When MERS is the rroftgagee of record, the seruicer must prepare an assignrnent from MERS to the servicer and bring the foreclosure in its own nare unless Fannie Ma specifically allows the foreclosure to be brought in the nare of Fannie Mae. assignrnent must be prepared and executed before the foreclosure begins. If the property is located in a jurisdiction that recognizes the effectiveness of executed, but unrecorded, assignments, the foreclosure nray be inltiated prior to recordation of the assignrnent, In these cases, the assignnents should be recorded as soon as possible, in compliance with the laws of the jurisdiction where the property is located. If the jurisdiction requires the assignnrent to the seruicer or Fannie l'ae to be recorded before proceding with the foreclosure in the seruicer or Fannie Mae's narre, the assignrnent must be recorded before the foreclosure begins.

If an assignnnt from MERS to either the seruicer or Fannie Mae has been recorded from MERs to either the seruicer or Fannie Mae and the borrower reinstates the nrortgage loan prior to completion of the foreclosure proceedings, the sericer need not r"-uriig the rrortgage to MERS and re-registerthe nrortgage with MERS. Re-assigning and re-registering the n.'ortgage with MERS is not required by Fannie Mae and any such action will be at the discretion and expense of the serucer. If the assignment is executed but not recorded at the tinre the borrower reinstates the mortgage loan, and the servicerdecides to re-registerthe nrcrtgage with MERS, the servcer should prepare an assignnent back to MERS. If the servicer decides to re-registerthe loan with MERs, the seruicer must nrake sure the assignrrent from MERS to not the seruicer or Fannie Mae is recorded.
Fannie Mae will not reimburse the seruicer for any expense incurred in preparing or recording an assignnent of the nrortgage loan from MERS to the seruicer or to Fanne Mae.

The seruicer must consult its foreclosure attorney to determine if any other legal requirenents apply when conducting foreclosures of moftgage loans in which MERS is the prior moftgagee of record. Fannie Mae will not reimburse the serv'rce r for any expense incurred in preparin-g r recording an assignrnent of the nrrcrtgage loan from MERS to the seruicer or to Fannie Mae,
