PRELIMINARIES
PRINCIPAL BUILDING AGREEMENT
The agreement shall be the JBCC Series 2000 Principal
Building Agreement prepared by the Joint Building Contract
Committee, 4th Edition Code 2101 March 2004 (including
State provisions).
PRELIMINARIES
The preliminaries shall be the JBCC Series 2000
Preliminaries prepared by the Joint Building Contracts
Committee, 3rd Edition Code 2103 January 2003 and shall be
deemed to be incorporated herein.
FULL INTENT AND MEANING OF CLAUSES
Tenderers shall be deemed to have referred to the
aforementioned documents for the full intent and meaning of
each clause. These clauses are hereinafter referred to by the
heading and clause number only.
Where standard clauses or alternatives are not entirely
applicable to this contract documents, such modifications,
corrections or supplements as will apply are given under each
relevant clause heading.
Where any item is not relevant to this specific contract such
item is marked N/A (signifying "not applicable").
PRICING OF CLAUSES
Tenderers are referred to the abovementioned documents for
the full intent and meaning of each clause thereof (hereinafter
referred to by heading and clause number only). Tenderers
shall allow apposite each clause for any cost involved with
complying with such clause. Any clauses left unpriced shall be
deemed to be covered by rates and prices elsewhere
incorporated throughout these bills of quantities.

PAYMENT CATEGORIES
Should 'Alternative A', as set out within clause 10.3 hereinafter,
be used for the adjustment of preliminaries then each item
priced is to be allocated to one or more categories by the
insertion of the letter "F", "V" or "T", as the case may be,
against the price in the "Quantity" column. These letters shall
indicate the relevant categories as follows :
"F" - Denotes a fixed amount which shall not be varied
"V" - Denotes an amount which shall be varied in
proportion to the contract value
"T" - Denotes an amount which shall be varied in
proportion to time

The contractor will submit shop drawings to the principal
agent for approval within two weeks tender closing. The
contractor shall commence manufacturing only after written
approval of shop drawings from the principal agent.
All designs as listed above are to be designed as to suit a
commercial development.

Without limiting the generality of the provisions of clause 7.0 of
the agreement, the contractors attention is drawn to the
provisions of the Construction Regulations, 2003 issued in
terms of the Occupational Health and Safety Act, 1993 in which
it is specifically stated that the employer shall prepare a
documented health and safety specification for the works and
that the employer shall ensure that the contractor has made
provision for the cost of health and safety measures during the
execution of the works. The principal agent shall, on behalf of
the employer, issue such health and safety specification and
the contractor shall price opposite this item for compliance
with the act and the regulations and the provisions of the
forementioned health and safety specification, provided such
provisions are reasonable in terms of the act and the
regulations.
The Contractor's compliance with Ocupational Health and
Safety Act shall be the principal agent's responsibility.

The contractor shall attend to defects during the defects
liability period on a progressive basis, to the satisfaction of the
principal agent, and will not be permitted to wait until the end
of the defects liability period or until the amount of defects
accumulates in order to attend to a comprehensive list of
defects.

Extension of time shall only be considered when work is on the
critical path of the contract programme, which the contractor
shall clearly identify, for the works affected.
Any delays to minor portions of the works will only attract
extensions of time to those areas and not the entire project.

Notwithstanding this or any other clause, materials and goods
stored off site shall not be included in the amount authorised
for payment.
Clause 31.9 is amended by the deletion of "within seven (7)
calender days of the date of issue of the payment certificate,"
in the first sentence and replacing with "within ten (10) calender
days of the date of issue of the VAT invoice,".

completion." at the end of the first sentence and replacing with
"date of final completion".

Clause 32.6 is amended by the omission in the first sentence of
"forty (40) working days" and replacing with "ten (10) working
days" and the replacement of the second sentence with "The
contractor shall submit details of the expense or loss within
twenty (20) working days from date of receipt of the
notification by the principal agent".
It is recorded that only the quantity surveyor is empowered to
rule whether any instruction issued constitutes an additional
cost and to resolve cost aspects of any nature pertaining to this
contract.

reasonable allowance for waste,"
The rates in these bills of quantities as priced by the
contractor shall be fixed. The contractor is to make due
allowance for any price increases in his tender and in the rates
in the bills of quantities up to and including final completion.

SECTION C : SPECIFIC PRELIMINARIES
SUPPLEMENTARY DOCUMENTATION
Shop drawings
The term "shop drawings" shall mean drawings, diagrams,
illustrations, schedules, performance charts, brochures,
operating manuals and other data which are prepared by the
contractor or any subcontractor, manufacturer, supplier or
distributor and which illustrate some portion of the works.
The contractor shall, at his own expense, prepare and submit
two prints of shop drawings of all fabricated work, working or
setting out drawings, shop details and schedules to the
architect for approval by the architect, the relative consulting
engineer and/or the principal agent as is appropriate and such
work shall not be performed by the contractor until such
approval has been given.
The contractor shall present a complete schedule showing the
sequence of submission of shop drawings, including
submission dates, for all trades and the scheduled dates for
approval of all drawings. This schedule shall take into account
that the architect and the relative consulting engineer and the
principal agent each reserve a two weeks check period for
each discipline from the date of the receipt of all shop drawings
and/or catalogue data.
All submissions shall be on dates as indicated in the above
schedule and sufficiently in advance to permit
the contractor to meet fabrication deadlines; no claim for
extensions to the contract period will be
granted to the contractor by reason of his failure in this respect
.

The contractor shall submit four copies of catalogues and data
for approval. The contractor shall check all submissions for
conformity with the contract drawings and specifications and
correct any errors, omissions or deviations before their
transmission to the principal agent.
All submissions shall bear the contractor's dated stamp of
approval as evidence that they have been so checked and
corrected by the contractor. Any drawings, schedule or
catalogue submitted without this stamp will not be considered
by the principal agent and will be returned.
When the principal agent advises the contractor that shop
drawings have been approved, he shall immediately submit to
the architect the original transparencies of such drawings so
that the architect's stamp of approval may be appended
thereto. Thereafter the contractor shall furnish to the architect
four prints of the approved shop drawings, setting out drawings
and schedules. The contractor shall also furnish to the works
as many prints of the approved shop drawings and schedules
as may be required. No work shall be performed from any
shop drawings and/or catalogues not stamped with the
architect's approval.
The contractor shall be responsible for ensuring that all
dimensions conform to the dimensions of built work.
The architect's approval of any document or drawing shall not in
any way vary his contractual or delictual obligations and
liabilities to the employer or any other party, nor does it vary
the contractual or delictual obligations and liabilities of the party
submitting such document or drawing for approval.
If the submissions differ from the requirements of the contract,
the contractor shall make specific mention of each difference
in his letter of transmission with a request for substitution,
together with his reasons for same, in order that, if acceptable,
suitable action may be taken by the principal agent. Otherwise
the contractor will not be relieved of the responsibility for
executing the work in accordance with the requirements of the
contract documents.

Corrections of shop drawings by the principal agent shall not
change the scope of work. Should any such correction be
considered to constitute a change of scope of work, the
contractor shall notify the principal agent in writing within not
more than seven calendar days of such change and shall not
proceed with the fabrication until so authorized by the principal
agent. Claims for change of scope made after performance of
the work constituting the claimed change of scope will not be
considered.
Unless otherwise agreed with the principal agent, shop
drawings shall be prepared to show all details of installation,
including reticulation, fixing, etc of all components and
assemblies, or if the contractor desires to deviate from the
design and these drawings shall be all in accordance with the
above procedures and at the contractor's expense. Item

A The position of construction breaks and the extent of individual
concrete pours are to be recorded by the contractor on the
structural engineer's drawings and are to be submitted to the
principal agent and the structural engineer for their records. Item

Interim payments for unfixed materials
A Before including the value of any unfixed materials and goods
in his valuation for each interim certificate the principal agent
will require a certificate of ownership and a cession of rights in
favour of the employer from the contractor and/or each and
every subcontractor. Item
Overtime
B The additional costs of overtime work shall be for the
employer's account only when prior written agreement thereto
is given by the principal agent. Item
MATERIALS AND WORKMANSHIP
Testing of windows to ensure watertightness
C As the windows are fixed they shall be glazed and prepared so
that each window can be tested for watertightness with water
sprayed on by means of a 20mm hosepipe using adequate
pressure. If the pressure proves to be inadequate, in the
opinion of the principal agent, then the pressure in the
hosepipe shall be boosted by means of compressed air or other
approved means. Each window section shall be tested under
the supervision of the principal agent or clerk of works and
approved before final acceptance of the fenestration. Item
Testing of flat roof waterproofing to ensure watertightness
D As waterproofing is completed, areas shall be prepared with
small sand dykes around them of a size and enclosing an area
approved by the principal agent, flooded with water and kept
"ponded" for at least 7 days as a test to ensure the

Warranty for design and materials
A The contractor warrants and undertakes in favour of the
employer that:
Insofar as the works or any part of the works has been or will
be designed by him, he will exercise reasonable, due and
proper skill and care in such design.
Insofar as any part of the materials and goods for the works
has been or will be selected by him, he will exercise due and
proper skill and care in such selection of materials and goods.
He is suitably qualified and competent to carry out such design
work and selection of materials and goods.
He shall comply with and satisfy any performance specification
or requirements insofar as such performance specification or
requirements are included or referred to in the sub-contract. Item
Guarantees
The contractor shall obtain written guarantees where called
for, addressed to the employer, from the firms supplying the
materials or doing the work and deliver such guarantees to the
principal agent.
The guarantees shall state that workmanship, materials and
installation are guaranteed for a specified period reckoned from
the date of practical completion of the works and that any
defects in the workmanship, materials and installation that may
arise during that period shall be made good at the expense of
the firm doing the work upon written notice from the principal
agent or the employer to do so. Item
Notice before covering up
B The contractor shall give notice to the principal agent of his
intention to cover up any work or materials with earth or other
material in order that the principal agent may inspect same
before they are so covered.
In default of such notice being received such work or materials
shall be uncovered and later made good at the contractor's

SUPPLEMENTARY PREAMBLES
Cost of tests
The costs of making, storing and testing of concrete test cubes
as required under Clause 7 "Tests" of SABS 1200 G shall
include the cost of providing cube moulds necessary for the
purpose, for testing costs and for submitting reports on the
tests to the Architect. The testing shall be undertaken by an
independent firm or institution nominated by the Contractor to
the approval of the Architect (Test cubes are measured
separately)
Formwork
Descriptions of formwork shall be deemed to include use and
waste only (except where described as "left in" or "permanent"),
for fitting together in the required forms, wedging, plumbing and
fixing to true angles and surfaces as necessary to ensure easy
release during stripping and for reconditioning as necessary
before re-use. The vertical strutting shall be carried down to
such construction as is sufficiently strong to afford the required
support without damage and shall remain in position until the
newly constructed work is able to support itself
Formwork to soffits of solid slabs, etc shall be deemed to be to
slabs not exceeding 250mm thick unless otherwise described
Formwork has been measured to the sides of all reinforced
concrete in foundations and will be remeasured according to
actual usage. However, formwork necessitated by irregularity
or collapse of excavated faces will not be measured and the
cost thereof shall be deemed to be included in the allowance for
taking the risk of collapse of the sides of the excavations,
provision for which is made in "Earthworks"

Copper pipes
Pipes shall be hard drawn and half-hard pipes of the class
stated. Class 0 (thin walled hard drawn) pipes shall not be
bent. Class 1 (thin walled half-hard), class 2 (half-hard) and

benders with inner and outer formers. Fittings to copper waste,

Fixing of pipes

Design Responsibility
The contractor shall be responsible for the design of the
internal plumbing reticulation. The contractor will submit shop
drawings for approval to Davis Langdon Farrow Laing for
approval by the engineer/architect within two weeks after the
date of tender closing. Appointment of the successfull tenderer
will be subject to approval of the internal plumbing reticulation.
The contractor shall commence manufacturing only after
written approval of shop drawings from the engineer/architect.
The following is to be taken into consideration in the
design and subsequent pricing of the internal plumbing
and drainage reticulation:
Soil Drainage
Soil drainage points has been allowed as indicated on the
architect's drawings. The contractor is to allow for the location
of point left by other on main drainage pipe, connection thereto,
new pipework and fittings, junctions, bends, excavation,
backfilling, etc to this point.
All sanitary waste pipework shall be uPVC. Where pipework
pass under buildings they shall be encased in concrete. Fittings
to waste pipes shall be standard uPVC pipe fittings and
adequate rodding eyes are to be allowed.
Water Supplies
Connection shall be made at point left by other as indicated on
the site plan and the contractor is to allow for the location of this
pipe and connection of all new pipework.
The contractor to allow for one external masterbox with a
stopvalve and a domestic watermeter.
All pipework to be class II copper pipe with compression fittings
under ground and solvent welded fittings above ground.
The contractor is to ensure that a balanced water system is
achieved.
The contractor are to allow for minimum 5 no. external taps.
