Introduction
The impact on the consciousness and subconscious long worried people in many countries. New information technologies, mass media repeatedly strengthened the
possibility of such effects on the human psyche, to large groups of people and the whole population of the country. Along with the progress that carries us to a new
information revolution, it has drawbacks.
Cruelty, violence, pornography, propagated in the media, print unlimited sale, as well as in computer games, etc., leads to the sometimes unconscious desire among
adolescents and young people to emulate this, helps to perpetuate these behaviors in their own habits and lifestyle, lowers thresholds and legal prohibitions that, along
with other conditions, paving the way for many of them to the offenses.
Numerous existing today in the Russian community committees for protection from such exposure, including parents, a large number of citizens to public authorities
with requests for verification of such facts and protect the public from the harmful effects of special devices on their psyche - all this also indicates a serious lagging state
of the practice of public relations in this sphere. Long overdue need for the participation of the state in the legal regulation of these processes.
These findings indicate the need for development of national legislation and international law, to protect the human psyche of unconscious destructive informational
influences. This brings the problem of legal protection against such exposure a priority of the state policy that requires along with the improvement of existing today
certain provisions of laws and regulations (including "On the Media," "On Advertising", "On Freedom of Conscience and Religious Associations "," Fundamentals of the
Legislation on health care, "etc.) to adopt a special Federal Law" On information and psychological security. " The bill, according to its authors, is to be a framework, a
general nature (it does not infringe on freedom of expression, media and freedom of conscience), and could serve as a basis for training and further adoption of a
package of other laws in this area.
Such a bill drafted by a working group of the State Duma Committee on Security and was introduced December 3, 1999 as a legislative initiative to the State Duma

Chapter 1. General
Article 1. Objectives and scope of the present Federal Law
The purpose of this Federal Law is to protect individuals in the territory of the Russian Federation, of the negative information and psychological influences.
Subject to regulation hereof are matters arising in connection with the information - psychological effects on a person, a group of individuals, populations, and their
protection from the adverse effects of such exposure.
Subjects of the present Federal Law are: persons subjected to negative information and psychological impact; person, group of persons, organizations asking for
information and psychological effects; authorized bodies and organizations to provide information and psychological security.
Providing information-psychological security by the state represented by authorized government bodies, local government bodies, specialized agencies and
organizations.
Article 2. Concepts
For the purposes hereof, the following basic concepts:
Information and psychological security - the state of protection of individuals and (or) groups of individuals from the negative effects of information-psychological and
related other vital interests of the individual, society and the state in the information sphere.
Negative information and psychological impact - impact on a person or group of persons (including, in addition to their will), carried out with the use of special means
and methods of influence on the human psyche and leads to negative consequences for the individual, society and the state.
Special means of influence - both hardware and software used for the negative information and psychological impact on a person or group of persons.
Special methods of influence - a sequence of techniques impact on the human psyche, the use of which leads to negative consequences for the individual, society
and state.
Standards information-psychological security - duly approved parameters of information and psychological effects that do not cause adverse effects on the human
psyche.
Article 3. Legislation on information-psychological security
Legislation on information-psychological security consists of the present Federal Law, adopted in accordance with it normative legal acts of the Russian Federation
and normative legal acts of the Russian Federation and local self-government within the powers delegated to them by the federal government regulating relations in the
sphere of information and psychological security.
Article 4. Principles of information-psychological security
The basic principles of security of information-psychological security are:
the adequacy of existing security threats;
state monopoly on the development and production of special tools information and psychological warfare, the use of which is permitted in cases stipulated in Article
16 of this Federal Law;
combination of centralized command and control to ensure information-psychological security to the transfer, in accordance with the federal structure of Russia, part
of the powers in this area state authorities of the Russian Federation and local authorities;
transparency and civilian control over maintenance of information-psychological security;
mandatory participation in the activities of non-governmental organizations to provide information and psychological security.
Article 5. Threats of negative information and psychological effects
The main threats to information-psychological security is the possibility of negative consequences for subjects exposed to information and psychological effects,
which may be expressed in the following forms:
- Causing harm to human health;
- Blocking at the unconscious level of freedom of expression rights, instilling him artificial dependence syndrome;
- Loss of ability to political, cultural, moral self-identification;
- Manipulation of public opinion;
destruction of the common informational and spiritual space of the Russian Federation, the traditional foundations of society and public morality, as well as violations
of other vital interests of the individual, society and the state.
Threat information-psychological security realized through the development, production, distribution and use of information and subjects negative psychological
effects of special tools and techniques that impact.
Chapter 2. State system for ensuring the security of information and psychological
Article 6. Main tasks of state policy in the field of information-psychological security
State policy in the field of information-psychological security is aimed at the following goals:
- Improvement of the legislation of the Russian Federation in the area of information-psychological security;
- Formation system of information-psychological security;
coordination of the activities of public authorities and public associations to provide information-psychological security;
definition of the powers of state authorities of the Russian Federation and local authorities in the area of information-psychological security;
establishing an appropriate balance between the need for free exchange of information and the permissible limitations of its distribution;
preservation of a common informational and spiritual space of the Russian Federation, the traditional foundations of society and public morality;
- Develop and support domestic production protection from negative information and psychological effects;
- Development of legal awareness and legal culture of citizens in the area of information-psychological security;
teaching people techniques to protect themselves from the negative psychological effects of information and the basics of safe behavior in the modern information
environment;
- Organization of international cooperation in the field of information and psychological security.
Article 7. Functions of the State system of information-psychological security
State system for ensuring information-psychological security performs the following functions:
identification and registration of entities in a negative psychological impact of information and control over their activities;
- Conducting monitoring adverse information and psychological effects;
- Suppression of negative information and psychological effects;
training to ensure information-psychological security involving non-state educational and scientific organizations;
- Development and improvement of methods and tools to identify and neutralize the negative effects of information-psychological, rehabilitation of persons affected
by such impacts;
- Organization of rehabilitation of persons affected by negative information and psychological effects;
- Organization of a system of licensing, certification, examination and control of information-psychological security;
- Organization of the development and adoption of standards in the field of information-psychological security;
development of special means and methods of information-psychological effects for use in cases stipulated in Article 15 of this Federal Law;
- Informing the public about the activities of individuals and organizations that violate the laws of information and psychological safety;
- Promoting the development and adoption of international law in the field of information and psychological security.
Article 8. Structure system of information-psychological security
For the implementation of state policy in the field of information and psychological security in accordance with the stated objectives, functions and principles formed
the state system to ensure information-psychological security, which consists of agencies and organizations providing information and psychological security.
Article 9. Bodies of the system of information-psychological security
The organs of state system of information-psychological security are federal authorities operating within its jurisdiction fully or partially the tasks and functions referred
to in Articles 6 and 7 of this Federal Law, the state authorities of the Russian Federation and local authorities in accordance with delegated to them by higher powers of
public authorities to provide information and psychological security of current legislation.
Coordination of the provision of information and psychological security is implemented by the Government of the Russian Federation, a federal agency to provide
information-psychological security, which also has:
- Organization of the licensing of individuals and organizations that make up the forces of information-psychological security, and control of the licensed activity;
certification organization of means and methods of information-psychological influence and control over the activities of the certification;
- Organization of expertise in order to provide information and psychological security and control over the activities of expert organizations (units);
- The formation of the state order to conduct research in the field of information-psychological security;
- Control over maintenance of information-psychological security in general;
- Preparing an annual report to the President of the Russian Federation on the state of information-psychological security of the country;
informing the public authorities and local authorities about the threats of information-psychological security and the measures taken to secure it, the shortcomings of
providing information and psychological security identified during the inspection. State agencies and local governments are obliged to consider this information when
making relevant decisions within its competence.
Authorized by the Government of the Russian Federation, the federal body responsible for building the system of information-psychological security organization and
its activities in accordance with the objectives, functions and principles established by this Federal Law.
Article 10. Organizations providing information and psychological security
The organizations providing information and psychological security include:
head and leading research, scientific and technical, design, engineering and other public organizations that research and development in the field of methods and
means of protection against negative information and psychological effects on the human psyche;
educational institutions for training and retraining of personnel in the area of information-psychological security;
authorized by the state system of information-psychological security organizations performing certain functions to ensure information-psychological security.
Article 11. Licensing in the area of information-psychological security
Licensing of organizations associated with the provision of information-psychological security, carried out by bodies authorized by the Government of the Russian
Federation, on the proposals of the Federal agency to provide information and psychological security and in accordance with Federal law.
A prerequisite for obtaining a license is a certificate of the means and methods used in carrying out the licensed activity.
Public authorities have the right to work to ensure the information-psychological security without a license within its competence established by the legislation.
Article 12. Certification tools and techniques of information-psychological security
Subject to mandatory certification means and methods to ensure information-psychological security. A list of these tools and techniques and their certification
procedure established by the Government of the Russian Federation.
Article 13. Examination in order to detect negative information-psychological influences
State examination in order to identify the negative information and psychological effects by organizations authorized by the Government of the Russian Federation, in
accordance with the legislation of the Russian Federation.
State examination is carried out on the instructions of providing information and psychological security, as well as in a declarative manner.
A statement on the expertise of the right to appeal a person subjected to negative information and psychological warfare, and persons acting on their behalf in
accordance with the civil law, including their relatives, trustees, employers, public associations.
If the examination revealed negative information and psychological impact on the human psyche, a person has been exposed to such an impact, providing
rehabilitation assistance in accordance with applicable law.
Expert opinion may be appealed to a court or arbitral tribunal in the prescribed manner.
Article 14. Control to provide information-psychological security
The control to provide information and psychological security in the territory of the Russian Federation shall be exercised by the Government of the Russian
Federation authorities on information-psychological security, federal authorities, the authorities of the Russian Federation and local authorities within their powers, as well
as their authorized bodies and organizations.
In exercising oversight of information-psychological security competent authorities conduct registration identified entities carrying negative information and
psychological impact.
Article 15. Exceptional cases of the use of special means and methods of information-psychological influence
1. Use of special means and methods of information-psychological influence allowed agencies and organizations within the state system of providing information and
psychological security in the following cases:
1) without the consent of the subject with respect to which such funds are used and methods of influence:
emergencies that occur during natural disasters, man-made and man-made for the purpose of localization and liquidation of emergency situations;
during anti-terrorist and peacekeeping operations during hostilities in repelling foreign aggression against the State;
2) with the consent of the person against whom such funds are used and methods of influence:
- For scientific purposes, for research in the area of the psyche;
- With training, using means and methods of influencing the psyche;
- The preparation of professionals whose work is related to extreme and emergency situations,
- The preparation of specialists to conduct anti-terrorist operations;
- With training in the field of information security.
2. The grounds for the application of special means and methods of information-psychological influence is exhaustive and may be amended only by the Federal Law.
Article 16. International cooperation in the field of information-psychological security
Russian Federation promotes international cooperation in the field of information-psychological security, including issues of legal regulation.
International cooperation in the field of information-psychological security is based on international treaties and agreements of the Russian Federation.
Russian Federation in international cooperation in the field of information-psychological security emanates from the need to protect the psyche of any person from
the negative psychological effects information and guided by the following principles:
- Every person, regardless of nationality and location must be protected from the negative information and psychological effects;
- Economic, scientific and other activities on the territory of a State shall not be accompanied by negative information and psychological effects on the human
psyche, located on the territory of another State;
States shall ensure state control of information-psychological security based on internationally recognized standards;
- State, assist each other in order to ensure information-psychological security of people in their territory;
- Contribute to the state to prosecute those responsible for the implementation of information and negative psychological effects.
Export and import of tools and techniques of information-psychological security in accordance with international treaties of the Russian Federation on the basis of a
special permit issued by the Government of the Russian Federation.
Chapter 3. Final Provisions
Article 17. Responsibility for violation of this Federal Law
Implementation of negative information and psychological effects by using special tools and methods, as well as illegal development, production and distribution of
special means and methods of action entail criminal, administrative and other liability in accordance with the legislation of the Russian Federation.
Compensation for damage caused as a result of negative information and psychological impact and costs associated with medical and psychological rehabilitation of
persons affected by negative information and psychological warfare, carried out by the courts.
Actions (inaction) of bodies and organizations carrying out state regulation of relations in the field of information-psychological security, as well as the actions of their
officials may be appealed in accordance with the legislation of the Russian Federation or to the administrative court.
Article 18. Financing activities related to the provision of information-psychological security
Activities of federal agencies and organizations of the state system of information-psychological security is financed by the federal budget of the Russian Federation
allocated public authorities, in accordance with their departmental classification.
Article 19. Procedure for the entry into force of this Federal Law
This Federal Law shall enter into force on the day of its official publication.
Regulations of the Russian Federation must be brought into compliance with this federal law in the prescribed manner.
Article 14 and paragraph 2 of Article 15 of this Federal Law shall enter into force on 1 January 2001.

"On information and psychological security"
Possibilities of science and technology now allow you to create tools and methods for information management system effects on living organisms, altering their
function. Potentially there is a big risk of social technologies of artificial human behavioral change, restrictions on the freedom of expression it, as well as the impact on
human health, and groups of people in general population. In a society increases psychological stress due to the alleged use of some government organizations,
corporate groups and individuals special means and methods of influence on the human psyche. For example, in the information-analytical review of the Moscow
committee of ecology home "on the deliberate use of inhumane means of special equipment in the Russian Federation", presented by the Public Prosecutor of the
Russian Federation and the State Duma, said on mass appeals of individuals to them in order to find protection. Answer Prosecutor's Office in Moscow (from 30.12.96
32-5-14-95) characteristic: "Unfortunately, to take any action the prosecutor's response on the facts given in the documents submitted by you, it is not possible due to

The problem of providing information and psychological security is extremely important for Russia and the world community as a whole. It is directly related to
national security. For example, in the U.S. since the 50s are intensive development of methods and means of the special effects on the psyche. Since the 70s the
research programs carried out in the best laboratories in universities around the world: USA, Germany, Austria, France, Italy, Japan, Israel, China and others in the United
States published the results of research authoritative commission of the American Physical Society in 1993 concluded that such weapons systems (Psychophysical Arms
System) can be effectively used to address a broad range of military tasks. They can be used to create a fundamentally new means and methods of warfare, including
the creation of a new type of strategic weapons.
According to the Russian Foreign Intelligence Service, given the parliamentary hearings in the State Duma, "Threats and challenges in the field of information
security," such information weapon is aimed, inter alia, "the mass distribution and introduction into the minds of people of certain ideas, habits and behavior patterns
that cause dissatisfaction or panic among the population, as well as provoking destructive actions of various social groups. "
Today, at the legislative level, there is sufficient safeguards to protect people from the risks associated with the negative effects of information, which may result in:
causing harm to human health, at an unconscious level blocking freedom of expression rights, instilling him artificial dependence syndrome; manipulation of public opinion,
etc. These threats are realized through the development, implementation and use of special means and methods of action.
These facts indicate the need to develop both national legislation and international law, to protect the human psyche from negative information and psychological
influences.
This federal law is aimed at ensuring the rights of persons within the territory of the Russian Federation, to protect their health from the negative psychological
impact of information and related other vital interests of the individual, society and state in the information sphere.
Concept of the bill is based on the following key positions.
- Any person who is in the territory of the Russian Federation, must be protected from the negative information and psychological effects on his psyche.
- Providing information and psychological security is one of the most important tasks of the state.
To achieve this task should be developed public policy and established a state system of providing information and psychological security. The bill defines the main
directions of the state policy and the structure of the state system of information-psychological security, its main tasks and functions.
Tools used by the public system should provide a sufficient level of protection from the negative information and psychological influences. The bill provides for the
use of such instruments of state regulation, such as compulsory licensing activities to ensure information-psychological security, mandatory certification means and
methods of security expertise in order to identify negative information-psychological influences, supervision to ensure information-psychological security.
The most important duty of the state in the sphere of information-psychological security is to inform citizens, organizations, public authorities and local governments
on the availability of information and psychological threats and security measures taken to neutralize them, and provision of training people how to protect against
negative information and psychological impact on their psyche.
Feature negative information effects is that they can be detected only by special examination. For hazard identification should be developed and used special safety
standards - duly approved parameters of information and psychological effects that do not cause adverse effects on the human psyche. The examination must be
available to anyone, so the bill establishes that such examination may be conducted in a declarative manner (to a person who has been exposed to, or a person acting in
his best interests), as well as on behalf of the state system of information-psychological security in order control.
Given public concern about the potential for uncontrolled use of special tools and techniques of information and negative psychological impact and to better
oversight of information-psychological security, the bill provides along with the state and civil control.
The bill establishes an exhaustive list of cases where the use of state funds and special methods of influence on the psyche of people may be justified, thus
implementing the principle of state monopoly on the use of such means.
Coordinating the activities of bodies belonging to the state system for providing information and psychological security, and the implementation of specific public
policies in this area by the authorized federal body of the Government of the Russian Federation.
Federal law consists of three chapters and 19 articles.
The first chapter defines the purpose and scope of the Federal Law, the basic concepts, threat information-psychological security; established principles of
information-psychological security.
The second chapter is devoted to public policy in the area of information-psychological security, including: key public policy objectives and functions of the state
system of information-psychological security; structure of the state system and methods of state regulation (coordination, licensing, certification, expertise and control);
exceptional cases the use of special means and methods of information-psychological influence; basic principles of international cooperation in the field of information and
psychological security.
The third chapter contains the final provisions on monitoring compliance with this Act, responsibility for its violation, the funding for information and psychological
security and order of entry into force of the law.
Costs for implementation of this law depends on the creation within the state system of information-psychological security special federal authority. If such a body is
created, then to ensure that its activities would require additional budget funding (up to 10 million rubles a year). If the functions of the state system of information-
psychological security will be distributed among existing federal authorities, the additional costs of the federal budget for the first stage is not required.
In the case of adoption of the Federal Law "On the information-psychological security" must be:
- Amendments and additions to the Criminal Code of the Russian Federation (offsetting the article 17 of the Federal Law);
- Amendments to the Code of Administrative Offences (offsetting the article 17 of the Federal Law);
- Amendments and additions to the Federal Law "On Licensing Certain Types of Activities" (offsetting with Article 12 of the Federal Law);
- Amendments and additions to the normative legal acts of the federal government, authorities of the Russian Federation and local authorities involved in the system
to ensure the information and psychological information (offsetting with Article 9 of the Federal Law);
- Adopted regulations on licensing of organizations and individuals associated with the identification and neutralization of negative information and psychological
influences, training protection from such impacts, rehabilitation of people affected by negative information and psychological warfare (Art. 12); certification tools and
techniques of information-psychological security (Article 13); on the examination in order to ensure information-psychological security (Article 14).
Development of the concept of the legislation in the field of information-psychological security was started in 1990 in a parliamentary committee of the Supreme
Soviet of the USSR on problems of national security under the leadership of Yu.A.Ryzhova.
In order to prepare the draft law were held Conference on information and psychological security in years. Moscow and St. Petersburg (1996 and 1997)., Ufa
(1999), the Conference on Information and psychological safety campaign at the Institute of Psychology RAS (Moscow, 1999), "round tables" in a variety of scientific ,
