Minutes of the seventy seventh meeting of the State Level Expert Appraisal Committee, West

Bengal held on 26.03.2013 at 12:00 hrs. at the Conference Room, Paribesh Bhawan, Salt Lake.

In the beginning of the 77
th
meeting of SEAC, which was held on 26.03.2013 at 12:00 hrs at the
Conference Room, Paribesh Bhawan, Bidhan Nagar, the Secretary, SEAC welcome all the members. Due
to some unavoidable circumstances Prof. (Dr.) Sudarsan Neogi could not attend the meeting. However, as
desired by Prof. (Dr.) Sudarsan Neogi and as also agreed by other members of SEAC Shri Manoj Kumar
Nandi chaired the meeting. After introductory session, three cases were discussed under 'Miscellaneous'
section. Six cases were placed for reconsideration. Seven applicants were requested to make their
presentation before the committee. All the seven applicants appeared before the SEAC for technical
presentation on their respective project proposal.
Session I
A. Miscellaneous Section :-
1. Proposed 315000 TPA Bottle Grade PET Resin Plant and 10 MW Captive Power Plant of M/s.
Dhunseri Petrochem and Tea Ltd. Petrochem Division (formerly M/s. South Asian Petrochem
Ltd.) at JL No. 126, Mouza Basudevpur, JL No. 135, Mouza Paranchak, PO Khanjanchak,
PS Durgachak, Haldia, Dist. Purba Medinipur, West Bengal.
Activity:
This is a proposal for installation of 315000 TPA Bottle Grade PET Resin Plant, 10 MW Coal based
Captive Power Plant and Coal fired Thermic Fluid Heaters, at the plot area adjacent to the existing
PET Resin Plant of the proponent at Haldia. The proposed plant will have different units like
Continuous Polymerization (CP), Solid State Polycondensation (SSP), Captive Power Plant, HTM
Heaters and other auxiliary units.
Chronology of the event:
The SEIAA has granted
Environmental Clearance for the proposed 315000 TPA Bottle Grade PET Resin Plant vide
No. EN/3167/T-II-1/2009 dated 16.11.2010 and
Environmental Clearance for installation of 8 MW Captive Power Plant to M/s. South Asian
Petrochem Ltd. vide No. EN/1112/T-II-1/116/2008 dated 12.04.2010.
On direction of Ministry of Environment & Forests, Govt. of India, the West Bengal State Level
Environment Impact Assessment Authority hereby withdraws the above mentioned two environmental
clearances with immediate effect.

2. Consideration of Environmental Clearance for Building & Construction projects/ Area
development and township projects based on CEPI- Regarding
MoEF vide O.M dated 13.01.2010, has imposed a moratorium on consideration of projects for
environmental clearance to be located in Critically Polluted Industrial Clusters identified by CPCB to
improve the quality of environment in these industrial clusters. In West Bengal, following areas have
been identified as critically polluted industrial areas:-
a. Haldia Five kilometer wide strip of industrial area on the southern side of the confluence
point of rivers Hooghly and Rupnarayan covering Haldia Municipal Areas and Sutahata
Block I & II.
b. Asansole Burnpur area surrounding IISCO.
c. Howrah - i. Liluah-Bamungachi Region
ii. Jalan industrial complex-1.
With the identification of critically polluted industrial areas, MoEF imposes temporary restrictions on
consideration of development projects in such areas.
As per O.M issued by MoEF dated 22.01.2010, proposals including Category B projects to be
located in critically polluted areas will be returned.
MoEF also clarified vide O.M dated 24.05.2011 that building and construction projects item 8(a) and
township area development projects item 8(b) do not attract general conditions and would continue to
remain as category B irrespective of their location with respect to identified critically polluted areas
and would continue to be appraised by respective SEIAAs.
As per O.M. dated 30.03.2012 the moratorium has been extended till further orders for the above
mentioned critically polluted areas.
Following applications are pending with the SEAC for appraisal at various stages which falls under
the critically polluted areas.
1) Proposed Commercial Complex by M/s. Rose Valley Estate & Construction Ltd. at Debhog,
Bhabanipur (Sutahata), H.D.A. Purba Medinipur. (Provisional EC on 05.09.2008).

Forests, Govt. of India as per O. M. J-11013-5-2010-IA.II(I) dated 13.01.2010 has imposed
temporary restriction on consideration of developmental projects in critically polluted industrial
clusters. As per clause 4.1.1 of said O. M. the developmental projects from critically polluted
industrial clusters received for grant of environmental clearance in terms of the provisions of EIA
Notification 2006, which are presently in pipe line for environmental clearance or which would
be received hereafter shall be returned to the project proponents.
As per the records available, the SEAC has observed that the project falls within the critically
polluted area, Haldia as listed by MoEF, Government of India and the moratorium imposed in
Haldia critically polluted industrial cluster is still in force.
The SEAC recommended to forward this case to SEIAA, West Bengal for taking necessary action
in terms of Office Memorandum dated 13.01.2010 and 22.01.2010 of MoEF, Govt. of India.

2) Proposed Commercial cum Residential Complex "GENEXX ASANSOL" Phase-I &
PHASE-II by M/s. Paharpur Cooling Towers Ltd. at Mouza-Kalikapur, Pargana-Shergarh,
Asansol, Burdwan. (Phase I NOC issued on 25.04.2011, Phase II under Process).
The proposed Commercial cum Residential Complex "GENEXX ASANSOL" PHASE-II by M/s.

West Bengal. The Ministry of Environment & Forests, Govt. of India as per O. M.

Ltd., at Mouza Ganrui, Gobindapur, Kumarpur, Gopalpur, , PS Kanyapur, Asansol
Municipal Corporation Ward No. 2,30 & 31, Dist Burdwan.

Kanyapur, Asansol Municipal Corporation Ward No. 2,30 & 31, Dist Burdwan.

3. Environmental Clearance for the proposed IT Park at Kolkata Leather Complex.
SEIAA has requested SEAC to study the water balance in CLC area through letter dated 16.08.2012.
Water requirement for 3 nos. IT project at Kolkata Leather Complex (as per SEAC office record) is as
follows:
Fresh Water requirement for Phoenix Software Ltd 0.402 MLD
Fresh water requirement for Dhunseri Petrochem & Tea Ltd 0.254 MLD
Fresh water requirement for CTS Ltd 0.664 MLD
Total 1.220 MLD
The State Level Expert Appraisal Committee (SEAC), West Bengal considered the case in the 71
st
SEAC meeting held on 24.09.2012 & 73
rd
meeting held on 30.11.2012. SEAC requested the
Director, SWID, GoWB to provide the opinion on the status of water availability based on latest water
census in the concerned area. However, no such response received till date.
In the meantime EIM Cell of WBPCB, Secretariat of SEAC collected information from the SWID,
GoWB regarding detailed list of permit and registration certificates issued in favour of M/s. M.L
Dalmiya & Co. at KITP, Bantala, Kolkata Leather Complex for abstraction of groundwater. As per the
said list provided by the Supdt. Geologist, South 24 Pgns., permission/registration has been granted
for abstraction of groundwater - 34920 KLD.
The Director, SWID is once again requested to kindly provide the opinion on the status of water
availability based on latest water census report in the concerned area at the earliest.
3. (a) Proposed IT Park by M/s. Phoenix Software Ltd. at Jl. No. - 35, Mouza Gangapur,
Kolkata Information Technology Park (KITP), Bantala, PS Kolkata Leather Complex, Dist.
24 Parganas (South), West Bengal.
During the 69
th
meeting held on 25.07.2012 and the SEAC had directed the PP to submit the source
and availability of fresh water to be supplied by M/s M L Dalmiya and Co. In the subsequent response
of the unit submitted on 10.09.2012 the project proponent has mentioned that M/s. M. L. Dalmiya &
Co. Ltd. has already given permission vide letter under Ref. No. L/40/IT-Park/67 dated 03.08.2011.
During the 73
rd
meeting held on 30.11.2012, the reply of the unit dated 17.10.2012 was considered
and noted that no specific information regarding source and availability of fresh water as sought by the
committee has been provided. The case is kept pending due to non-availability of opinion of SWID.

3. (b) Proposed IT Park by M/s. Dhunseri Petrochem & Tea Ltd. at Jl. No. - 35, Mouza
Gangapur, Kolkata Information Technology Park (KITP), Bantala, PS Kolkata Leather
Complex, Dist. 24 Parganas (South).
SEAC has recommended EC in the 67

meeting held on 21.05.2012 for M/s. Dhunseri Petrochem &
Tea Ltd. SEIAA has sent a letter to SEAC on 16.08.2012 requesting to study the water balance in CLC
area.
The above matter was discussed in the 71

meeting held on 24.09.2012, 73

30.11.2012 & 75

meeting held on 30.01.2013 and SEAC had opined that once again Director,
SWID, GoWB may be requested to provide the opinion on the status of water availability based on
latest water census in the concerned area. However, no such response received till date. The case is
kept pending due to non-availability of opinion of SWID.
B. Reconsideration Proposals :-
Six reconsideration proposals were placed in the meeting.
Industry Sector :-
1. Proposed expansion project for enhancement of production of Unsaturated Polyester Resins by
M/s. Strongbonds Polyseal Pvt. Ltd. at Plot No. 26/C, 26/D/1 & 26/D/2, Kalyani Industrial
Estate Phase I, Block D, Dist. Nadia, Pin 741235, West Bengal.
Activity:
This is an expansion proposal for enhancement of production capacity of Unsaturated Polyester Resins
(UPR) by 690 TPA. The proposed plant will be located adjacent to the existing plant at Kalyani
Industrial Estate.
Chronology of the event:
The case was recommended by SEAC in the 60
th
SEAC meeting held on 24.10.2011 with condition
that the effluent as well as kettle wash water should be suitably treated in ETP to meet environmental
standards. The effluent should be reused within the plant as much as possible and only the excess flow
is to be discharged after compliance with the environmental standards. Effluent treatment plant
should be monitored on a regular basis.
The Member Secretary, SEIAA noted that there is a lack of clarity regarding effluent treatment unit
(both existing as well as proposed unit) and returned the case to SEAC with a request to get the
clarification on effluent treatment from the project proponent.
The case was placed in the 63
rd
SEAC meeting held on 31.01.2012 and the committee has sought
observation from WBPCB regarding the present status of effluent treatment plant.
The unit was inspected by Board officials on 02.04.2012 and it was observed that the process does not
require any water. Water is by-product generated due to polymerization process which is collected in a
container for pH correction by caustic soda and then evaporated in an evaporator and released through
a stack of ht. 24 m from ground level.

The unit has submitted a letter dated 03.05.2012 mentioning that earlier the unit had biological
effluent treatment plant for treatment of water generated from the process. However, the unit has
failed to maintain the anaerobic bacteria, in most cases it died and instead controlling the oxygen
deficiencies it was actually increasing the BOD and COD level. Therefore, the unit has installed
evaporator by discarding the ETP.
The unit has also proposed to install higher capacity evaporator for the expansion project and
mentioned that as the polymerization reaction is hydrophobic in nature, no water is used to clean the
reactor. Styrene Monomer which is used as raw material and is also a solvent for the product is used
for cleaning.
The solid waste remaining after evaporation is sent to WBWML, Haldia and unit has obtained
hazardous waste authorization from WBPCB for existing plant.
The SEAC has reviewed the letter of the pp submitted on 07.05.2012 in the 67
th
meeting held on
25.04.2012 and made the following recommendations. Subsequent response dated 28.02.2013 from
the unit is given below :-

1. A detailed proposal for Effluent Treatment
Plant.
1. The project proponent mentioned that the
wastewater from the reaction chamber is
slightly acidic in nature. Such acidic
effluent is initially neutralized using caustic.
Neutralized effluent is then put into an
evaporator (functioning at more than
100C). Water vapour from the evaporator
is released to the atmosphere through a
piping system (comprising of SS and FRP
pipes). Wastewater treatment flow sheet
submitted in this regard.
2. Analysis report of stack gas emitted from
the evaporator especially with respect to
composition of volatile substances for the
existing plant.
2. The unit has submitted Chromatogram Plot
of organic compounds present in flue gas.
The unit has also submitted list of organic
compounds identified by GC/MS analysis.
The proponent mentioned that Sludge
generated in the evaporator is hazardous
in nature. Such sludge is being handed
over to West Bengal Waste
Management Ltd. for ultimate disposal
which is accomplished by incineration
at WBWMLs own facility. The unit has
also submitted application for renewal
of Hazardous Waste Authorization to
WBPCB, Authorization was valid upto
30.04.2012.

The case was put up for consideration in the 77
th
SEAC meeting held on 26.03.2013. The SEAC had
reviewed the letter submitted by the project proponent and recommended that a detailed proposal for
effluent treatment plant to be submitted.
It has been decided that the case would be further considered only after submission of the necessary
clarification.
2. Proposed expansion of Cement Grinding Unit by M/s. Shri Shankar Suwan Estate Pvt. Ltd. at
Jl. No. 36, Mouza Balanpur, PS Jamuria, PO Ikra, Jamuria Municipality, Pin 713362,
Dist Burdwan, West Bengal.
Activity:
This is a proposal for expansion of an existing Cement Grinding unit through installation of 2x50 TPD
grinding mill for additional production of Portland Slag Cement (30000 TPA). The existing plant has
2x50 TPD cement grinding mill(capacity-30000 TPA) with coal fired slag drier (50 TPD). It is noted
that clinker will not be manufactured at the site. The manufacturing process will involve grinding of
Cement Clinker with Slag and Gypsum.
Salient features of the proposed project are
i. Location of the Site Jl. No. 36, Mouza Balanpur, PS Jamuria, PO Ikra, Jamuria
Municipality, Pin 713362, Dist Burdwan, West Bengal.
ii. Land Area 3.282 acres, within the existing plant. Green belt- 1.09 acres
iii. Raw Materials (total requirement after expansion) Clinker (42 TPD), Slag (60.9 TPD),
Gypsum (2.1 TPD), Coal (0.5 TPD).
iv. Additional Production Capacity Portland Slag Cement (30000 TPA).
v. Emission Sources - Raw Material Handling Section, Transfer Points, Cement Grinding Mill,
Cement Silo, Packing Machine etc.
vi. Air Pollution Control System Bag Filters with stack height of 30m from GL shall be
provided at Raw Material Handling Section, Ball Mill, Silo and Packing Section.
vii. Additional Water Requirement 2 KLD, (ground water), Existing 2 KLD
viii. Wastewater process: nil, domestic effluent to be discharged through septic tank to soak pit.
ix. Solid Waste cement dust will be recycled back to the process, ash from drier will be used
for landfilling or sold to flyash brick manufacturers.
x. Additional Power Requirement 200 KVA, DPSC supply.
Chronology of the event :
During presentation in the 61
st
SEAC meeting held on 29.11.2011, the State Level Expert Appraisal
Committee (SEAC), West Bengal, had noted that
(a) a pond is present in the factory premises.
(b) the project proponent has verbally agreed to comply with the stringent standard for particulate
emission of 50 mg/Nm
3
in the existing plant.
(c) the proponent has not yet obtained permission for groundwater abstraction in the existing
plant.
Further the SEAC made the following recommendations in the 61

Recommendations / Directions of the
Committee, issued on 19.12.2011
Response of the Proponent submitted on
24.01.2012
1. The project proponent should obtain the
permission for groundwater abstraction
for the existing plant at first.
1. The project proponent has mentioned that
water is being used for domestic purposes
only and no process water is required for the
operation of the Cement Grinding Unit. As per
notification issued by Water Resources
Investigation & Development Department,
domestic users with sump or overhead tank
upto 10000 ltrs. are exempted from obtaining
permission. However, for permission towards
abstraction of groundwater which will be used
for domestic purposes only, application has
already been submitted to State Water
Investigation Dept.
2. The proponent should retain the existing
pond and utilise the same for Rainwater
Harvesting. The proponent should submit
authenticated document regarding size of
pond. The project proponent should
overlay the site plan on the Mouza map
for showing the location of the existing
pond.
2. The project proponent has submitted that the
area marked as pukur and mentioned in the
Mutation Certificate is outside the proposed
project area of M/s. Sri Shankar Suwan Estate
Pvt. Ltd. and M/s. Satwik Metals Pvt. Ltd. and
is being kept as an open area without any
construction or development. The area will be
utilised for rainwater harvesting.
3. Scaled plant layout showing existing and
proposed facilities, Greenbelt area,
Rainwater Harvesting storage area,
internal roads, storage sheds etc. on a
suitable grid should be submitted.
3. The proponent has submitted the copy of
layout.
4. The plantation area should be 33% of the
land area.
4. The proponent has mentioned that the total
land area considered for the project is 3.282
acres, out of which 1.09 acres (33% of total
land) has been allocated for greenbelt
development. Plantation is being developed as
a continuous process along with periphery of
the plant in line with the area shown in the
plant layout.
The matter was placed before the committee in the 63
rd
SEAC meeting on 31.01.2012 and the
committee has noted that this is a proposal for expansion of existing Red category unit located under
Jamuria Municipality, Dist Burdwan. As per the siting policy of WBPCB, Special Red & Red
category industries are not permitted to set up within the municipal areas of Burdwan District except
Jamuria Industrial Area. Therefore, before consideration of this proposal, the committee requested the
project proponent to obtain in principle approval from the West Bengal Pollution Control Board for
the proposed expansion of the existing unit. Furthermore, the committee has not yet received
permission for drawl of groundwater from the concerned authority. The committee has requested to
submit the necessary clarification in this regard.

The unit submitted their reply through letters dated 09.03.2012 and 05.04.2012 mentioning that
(a) There is no proposal for additional slag drier which has also been mentioned from the very
initial stage of the application and every step followed for obtaining EC. The also mentioned
that since the stack emissions will be complied with of 50 mg/Nm
3
in comparison to the
earlier stack emissions permissible limit of 150 mg/Nm
3
, there will be no increase in pollution
load due to this expansion project.
(b) The proponent informed that in order to increase the efficiency of the existing bag filter
system attached to 2x50 TPD Ball Mill, the bag filter unit (consisting of 90 bags) has already
been revamped including total cleaning of the system and replacement of bags and solenoid
valves to meet the present stack emissions permissible limit of 50 mg/Nm
3
. The also
mentioned that stack emission monitoring was conducted by Asansol Sub Regional Office,

. The PP mentioned that since significant quantity of slag drying is being
done by sun drying, at present the existing slag dryer is operating only for 6 to 7 hours and
after the expansion project is completed, it will be operated for 10 to 12 hours considering the
above mentioned expansion. Hence, no additional slag dryer is required and accordingly
proposal was not made for any additional slag dryer from the very initial stage of the
application and every step followed for obtained EC.
(c) The project proponent also submitted that the water is being used for domestic purposes only
(total requirement is 2 KLD for existing project and 2 KLD for the expansion project) and no
process water is required for the operation of the Cement Grinding Unit. In this connection
they have already submitted the Notification issued by Water Resources Investigation and
Development Department, Government of West Bengal where it has been mentioned that no
permission is required for Domestic users with sump or overhead tank upto 10000 litres.
The WBPCB also opined that the proposal for expansion for setting up of 2x50 TPD Portland slag
cement may be considered subject to condition that the unit should not be allowed to put up any
additional slag drier. The capacity of slag drier will be limited to the existing approved capacity i.e.
50 TPD and coal consumption for the drier 15 TPM or 500 Kg/day maximum. The emission load
would be restricted by minimizing PM level maximum 50mg/Nm3 both for existing and proposed
expanded capacity.
The case was considered in the 72

SEAC meeting held on 18.10.2012 and the committee has
requested the project proponent to submit the permission for abstraction of ground water for the
project.

of fly ash based bricks in the project.
2. The proponent has mentioned that there is no
thermal power plant within 100 km radius
from the project site. It is very difficult to get
fly ash bricks in this zone. 25% of bricks that
will be used in the proposed project will be fly
ash based bricks. If fly ash bricks are readily
available then they may use fly as bricks as
much as possible.
3. Rainwater harvesting and tree plantation
proposal to be modified.
3. The pp has submitted the revised RWH and
tree plantation proposal. They mentioned that
average capacity of recharging through 3 nos.
of tubewells is 235.71 cum/day. Depth of
recharge well is 59 mtr. They are proposing 3

the case of Item 8 of the schedule, considering its unique project cycle, the EAC or SEAC concerned
shall appraise projects or activities on the basis of FORM-I, FORM-IA, conceptual plan and EIA
report [required only for projects listed under 8(b) and make recommendations of the project] and in
view of the above and also the fact that the project is coming up in an environmentally sensitive area,
SEIAA feels that EIA should be carried out for this project.
The SEAC has scrutinized the application in the 65

SEAC meeting held on 20.03.2012 and noted
that this project has come under 8(b) of item 8 of schedule of EIA notification, 2006 and its
amendment thereafter and recommended that EIA study to be undertaken for the proposed project.
The SEAC, therefore, requested the proponent to submit the proposed Terms of Reference for EIA
studies of the project. Further, the committee has recommended that since the project is proposed to be
located in the fringes of the East Kolkata Wetlands and the project proponent will be extracting
ground water for the above mentioned project, the expert comments / opinion of East Kolkata
Wetlands Management Authority on the above to be obtained.
Accordingly letter was issued to Chief Technical Officer, East Kolkata Wetlands Management
Authority vide Memo No. 186-2N-82/2008(E) dated 09.04.2012 seeking expert opinion. Chief
Technical Officer, East Kolkata Wetlands Management Authority has sent his observations vide letter
dated 03.07.2012, No. CTO/EN/2357/12 as follows: -
1. The distance between the project area and EKW boundary to be accurately mentioned.
2. Detailed impact of construction of such tall building on the migration of fauna may be carried
out by an institute of repute like Wildlife Institute of India (WII), Bombay Natural History
Society (BNHS) or community based organisations like Prakiti Sansad.
3. Abstraction of ground water may not be allowed, it will be affected the hydrology of EKW.
4. During construction work no slurry may be disposed off in wetlands. Hot mix plant or any
such operation may not be allowed to the site. No waste should be disposed off in the EKW
area during construction or in post construction.
5. There is a mismatch in the total project area (265237.98 sqm) and built up area (678317 sqm)
The case was considered in the 66
th
SEAC meeting held on 25.04.2012. The committee has
recommended that in view of the Office Memorandum (Guidelines for high rise buildings) issued by
MoEF vide no. 21-270/2008-IA-III dated 07.02.2012, the proponent should submit the height of the
proposed building and the width of the road (right of way) on which the said building is to be situated
and the distance of the local fire station from the building.
