Returns and Payments on Income Taxation
Venue
1. Taxpayers legal residence;
2. Principal place of business in the Philippines;
3. If there be no legal residence or place of business in the
Philippines, with the Office of the Commissioner.
XPN:
1. when the donors tax has been paid on such property or;
2. when the transfer of such property is exempt from donors
tax
Estimated Tax
-amount which the individual declared as income tax in
his final adjusted and annual income tax return for the
preceding year minus the sum of the credits allowed under
this title against the said tax.
Place of filing
The income tax due on the corporate quarterly returns and the final
adjustment income tax returns computed in accordance with
Sections 75 and 76 shall be paid at the time the declaration or
return is filed in a manner prescribed by the Commissioner.
The return for final withholding tax shall be filed and the payment
made within twenty-five (25) days from the close of each calendar
quarter, while the return for creditable withholding taxes shall be
filed and the payment made not later than the last day of the month
following the close of the quarter during which withholding was
made: Provided, That the Commissioner, with the approval of the
Secretary of Finance, may require these withholding agents to pay
or deposit the taxes deducted or withheld at more frequent
intervals when necessary to protect the interest of the government.
All taxes withheld pursuant to the provisions of this Code and its
implementing rules and regulations are hereby considered trust
funds and shall be maintained in a separate account and not
commingled with any other funds of the withholding agent.
The term 'wages' means all remuneration (other than fees paid to a
public official) for services performed by an employee for his
employer, including the cash value of all remuneration paid in any
medium other than cash, except that such term shall not include
remuneration paid:
Requirement of Withholding
The return shall be filed and the payment made within twenty-five
(25) days from the close of each calendar quarter: Provided,
however, That the Commissioner may, with the approval of the
Secretary of Finance, require the employers to pay or deposit the
taxes deducted and withheld at more frequent intervals, in cases
where such requirement is deemed necessary to protect the
interest of the Government.
Year-End Adjustment
On or before the end of the calendar year but prior to the payment
of the compensation for the last payroll period, the employer shall
determine the tax due from each employee on taxable
compensation income for the entire taxable year in accordance
with Section 24(A). The difference between the tax due from the
employee for the entire year and the sum of taxes withheld from
January to November shall either be withheld from his salary in
December of the current calendar year or refunded to the employee
not later than January 25 of the succeeding year.
Fiduciary Returns
Any person who attempts to make it appear for any reason that he
or another has in fact filed a return or statement, or actually files a
return or statement and subsequently withdraws the same return
or statement after securing the official receiving seal or stamp of
receipt of internal revenue office wherein the same was actually
filed shall, upon conviction therefor, be punished by a fine of not
less than Ten thousand pesos (P10,000) but not more than Twenty
thousand pesos (P20,000) and suffer imprisonment of not less than
one (1) year but not more than three (3) years.
