vermeiden. 4. Verbinden der Rohre Das Personal mu mit den geeigneten Verbindungsmethoden vertraut sein. Die Verbindungsverfahren mssen sorgfltig eingehalten werden, um qualitativ gute Verbindungen zu erzielen. Sauberkeit ist von entscheidender Bedeutung fr die Herstellung von zuverlssigen Rohrverbindungen. 5. Endkontrolle Die Prfung der fertig verlegten Leitung erfolgt nach den einschlgigen Normen bzw. nach Anweisung der rtli chen Bauleitung.

1. General UNIVOLT ductings for optical fibre cables are manufactured from high grade Polyethylene-high density (PE-HD), and are UV stabilized. Due to the material characteristics of Polyolefines it is necessary to pay attention to careful treatment and handling of fibre optical ductings during transport, storage and installation. 2. Transport UNIVOLT ductings for fibre optical cables from PE-HD require transport in specially prepared trucks (clean loading space, no nails, screws or other objects that could harm the conduits) need to be loaded and unloaded by special lifting devices and fixtures (belts or hemp ropes). If the conduits are handled by means of a fork lift truck the forks should be equipped with suitable protection (rubber or PE wrappings) to avoid any damage on the conduits. In no case the coils should be thrown or pulled over the edge of the loading space. Dragging the coils over the floor or re-arranging coil piles may also cause harms on the conduit surface and it is advised to pay particularely attention to a careful moving of the coils at any time. Such harms could lead to a malefunctioning of the conduits when put under pressure. Coils and drums (Pacable) should preferably be shipped on paletts. During transport the coils may also be piled horizontally. 3. Storing The conduits should not be stored in an environment with extreme outer physical influences and temperatures (e.g. intensive sun light), which may result in changes of the microstructure of Polyethylene and deformation of the conduit profile. Pacable drums should preferably be stored on even and clean surface and should be protected against weather influences. To make maximum use of the storing area the drums may also be piled horizontally (max. number: 2). The fibre optical ductings are supplied with plugs on each conduit end to avoid any dirt ingress before the system is exposed to air pressure. 4. Connection of Conduits Workers should be trained in correct handling of connectors and coupling of the conduits. All jointing methods have to be followed strictly to achieve a quality connection in the whole system. Tidyness is an important factor for the reliable and functioning conduit connections. 5. Final Inspection The final inspection of the ducting system has to be in accordance with the relevant standards and instructions of the local supervision of construction works.

GENERAL TERMS AND CONDITIONS FOR SALE AND DELIVERY OF DIETZEL GMBH.
1. General Provisions 1.1 These general terms and conditions shall apply unless the parties to the contract have expressly made an explicit agreement to the contrary in writing. 1.2 Any quotations submitted by DIETZEL GmbH. (hereinafter briefly referred to as DIETZEL) shall be subject to change without notice. The contract shall only come into force upon written confirmation or delivery. The documents part of the quotation such as illustrations, drawings, weights and measurements in particular shall only be considered to be approximate statements unless they were expressly referred to as binding. Statements as to properties, weights, volumes, capacities, colours, prices and similar specifications shall only become an integral part of the contract to the extent they were used in the catalogues, circulars, brochures, adverts, illustrations and price lists used by DIETZEL in the course of its business operations. 1.3 DIETZEL expressly reserves the right to implement changes in the design and shape of the subject matter of the contract based on technical progress without prior announcement. 1.4 Guarantees, collateral agreements and changes in and amendments to this agreement shall only be effective in writing. This requirement cannot be dispensed with. 1.5 Changes in the general terms and conditions of sale and delivery shall become legally effective at the beginning of next but one month following the month during which the customer was notified and shall henceforth apply to any current and future business transactions between the customer and DIETZEL unless a written objection filed by the customer was received by DIETZEL prior to that date. 2. Prices and Terms of Payment 2.1 Unless otherwise agreed, DIETZELs prices shall be ex works or warehouse, excluding loading, excluding VAT. Unless otherwise agreed, we will charge the prices applicable on the day of delivery. 2.2 The indicated prices are including packaging as usual in trade. Any other packaging which might be required shall be charged at the actual fee. If reusable packaging which is provided upon delivery is not returned in time franco one of DIETZELs warehouses, it shall be invoiced. 2.3 Unless otherwise agreed, invoices shall be payable within thirty days from date of invoice without deductions. If the customer effects payment within fourteen days from date of invoice, DIETZEL shall grant the customer a 2 % cash discount. No cash discount shall be granted for invoices concerning repair and outwork. The ordering party shall not be entitled to a cash discount if the ordering party is in default of payment obligations to DIETZEL based on any other contracts. 2.4 At request, the customer shall effect payment in instalments to DIETZEL relative to progress in performance of the contract. 2.5 The customer shall not be entitled to offset any counterclaims or warranty claims which are in dispute or have not been declared in a final and absolute judgement. This shall also apply to the assertion of a right of retention by the customer. 3. Delay in Payment 3.1 If the customer is in delay with payment of an agreed sum or any other performances, DIETZEL shall have the following rights: the right to defer performance of its own obligations until the arrears were paid or any other performances were effected. the right to implement a reasonable extension of the term of delivery. the right to charge 8 % interest on arrears from the due date subject to assertion of higher actual damage due to delay in performance. the right to rescind the contract after a reasonable period of grace has lapsed without results. 3.2 In any case, the customer shall be obliged to compensate DIETZEL for any costs incurred for demands for payment as well as any costs such as creditor protection association and collection agency costs and lawyers fees incurred before institution of proceedings in particular. 4. Delivery and Performance 4.1 The term of delivery which must be expressly agreed shall start upon conclusion of the contract but, in any case, not before receipt of a down-payment which might have been agreed. One condition for DIETZEL respecting the term of delivery shall in any case be the performance of contractual obligations by the customer. 4.2 The term of delivery shall be deemed to have been observed if the subject of delivery was dispatched by DIETZEL to the customer or if notice of readiness for shipment was given to the customer by DIETZEL before expiry of the term of delivery. The term of delivery shall be prolonged correspondingly if changes or amendments are subsequently requested by the customer. This shall also apply if any impediments were to occur which had not been foreseeable upon execution to the extent such impediments are proven to influence the completion or delivery of the subject of performance such as, in particular, delays caused by force majeure, industrial strife, strikes, lock-outs, delays in the delivery of key raw materials, materials or components. This shall also apply if the above-mentioned circumstances occur at one of DIETZELs sub-suppliers. If the delivery cannot be effected due to the occurrence of such circumstances, DIETZEL shall be entitled to repudiate the contract. This shall not give rise to any customer claims whatsoever. This shall also apply if the aforementioned circumstances have occurred during an unrelated delay in performance. 4.3 If it is impossible to ship goods ready for shipment without DIETZEL being responsible for this inability to ship or if the customer refuses to take delivery of the goods, DIETZEL shall be entitled to store the goods at the customers expense. In this case, delivery shall be deemed to have been effected upon delivery to the warehouse. This shall, however, be without prejudice to the agreed terms of payment. 5. Passage of Risks 5.1 Unless otherwise agreed, the goods shall be deemed to have been sold ex works (readiness for collection). DIETZEL shall effect delivery excluding insurance and duties unpaid ex works. Part deliveries shall be allowed, unless otherwise agreed. 5.2 The risk of accidental perishing of a chattel and damage shall pass to the customer upon dispatch of the delivery parts at the latest even if part deliveries are effected and other items are included in DIETZELs scope of performance such as consignment fees or delivery and installation. 5.3 Otherwise, the INCOTERMS as amended on the day of execution of the contract shall apply. 6. Reservation of Ownership and Assignment 6.1 DIETZEL reserves the proprietary right to the object of purchase until complete performance of all financial obligations by the customer. 6.2 The customer shall be entitled to sell the reserved goods in its ordinary course of business as long as it is not in delay with payment. It shall not be entitled to dispose of the reserved goods any other way (such as by chattel mortgage, assignment by way of pledge). The customers claims to payment of the purchasing price or compensation for work arising from resale of the reserved goods shall be assigned to DIETZEL up to the amount of DIETZELs claim to the customer. 6.3 In case of a delay in payment, the risk of cessation of payments or in the event of execution upon the customers assets, DIETZEL shall be entitled to dismantle the reserved goods and/or otherwise require them to be returned. This shall not, however, be considered to be a repudiation of the contract. The customer is required to return property. 6.4 DIETZEL must promptly be informed if the reserved goods are assigned by way of pledge or if the reserved goods are affected any other way by third parties. The customer shall bear any costs incurred for such third-party attachment. 6.5 The customer expressly consents to DIETZELs right to assign any claims to the customer to third parties for any purpose whatsoever. Any prohibition to assign which might be applicable shall only become legally effective if this was explicitly agreed between the parties to the contract in each specific case. 7. Returned Goods 7.1 Goods can only be returned if this was expressly agreed in writing beforehand. Goods must be returned franco warehouse specified by DIETZEL. The goods must be as good as new and packed in their original packaging. In any case, DIETZEL shall charge a reasonable manipulation fee. 8. Warranty 8.1 DIETZEL shall assume warranty for the accordance of the delivered goods with the order and for the fitness of the goods for normal use. It is expressly stated that indications as to the properties, weight, volume, capacity, colour, prices and any other specifications shall only become an integral part of the contract if these statements were used in the catalogues, circulars, brochures, adverts, illustrations and price lists used by DIETZEL in its ordinary course of business. Public statements on DIETZEL products by parties other than DIETZEL shall not be decisive for the evaluation of the integral parts of the contract. 8.2 DIETZEL shall only assume a warranty obligation for defects which are based on a design defect, faulty material or execution and even then only if such defects are noticed over a period of twelve months of common use from the passage of risks and/or the date of delivery: a) Within the first six months, DIETZEL undertakes, at its absolute discretion, to rectify defects or replace parts in defective goods which turn out to be unfit for use or only suitable for considerably limited use due to a circumstance which occurred before the passage of risks such as, in particular, faulty construction, faulty material or faulty execution free of charge excluding incidental expenses (such as, in particular, travelling time costs, labour costs or transport costs and the like). DIETZEL reserves title to the replaced components. The customer must prove that the defect already existed at the time of delivery within the first six months after delivery. b) Six months after performance, DIETZEL shall assume a guarantee for, at its absolute discretion, either repairing or replacing defective objects by objects free of defects for another six months if it can be proven that the defective goods are not fit for use or are only suitable for considerably limited use due to a manufacturing defect, faulty material or design. Any incidental expenses such as travelling time expenses, labour costs or transport costs in particular, shall be borne by the customer. DIETZEL excludes liability for any other warranty claims such as, in particular, the right of rescission of sale or reduction in price (even in the event of failure of the rectification of defects and/or repeated delivery) as well as claims for damages on any legal basis whatsoever. 8.3 The customer shall only be entitled to claim relief based on its warranty rights if DIETZEL was promptly notified of the defects which have occurred in writing. In this case, DIETZEL shall have the following options if the defects can be rectified by DIETZEL based on the applicable provisions: a) it can rectify defects in defective goods at the customers premises; b) it can ask the customer to send the defective goods or components to it for rectifying the defects; c) it can replace the defective goods or components. If it is impossible to rectify the defects or if it would be disproportionately expensive to rectify the defects, DIETZEL shall also be entitled to grant a reasonable reduction in the price. 8.4 If the defective goods or components are returned for rectification of defects or replacement, the customer shall bear both the costs and risk of transportation. 8.5 The defective goods or components replaced pursuant to these provisions shall exclusively be placed at DIETZELs disposal. DIETZELs warranty obligations shall only apply to defects which have occurred subject to observance of the prescribed operating conditions and in the course of use common in trade. The customer must provide evidence. In particular, DIETZEL shall not assume warranty for defects which were caused due to improper installation by the customer or its agents, improper maintenance, improper repair or modifications by third parties which were not approved by DIETZEL in writing as well as common wear and tear. 8.6 DIETZELs liability based on the special right of recourse shall in any case expire two years from DIETZELs performance and the scope of liability shall be limited to the effect that the customer is only indemnified for any warranty costs which might be incurred by the customer to the amount of the actually agreed DIETZEL sales price of the defective goods minus any cash discounts or other discounts which might have been granted. 8.7 DIETZEL shall not assume liability for defects in excess of the aforementioned provisions. 9. Liability 9.1 DIETZEL shall not assume liability for personal injury, for damage to goods which do not constitute a subject matter of the contract as well as for any other damage and lost profit unless it turns out in this individual case that this was caused by DIETZEL with gross negligence. 9.2 The goods delivered by DIETZEL are safe to the extent specified in the provisions for approval, operating instructions, DIETZEL instructions on how to use the object of purchase such as, in particular, with a view to any inspections which might be required and other warnings which might have been given. If sub-section 8.1 does not apply, DIETZELs liability for slightly negligent damage shall in any case be limited to 5 % of the volume of the order. 9.3 Unless otherwise agreed, this stipulation shall exclude liability on the part of DIETZEL vis--vis the customer for production downtime, lost profits, loss of use, lost contracts or any other economic or indirect consequential damage. 10. Data Protection 10.1 DIETZEL shall be entitled to store, transmit, revise or delete personal data concerning the customer in the course of its ordinary business. 10.2 The parties undertake to keep any information obtained within the framework of their business relations strictly confidential and refrain from disclosing it to third parties. 11. Place of Jurisdiction, Applicable Law, Place of Performance 11.1 The court which has jurisdiction as regards the subject matter at the registered office of DIETZEL GmbH. in Vienna shall be the place of jurisdiction for any disputes which might arise directly or indirectly from the contract. Regardless of this agreement, DIETZEL shall be entitled to invoke a court competent for the other party to the contract. 11.2 The remainder of this contract shall continue to be binding even if individual provisions of this contract may be or become legally invalid. This shall not apply if it would constitute an unreasonable hardship for either of the parties to continue to be bound by the terms of this contract. 11.3 This contract shall be governed by Austrian substantive law. Both parties have mutually agreed to exclude application of the United Nations Convention on Contracts for the International Sale of Goods. 11.4 The registered office of DIETZEL GmbH. in Vienna shall constitute the place of delivery and place of payment even if it is agreed to effect delivery to any other location.
ALLGEMEINE VERKAUFS- UND LIEFERBEDINGUNGEN DER DIETZEL GMBH.

Die nachstehenden Bedingungen gelten, falls mit unserer Firmenleitung nicht ausdrcklich schriftlich anders vereinbart, fr alle gegenwrtig und knftig abzuschlieenden Verkufe. Abweichende oder mndliche Abmachungen haben erst dann Gltigkeit, wenn sie schriftlich von uns besttigt sind. Aus Schreibfehlern und sonstigen Irrtmern unsererseits knnen keinerlei Rechte abgeleitet werden. Die in Katalogen, Prospekten, Rundschreiben, Anzeigen, Abbildungen und Preislisten enthaltenen Angaben ber Gewichte, Mae, Fassungsvermgen, Farben, Preis, Leistungen und hnliche Spezifikationen sind nur annhernd. Diese sind uns gegenber nur dann verbindlich, wenn sie beim Kaufabschlu schriftlich zur Bedingung der Bestellung gemacht wurden. Wenn nicht anders vereinbart, liefern wir die Ware nach einschlgiger NORM in werksblicher Sortierung. Warenproben sind hinsichtlich Gte und Farbe Durchschnittsmuster. Auftrge werden fr uns erst durch schrift-liche Annahme unsererseits verbindlich, wir sind jedoch trotz Annahme des Auftrages berechtigt, vom Liefervertrag zurckzutreten, wenn berechtigte Zweifel bestehen, da der Kunde die vereinbarten Zahlungsziele nicht einhalten kann. Unsere Erzeugnisse werden handelsblich verpackt und soweit angegeben, nur in kompletten Verpackungseinheiten geliefert. Eine fr den Versand erforderliche zustzliche Verpackung wird berechnet. Wir sind Lizenznehmer der ARA (Nummer 638) und sind daher entpflichtet, Verpackungsmaterial zurckzunehmen, ausgenommen sind Mehrwegverpackungen, die von uns beigestellt wurden; werden diese nicht zurckgegeben, erfolgt Verrechnung. Der Versand erfolgt stets auf Gefahr des Empfngers ab unserem Lager Wien oder ab unseren Zweigniederlassungen. Fr beschdigte oder verlorengegangene Gter sind wir nicht ersatzpflichtig. Bei neutralen Sendungen an einen vom Besteller genannten Empfnger erfolgt der Versand grundstzlich unfranko, ebenso in allen Fllen, in welchen fr den Versand vom Besteller eine bestimmte Speditionsart vorgeschrieben wird. Versicherungen aller Art erfolgen nur ber Anordnung und auf Kosten des Bestellers in dem von ihm gewnschen Ausma. Die Lieferungsgegenstnde bleiben bis zur vollstndigen Bezahlung der Kaufsumme und aller eventuellen Nebenspesen unser Eigentum, auch wenn inzwischen ein Weiterverkauf durch den Kufer erfolgte. Stellt sich bei oder nach Auftragsannahme heraus, da sich der Kufer in schlechten Vermgensverhltnissen befindet, so sind wir berechtigt, den Abschlu fr ungltig zu erklren, bereits gelieferte und noch nicht bezahlte Waren, wo immer sie sich befinden, auch ohne gerichtliche Genehmigung sofort abholen zu lassen und weitere Lieferungen von Kassazahlungen abhngig zu machen. Schadenersatzansprche des Kufers aus diesen Manahmen uns gegenber sind ausgeschlossen. Wird die unter Eigentumsvorbehalt verkaufte Ware beim Kufer oder dessen Kunden von Zwangsvollstreckungsmanahmen betroffen, so sind uns diese vom Kunden unter bergabe der fr ein Einschreiten notwendigen Unterlagen unverzglich bekanntzugeben. Unsere Lieferungen erfolgen im allgemeinen prompt ab unserem Lager Wien oder ab unseren Zweigniederlassungen. Ist dies nicht mglich so werden die krzesten Lieferzeiten bei Bestellungsannahme bekanntgegeben. Unvorhergesehene Hindernisse irgendwelcher Art und Flle hherer Gewalt berechtigen uns, die Liefertermine angemessen hinauszuschieben oder berhaupt von der Lieferung zurckzutreten. Angaben und Lieferzeiten sind stets unverbindlich. Rcktritt des Kufers wegen verspteter Lieferung ist nur mglich, wenn uns erfolglos eine angemessene Nachfrist gestellt wurde. Schadenersatzansprche des Kufers wegen verspteter, unterbliebener oder nur teilweiser Lieferung sind ausgeschlossen.

Die Preise gelten ab Lager Wien bzw. Zweigniederlassungen. Auftrge bis S 500,- exkl. Mwst. werden brutto fr netto verrechnet. Ab einem Netto-Auftragswert von S 5.000,- exkl. Mwst. wird die Ware franko Empfangsstation geliefert. Die Preise sind auf Grund der derzeitigen Gestehungskosten im Anbot erstellt. Sollten sich die Gestehungskosten ndern, behalten wir uns vor, nach Ablauf der Anbotsverbindlichkeit jeweils Zu- oder Abschlge inkl. Abgaben (z. B. Mwst.) zu verrechnen. Wenn nichts anderes vereinbart, werden diejenigen Preise berechnet, die am Tag der Lieferung Gltigkeit haben.
7. ZAHLUNGSBEDINGUNGEN
Bei Erstgeschften wird grundstzlich nur gegen Kassazahlung geliefert. Ansonsten gewhren wir bis auf weiteres ein Zahlungsziel von 30 Tagen de dato Faktura. Nur bei Zahlung innerhalb von 14 Tagen de dato Faktura rumen wir einen Kassaskonto von 2% ein. In Sonderfllen behalten wir uns vor, bei Auftragsannahme eine dem Umfang des Auftrages entsprechende Anzahlung zu verlangen. Bei Zielberschreitungen sind wir berechtigt, Verzugszinsen zu verrechnen, die um 1% ber dem jeweils gltigen Kontokorrentkreditsatz liegen. Darber hinaus steht uns das Recht zu, im Verzugsfall auer den Verzugszinsen diejenigen Kosten zu begehren, welche uns aus Mahnungen, auergerichtlicher Eintreibung unserer Forderungen, Anmeldung oder Beteiligung im Konkurs-, Ausgleichs- oder Zwangsausgleichsverfahren auflaufen. Wir behalten uns vor, berhaupt alle diejenigen Kosten, die uns entstehen, aber im Rahmen eines eventuellen Proze-und Exekutionsverfahrens gerichtlich nicht zugesprochen werden, einzufordern. Die Annahme von Wechseln und Schecks erfolgt nur zahlungshalber, Gutschriften werden nur vorbehaltlich des Einganges und Valuta zum Eingangstag erteilt. Smtliche mit der Einlsung und Diskontierung dieser Papiere auflaufenden Kosten und Abgaben, Zinsen und Belastungen welcher Art auch immer, gehen zu Lasten des Kufers. Wir sind berechtigt, die Annahme von Wechseln und Schecks ohne Angabe von Grnden abzulehnen. Der Kufer ist nicht berechtigt, Gegenforderungen, welche von uns nicht ausdrcklich anerkannt werden und mit deren Aufrechnung wir uns einverstanden erklrt haben, mit seinen offenen Buchforderungen zu verrechnen oder daraus Rckbehaltungsansprche geltend zu machen. Beanstandungen der Beschaffenheit oder Liefermenge sind nur gltig, wenn sie innerhalb von 8 Tagen nach Empfang der Ware schriftlich zu unserer Kenntnis gebracht werden. Mngel eines Teiles einer Lieferung berechtigen nicht zur Beanstandung der ganzen Lieferung. Werden Beanstandungen von uns anerkannt, so haben wir bei Rcknahme der mangelhaften Ware das Recht, dafr entweder einwandfreien Ersatz zu leisten oder Rechnungsgutschrift zu erteilen. Alle weiteren Ansprche und Rechte des Empfngers bzw. Kufers wie Rcktrittsrecht, Schadenersatz, Wandlung oder Vergtung von Lhnen, Frachten, Verzugsstrafen usw. sind ausgeschlossen. Fr von uns geleistete Ersatzlieferungen und ausgefhrte Verbesserungsarbeiten wird unter den Bedingungen der Erstlieferung gehaftet. Wir leisten Gewhr dafr, da das verwendete Material einwandfrei verarbeitet ist und Mae den geltenden Bestimmungen (NORM) entsprechen. Prfungen der Fertigteile erfolgen nach VE-Vorschriften. Spezielle Prfungen mssen besonders vereinbart werden und gehen mangels anderer Vereinbarungen zu Lasten des Bestellers. Von uns ausgelieferte Waren knnen nur dann zurckgegeben werden, wenn vorher dazu unsere ausdrckliche Zustimmung eingeholt wurde. In jedem Fall hat die Rcksendung frei Haus d.h. franko unserem Lager Wien bzw. unseren Zweigniederlassungen zu erfolgen. In der Regel wird die Rcksendung an die Auslieferstelle vorzunehmen sein. Fremdfabrikate werden von uns grundstzlich nicht angenommen. Die Rcknahme von Sonderanfertigungen oder beschdigten und/oder verschmutztem Material mssen wir ebenfalls ablehnen. Unter der Voraussetzung, da die Warenretoure zu einer Gutschriftserteilung berechtigt, behalten wir uns in jedem Fall, abgesehen von der Anlastung allenfalls notwendiger Nachbearbeitungskosten, die Berechnung einer angemessenen Manipulationsgebhr vor. Fr Waren (Gegenstnde), die wir nach vom Kunden beigestellten Unterlagen hergestellt haben, bernimmt ausschlielich der Kunde die Gewhr, da dadurch keine Schutzrechte Dritter verletzt werden. Bei Geltendmachung derartiger Schutzrechte durch dritte Personen sind wir berechtigt, ohne die Richtigkeit dieser Ansprche zu prfen, die Herstellung der Liefergegenstnde einzustellen und den Ersatz der uns entstandenen Kosten zu beanspruchen. Schadenersatzansprche des Bestellers sind ausgeschlossen. Schden, welche uns mittelbar oder unmittelbar durch die Verletzung von Schutzrechten entstehen, sind vom Besteller zu ersetzen, dies gilt fr alle mit der Verletzung zusammenhngenden entstehenden Ansprche einschlielich Proze- und vorprozessualer Kosten. Mangels anderer Vereinbarung steht es uns frei, alle Liefergegenstnde oder Waren unserer Produkte auch fr den Fall, da Unterlagen des Bestellers verwendet wurden, zu verffentlichen. Der Kunde nimmt zur Kenntnis, da wir unser gesamtes Rechnungswesen automationsuntersttzt fhren. Unter Bedachtnahme auf die Bestimmungen des Bundesgesetzes v. 18.10.1978, BGBl. 565 (Datenschutzgesetz), erklrt sich der Kunde gem. den 17 und 18 dieses Gesetzes ausdrcklich mit der Speicherung und Verarbeitung der aus der Geschftsverbindung zwischen Kunden und uns notwendigen Daten, sowie mit der bermittlung dieser Daten, sofern sie weder das Privat- noch das Familienleben des Kunden betreffen, an Dritte einverstanden. (DVR-Nr. 0516554). Fr alle aus den Geschften sich ergebenden Rechte und Pflichten gilt als Erfllungsort und Gerichtsstand Wien.
