Members of the public might submit requests that are so vague or broad staff cannot identify responsive records. You should work with requesters to narrow down their request or attempt to understand what they need. You should attempt to contact the requester using all means they provided. In other words, if requester provided a phone number, you shall attempt to contact them via phone, in addition to contacting them through the online system. If you dont hear from the requester after attempting to contact him or her 3 times within 30 calendar days from your first attempt to contact them, then close the request (be sure to add comments for each communication attempt and the closure).

Immediate Disclosure Request RECORDS Due within 3 Business Days.
When a City department receives a request marked Immediate Disclosure, you must: provide the documents requested within 3 business days, or send requestor a written notice of extension if grounds exist. See extension grounds below. The immediate disclosure timeline applies only if: the words Immediate Disclosure are expressly stated in the request, and the request is for public records that have been previously distributed to the public; examples of such records are previously published meeting agendas and agenda-related materials and City Administrator announcements, and the requestor has provided a contact email, telephone or facsimile number.
Extension: You may extend the time to provide documents by 4 calendar days to determine it is necessary: to search for and collect records from field facilities or other off-site locations, or to search for, collect, and examine a voluminous amount of separate and distinct records, or to consult another agency with a substantial interest in the records about disclosure of the records; or to compile data or create or buy computer programming to extract data. 7 calendar days of date of request - these determinations must be communicated in writing to the requestor within 7 calendar days of the date of the request. 14 calendar days after sending day written determination sent to requestor must provide nonexempt records for inspection or copying within 14 calendar days of sending the 7-day written determination to requester. (Oakland Municipal Code 2.20.230)

Suggested Text of Response, including Legal Statutes. The City has not provided documents covered by the attorney-client privilege provisions of the Evidence Code (Evid. Code Section 954 and other applicable provisions of state law), pursuant to Section 6254(k) of the Public Records Act which provides that Records, the disclosure of which is exempted or prohibited pursuant to federal or state law, including, but not limited to, provisions of the Evidence Code relating to privilege are exempt from disclosure. Please note that this exemption DOES NOT apply to communications between the Citys representatives and an adverse party, including the text and terms of any settlement agreement, once the pending litigation has been settled or finally adjudicated, unless otherwise privileged or made confidential by law. The City Attorneys Office must be consulted prior to withholding or disclosing.
Attorney Work Product (such as legal research, analysis, impressions, and conclusions of an attorney)
The City has not provided documents covered by the attorney-client privilege provisions of the Civil Code of Procedure (Code Civ. Proc. Section 2018.30 and other applicable provisions of state law), pursuant to Section 6254(k) of the Public Records Act which provides that Records, the disclosure of which is exempted or prohibited pursuant to federal or state law, including, but not limited to, provisions of the Evidence Code relating to privilege are exempt from disclosure. The City has not provided information identifying private citizens who have made complaints as they have a right to privacy in complaining to the government. (City of San Jose v. Superior Court (1999) 74 Cal.App.4th 1008, 1020.)
The City has not provided investigative and/or intelligence records or information pursuant to Government Code 6254 (f), which exempts from Exemption applies only to disclosure investigatory/intelligence files of the Attorney General, investigations done for law district attorneys offices, law enforcement agencies and such files of enforcement purposes or by other agencies conducting investigations for law enforcement purposes. law enforcement agencies.
Litigation Records
The City has not provided records per Government Code 6254 (b), because Records pertaining to pending litigation to which the public agency is a party, or to claims made pursuant to Division 3.6 (commencing with Section 810), until the pending litigation or claim has been finally adjudicated or otherwise settled are exempt from disclosure and have been withheld.
Personnel Records (such as performance evaluations, letters of reprimand, discipline, etc.) This exemption DOES NOT apply to a personnel file in its entirety. Consult the City Attorneys Office regarding disclosure of personnel information. Privacy related information, such as: home addresses home telephone numbers social security numbers drivers license number marital status credit card numbers bank accounts information (except if connected to a loan made by the City. Always consult City Attorneys Office).
The City has not provided records pursuant to Government Code Section 6254(c) because personnel records or information, such as medical records, records of performance, termination, discipline, etc. are exempt from disclosure.
Personal information [state what type, e.g., home phone numbers, addresses] has been redacted pursuant to the individuals constitutional right to privacy and to protect against identity theft per Government Code Sections 6254(c) and 6255.
Preliminary notes, drafts, and memoranda not retained in the ordinary course of business, but only if the public interest in nondisclosure outweighs the public interest in disclosure. Staff must articulate in writing a significant public interest in non-disclosure in order to withhold this category of records.
The City has not provided records that are exempt for disclosure pursuant to Government Code 6254 (a), which states the following kind of records are not required to be disclosed: Preliminary drafts, notes, or interagency or intra-agency memoranda that are not retained by the public agency in the ordinary course of business, if the public interest in withholding those records clearly outweighs the public interest in disclosure. [Staff must also provide reasons supporting a significant public interest in withholding the records.] Staff must submit a written request to use this exemption that describes a substantial public interest in withholding to the Office of the City Attorney for approval prior to asserting exemption to requester.
11. How do I redact information from a document or withhold a record that is exempt?
You must redact the confidential material or data that is subject to exemption from the document before it is released to the public. Redaction can be done by any method that covers the portion of the information that cannot be disclosed to the public, such as with redaction tape, black marker (only on a duplicate of the document), or computer software that allows for electronic redaction of selected sections. If you need assistance identifying the information that should be redacted, contact the Open Government Coordinator in the City Attorneys office to coordinate advice from the City Attorneys Office. You need to provide the original document and the redacted document you created. Highlight your proposed redactions and state your concerns. If the entire record is exempt from disclosure, you must inform the requester of the reason in writing by citing the law that allows for the exemption. Contact the Open Government Coordinator in the City Attorneys office for help with the proper citation. Each departments Public Records Request Liaison is the last line of assurance for record redaction. Before any record is uploaded to RecordTrac, or disclosed to a requester in any other manner, the custodians departmental Liaison must review the record for exemptions and, if needed, facilitate or perform proper redaction.
12. How do I communicate with a requester via RecordTrac regarding redacted or withheld information?
Do not upload exempt information onto RecordTrac. Refer to the exemptions listed above. Redacted documents can be uploaded as a PDF file after redaction has been completed. In addition, for records that are only disclosable to specific individuals, use the Add Note feature to communicate with the requester about how to arrange for the document to be delivered through other means.

Paper Records: 1. Records may be provided by allowing access (inspect or obtain a copy) to the documents during normal business hours. 2. Scan and upload document to RecordTrac (the scanned record should not be saved or filed on share drives or in email, etc.). 3. Notify requestor via the RecordTrac response section of cost to duplicate, based on the Master Fee Schedule (obtain deposit if required). Copy records, contact requestor advising when ready for pick up, collect fee and note amount in RecordTrac on pickup date. Voluminous (large) Amounts of Records: 1. Evaluate the records to determine the amount of records you have as well as any additional records that may need to be obtained from someone/where else; 2. Inform the requester via the RecordTrac response section that the information will be provided in segments with an estimated completion date and the first segment of records; 3. Remaining records should be provided as soon as the records become available. If a request produces a significant amount of records and it is not possible to upload all the records to RecordTrac then provide the requester with the hardcopy documents (follow Step 3 of Paper Records above); 4. Document what was given to requester, the process of fulfilling the request, and how/where the records provided can be accessed for future reference.
14. I converted some records into PDF format and provided them to the requester, but requester wants them in Excel, do I have to give the records in Excel format?
The California Public Records Act does not require an agency to create a new record; Government Code 6253.9 (1) states The agency shall make the information available in any electronic format in which it holds the information.; (2) Each agency shall provide a copy of an electronic record in the format requested if the requested format is one that has been used by the agency to create copies for its own use or for provision to other agencies.; (2)c Nothing in this section shall be construed to require the public agency to reconstruct a record in an electronic format if the agency no longer has the record available in an electronic format. (2)d If the request is for information in other than electronic format, and the information also is in electronic format, the agency may inform the requester that the information is available in electronic format. Hence, examples for format change would be: Agency should provide the information in the format requested if that format is readily available to the Agency. For example, if the requester requests the document in Microsoft Word and the Agency has the document in Microsoft Word, it should be produced in Microsoft Word. However, the Agency responding to a request is not required to create a record in a medium in which it does not exist unless the alternative medium is required by the requesters disability. If a person with a disability requests information in a medium in which it does not exist (e.g., disc, tape, written transcript or Braille), the Agency must make every effort to create a record that will provide effective communication to the Requester. For example, if a person with a hearing impairment requests a record of a meeting recorded on audio disk, the Agency should make every effort to provide the requester a written transcript or disk of the meeting.

21. Can I charge for the staff time required to locate the records?
No. The City may only charge for the direct costs of copies (currently 10 cents per page). Check Master Fee Schedule (may be access on the Citys Intranet) for future reference. In addition: A department may charge the cost of postage if the documents are mailed to the requester. There is no charge for staff time used to locate or collect records. There is no charge for staff time used to redact non-disclosable information. There is no charge fee for staff time used for supervision during inspection of records. Inspection of any video or audio recording must be provided free of charge on a device made available by the local agency or body responding to the request. Alternative forms of communication provided to persons with disabilities shall be provided at a fee no greater than the fee charged to persons requesting the information in its original form. Agencies may require requesters of electronic records pay for production costs, including the cost to construct the record and the cost of programming and computer services necessary to produce the copy if the request would require data compilation, extraction, or programming to produce the record. However, the City will not charge for access to data that is readily accessible without significant cost to the City. Since compilation costs are often expensive, the Agency Representative should contact the requester first to see if the requester is willing to pay for the costs.

5. Are requests for information subject to the same timeline as requests for public records?
Yes. Process the same, including input and closure in RecordTrac. Consult with Department Director and Online Engagement Manager in the City Administrators Office to discuss options for upload information to Open Data Portal.

12. If a requester is unable to read in English, is it possible to arrange to have the documents translated?
Yes. PRR liaisons shall: 1. Contact the Equal Access Office and coordinate translation of records. 2. Inform requester when records will be ready. 3. Provide records following the guidelines previously described.

There are two views in RecordTrac: the city employee view and the public view. Any time there is a web page only a City employee who is logged in should see city in the URL.
City employees are the only users able to upload records, extend a request, close a request, and correspond with the requester through RecordTrac. Only City employees can view: A requesters name A requesters phone number A particular requests due date. This information is hidden from the public. Whether a request is overdue or due soon. Members of the public are only able to tell whether a request is open or closed.

Request Area
This section includes the submitted records request. Below the request is the requesters contact information. Only city employees can view the requesters name and phone number. Everyone can read the request.
When you receive an offline request, please follow the steps below: 1. Inform the requester that you will be processing their request as a public records request. Perform this in the same method of communication that the requester submitted the request. For example, if you receive a request by fax then notify the requester via fax. If you receive a request through email then notify the requester by replying over email. If you receive a request in person or over the phone inform the requester orally. 2. Use the template below for EVERY notification to the requester (for every submission method regardless of whether submission is electronic or in person ):

3. Wait for 24 hours to post the offline record request to give the requester ample time to respond to your notification that their request will be uploaded to RecordTrac. 4. If the requester offers no objection then proceed to Step 5 below. If the requester objects to City staff uploading their request to RecordTrac then they must rescind the request. a. If the request is for a limited-release exempt record then explain this to the requester. The requester may need further assistance to identify who they should contact to obtain limitedrelease exempt records e.g., current or former employees seeking their own personnel records or medical files, crime victims or insurance carriers seeking police reports. Please refer them to the appropriate department. 5. Enter the request description into RecordTrac by accessing the Request a New Record page: http://records.oaklandnet.com/new a. If the request is submitted electronically then you can Copy and Paste the text of the request into the What are you trying to find? box. You MUST be careful when doing this not to enter any personal details (name, address, any personal identification details) into this box. b. If the request is submitted in person then summarize the request yourself in the What are you trying to find? box. c. Specify the date the request was submitted. d. Specify the communication method used to submit the request. Example: This request was submitted via an email on (date submitted) or This request was submitted in-person on (date submitted). 6. In the Select a department or document type drop down menu, select the department that is the custodian of the record requested. a. If you need assistance with determining the which department houses the requested record then please review the Public Records Request Liaison List on the Citys Intranet page (in the Employee Resources section, Applications subsection, under RecordTrac). Then enter the requesters personal contact details into the Contact Information section below.

8. Then click Submit my request button. a. If you are submitting a request on behalf of a requester, make sure to include the requesters email address. If this is not possible, add a statement in the Request Area clarifying that no email address was provided. For example, Request received via regular mail on Jan. 13, 2014 by Jane Doe. Requester did NOT provide email address, but did give a phone number so communication will take place via regular mail and/or phone.
Change the Point of Contact of a request if your department does not have the information the requester needs nor is the custodian of the record requested. Click on Point of Contact. Enter a City employees name or email address and a short message explaining why you are reassigning the request.

Add a Helper
Sometimes more than one person is needed to fulfill a request or it involves multiple departments. Click on Helpers to notify additional City employees of this request.
Ask a Question
Click on the words Ask a Question to ask the requester a question about his/her request. The question will immediately be posted online and can be viewed by the public. The requester will be notified via email of your question. You will get an email when the requester answers your question.
Upload a Record

Documents stored on a computer can be uploaded. The requester will be notified via email every time a record is uploaded. The documents will be posted online for everyone to view. You must provide a name for the document you post. When you click the Add Record button, the document will immediately become available to the public online. The requester will be notified by email when a record is added. Records are displayed online via Scribd. Supported file types are the following: txt, pdf, doc, ps, rtf, epub, key, odt, odp, ods, odg, odf, sxw, sxc, sxi, sxd, ppt, pps, xls, zip, docx, pptx, ppsx, xlsx, tif, tiff
You can respond to a request by providing a link to where the document or information is stored online. The requester will be notified via email about this link. This web address will be posted online for everyone to view. You must provide a name for the link you post. When you click the Add Record button, the link will immediately become available to the public online. The requester will be notified by email when a record is added. Please note that multiple records cannot be added at the same time, and they shall be added one at a time. Also, the system does not allow users to perform two or more tasks at the same time. For example, if you want to add 2 records and a link to a website, you must first upload one record, click add record, then upload the second record, click add record, and finally type the link to the record in the field provided and click add record.

Some records cannot be uploaded to the website and requesters will have to be told when and where to pick up copies of it. The requester will be notified via email about this message. This message will be posted online for everyone to view. You must provide a name for the document or link you post. When you click the Add Record button, the message will immediately become available to the public online. The requester will be notified by email when a record is added. Below is an example of a posted message:
Add a Note

Use this section to send updates to the requester. This message will immediately become available to the public online. The requester will be notified by email a message has been posted. You may also use this feature to document your attempts to contact requester through other means, such as phone calls or letters.
Use this feature if you need additional time to respond to a request. You can select multiple reasons by holding down the Shift key and clicking on more than one reason. Close a records request by clicking on Close Request. After selecting one or more reason, you have the opportunity to edit the boilerplate message. When you click on the Request an Extension button, the message will immediately be posted online and anyone can read it. The requester will be notified by email of the extension. The due date of the request changes, giving the city employee 14 additional calendar days to respond to the request. An extension can only be requested once. The four legal reasons that you may request an extension and the boilerplate message that will appear in the message field are:
Extension - Large Amount: Additional time is required to answer your public records request. We need to search for, collect, or examine a large number of records (Government Code Section 6253(c) (2)). Extension - Separate Facility: Additional time is required to answer your public records request. We need to search for and collect the requested records from a separate facility or set of facilities (Government Code Section 6253(c) (1)). Extension - Another Agency: Additional time is required to answer your public records request. We need to consult with another agency before we are able to deliver your record (Government Code Section 6253(c) (3)). Extension - Data: Additional time is required to answer your public records request. We need to compile data or create a computer report to extract data (Government Code Section 6253(c) (4)).

Closing a Request
Close a records request by clicking on Close Request. After selecting one or more reason, you have the opportunity to edit a message.
When you click on the Close the Request button, the message will immediately become available to the public online. An email will also be sent notifying the requester that his/her request has been closed. The reasons a request can be closed are in drop-down menu closing prompt. (this drop down list in currently under construction).

Reopen a Request
This button allows you to re-open a request after it is closed. This makes it possible for you to send more messages and upload additional records.
Responses
All of the messages you send to the requesters, links to websites you post, or documents you upload will be displayed here. Everything posted in the response area can be viewed by the public.
All responses are displayed in chronological order. Each response includes the time it was uploaded and who uploaded the document or sent the message.
Tutorial
RecordTrac tutorial shows you how to successfully manage a public records request with RecordTrac. Only government employees who are logged into RecordTrac are able to view the tutorial. You can view the tutorial by going to http://records.oaklandnet.com/tutorial.

Request #: Each request is assigned a unique number. You can easily track your request with this number by visiting http://records.oaklandnet.com/track. Received: This is the date the request was entered in RecordTrac. Most municipalities allow an individual to submit a public records request any way they please, including by mail, fax, and over the phone. If a request wasnt originally submitted through RecordTrac, it may take City employees a day or two to enter it into the system. Request: This is the message sent to the municipality by a member of the public. Sometimes City employees will enter a request on behalf of an individual. If the requested document contains confidential information that may violate the security or privacy of a requester, the public will only see a short description of the document. Point of Contact: The Point of Contact is the employee responsible for providing the requester with the information they need. Sometimes City employees from several departments will be needed to respond to one public records request. They will be added as Helpers, but they will not be displayed on this particular web page. Department: The City department where the point of contact works. Multiple departments may be involved in one request, but the Point of Contacts department will only be displayed. Requester: Only City employees are able to view this personal information. The first and last name of the person requesting documents or information. If a person does not identify themselves at the time they submit their request, the phrase not given will appear in this field.

When they click on the green Update Table button, they can only view the request they selected. By default, only the open requests assigned to that particular City employee are displayed. You can also: Search through the text displayed in the table Select whether you want to see 10, 25, 50, or 100 requests per page (The default is set to 50) View whether a request is open, closed, due soon, or overdue
2. A temporary password will be sent via email to the City email address you entered on RecordTrac. 3. Use the temporary password to log into RecordTrac on its homepage in the login upper right corner. (If you use your computers copy and paste features to enter the temporary password into RecordTrac, then make sure to copy the exact temporary password in order to paste it successfully into RecordTracs blank field. Be careful not to include blank spaces in the area you select using your computer cursor when you copy) 4. Once you are logged in, go to http://records.oaklandnet.com/update_password in the same Internet browser in order to change your password. Enter your new password. Once you click the green Update button your password will change.
