V. 8/07

STATEMENT OF PROBABLE CAUSE

The Complainant states that the following facts establish probable cause:

On June 25, 2014, at 12:08 PM, St. Paul squads responded to the intersection of Arcade Street and Case Avenue
in St. Paul, Ramsey County, Minnesota, on a report of a shooting. Witnesses stated that they heard shots and
then saw a male fall to the ground near a silver, four-door Buick, which was parked in traffic. Several males
lifted the gunshot victim into the Buick and drove away. Witnesses also stated that they saw a male fleeing from
the area shortly after the shots. They described him as a black, heavyset male in a beige shirt over a white tank
top with shorts.

Officers learned that the gunshot victim was transported to a fire station at 1038 Ross Avenue E. in St. Paul.
Paramedics at the station transported him to Regions Hospital, where he died from multiple bullet wounds to his
upper torso. Police identified the deceased as LRH, DOB 06/08/1989.

Officers saw a male matching the suspects description walking at a quick pace southbound on Desoto Street
toward York Avenue. He was holding a white tank top and attempting to put the tank top on. He was sweating
profusely and breathing heavily. He was also wearing shorts. Officers arrested him and identified him as the
defendant, CHEVAZE DARRELL WARD, DOB 01/10/1990. A witness told officers that he saw the
defendant throw a tan shirt into a trash receptacle near Weide Street and Case Avenue. Officers went to that
location and recovered the shirt. Officers also used a canine and tracked from the area of the arrest. Officers
recovered a handgun inside of a white tube sock on top of a retaining wall near 908 Desoto.

Police spoke with the deceaseds mother at Regions Hospital. She stated that her son had been involved in an
argument for the past several days with the defendant, who is his cousin. She stated that the family calls the
defendant by the nickname REZZY. The two of them were arguing on the phone just the day before. When
her son hung up, he told her that REZZY had threatened to shoot him.

Investigation revealed that one of the vehicles involved in the shooting was a silver, Buick LeSabre displaying
Minnesota license plate 503 LYT. This vehicle registered to the deceaseds mother. Officers discovered this
vehicle parked near Case Avenue and Weide Street. A group was standing near the vehicle. Officers learned
that they were family members of the shooting victim. Officer Sherwood spoke to an adult male, RLB, who was
among the group. He told Sherwood, Get your notebook out. I am going to tell you what happened, because I
want you to know the truth, because youre out on the street every day. He said that both the victim and the
defendant are family. He learned of a recent dispute between the victim and the defendant. They were talking
about fighting. RLB said that he was riding in the rear passenger seat of a four-door, green, Mercury Sable. The
defendant was sitting next to him in the rear drivers side seat. Another family member was driving the vehicle,
and a fourth family member was in the front passenger seat. They drove by the Mobil station at E. 7
th
Street and
Cypress Street when they saw LRH standing next to the silver Buick in the parking lot. LRH said, Whats up?
He said it in a confrontational way. A short time later they were stopped at Arcade Street south of Case Avenue
for a traffic light. LRH pulled up, driving the silver Buick. He was positioned along the passenger side of the
green car. LRH got out of the Buick and walked around the drivers side of the green car. He opened the rear
door on the drivers side and attempted to pull the defendant out of the car. The defendant then pulled a
handgun out of a white sock and shot LRH multiple times. The defendant then ran away on foot. The others got
out of the green car, pulled the victim into the Buick, and drove to the fire station for help.

Police interviewed an adult male, CAC. He said that he was driving the green Sable at the time of the shooting.
The shooting victim and the defendant are both his cousins. He was aware that they were having an argument

about money. He heard that LRH wanted to fight with the defendant over the incident. He, his uncle, and his
father were also present with the defendant in the car prior to the shooting. They were telling the defendant that
they are family so they should work it out. The defendant said that he is big and has two bad knees so he cannot
fight anymore. The defendant said that he would just shoot whoever wanted to fight with him. A short time
later, LRH approached the green Sable while they were stopped in traffic. He punched the defendant and tried
to pull him from the vehicle. The defendant then shot LRH, and ran away from the scene.

Police also interviewed the fourth family member, TMW, who was present in the Sable at the time of the
shooting. His account of the incident was consistent with the accounts provided by RLB and CAC.

This investigator attempted an interview with the defendant but he asserted his right to an attorney and
remained silent.

The Office of the Ramsey County Medical Examiner issued a provisional report determining that the cause of
death in this matter was exsanguination due to contact gunshot wound to the chest, and the manner of death was
homicide. The report states that LRH suffered an entrance gunshot wound to the chest with damage to the right
ventricle of the heart and pericardium, and upper lobe of the left lung. The victim also suffered a fracture to the
anterior 3
rd
rib. There was an associated exit gunshot wound to the left posterior back area and no projectile
was recovered. The direction of the wound was from front to back and right to left at an approximate 45 degree
angle. LRH also suffered a contact gunshot wound to the left lower abdomen with associated damage to the
mesentery and a fracture of the right ilium. A projectile was recovered in the right hip. The direction of this
wound was left to right and slightly front to back.

The defendant was convicted of Sale of Cocaine in the First Degree in October, 2008; and Possession of a
Controlled Substance in the Second Degree in December, 2008. Both convictions occurred in Ramsey County.
He served time in prison for both convictions and was paroled on January 9, 2014, with a sentence expiration
date of August 3, 2016.
