No BILL NO. 1 PRELIMINARIES PRINCIPAL BUILDING AGREEMENT The agreement shall be the JBCC Series 2000 Principal Building Agreement prepared by the Joint Building Contract Committee, 4th Edition Code 2101 March 2004 (including State provisions). PRELIMINARIES The preliminaries shall be the JBCC Series 2000 Preliminaries prepared by the Joint Building Contracts Committee, 3rd Edition Code 2103 January 2003 and shall be deemed to be incorporated herein. FULL INTENT AND MEANING OF CLAUSES Tenderers shall be deemed to have referred to the aforementioned documents for the full intent and meaning of each clause. These clauses are hereinafter referred to by the heading and clause number only. Where standard clauses or alternatives are not entirely applicable to this contract documents, such modifications, corrections or supplements as will apply are given under each relevant clause heading. Where any item is not relevant to this specific contract such item is marked N/A (signifying "not applicable"). PRICING OF CLAUSES Tenderers are referred to the abovementioned documents for the full intent and meaning of each clause thereof (hereinafter referred to by heading and clause number only). Tenderers shall allow apposite each clause for any cost involved with complying with such clause. Any clauses left unpriced shall be deemed to be covered by rates and prices elsewhere incorporated throughout these bills of quantities. The principal agent shall, on behalf of the employer, issue such health and safety specification and the contractor shall price opposite this item for compliance with the act and the regulations and the provisions of the forementioned health and safety specification, provided such provisions are reasonable in terms of the act and the regulations. The Contractor's compliance with Ocupational Health and Safety Act shall be the principal agent's responsibility. The contractor shall, at his own expense, prepare and submit two prints of shop drawings of all fabricated work, working or setting out drawings, shop details and schedules to the architect for approval by the architect, the relative consulting engineer and/or the principal agent as is appropriate and such work shall not be performed by the contractor until such approval has been given. The contractor shall present a complete schedule showing the sequence of submission of shop drawings, including submission dates, for all trades and the scheduled dates for approval of all drawings. This schedule shall take into account that the architect and the relative consulting engineer and the principal agent each reserve a two weeks check period for each discipline from the date of the receipt of all shop drawings and/or catalogue data. All submissions shall be on dates as indicated in the above schedule and sufficiently in advance to permit the contractor to meet fabrication deadlines; no claim for extensions to the contract period will be granted to the contractor by reason of his failure in this respect . The contractor shall check all submissions for conformity with the contract drawings and specifications and correct any errors, omissions or deviations before their transmission to the principal agent. All submissions shall bear the contractor's dated stamp of approval as evidence that they have been so checked and corrected by the contractor. Any drawings, schedule or catalogue submitted without this stamp will not be considered by the principal agent and will be returned. When the principal agent advises the contractor that shop drawings have been approved, he shall immediately submit to the architect the original transparencies of such drawings so that the architect's stamp of approval may be appended thereto. Thereafter the contractor shall furnish to the architect four prints of the approved shop drawings, setting out drawings and schedules. The contractor shall also furnish to the works as many prints of the approved shop drawings and schedules as may be required. No work shall be performed from any shop drawings and/or catalogues not stamped with the architect's approval. The contractor shall be responsible for ensuring that all dimensions conform to the dimensions of built work. The architect's approval of any document or drawing shall not in any way vary his contractual or delictual obligations and liabilities to the employer or any other party, nor does it vary the contractual or delictual obligations and liabilities of the party submitting such document or drawing for approval. If the submissions differ from the requirements of the contract, the contractor shall make specific mention of each difference in his letter of transmission with a request for substitution, together with his reasons for same, in order that, if acceptable, suitable action may be taken by the principal agent. Otherwise the contractor will not be relieved of the responsibility for executing the work in accordance with the requirements of the contract documents. Should any such correction be considered to constitute a change of scope of work, the contractor shall notify the principal agent in writing within not more than seven calendar days of such change and shall not proceed with the fabrication until so authorized by the principal agent. Claims for change of scope made after performance of the work constituting the claimed change of scope will not be considered. Unless otherwise agreed with the principal agent, shop drawings shall be prepared to show all details of installation, including reticulation, fixing, etc of all components and assemblies, or if the contractor desires to deviate from the design and these drawings shall be all in accordance with the above procedures and at the contractor's expense. Item As built drawings A The position of construction breaks and the extent of individual concrete pours are to be recorded by the contractor on the structural engineer's drawings and are to be submitted to the principal agent and the structural engineer for their records. Item Plant record D At the end of each week the contractor shall provide the principal agent with a written record, in schedule form, reflecting the number, type and capacity of all plant, excluding hand tools, currently used on the works. Item FINANCIAL ASPECTS Carried to Collection R Bill No. 1 Preliminaries Eldoraigne Ext 35 Erf 4145 20 Lousi Pasteur Investments Interim payments for unfixed materials A Before including the value of any unfixed materials and goods in his valuation for each interim certificate the principal agent will require a certificate of ownership and a cession of rights in favour of the employer from the contractor and/or each and every subcontractor. Item Overtime B The additional costs of overtime work shall be for the employer's account only when prior written agreement thereto is given by the principal agent. Item MATERIALS AND WORKMANSHIP Testing of windows to ensure watertightness C As the windows are fixed they shall be glazed and prepared so that each window can be tested for watertightness with water sprayed on by means of a 20mm hosepipe using adequate pressure. If the pressure proves to be inadequate, in the opinion of the principal agent, then the pressure in the hosepipe shall be boosted by means of compressed air or other approved means. Each window section shall be tested under the supervision of the principal agent or clerk of works and approved before final acceptance of the fenestration. Item Testing of flat roof waterproofing to ensure watertightness D As waterproofing is completed, areas shall be prepared with small sand dykes around them of a size and enclosing an area approved by the principal agent, flooded with water and kept "ponded" for at least 7 days as a test to ensure the watertightness of the waterproofing concerned before any further construction work is carried out above the waterproofing . Item Carried to Collection R Bill No. 1 Preliminaries Eldoraigne Ext 35 Erf 4145 21 Lousi Pasteur Investments Warranty for design and materials A The contractor warrants and undertakes in favour of the employer that: Insofar as the works or any part of the works has been or will be designed by him, he will exercise reasonable, due and proper skill and care in such design. Insofar as any part of the materials and goods for the works has been or will be selected by him, he will exercise due and proper skill and care in such selection of materials and goods. He is suitably qualified and competent to carry out such design work and selection of materials and goods. He shall comply with and satisfy any performance specification or requirements insofar as such performance specification or requirements are included or referred to in the sub-contract. Item Guarantees The contractor shall obtain written guarantees where called for, addressed to the employer, from the firms supplying the materials or doing the work and deliver such guarantees to the principal agent. The guarantees shall state that workmanship, materials and installation are guaranteed for a specified period reckoned from the date of practical completion of the works and that any defects in the workmanship, materials and installation that may arise during that period shall be made good at the expense of the firm doing the work upon written notice from the principal agent or the employer to do so. Item Notice before covering up B The contractor shall give notice to the principal agent of his intention to cover up any work or materials with earth or other material in order that the principal agent may inspect same before they are so covered. In default of such notice being received such work or materials shall be uncovered and later made good at the contractor's expense.
