It is clear that Mr Geoff Shaw Member for Frankston had publicly made known he would pursue

a non-confidence vote against Premier Denis Napthine and I view the misuse and abuse of

Standing orders to railroad Mr Geoff Shaw is a very serious abuse of your position as a Speaker. The public must be able to have confidence in a public officer who is being paid and employed by the Parliament to ensure matters are appropriately conducted.

The question I have is if you have absolutely no concern acting in violation of the duties and obligations of the Office of speaker and just let the premier run the Parliament as he desires, despite this violates the separation of powers between the Parliament and the State Executives?

Let us look at something else.

I have made it ongoing clear that English is not my native language and neither did I have any formal education in the English language but when Banyule City Council in 2008 issued an infringement notice for exceeding a 3 hour parking limit because their records showed I had been parked for 2 hours and 29 minutes I made clear that regardless of my self-professed “crummy English” in my view 2 hours 29 minutes is less than 3 hours, and after a lot of writing

and many months finally Banyule City Council lawyers realised that counting a clock is the same in Dutch or English and cancelled the Parking Infringement Noticed. But the question is how many other motorist ended up paying because they employed someone who as a parking inspector cannot read times of a clock and understand that 2 hours 29 minutes (their records) is less than 3 hours!

I have used the above example because in my view the number 22 is before number 23 and only if one add to 22 a 1 then one get to 23. 1 + 22 = 23 But it appears to me that neither the Premier Mr Denis Napthine, the Governor, the President of the Legislative Council or yourself as Speaker of the legislative assembly understand the difference between 22 and 23. Also in my view “six” and “8” are not the same either.

Let me use an example:

Section 50 limits the number of salaried officers in parliament to 22 whereas it appears to me from the Victorian Governments there are “There are 23 MP(s) that match your query”. (Last update to MP listed here: 2014-06-03) I have reproduced the records downloaded from websites so you may verify the same.

This means that the last 2 person who became purportedly a Minister/secretary to the legislative Council never did so. And where the Minister was sworn in to the Legislative Assembly exceeding 22 in total then this person neither may have been validly appointed. Moreover, there are more than 6 Members of the Legislative Council who have a position of

Office of Profit, this as by the website details there are 8, meaning that in my view 2 unconstitutionally in the Legislative Council. As such what needs to be considered is the order of appointments, when sworn in on 17 March 2014. And one also may have to consider what eventuated previously as then the excess of Ministers in one House or the orders must be severely dealt with.

While Section 50 provides for a 3 month period considering that the swearing in was on 17 March 29014 then any excess has already exceeded 3 months by 17 June 2014 and as such it

cannot be argued that such a minister resigns from the Parliament but continue to remain a Minister.

Despite my past writings, including to Premier Mr Denis Napthine, President of the Legislative Council Mr Bruce Atkinson and yourself to mention a few no attempt to my

knowledge was made over the last 2 weeks by anyone to try to work through the issues I then already raised.

This conduct of arrogance may cost some people dearly.

For the above it means that the person who was last sworn in to a salaried office by the

Governor was not duly and appropriately sworn in and as such is not a Member of Parliament as he/she is holding an office of profit not entitled upon. Meaning that the Government parties are technically 1 short, and there is no balance of power as such. As such ousting Mr Geoff Shaw actually was the most stupid thing to do, at least in my view.

I have below copied and paste details obtained on 18 June 2014 from the various websites and noted their web addresses. It may also mean that the vote to suspend Mr Geoff Shaw was in valid if one person on the government parties in the Legislative Assembly may not have been eligible to vote.

It is beyond belief that no one bothered to consider the constitution as quoted below (downloaded on 18 June 2014) as to ensuring that the number of paid officers in the Parliament were not exceeding what was allowed for by s50 of the constitution act 1975.

You cannot hold that Mr Geoff Shaw must be punished because as Premier Denis Napthine

stated “fair, just and appropriate” even so in my view Mr Denis Shaw was entitled upon having defeated the criminal charges to have the benefit of this, and then not to pursue rigidly the same kind of punishment against other Members of Parliament merely because they happen to be party members associated with Premier Denis Napthine.

Do understand that I spend decades in the courts and use my own kind of tactics to defeat opponent lawyers, even the so called highly priced lawyers of the government, as such, you can refuse to co-operate and so to say you will regret having done so as many lawyers over the decades discovered when defeated.

As many lawyers made clear they rather have me on their side then as an opponent.

Ignorance will not be any excuse and I have only so far been building up the case and if I were to bring down the Government in the process then so be it. despite my self-professed "crummy English" do not make the error to

under estimate what I am on about.

It may turn out that suspending Mr Geoff Shaw may have been the worst thing that could have been done.

I have had never personally spoken with Mr Geoff Shaw Member for Frankston neither does he know or did he

know what I am contemplating to do. But I view he is entitled to receive copies of my writings in view that it refers to his person.

I view that I have provided you, Premier Denis Napthine and Speaker Christine Fyffe ample of time to address

what I consider to be the gross injustice against Mr Geoff Shaw.

I consider your conduct appalling at the very least, and while I am aware that you cannot dictate the Legislative

Assembly nevertheless I view you could perhaps so to say have counselled Christine Fyffe and others that misusing

Standing Order 125 and failing to comply with Standing Order 126 was not the way to go.

I can assure you I do not need to make threads as I do what I view is legally appropriate. As Premier Denis Napthine stated "fair, just and appropriate".

It is of no use to be arrogant or be seen or deemed to be arrogant as while this may satisfy your own personal ego you might just discover that in the end it is the worst thing you could have done.

Not uncommon lawyers would seek adjournments because they needed time to provide further evidence but I would oppose this as after all where they admitted to have ignored my writings then that is no excuse for the courts then to give them an adjournment. so far judges always refused to adjourn matters as such.

.

I

can assure you that once you get a copy of my next writing to Speaker Christine Fyfe you may just regret having

been as I view it so narrow minded with blinkers on instead of having bothered to address issues appropriately. Always remember that I am used to opponents in court to be ignorant and used this often very successfully in my

favour when representing parties.

Perhaps tomorrow someone may put a motion for NO CONFIDENCE and if this were to occur I have no doubt that it will succeed. and without Geoff Shaw to so to say saved the Premier's neck he might just regret having sidelined him.

For the record I have not made any kind of arrangement with any Member of Parliament regarding matters as no

one knows what I contemplate to write about. so to say it will be a surprise to all Members of Parliament, that is for

certain.

But if Mr Tim Bull is correct then from this at least Mr Damian Drum is in my view not validly

25 appointed by the Governor. A further member of the Legislative Council would have to be established from who was second last as a member of the legislative Council appointed by the Governor. Why on earth the Governor’s Office didn’t wake up about there being too many persons to be commissioned? Also, Premier Denis Napthine never bothered to be aware that he was violating constitutional provisions is also beyond me.

30 To me this is sheer arrogance and incompetence. It might be all right for him to accuse Mr Geoff Shaw of violating certain provisions but without conceding this eventuated I view that his own conduct so to say to thumb his nose on the constitution act 1975 is far more severe. And the fact that no Member of Parliament alerted him and others to this also is a considerable issue to me. Here we have purported Ministers who

35 constitutionally were not at all entitled to the salary they were receiving nor entitled to have the authority they exercised and this I view may constitute defrauding taxpayers.

In my view in the circumstances wart was pursued against Mr Geoff Shaw Member for Frankston then the same application ought to be made to Members who so to say defrauded

40 public monies as Ministers, etc not entitled upon. Considering the amount of monies involved then one may ask how much suspension will they be punished with? How much fines will they have to pay on top of the monies they may have defrauded? Will they also be forced to make separate apologies as was pursued against Mr Geoff Shaw? Why did Mr Daniel Andrews not then alert the parliament about this unconstitutional conduct? Where he as I understand it

45 promote himself as an alternative Premier then surely he should have be aware of it. And, one also may have to check prior to 17 March 2014 how many Members of Parliament then were in excess to what was permitted. It must be clear that pending the order that members of Parliament were sworn in those who were last sworn in, but not already had an existing portfolio were therefore not sworn in and invalidly?

It must be clear from “IN RE WOOD (1988) 167 CLR 145 F.C. 88/018that it is not relevant if the Governor commissioned a Member of Parliament as a Minister because if the person was not entitled to become a Minister as there were already a number of Ministers appointed to the Legislative Council then the 6 th and 7 th so purportedly appointed were not at all. By this all and any documents they signed as Ministers must be deemed invalid this as they were

never lawfully a Minister. And, as yet I have not checked back any possible fraudulent conduct

by those who currently or in the past in this or any previous Parliament were collecting monies as shadow Ministers because they too in my view should be severely dealt with. Once you set the rules as to punishment upon one Member of Parliament you always have to be careful it so to say doesn’t bite your bum.

Ryan, and today announce a refreshed and rejuvenated Cabinet team to continue building a better Victoria.

Swearing in of Premier and Ministers

After an election the Governor appoints the new government by swearing in the new Premier and Ministers. Where the existing government loses the election, convention requires the Premier to advise the Governor to call on the Leader of the Opposition to form a government and the Premier then tenders the resignation of the ministry.

In those circumstances, the Leader of the Opposition (the Premier-elect) must assure the Governor that he or she has the confidence of the majority in the Legislative Assembly. Upon being so satisfied the Governor commissions the Premier elect to form a government. Until the Governor accepts the resignation and appoints the new governments, the conventions inherited from the Westminster system see that the existing Premier and Ministers continue on a caretaker basis.
