Bill Elfo - Civil Service Deposition - 11-9-12
The operative principle here was a quick in and out so that Elfo wouldn't have opportunity to bloviate about nonsense, or attempt to link everything to some of his equally nonsensical claims of 'political correctness.'
I was sitting there for the whole thing and I'd have to say that Butler was masterful in getting in quick, getting the red meat on the record and getting back out.
To watch this deposition was very interesting. I remain of the opinion that Elfo simply didn't realize what had just hit him. He literally walked right into it and was completely oblivious to the fact that he'd just trapped himself in the very things he'd set-up to manufacture a trumped up 'just cause' in my case.
He didn't seem to figure out that he'd just admitted to #1: Monitoring me, my postings and ordering my public postings to be monitored ahead of the last internal in connection with the election (the pre-text), #2: That he'd been coordinating (AKA: conspiring) with other elected officials and county attorneys (pre-text), #3: That he had spoken to the county hired whistleblower investigator, Janice Corbin and that she did take written notes.
(Those notes have still not been produced and Ms. Corbin has still not testified at any deposition in connection with this case that I'm aware of. A fact that remains troubling to me in light of the county's complete disregard to what I had reported and what has now been proven as far as the whistleblower aspect goes.)
Perhaps most interesting, aside from the clear admissions in this short, very quick in and out deposition, is what happened AFTER the deposition had been concluded and the transcriptionist had just gone off the record.
Right after the deposition was finished, Elfo seemed to have an inkling that he'd just been had and started getting a little jumpy. He nervously asks Butler if they can go back on the record to 'clarify' a few of his answers, meaning he wanted to change his responses after he'd already given them.
Now I wouldn't have a problem with that, but I can also see why Butler didn't accommodate Elfo on that request. After all, I was sitting in a civil service deposition contesting a termination that Elfo had caused for essentially the same reason, that I added information to clarify my responses after being sideswiped in an interview by Cooley and Rossmiller.
Turnabout is fair play, no?
Anyway, it was humorous to watch Elfo fidget, squirm and speak nervously when the reality started sinking in that he'd just handed me my case. Too bad we didn't go back on the record. At least it would have been on record.
