APPLICATION: Voluntay deparure
The respondent, a native ad citizen of te Dominica Republic, has fled a timely appeal of
te I igation Judge's Mach 16, 2012 decision, which denied her application fr voluntar
departure on discretiona gounds and ordered her removed. The Depaent of Homelad
Security (DHS) has not fled a bref or other response. Te appeal will be sustained and te
record will be remanded to te hgation Judge.
The fctual fndings of the hgation Judge are reviewed to deterine whether tey ae
"clearly eroneous." 8 C.F.R. 1003.l(d)(3)(i). All other issues in appeals fom decisions of
Iigation Judges, including legal ad discretionay deterinations ad applications of law to
fct, ae reviewed de novo. 8 C.F.R. 1003.l(d)(3)(ii).
Upon de novo review, we disagee with te Iigration Judge's denial of voluntay
departure in the exercise of discretion (I.J. at 2-3). We fnd that the negative fctors do not
outweig the positive fctors in tis case (I.J. at 1-3; Tr. at 19-21). SeeMaueroJ4rgehes,22
I&N Dec. 812, 819 (BIA (1999). U paticula, the respondent's immigaton violations, not
accompaed by ay criminal convictions or similaly severe negative fctors, do not outweig
the respondent having two United States citizen children, one of whom sufers fom ata, and
who appea to be dependent on te respondent (l.J. at 1-3; Tr. at 19-21). Upon balacing te
fvorable ad unfavorable fctors, we fnd that the respondent war ats a fvorable exercise of
discretion. We will terefre remand te record to provide te respondent a opportunty to
establish that she is oterise eligible fr volutay departure.
Accordingly, the fllowing orders will be entered.
ORDER: The appeal is sustained.
FURTHER ORER: The record is remaded to the Imigration Judge fr fer
proceedings ad the entry of a new decision not inconsistent with te fregoing opinion.
