ABILLPRESENTEDBYFREEALABAMAMOVEMENTTITLED,ALABAMA'SEDUCATION,REHABILITATION,

ANDREENTRYPREPAREDNESSBILL.

BeitENACTEDALAWthatbyJanuary1,2018,Alabama'sDepartmentofCorrectionswillreduceits
prisonpopulationdowntoitsdesignedcapacityofapp.13,500;Alabama'sDepartmentofCorrections
currentlyhasover29,000peopleincarceratedinasystemdesignedtoholdlessthanthe14,000,making
thisState'sprisonpopulationoccupancyrateofapprox.200%theHighestintheNation.ASrecentas
2012California'sprisonsweredeclaredunconstitutionalbyU.S.federalcourtforexceeding160%ofits
occupancyrate.

Thisovercrowding,coupledwithunderfundingandunderstaffinghashaddisastrousconsequenceson
theprisonpopulation,includingwidespreaddiseases,excessiveviolenceandalackofopportunitiesfor
educationandrehabilitation,whichhasledtorecidivismratesashighas80%forsomegroupsof
offenders,andvariousothercivilandhumanrightsabuses.

Fortheseobviousreasons,theCommissionerofADOCisorderedbythislawtoreleasenolessthan400
personspermonth(4800)peryear,beginningJanuary31,2015,untiltheprisonpopulationisreduced
toitscurrentdesigncapacity.

BeitalsoEnactedthattheCommissioneroftheAlabamaDepartmentofCorrectionsshallnotallowthe
prisonpopulationoftheADOCtoexceed105%ofthedesigncapacity,andthatiftheCommissioner
shallviolatethisdecree,anyoneincarceratedinADOCsubjecttosuchovercrowdingshallhavetoright
tosuetheCommissionerinanyStatecourtandreceiveascompensation$1,000fromtheADOCbudget
foreachdaythatthislawisviolated:

BeitalsoenactedthatamoratoriumshallissueuponthepassageofthisBillstatingthatnoperson
convictedofacrimeinthestateofAlabamashallbetransferredtoanyoutofstatefacility.Noother
publicorprivateprisonseitherwithinorwithoutoftheStateofAlabamashallbebuilttohouseany
personconvictedofanycrimewithintheStateofAlabama.However,ifanoldprisoncurrentlyexisting
withintheStateofAlabamaisclosed,condemnedorshutdown,anewprisonmaybebuiltbutshallnot
exceed110%oftheoriginaldesigncapacityoftheprisonthatsuchnewprisonshallreplace;

BeitalsoENACTEDthatuponthepassageofthisBill,theCommissioneroftheADOCshallimplementa
programwithintheADOCtitledtheEducation,Rehabilitation,andReEntryPreparednessprogram,and
theCommissionershalldesignateatleast100%ofallbedspacewiththeADOCforthisprogram.Such
programshallbemadeavailabletoallprisonerswithintheADOC,irrespectiveofsentence,including
sentencesofLifeWithoutParoleandDeath,whichsentenceshallbeabolishedinthestateofAlabama.

OnceenrolledintotheE.R.ReE.P.program,anewsocial/psychologicalevaluationwillbeperformed,
alongwithcasereviewoftheperson'sconvictedoffense.Thereafter,anEducation/Rehabilitation
curriculumwillbemadebasedontheindividualneedsofthepersonbeingevaluated,andabaseparole
datewillbesetwithin30days.

CAPITALMURDERCASES:

CapitalMurdercaseswillbeclassifiedintotwo(2)Levels:

Level1:Levelonecapitalmurdercaseswillconsistofthosepeoplecurrentlyconvictedofacapital
offenseandsentencedtoDeathorLWOPwithtwoormorevictims,murderofapoliceofficer,orachild.
Thesepeople,thougheligibleforparole,willrequireSpecialReviewbeforeparoleisgranted.Review
willbebytheGovernor,aclassificationspecialistandpsychologistwithintheADOC,andmembersofa
CitizensCommitteeselectedbyFreeAlabamaMovementExecutiveCommittee.

Thisperson,afteraminimumof25yearsserved,anduponcompletionoftheEducation/Rehabilitation
program,willthenbeeligibleforreviewtobeplacedintheReEntryPreparednessphaseofthe
program.UponsuccessfulcompletionoftheReEntrypreparednessphase,thispersonwouldthenbe
eligibleforparoleuponSpecialReview.

LEVEL2CAPITALMURDERCASES

Level2offendersconsistofthosepeopleconvictedofacapitaloffensewithonevictimandwhoare
currentlysentencedtoLWOP.Thesepeoplewillnotrequirespecialreviewandwillbecomeparole
eligibleuponsuccessfulcompletionofthecurriculumandafterservingthefullbaseminimum.

ThisLevel2offender,ifconvictedundersections13A540(16,17,18),Code1975,afterserving20
years,andalltheotherLevel2CapitalMurderoffendersafterserving25years,anduponcompletionof
theEDUCATION/REHABILITATION/REENTRYCurriculum,shallthenbeparoledbacktosociety.

*AnyjuryfindingoffuturedangerousnessautomaticallyrequirestheoffendertoseekSPECIALREVIEW
PAROLE.

MURDERCONVICTIONS

Allotherpersonsconvictedofmurderunder13A62andsentencedto15to99tolife,willreceiveda
baseparolerangeof15to20yearsuponcompletionoftheirinitialreview,andwillbeparoledupon
completionoftheEDUCATION/REHABILITATION/REENTRYPREPAREDNESSProgram.

AnypersonconvictedformurderandsentencedtoLWOPpursuanttotheHabitualFelonyOffenderAct,
willstartwithabaseminimumof15to20years,withenhancementsavailableforeachvalidprior
felonyconviction.(Apriorfelonyusedtoenhancebutlaterruledinvalidwillberetroactivelydeducted
fromtheparoledate).

PRIORFELONYCONVICTIONS:

CAPITALOFFENSESANDMURDER:

Anynonviolentfelonyconviction(nonviolentbeingdefinedasnoseriousphysicalinjurysufferedby
thevictim),canincreaseaparolebaseby1yearperpriorconviction,withamaximumof5years.

Anyviolentpriorfelonyconviction(wherethevictimsufferedseriousphysicalinjury)canincreasea
parolebasebytwoyearseach,withamaximumincreaseof10years.ButinnoeventmayaLevel2
offenderberequiredtoservemorethan35yearsuponsuccessfulcompletionoftheprogram,andinno
eventmayanoncapitalnonhabitualoffendermurderdefendantservemorethan25yearsbefore
parole,andnomorethan30forapersonconvictedasahabitualoffenderuponsuccessfulcompletion
ofthecurriculum.

Note*Anyoneormorepriorviolentfelonyoffensefoundbyajurytocontainspecialcircumstances(for
example,shootingavictim3ormoretimes,sexoffenseorcrimechildsexabuse),canincreaseaparole
basebyamaximumof5yearstotal.ButinnoeventmayaLevel2offenderberequiredtoservemore
than35yearsuponsuccessfulcompletionoftheprogram,andinnoeventmayanoncapital,non
habitualoffender,murderdefendantservemorethan25yearsbeforeparole,andnomorethan30fora
personconvictedasahabitualoffenderuponsuccessfulcompletionofthecurriculum.

LEVEL6PRISONS:

OPTOUTCAMP.AnypersondesiringtooptoutoftheE.R.&ReE.P.willbeassignedtoanoptout
facilityandbeprocessedpursuanttocurrentADOCregulations,s.o.p.andrules.

LEVEL5PRISONS:

STUDENTORIENTATION:

Level5institutionswillserveas90dayto180dayorientationfacilities,andwillbewhereinitial
social/psychologyevaluationswillbeconductedandwhereparolebaseswillbeset.Thesefacilitieswill
alsohouseCapitalandDeathsentenceprisonersfor180daysto1year,respectively,forevaluation.
Programreadjustment,programfailures,andGEDprepclasseswillbeheldattheseinstitutions.

LEVEL4PRISONS:

ThesefacilitieswillhousestudentsparticipatinginGED,SKILLANDTRADEDEVELOPMENT,ANDSOCIAL
PSYCHOLOGICALNEEDS(suchasAngerManagementforviolentoffenders,AANAtreatmentforaddicts,
etc.)

LEVEL3FACILITIES:

ThesefacilitieswillofferINTRODUCTIONTOLIFESKILLS,PEERLEADERSHIPDEVELOPMENT,MENTORING
ANDCOMMUNITYDEVELOPMENTSKILLS.Also,thesefacilitieswillemphasizecommunityvolunteer
programsandhaveanemphasisonfreeworldvolunteers,religiousandsecularprisonministries,and
corecurriculumanddistancelearningcourses(thelattermaybeusedtoqualifyforpointdeductions
frombaseparolesetups).

LEVEL2FACILITIES:

ResidentsassignedtothesefacilitieswillbeginReEntryPreparednesslearning,includingreceiving
practicalcomputerskills,learningthejobmarketfortheirskillortrade,HomeandParolePlan
development,andcontinuedlearningandaftercaretherapies.

LEVEL1FACILITIES:

ResidentsatthesefacilitieswillreceivepracticallearninginLifeSkills,includingfindingajob,creatinga
budget/savingsplan,openingabank/checking/savingsaccount,findingasapartment,roommate,etc.
forthosewithoutfamilyassistance,andthenReEntersociety.

PART2SECTION3

EXEMPTPERSONS:

Exemptions

Anypersonwhohasalreadyserved25Yearsormore,andwhowouldnotbeclassifiedinLEVEL1status
orneedSpecialReviewParole,shallbeeligibleforimmediateplacementinLEVEL3status.

Anypersonage62orabove,whohasalreadyserved25yearsormoreandwhowouldnotbeclassified
asLEVEL1statusorneedSpecialReviewParole,shallbeeligibleforimmediateplacementinLEVEL2
status.

AnypersoninLEVEL1statusorwhorequireSpecialReviewParoleshallbeeligibleforSpecialReview
Parolewithone(1)yearofpassageofthisBillintolaw.

PART2SECTION4

DISQUALIFIEDPERSONS:

Nopersonhavingcommittedandbeenconvictedoftwoormoresexoffensesarisingoutofseparate
incidents,twoormoresexoffensevictims,orforcommittingasexoffenseagainstachildunder14,an
elderlyordisabledpersonshallbeeligibletoadvancebeyondLEVEL3STATUS,andmustseekSpecial
ReviewParole.

PART2SECTION5

SPECIALREVIEWPAROLE:

AnypersonrequiredtoseekSPECIALREVIEWPAROLEwillbeaffordedanopportunitytoattendsuch
hearinginperson,orbyaudiovideomeans,attheirdiscretion.Inpersonreviewsshallbeconducted
semiannually,andaudiovideohearingswillbeheldquarterly.Nopersonshallreceivemorethanone
reviewperyear,anduponcompletionoftheprogramcurriculumandremainingingoodstanding,shall
notbedeniedreviewformorethan3years.

TheprovisionsofthisBillcreateasubstantivedueprocessrightpursuanttotheAlabamaConstitution,
andanypersonsubjecttoremoval,reclass,orotherdisciplinaryactionshallenjoytherighttochallenge
suchdecisionbyHabeasCorpusintheproperjurisdictionasestablishedbyTitle15,CodeofAlabama
1975,andallprovisionsoftheAlabamaAdministrativeProcedureActappliestotheADOCinitsentirety,
Section41223(9)g.1),tothecontraryisherebyamended.Allproceedingsofadisciplinarynature
mustberecordedbyaudio/videomeans.

PART3SECTION1

BeitENACTEDthatanypersonsentencedpursuanttotheHabitualFelonyOffenderLawsofthisState,
saidapplicablelawmustbechargedintheIndictmentandproveninabifurcatedtrialbeforethe
convictingjury,(seeU.S.SUPREMECOURTdecisionsAlleynev.UnitedStates,570U.S.(June17,2013)
Apprendiv.NewJersey,536U.S.545(2002);RangelReyesv.UnitedStates,547U.S.1200SlipOpinion
(2006);and;13A510.1(b),CodeofAlabama1975),withsaidrequirementsbeingretroactivetothe
passageofthislawtoanypersonsentencedasahabitualoffender.Also,habitualoffendershallbe
definedasapersonwhocommitstwoormoreviolentoffenseswherethevictimwasinjured,orwhere
theoffendercommitsthesameoffensetwoormoretimes(editthis):

BeitalsoENACTEDthatanypersonwhocommitsanycrimebeforethere22birthdayshallbe
prosecutedasaYouthfulOffender,andasaYouthfulOffender,suchindividualshallbeineligibletobe
charged,triedorconvictedasanadult,andsuchoffendershallremainineligibleofbeingchargedwitha
capitaloffenseorsentencedtolifewithoutparoleordeath.Withtherecentdecisionsissuedbythe
UnitedStatesSupremeCourt,includingitsdecisioninMillerv.Alabama,concerningjuvenile
prosecutionsforcrimecommittedwhentheywereasyoungas14,itSHOULDnowbeobvioustothe
criminaljusticesystemthatmodernsciencedebunksalltheoriesthatthesechildrencanbeeffectively
prosecutedasadults.

Modernscienceshowsthatthesechildrensimplylackmentaldevelopmenttosufficientlyappreciate
themagnitudeoftheirconduct,andthattheyaresimplytooyoungtomakesuchdecisionswithout
takingintoaccountexternalinfluences.

Therefore,uponpassageofthislaw,nochildundertheageof18maybeprosecutedasanadultinthe
StateofAlabamaforviolationofanylawofthisStatewheretheywouldbesentencedtoaprison
designedtohouseadults.

Childrenundertheageof18shallbeprosecutedunderthelawsdesignatedforjuvenilesandmaybe
heldinajuvenilefacilityuntiltheir22birthday,atwhichtimetheywillbereleased.Childrenage18and
abovemaybeprosecutedasanadult,butonlyunderthelawsdesignatedforYouthfulOffenders.This
lawwillbecomeretroactiveuponpassageofthisBill.Suchlawshallberetroactiveuponpassageofthis
Bill:

prison,composedofmenandwomenincarceratedelectedbythemenandwomenincarcerated,and
thatsuchCommitteeshallhaveauthorityandownershipoverallprisonstores,canteens,andincentive
packageprograms,withtheabilitytonegotiatewiththeirownsuppliers,andtheWelfareCommittee
shallbepermittedtousetheprofitsfromthesebusinessesthatmenandwomenincarceratedandtheir
familiesaretheexclusivecustomersofforEducation,RehabilitationandReEntryPreparedness
Programs,recreationalsupplies,andinfrastructureneedslikeirons,icecoolers,coffeepots,televisions,

BeitalsoEnactedthatuponthepassageofthisBill,thereshallbeallowedwithintheDepartmentof
Correctionsconjugalvisits,whichshallbeallowednolessthanevery30daysforanymanorwoman
incarceratedwhohasserved2ormoreconsecutiveyearswiththeADOC,andthateveryperson,upon
marriage,shallbeabletoconsummatesuchMarriagewithaconjugalvisit:

BeitENACTEDINTOLAWthattherighttovoteintheStateofAlabamashallnotbepermanentlydenied
toanypersononaccountofafelonyconviction.

Thislawwillbecomeretroactiveuponitspassage,andanypersonwhohasalreadybeen
disenfranchisedforover2yearsshallnothavetotakeavotingclassbeforebeingpardonedandhaving
theirvotingrightsrestoredbytheAlabamaBoardofPardonsandParole,andshallbeaffordeda
Provisionalballotforanyelectionuponapplyingforapardonwhilewaitingforthepardonapplicationto
begranted.

AnypersonhavingbeenconvictedofafelonyandsentencedtoatermofimprisonmentintheStateof
Alabamashall,uponcompletionofavotingrightsclassofferedbyADOC,beentitledtoapplyfor
restorationoftheirvotingrights1yearfromthedateoftheirconviction,regardlessoftheirrelease
date.Ifthepersonisreleasedonparole,probationoranyotherreleaseprogramandthenviolates
paroleorisreturnedtoprisontheyshallthenberequiredtorestartthe1yearperiodbeforeapplying
forreinstatementoftheirvotingrights.

Anypersonwhoissentencedtoatermofprobationshall,uponthepassageof180daysorcompletion
ofprobation,whicheveroccursfirst,petitiontheAlabamaBoardofPardonandParoleforrestorationof
votingrights,anduponpetitionandproofofcompletionofaclassonvotingrights,shallreceivea
pardonandhavetheirvotingrightsrestored.

Anypersonwho,havingviolatedtheirprobationbeforetheelapseof180dayperiodandwhois
thereafterresentencedtojailorprison,shallthenberequiredtorestartthe180dayperiodbefore
beingabletoapplyforreinstatementoftheirvotingrights.

PART7OPENMEDIAACCESSTOALABAMADEPARTMENTOFCORRECTIONS

SECTION1

ItshallbetheLawofthisStateandthepolicyoftheAlabamaDepartmentofCorrectionstoallow
unlimitedaccessofthenewsmediaintoanyandallStateprisonsatleast3timespermonthupona
regularlypostedschedule,whichshallbepostedineachinstitutionandmadeavailabletothemedia.
Suchaccessshallbepermittedforatleast4hoursonthedesignatedmediadayatanyprisonwhere
permissionfromamemberofthemediaisrequested.Whenmediaisonsitenorestrictionsaretobe
placedonareaswheretheymaygo.

AnymediarequesttointerviewanypersonofinteresttothemediawhoisincarceratedinanAlabama
prisonshallbeconductedonthisdesignatedmediadayalso.Suchinterviewrequestshallbemadeat
leastoneweekinadvanceandshalltakeplaceonthevisitationyard.

NopersonincarceratedinADOCshallbedeniedaccesstothemedia,andthenormalrulesofvisitation
shallapply,exceptthatthemediashallnotberequiredtobeonanincarceratedperson'svisitationlist.
Themediashallnotberestrictedinanywayfromusingaudio,videoorotherrecordingequipmenton
mediaday.

Incasesofemergency,suchasdeath,quarantineduetooutbreakofdisease,orothermatterof
importancetothepublic,themediashallbeallowedaccesswithin48hoursofthedeclaredemergency
situation.Lockdowns,assaultbyofficersandotherissuesshallnotbegroundstodenyemergencyor
generalmediaaccess.

PART8SECTION1

ThisBILLisexemptfromArticleIV,45oftheConstitutionofAlabama1901,whichrequiresthatall
Billsmustcontainonlyonesubjectmatter.
