Defendants United Park City Mines Company and Talisker Land Holdings, LLC
(collectively, Talisker), by and through their counsel, hereby respond to Plaintiffs Motion to
Postpone or Stay the Effect and Enforcement of Any Ruling that May Be Rendered on
Defendants Unlawful Detainer Counterclaim.
Talisker does not believe that GPCC/GPI are entitled to a stay. The statutory framework
and the Rules of Civil and Appellate Procedure clearly prescribe the next steps for a speedy
resolution of the issue of possessionspecifically, an order requiring GPCC/GPI to vacate the
property and the prompt return of possession to Talisker. Osguthorpe v. Wolf Mountain Resorts
LC, 2010 UT 29, 23, 232 P.3d 999. Talisker is, however, mindful of the Park City
communitys concerns that operations at the Resort continue uninterrupted next ski season. For
this reason, Talisker has decided not to oppose a stay.
GPCC/GPI are, however, required to post a bond sufficient to protect Taliskers rights to
collect on a judgment for GPCC/GPIs wrongful use of Taliskers property. If they do not, the
stay must be lifted. See Utah R. Civ. P. 62(c) (stay will be granted only upon such conditions as
[the court] considers proper for the security of the rights of the adverse party); June 19, 2014
Hearing, Tr. at 65:13-19 (confirming that, absent the posting of a sufficient bond, a stay would
not issue).
Of course, if GPCC/GPI refuse to post a bond, there can be no stay. The bond will be
addressed in subsequent briefing due by August 15, 2014. Talisker respectfully requests that the
Court determine the amount of bond as expeditiously as possible to provide certainty as to
whether GPCC/GPI will post the required bond so that ski operations are not interrupted next
season. Talisker respectfully suggests that the August 27, 2014 hearing be devoted to that
purpose.
