I was born in the Netherlands and didnt have any formal education in
the English language and neither was it my native language. Yet, as a self -educated
CONSTITUTIONALIST and (now retired) Professional advocate even representing lawyers, I 15
achieved success despite of my self-professed crummy English. What I proved is that when
you have the right attitude then you can succeed often far better than those who might be deemed
to be more educated. Law degrees do not give a person intelligence, it merely creates a certain
status but as many opponent lawyers discovered I comprehensively defeated them time and time
again when representing a party. 20

As a 14 year old I ventured out on my own and this because I longed to study but circumstances
were such that I had to go to work. So, leaving home I then did my apprenticeship, while also
studying at night. While this was in the metal trade, nevertheless if founded the basis of my later
life. In Australia I worked myself up from the ground to be in management. Actually, my wife 25
has a university degree and her late husband was a civil engineer, architect, etc, and it took some
years before my wife realised that not having a degree doesnt make a person of any lesser value.
In fact my wife now realised that not only did I understand and comprehend her late husbands
work, but she admits that actually I can do a lot more than her late husband could, because while
he had the knowledge I have also the ability to create what I design. Yet, I very much have the 30
view that education and being able to advance in studies is important to people.
As the Framers of the Constitution stated:

What I promote is a free university education to all Australians, provided they make the bench
mark requirements and in return they will upon graduation serve at least 10 years in their chosen
profession within the Commonwealth of Australia. As such Australians in general will benefit
from the free education they provided to the graduates.
While it is argued that people should pay for their education, reality is that if for example a 45
doctor has to repay a HECS/HELP charge then he needs to get this from his patients. So, the
patients are the once in the end paying for it. Really a very silly way to get them to pay. In my

view to provide free education will mean charged by doctors and other professions can be kept
low because they will not have any need to recoup the monies from clients/patients.
But those who create the budget deficit disaster often are the once who themselves had FREE 50
UNIVERSITY EDUCATION and now deny the same to others, while claiming to fix the budget.
I will not go in all kinds of details safe to state that as Author in numerous books in the
INSPECTOR-RIKATI series on certain constitutional and other legal issues I canvasses
numerous constitutional issues. And on 19 July 2006 comprehensively defeated the
Commonwealth in the county court of Victoria as to compulsory voting. (See my blog at 55

Two of my daughters have university degrees, one in law and another is psychology, but
nevertheless they respect my input in matters.
Having set out the above I now turn to your student Tallulah who I understand participated in a
protest in Melbourne, regarding the changes to university charges. 60
While I am a grandfather of more than a dozen grandchildren I can assure you that I was
pleasantly surprised by Tallulah conduct and would like to see this kind of determination and
foresight in my own grandchildren.
It is wrong to hold that because she is not an adult that somehow then she has to be silenced or
prevented from speaking out about issues that will likely affect her if she desires to engage in 65
university studies. Waiting to protest until she was to attend to university would be rather late.
The time is now and she proved to be formidable in her quest to show she disapproved of the
changes that likely would also affect her future ability to study and the financial burden
associated with this.
I am not a person who goes to protest meetings/marches because I rather (despite my self- 70
professed crummy English) prefer to put in writing my distain/disapproval about certain matters)
however acknowledge that others may and indeed may need to make a physical demonstration to
show they mean business.

The following will also make clear that the Framers of the Constitution intended to have CIVIL 75
RIGHTS and LIBERTIES principles embedded in the Constitution;

liberty is enshrined in this Constitution, which is also a charter of peace-of peace, order, and good
government for the whole of the peoples whom it will embrace and unite. 100

Therefore let not kid ourselves as to Tallulahs conduct. She exercised her right of political
liberty and the fact she achieved headlines underlines how powerful her involvement was.

As I understand it Camberwell High School the Framers of the Constitution didnt restrict
political and religious liberty to only adults of a certain age or to any particular gender. Indeed, 115
much of the debates to create the constitution was about women who like Tallulah conduct had
at the time persuaded the South Australian colony to grand voting rights to women, and this
resulted to s41 of the federal constitution to ensure that any person (including women) who had
been granted franchise (colonial/state voting rights) automatically then had a right to vote in the
Commonwealth of Australia. In my view Tallulah conduct showed the spirit of the women who 120
promoted at the time of federation womens rights.
I for one can only compliment Tallulah conduct for doing so.
To me her age is irrelevant, as she is not limited by the constitution to exercise views about what
was clearly also a political matter also. And, I view, it would be contrary to her civil and political
rights if she was caused to suffer any form of punishment merely for doing what the Framers of 125
the Constitution held so critical in a democracy and that was to exercise once political rights.
It obviously, considering the number of people protesting, the time and place Tallulah conduct
chose for a protest to eventuate. She merely spontaneously appeared to participate where she
held it was going to affect her own future ability to study. Hence her absenteeism from her
school hardly can be an issue as it was again not her choice that the demonstration was held at 130
that day at that time.
In my view it must be4 considered part of her education to show initiative and ability to
participate in a demonstration and doing so as a peaceful sit in. By this she showed a
considerable maturity often missing from many adult demonstrators who are using violence, etc.

What academic environment exist I ask when a student shows the kind of spirit the women had
to achieve voting rights for women and then is as I understand it being punished for being absent 140
from classes. We live in a society where people at times do act in a manner that we need to look
upon the circumstances that exist.
For example if say Tallulah had say smashed the window of someones house and by this was
absent from school also would you than scream blue murder, that she was a disgrace to the
school, etc, or would you not first inquire in what the circumstances were and it might be then 145
that you may discover that Tallulah having been walking along the street noticed smoke coming

from a house and then smashed a window to assist the rescue of the occupants. Instead of being a
deviant she would rather be a hero.
Likewise, it is essential that Tallulah conduct to participate in the demonstration, albeit in a
peaceful manner, must be respected as having been an exercise of her constitutional rights. To 150
silence her and/or to deny her that right in my view would stifle the rights of students, and
undermine precisely what Camberwell High School purports to be about.

How on earth can you claim Our students need to be prepared for 21st century life and its challenges. when 185
Tallulah precisely doing so is to be punished for no other reason but to be absent from school?
For sure, I wouldnt support students willy nilly to be absent from school whenever they feel like
it but clearly in regard of Tallulah absenteeism can be taken she was representing all students
who desire a future education as university, etc.

A 16 year old young man in the 1970s attended to my office, making known he had been
rejected by the companys personal manager for a job, but nevertheless asked me if he could
have a job. I asked him what he had done before and he explained he had been sheepherding in
New Zealand. I made clear that as the factory was full of machinery he would need to pass a test
and if he did so he would have a job. He accepted. I asked him to show me 1 inch on a ruler and 195
he pointed out where it was. I then made known he had passed the test and everything else he
would learn on the job. Within 2 months I had senior management agreeing that he would be
paid full adult wages as I had explained he deserved it. This 16 year old had taken to the
machinery like a duck to water and was even better than those who had been machine setters for
26 years with the company. 200
Never under estimate the intelligence and ability of a person me\rely because of age.
If we had more of Tallulahs then we may not be in the financial mess that the Commonwealth
of Australia is in because all those politicians who created the mess are nevertheless funding all
their own perks from Consolidated revenue Funds and will continue to do so as if there is no
tomorrow and if more people showed the backbone (before this disaster eventuated) that I view 205
Tallulah did, then we may have never ended up in this financial mess.
In m y view her absenteeism was justified in the circumstances and the school should not be
narrow minded or be seen to be narrow minded as to inflict as punishment upon Tallulah for
having been absent without leave from the school. Do remember with a strong focus on personalised
learning and individual growth isnt always going to fit within specific rules of the school and in those 210
circumstances I view it is about the intelligence and intellect of the school staff, such as the
principle to show understanding, etc, and also understand and comprehend that if students
become dissolutioned about the ability to progress to university then they might also abandon the
continuation of their High School studies. Therefore Tallulah conduct may in fact end up having
amore of a benefit to the school than it may so far realize. 215

DISCLAIMER: Other than the news report I never had any knowledge about the existence of
Tallulah and as such no bias exist by me to write this correspondence. I state this just in case any
claim were to be made that somehow I was bias. I just like to see the youth of today to show
more backbone than adults so far appear to have, and as long as it is in a peaceful manner we can 220
only applaud them for it. Our youth of today is Australians future!
