iv)Copies of License of &ducation Soft$are shall be available in

installed in another School such that at no point of time any
unlicensed &ducation Soft$are is running in any School.

) Any change in staf by (mplementing Agency has to be intimated
to overnment of u!arat in advance.
c) (f overnment of u!arat does not approve the deployment of
any staf then the (mplementing Agency shall change the staf

e) overnment of u!arat can also reCuest for additional staf, if

staf, etc. means that the personal information of the individual
are captured in forms, data is entered into the computer and the
Angerprints are captured based on the entered data. %he

maintenance and administration of 'ard$are and Soft$are
for entire pro!ect duration.
ii) %he (mplementing Agency $ill stoc) the spares at district
head Cuarters
iii)%he (mplementing Agency $ill submit a guarantee for
availability of spares from the manufacturer or supplier of the
'ard$are or Soft$are.
g) %he (mplementing Agency shall la$fully acCuire and provide all
'ard$are and Soft$are reCuired for the proper and timely
discharge of the (mplementing AgencyMs obligations under the
Agreement. All the 'ard$are shall be of international repute and
all Soft$are shall be licensed.
2*) Cesponsiilities of -overnment of -%jarat:
a) 9rovide Space for Site 9reparation and other necessary
clearances reCuired for the implementation of the pro!ect.
) Assist in Aeld inspection and :eriAcation of Acceptance %ests.

$hether the implementing agency has installed the system as
per the reCuirements of the pro!ect. %he acceptance test is
carried out by verifying the details as per the test plan that
shall be Analized during System ?eCuirement Study 4S?S5.
(L8-S &ducation shall carry out acceptance tests for the
implementation done by the (mplementing Agency.

Any delay by the (mplementing Agency in ensuring the testing
shall render liCuidated damages. #ispute bet$een the
(mplementing Agency and (L8-S &ducation $ill be referred to the
Secretary, %ribal #evelopment.
27) Performance -%arantee:
a) Ojective: %o ensure that the implementing agencyKs
performance is as per the terms and conditions of the
agreement and in case of any failure to perform the loss of the
government can be recovered from the 9erformance
uarantee.
) Val%e: %he value of the performance ban) guarantee $ill be
eCual to BO of the total amount that is left to be released to
the (mplementing Agency for the entire pro!ect.
c) S%mission: Hithin 1B 4Afteen5 days of issuance of Letter of
(ntent, the (mplementing Agency $ill furnish 9erformance Ban)
uarantee.
d) Validit': %he performance ban) uarantee $ill be valid for one
year and has to be rene$ed $ithin /0 days before it e=pires.

i) 9ayment as above for a Cuarter shall be made to the
(mplementing Agency on the Arst date of the succeeding

deemed to commence either on Lanuary 1, April 1, Luly 1 or
>ctober 1 of a calendar year, hence there $ill be four
invoices raised in one year for each unit. -or e=ample if the
implementing agency has successfully run 1B0 units for the
