Pursuant to Federal Rule of Appellate Procedure 42, appellants Greg Zoeller,
in his official capacity as Indiana Attorney General, et al., and appellees Marilyn Rae
Baskin, et al., through their respective attorneys, respectfully ask this Court to
dismiss Case No. 14-2037, an appeal from the Southern District of Indianas entry of
a preliminary injunction, as moot. On June 25, 2014after this appeal was
docketedthe district court in the above-captioned matter ruled on the merits,
granting summary judgment to Plaintiffs-Appellees and entering a permanent
injunction that replaced the preliminary injunction. As a result, the appeal relating
to the preliminary injunction is moot.
In support of their motion, the Parties state as follows:
1. On May 8, 2014, the United States District Court for the Southern
District of Indiana granted a preliminary injunction requiring the State of Indiana to
recognize the out-of-state marriage of Plaintiffs Amy Sandler and Nikole Quasney.
The Defendants-Appellants filed their Notice of Appeal the same day. Shortly
thereafter, this Court docketed the interlocutory appeal as Case No. 14-2037
(Preliminary Injunction Appeal) and issued a briefing schedule.
2. On June 25, 2014, the District Court ruled on the merits of the case,
granting Plaintiffs-Appellees Motion for Summary Judgment and entering a
permanent injunction that, in addition to other relief, permanently enjoined
Defendants-Appellants from enforcing Indiana Code Section 31-11-1-1 and other
Indiana laws preventing the celebration or recognition of same-sex marriages.
Defendants-Appellants filed their Notice of Appeal for the District Courts merits

decision the same day and this Court docketed the merits appeal as Case No. 14-2386
(Merits Appeal).
3. An appeal from the grant of a preliminary injunction becomes moot
when the trial court enters a permanent injunction because the former merges into
the latter. See Grupo Mexicano de Desarrollo, S. A. V. Alliance Bond Fund, Inc., 527
U.S. 263 (1999);Smith v. Ill. Bell Telephone Co., 270 U.S. 587, 588-89 (1926) (holding
that order granting preliminary injunction was not appealable because permanent
injunction was subsequently granted and thus the interlocutory injunction had
become merged in the final decree).
4. Because the Preliminary Injunction Appeal is moot, and because the
underlying merits of this case will be determined in the related Merits Appeal, the
Parties respectfully request that this Court dismiss the Preliminary Injunction
Appeal, Case No. 14-2037.
