Subject: Notice under section 55 of the Wildlife Protection Act, 1972 regarding.
Sir,
It has been confirmed that Sunder baby elephant is being badly abused since last many years, PETA India have sufficient evidences to prove Sunder is being abused by their custodians, where as Bombay High Court along with many senior officers admitted abuse of Sunder.
The United Nation affiliated OIPA www.oipa.org chapter in India placed this notice upon you, for immediate strict legal action against all offender custodians of Sunder:
1. Elephant is a National heritage animal of India and no one can neither donate nor trade, where as sunder was donated violating the laws of the land.
2. No one can abuse animals, where as sunder is being badly abused by his custodians, violating section 3 and 11 of the Prevention of Cruelty to Animals Act, 1960 read with the section 39 of the Wildlife Protection Act, 1972 and IPC 428-120-B.
3. As per section 39 of Wildlife Protection act, 1972, state Government is the owner of sunder and being guardian, you can’t allow cruelty towards sunder, you are also violated section 3 of the PCA Act, 1960.
4. You are failed to perform your official and constitutional duties and responsibilities, as defined under article 51 A (g) of Indian constitution.
5. You are also responsible for criminal conspiracy with sunder elephant, violator of the Bombay High Court orders because private ownership of sunder not yet been cancelled or failed to take his custody from his abuser custodians, waiting death of this helpless wild animals, due to regular cruelty or any health report of sunder, claimed to unfit him to further travel.
6. Maharashtra State Government doesn’t have any rescue center for their wild animal properties, like elephant.
Hence you are requested to please apply your mind and Authority vested in the Chief Wildlife Warden of Maharashtra, for the welfare and protection of wild animals. You are further requested to please take immediate custody of sunder and book all abuser custodians including Vinay Kore, MLA and we are moving further complaint against you with the Department of Personnel and Training (Govt. of India) for not properly performing your official duties and responsibilities.
