Effective: 1.CONTRACT PERIOD The contract is valid for the period of one year and is effective from / /2005 to / /2006. If the Employee does not 'ant to 'or( overtime) the Employer shall not force the Employee to do so. 2% If the Employee does not 'ant to 'or( overtime) the Employer shall not force the Employee to do so. 3hen the Employee and the Employer reach a m#t#al agreement abo#t 'or(ing overtime) and the Employee does so) the Employer m#st pay the Employee for 'or(ing overtime) according to 2rticle 6 4la#se 5. 5% The Employee shall be paid 'ith the mentioned salary in this contract even if the Employee 'or(s less than &20 ho#rs per month d#e to lac( of classes. 6% The Employee m#st attend staff meetings and 'or(shops) 'hich are not held d#ring 'or(ing ho#rs ho'ever this 'ill not be considered as 'or(ing overtime. 5% 4lasses and teaching 'ill be sched#led in accordance 'ith the needs of the Employee. 4. EMPLOYEES DUTIES &% The Employee shall observe the Employer+s 'or( system and reg#lations concerning administration of foreign e1perts and shall accept the Employer+s arrangement) direction) s#pervision and eval#ation in regard to his/her 'or( 'itho#t the Employer+s consent. 2% The Employee m#st to try to act 'ith dignity as an English teacher. The Employee m#st act in this manner d#ring the 'hole time that the Employee 'or(s for the Employer. The Employee shall comply 'ith the la's) reg#lations and r#les of "ep#blic of $orea and shall not be involved in any illegal activities that might damage their visa stat#s and the rep#tation of the Employer. 5% The Employee m#st observe her/his class sched#les. -#rthermore) the Employee shall attend an orientation) training program) and staff meetings and prepare for their classes as re7#ired. 6% The Employee shall #se only teaching materials provided by or recommended by the Employer. The #se of s#pplementary materials is enco#raged) b#t only after the Employer gives prior approval. The Employee shall s#bmit the ne1t month+s teaching plan at the end of every month. 5% The Employee can be re7#ired to intervie' ne' st#dents and eval#ate their placement level. 6% The Employee shall not reveal any information regarding her/his class to any other person or to other instit#tes. 8% In the event that a disp#te arises) both parties shall try to resolve it amicably 'ith #nderstanding of different c#lt#res and c#stoms. 5. EMPLOYERS DUTIES &% The Employer shall provide the Employee 'ith f#ll s#pport. The Employer shall respect the Employee9s dignity and try to (eep their relationship harmonio#s 'ith the Employee. 2% The Employer shall pay the salary) as stated in this contract) and in case the Employee re7#ests teaching materials) the Employer shall s#pport these 'ith #tmost efforts. 5% The Employer ac(no'ledges the differences of c#lt#res and c#stoms bet'een the t'o parties. The Employer shall help the Employee to settle into their ne' residential and 'or(ing s#rro#ndings. If the Employee has any tro#ble s#ch as sic(ness and/or accident) the Employer is responsible for assisting the Employee. 6% The Employer shall not infringe on the Employee9s privacy. In case the Employee brings disgrace on the Employer) the Employer shall have the right to as( the Employee to correct the sit#ation. 5% In the event that a disp#te arises) both parties shall try their best to resolve it. 6. HOUSING &% The Employee 'ill be provided 'ith a non/shared st#dio room apartment that is f#rnished 'ith basic appliances and be located 'ithin a 'al(ing distance from the instit#te. 2% The follo'ing f#rnishings are provided: bed and sheets) 'ardrobe) table) chair) T?) ?4" (if cable net'or( is not connected%) refrigerator) la#ndry machine) basic coo(ing facilities and basic cleaning tools. 5% ,onthly #tilities for electricity) 'ater) gas) oil and Internet are the Employee9s responsibility. -#rthermore) all the e1penses regarding his/her meals are also the Employee+s responsibility. 6% The Employee shall be responsible for the maintenance of the apartment) f#rnit#re and e7#ipment. 2ny damage is the Employee+s responsibility. AIR FAIRE &% The Employer has to pay the Employee the airfare from the Employee+s point of depart#re to the 'or(place. 2% If the Employee has to visit @apan to rene' the visa after entry to $orea) all e1penses shall be paid by the Employer. E1penses shall be paid in $orean 3on. 3ith e1ception of the listed e1penses) the Employer shall not have responsibility for any other costs. 5% If the Employee terminates his/her contract before three months after the Employee+s arrival then the Employer has the right to ded#ct the amo#nt of money spent on an airfare from the Employee+s last salary. 0o'ever) if the Employer terminates the contract before three months) the Employer does not have the right to ded#ct the airfare from the Employee+s salary. 6% 3hen the Employee completes his/her contract) the Employer m#st pay the Employee 'ith the amo#nt of money that is e7#al to the airfare home. If the Employee does not complete the contract then the Employer 'ill not pay for the airfare. 5% The air tic(et shall be limited to Economy class only. 2fter arrival in $orea) teachers may be allo'ed a fe' days for ad*#stment and school preparation before beginning reg#lar teaching d#ties. The preparatory period 'ill be spent in the instit#te preparing for classes and learning the instr#ctional system. 1$. PAID VACATION AND PAID SICK LEAVE &% The paid vacation shall be &2 days in accordance to the Employer9s ann#al sched#le) only after the initial 5 months. Aational 0olidays) Bat#rdays and B#ndays shall not be incl#ded in the paid vacation. 2% .#e to the ann#al s#mmer/'inter brea( in $orea) from the &2 days vacation period) the Employee may choose to #se one vacation segment 'ith the s#mmer/'inter brea(. The vacations 'ill be administered thro#gh the 2cademic .irector. 5% The Employee 'ill be paid for all national holidays and not be e1pected to 'or( d#ring these days. 6% Caid sic( leave shall be 5 days d#ring the period of the contract. 2 doctor9s medical certificate for s#ch absences shall be s#bmitted to the Employer. 0o'ever) if the period of leave from illness e1ceeds 5 days) those days shall not be considered as paid sic( leave. 5% 3ith the e1ception of entitled paid vacation and sic( leave) in the case that the Employee is absent) the Employee+s monthly salary 'ill be ded#cted according to 2rticle 6 4la#se 2. 11. RENEWAL OF CONTRACT &% The Employee m#st give the Employer a 60/day notice in 'riting before rene'al or non/rene'al of the Employee+s c#rrent contract. 2% Doth the Employer and the Employee reserve the option to rene' the contract. 12. TERMINATION OF CONTRACT &% Doth parties 'ill give at least a 60 days notice in 'riting prior to the termination date of the contract and the Employer retains the right to terminate the contract immediately if: / The Employee is #nable to discharge the responsibilities or meet the conditions s#ch as being late for class on a contin#o#s basisE contin#o#s fail#re to (eep reg#larly sched#led class ho#rs and repeated absences from classes 'itho#t a valid reason. / The Employee teaches off the Employer+s property. / The Employee #ses illegal dr#gs or is into1icated d#ring 'or( ho#rs. / The Employee participates in any type of criminal activity that corr#pts p#blic morals 'hich violates the la's of the "ep#blic of Bo#th $orea. / The Employee fails to ac7#ire the E/2 ?IB2 beca#se of the Employee+s death) 'ar in the co#ntry and/or any accident) this contract shall be terminated. 2% The Employee shall terminate this contract in the event the Employer does not follo' this contract as stated herein) or in the case that the Employer assa#lts the Employee in a verbal) physical) and/or mental 'ay. 5% 3ithin &6 days) the Employee is re7#ired to sign a notice of termination and accompany the Employer to the $orean Immigration office to notify the $orean Immigration !ffice of the termination. 13. MODIFICATION OF CONTRACT &% In case there are any changes and/or modifications to the contract) both parties m#st give 50 days prior 'ritten notice after m#t#al agreement bet'een both parties. 2% 2ny changes and/or modifications made m#st be in 'riting and signed by both parties to be incl#ded in this contract. 2ny changes made to this contract) 'hether verbal or other) 'itho#t the (no'ledge and 'ritten consent of both parties are to be considered invalid) and as s#ch are not part of this contract. 14. VENUE FOR DISPUTES %ETWEEN EMPLOYER AND EMPLOYEE The appropriate la's of the "ep#blic of $orea 'ill govern this contract. 0o'ever) 'hile both parties enter into this agreement 'ith total honesty and integrity) disp#tes may sometimes occ#r. In s#ch cases) both parties 'ill be bo#nd by all terms and conditions of this contract and 'ill try to resolve the difference in a civil manner that is fair to both parties. In the event that no sol#tion can be fo#nd for a problem and either party decides to terminate this contract) they m#st do so in accordance 'ith E,C<!F,EAT 4!AT"24T herein. =pon s#ch termination) both parties 'ill agree to remain civil and to spea( honestly and fairly abo#t their e1periences and not in a disrespectf#l manner. 15. TRANSFERAL OF CONTRACT =nder no circ#mstances can the Employer e1change) give) sell or transfer this contract or the services of the Employee to another party or Instit#te 'itho#t the 'ritten consent of the Employee. 16. LANAGUAGE OF CONTRACT The <ang#age of this contract is 'ritten in English. -or the convenience of the Employer) this contract may be translated into $orean #pon re7#est and prior to the signing of these doc#ments. In event of a disp#te) the English version of this contract 'ill prevail. 1. MISCELLANEOUS PROVISIONS &% The Employer and the Employee agree that they have read the entirety of this E,C<!F,EAT 4!AT"24T and no other verbal agreement statement or promise made on or before the effective date of this contract 'ill be binding on the parties. 2% The Employer and the Employee 'ill act in good faith to'ard each other. The Employer 'ill not dismiss the Employee 'itho#t reasons that are reasonably considered as a good ca#se and the Employee 'ill do their #tmost to satisfactorily f#lfill all the responsibilities and meet all the conditions as described in the above agreement. 5% This contract is in d#plicate on the date stated at the end of this contract. The Employee retains one copy and the Employer retains t'o copies. The follo'ing Employment 2greement is made bet'een the follo'ing t'o parties.
