This document is Defendant Title Company's memorandum in support of its motion to dismiss Count I of Plaintiff's complaint against it. Title Company argues that the Protection of Homeowners in Foreclosure Act (PIFA) does not apply to title companies when conducting settlement services or issuing title insurance. As a title company, PIFA expressly excludes Title Company from liability under the Act. Therefore, Count I of the complaint against Title Company must be dismissed for failure to state a claim, as Title Company's role was that of a title company to which PIFA does not apply.
