NOTICE UNDER UTTARPRADESH URBAN

BUILDINGS (REGULATION O LETTING RENT AND EVICTIONS)

SUBJECT:- Regarding Unauthorized , TRESPASSER doing business at Shop No. 5, 9/2
Bahar SAHARA ESTATE, Jankipuram Lucknow.

Dear Tennat,
Please refer our agreement of Shop No. 5 with Shri AMIT VERMA
retrospective from 1

MAY 2013. As mandated by The RENT Agreement retrospectively
dated 1

May 2013 para 2, you will have to pay the rent of shop No. 5 on or before the date
mentioned in the rent agreement i.e. within first 3 days of every month, but you every time
fail to pay rent in stipulated period which most fequent cause for tenants to lose their tenancy
and for feiture of two month security deposit and have no right to claim any amount legally
according to provisions of Uttar Pradesh urban buildings ( Regulation of letting, Rent and
Eviction) act 1972.
Also we have been informed by neighbouring tenants and residents of Sahara Estate
about you in following.
Manner:-
1. That the said shop No. 5 was agreed on rent to Mr. Amit Verma , but Mr. Usman is doing
business without proper and legal agreement also it was told by Mr. Amit Verma to do
business of mobile but spicy items are being prepared for food use without valid Licence
from concerned U.P. Govt. Departments by Mr. Usman Shopkeeper.

2. That on preparation of spicy food items, Gases most injurious to public health and
producing hardles and problems for breathing to neighbouring Tenants and theirs
customers and students reading to coaching. Hence such type of business of shopkeeper
of shop No.5 is most hazardous to public health which is to be prevented with immediate
effect by us.

3. That Shop keeper of Shop No. 5 has used Electricity from our premises for about ten
months utilizing BULBS, FAN, FREEZER and Electronic Chhoolha which concludes one
thousand and Five hundred per month thus 15,000.00 (Fifteen Thousand) total in which
only receipt of three thousand of bill has been provided to us. Thus 12,000.00(Twelve
Thousand) of electric bill is due for recovery.

4. That Shop Keerper of Shop No.5 has also given electricity to Shop No. 4 and 6 but has not
recovered dues of electric used from then since theirs date of agreement i.e. from may
2012 and june 2013 respectively hence he is require to recover electric rent from
them@Rs. Five Hundred per month from Shop No.4 and 6.

5. That Shop Keeper of Shop No. 5 has mishandled the shutter of Shop which is broken
hence he is duty bound to get repaired the same with immediate effect.

6. That Para of agreement tells that if Shop Keeper of Shop No.5 fails to pay the rent at
stipulated period as per para No. 2 of agreement, the rent agreement will terminate, cancell
automatically and the said Shop Keeper have no legal right/claim.

Hence Shop Keeper of Shop No. 5 Mohd. Usman Khan is noticed to inform him that Tenancy
at the rented premises as owned by us will cease with immediate effect and Rent agreement
with Shri Amit Verma is terminated in accordance with the provisions of Uttar Pradesh
Urban Buildings ( Regulation of Letting, Rent and Eviction) Act 1972 and other relevant
rules and laws. The said Shop No.5 was rented for period of eleven months i.e. from
01/05/2013 and thus the tenancy period has come to an end suitable oral notices was given to
Shop Keeper of Shop No.5 on several earlier occasions for not depositing the rent of Shop
within three days of every month. Thus the said Shop Keeper has over stayed the originally
agreed term of rent which expired on 1

of march 2014 having asked for some grace period.
Please note we require the said Shop for our own personal need and use and we will
not renew tenancy further more. Hence you are required to vacate the said Shop No.5
immediately and remove all your possessions from the premises at once. All imfrastructure of
Shop No.5 to be returned upon and clear all the dues of electricity and Security deposit of
Two months rent i.e. Rs. Ten Thousand why not to be forfeited in our favour by not
depositing the rent of said Shop in time i.e. whithin first three days of every month. Since
Shop Keeper has not paid the rent timely penalty of Rs. 1000.00 (One Thouand) per day for
delay deposit rent will also be fined. Hence you will have to quit the premises and Shop with
immediate effect and deliver up poseession of the same to the Land Lord failure to vacate the
premises by immediate effect will be considered as trespassing to our property and the said
Shop Keeper of Shop No.5 will be imposed a compensation of Rs. One Thousand per day.
We reserve the right to initiate appropriae legal proceedings in this regard Legal proceeding
for an unlawful detainer and trespasser will be instituted.
