Pursuant to Article 4, paragraph (2) of the Law on Public Procurement (Official

Gazette of the Republic of Macedonia, no. 136/07) and Article 36, paragraph (3) of the
Law on Government of the Republic of Macedonia (Official Gazette of the Republic of
Macedonia, nos. 59/00, 12/03, 55/05, 37/06 and 115/07), Government of the Republic of
Macedonia, at its session held on 26 December 2007, adopted the following


DECISION
ON DETERMINING INDICATIVE LIST OF CONTRACTING AUTHORITIES

Article 1
This Decision shall regulate the indicative list of contracting authorities.

Article 2
Contracting authorities referred to in Article 4, paragraph (1) of the Law on Public
Procurement shall mean:

1. State bodies, bodies of local government units and the City of Skopje:

public interest other than those of industrial or commercial nature, being largely
financed; or subject to control in the operations; or where more than half of the
members of the management or supervisory board have been appointed by state
bodies, bodies of local government units and of the city of Skopje or by other such
legal entities.

3. Legal entities established by one or more contracting authorities referred to in Article
4, paragraph (1), items a) and b) of the Law on Public Procurement Law:

- ZELS (Association of Local Government Units)
- and other legal entities established by one or more contracting authorities.

4. Public enterprises, joint-stock companies and limited liability companies where the
contracting authorities referred to in Article 4, paragraph (1), items a), b) and c) of the
Law on Public Procurement have dominant, direct or indirect, influence and carry out
one or more activities in the area of water supply, energy, transport and postal services:

- Public water supply enterprise Studencica - Skopje
- Public enterprise for carrying out water management activities Zletovica hydro

5. Legal entity, other than those referred to in Article 4, paragraph (1), items a), b), c)
and d) of the Law on Public Procurement, carrying out one or more activities in the area
of water supply, energy, transport and postal services on the basis of special or
exclusive rights:

- AD ESM-EVN joint-stock company for distribution and supply of electricity
- AD Toplifikacija joint-stock company for production and distribution of thermal
energy

Article 2
The List determining the entities to which the provisions of the Law on Public
Procurement apply (Official Gazette of the Republic of Macedonia, nos. 34/04 and
10/05) shall cease to be valid as of the day this Decision comes in force.

Article 3
This Decision shall enter into force on the eight day following the day it is
published in the Official Gazette of the Republic of Macedonia.
