CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:



This AGREEMENT made and executed this __ day of,________ 2013, in Pasig City,
Philippines by and between:
JOCELYN R. RETA , of legal age with postal address at # ______________,
Pinagbuhatan, Pasig City referred to as the LESSOR
And
____________________________ of legal age and with postal address at Nagpayong,
Pinagbuhatan, Pasig City, herein after referred to as the LESSEE

WITNESSETH THAT
WHEREAS for and in consideration of the rental and mutual covenants hereinafter
specified, the LESSOR hereby lease unto the LESSEE the room, situated at
__________________Nagpayong, Pinagbuhatan, Pasig City.
WHEREAS, the LESSEE is willing to lease the above-mentioned property under the
terms and conditions specified herein to which the LESSOR has agreed,
NOW THEREFORE, for and in consideration of the foregoing premises and of the
mutual covenants and stipulations herein contained, the LESSOR AND LESSEE have mutually
agreed:
LEASE PERIOD: The term of these lease shall be for a period of One (1) year/s
commencing on January 17, 2013 and ending on January 17, 2014. One (1) month before the
expiration of contract of lease the LESSEE should notify the LESSOR in writing of her/his
intention to renew the contract and if the LESSOR is agreeable a new contract shall be
executed subject to the new terms and conditions to be agreed upon by the parties.
RENTALS; The monthly rental shall be Four Thousand pesos ( P4,000.00 )pesos
Philippine Currency. Upon signing of this contract of lease, the LESSEE shall pay the LESSOR
Two months advance rental and month deposit payable every 17
th
day of each every month.
SECURITY DEPOSIT:
The LESSEE shall likewise pay representing Two (2) month/s rental
deposit the cover outstanding utility bills and/ or damages to property, excluding natural wear
and tear after the termination of contract. Should there be any balance left from such deposit,
after deducting the expenses aforementioned , it shall not be refunded or the LESSEE should
consume the remaining at least 30 days from the termination of contract.
Further, the SECURITY DEPOSIT CANNOT BE APPLIED TO THE MONTHLY RENTAL
PAYMENT;
. Should there be any violation on the following terms and conditions of the said
contract of lease, the full amount of the security deposit shall be forfeited.
UTILITIES: All expenses for water and electricity shall be for the account of
LESSEE, AND THE LESSEE undertakes to pay for such expenses in a timely manner.
THE LESSEE shall use the premises for LAWFUL PURPOSES ONLY;
REPAIRS. The LESSEE has thoroughly inspected the leased premises to be
leased and he is satisfied with its condition and finds the premises acceptable and suitable for
the purpose for which it is being leased; Expenses for the repairs of the original structure of the
premises for both labor and materials shall be shouldered by the lessee.
The LESSEE before commencing to such must first submit/inform the plans thereof to
the LESSOR for its approval, otherwise, the LESSEE will be held liable for damages;
IMPROVEMENTS: Upon the termination of the contract, any
alteration/improvements, approved/allowed by the LESSOR, made or introduced by the LESSEE
in the leased premises shall automatically to ensue the benefit of the LESSOR without any
obligation whatsoever to the LESSEE;
OTHER CONDITIONS: LESSEE further covenants with LESSOR:
To answer for all the acts and omission of any family member, servants and
guests and all other persons allowed access by LESSEE into the premises;
Not to store or bring into the leased premises any obnoxious substances or
flammable material that might constitute fire hazard;
THIRD PARTY LIABILITY: For so long as this lease contract is in effect and/or
the LESSEE is occupying the premises, the LESSOR shall not answer for any damages, liability
and responsibility arising from:
Fire
The consequence of the use or misuse of the leased PREMISES by the LESSEE,
his agents, employees, domestic helps, guests and sub-lessees;
Fortuitous Events or Acts of god; and
Events similar to the above mentioned;
WAIVER OF CIVIL AND CRIMINAL LIABILITIES: Should part or portion of the
entire building leased by the LESSEE collapse and as a consequence, the LESSEE and his/her
immediate members of the family, visitors, guests, sustain/suffer injuries, damages, or loss of life,
the LESSORS is exempted from civil or criminal liabilities, henceforth, the LESSEE thereby
dismiss/discharge or release the LESSOR from any kind of claim that may arise in the future.
ABANDONMENT OF LEASED PREMISES: In case the leased premises shall be
abandoned/vacated without notice and before the expiration of this lease, the Lessor shall
have the right to enter the same, by any means, without any liability whatsoever. Further, the
LESSOR, shall have the right to forfeit the advance payment, security deposit, and guaranty
deposit, while holding the LESSEE liable for any deficiency and all rental due for the term of
the lease;
