EIGHTH AMENDED PRETRIAL SCHEDULING ORDER
Pursuant to Rule 16 of the Federal Rules of Civil Procedure and the Local Rules of
this Court, and in order to secure the just, speedy, and inexpensive determination of this
action, the following schedule shall govern these proceedings. The schedule may be
modified only upon formal motion and a showing of good cause as required by Local
Rule 16.3. Previous scheduling orders shall remain in effect to the extent they do not
conflict with provisions of the Eighth Amended Scheduling Order.
Now therefore, It is hereby Ordered that proceedings in this matter shall be
governed by the following:

Discovery Plan
1. Fact discovery pertaining to damages shall be commenced in time to be
completed by August 15, 2014.
2. By July 25, 2014 (one day following the deposition of Defendant pursuant
to Rule 30(b)(6)), Plaintiffs shall identify the second witness they intend to
depose on issues pertaining to damages.
3. Plaintiffs shall disclose the identity of its damages expert witnesses under
Rule 26(a)(2)(A) on or before August 15, 2015. The full disclosures
required by Rule 26(a)(2)(B), accompanied by the written report prepared
and signed by the expert witness, shall be made as follows:
a. By Plaintiffs on or before August 29, 2014.
b. By Defendant on or before September 26, 2014.
4. Expert discovery, including depositions, shall be completed by October 10,
2014. Barring exceptional circumstance and leave of the Special Master,
Defendant shall not be permitted to depose Plaintiffs expert(s) until
Defendants expert report(s) has/have been served on Plaintiff. Each side
shall call no more than 1 damages expert witness to testify at trial.
Non-Dispositive Motions
Non-dispositive motions may be scheduled for hearing by contacting the Special
Master.
1. All non-dispositive motions and supporting documents, including those
which relate to discovery, shall be served and filed by October 10, 2014.
2. Prior to scheduling any non-dispositive motion, parties are encouraged to
consider whether the motion, including motions relating to discovery and
scheduling, can be informally resolved through telephone conference with
the Special Master. All non-dispositive motions shall be scheduled, filed
and served in compliance with the February 2014 Order Addressing Special
Master Protocols.
Dispositive Motions
1. All dispositive Motions shall be scheduled, filed and served in compliance with
the Order regarding dispositive motion practices in cases assigned to J udge
Magnuson by contacting his Calendar Clerk, Suzanne Ruiz at 651-848-1156.

Counsel are given notice that six to eight weeks advance notice is necessary to
place a dispositive motion on the calendar.
2. All dispositive motions along with all supporting documents specified by Local
Rule 7.1(c)(1) must be served and filed by August 8, 2014.
3. Any response, along with all the supporting documents specified by specified
by Local Rule 7.1(c)(2), must be served and filed by September 5, 2014.
4. Any reply, pursuant to Local Rule 7.1(c)(3), must be served and filed by
September 19, 2014.
5. The hearing on all dispositive motions is scheduled for October 2, 2014.
6. Word Limits. Because the briefing will address several plaintiffs and several
state laws the Court will double the usual word limits imposed by Local Rule
7.1(f).
Daubert Motions
1. All Daubert motions along with all supporting documents specified by Local
Rule 7.1(c)(1) must be served and filed by October 20, 2014.
2. Any response, along with all the supporting documents specified by specified
by Local Rule 7.1(c)(2), must be served and filed by October 24, 2014.
3. Word Limits. The normal word limits pursuant to Local Rule 7.1(f) will apply
to each Daubert motion.
Pre-Trial Briefing
1. On October 17, the parties will serve and file the following materials:
a. Witness List
b. Exhibit List
c. Deposition Designations

The parties will meet and confer regarding these materials at least one week
before these materials are filed and will coordinate concerning the marking of
exhibits.
2. On October 17, 2014, the parties must serve and file the following materials:
a. Trial Brief
b. J ury Instructions
c. Verdict Form

3. Motions in Limine.
a. All Motions in Limine must be served and filed by October 20, 2014.
b. Any response must be served and filed by October 24, 2014.
Trial
1. Absent extraordinary circumstances, trial will begin on Monday, November 3,
2014. Anticipated length of trial is no more than two weeks.
