The part time Community Manager, the President and the Vice President of the Mesquite
Vistas Community Association are continuing their efforts to distract homeowners from the real
issues in the Mesquite Vistas Master Association by tainting the credibility of those questioning
the issues and demanding results.
It is implied by the recent articles released in the online publication Lets Talk Nevada that
the President and Vice President, stating and alleging that get even tactics and terminations
occurred and attacking certain individuals and a Sub Association, are listening to only part of
the story from the Terra West Community Manager instead of the homeowners that they were
elected to represent.
Although the fact that these directors presented only one side of the situation without
investigation is disappointing, the purpose of this response to the recent articles in Lets talk
Nevada is not to allege that the authors are bad people or that the person supplying
information to them is dishonest. That determination is one that should be made by each
person individually. I believe that property owners in Mesquite Vistas have a right to hear the
entire story so they can form their own educated opinion
pertaining to events in Mesquite Vistas.
President Shepherd wrote that Terra West terminated its management contract with Copper
Bluffs over disagreements in applications of policy. Vice President Hyland wrote that Terra
West fired the Copper Bluffs Owners Association and he suggested that Copper Bluffs Owners
should question the decisions and actions made by the board. Neither of them chose to
provide specifics or details to back up their claims.
More important than the alleged firing is: Did the Copper Bluffs Board perform in compliance
with the law and make the fiduciary decisions required by Nevada Statutes? The following
facts are documented by emails, meeting minutes and verbal discussions and are provided to
assist Copper Bluffs owners and Mesquite Vistas owners to make their own decisions about the
accusations:
September 22, 2011 Board Meeting Minutes - include the Board Presidents recommendation
that no official action be taken in November when the Terra West yearly agreement expired.
The board then reviewed matters promised by Terra West at the inception of the agreement
that had not been implemented. Kristen Remhoff representing Terra West suggested that the
existing contract continue on a month to month basis starting in November while these
matters were being discussed. The board concurred and advised Kristen that this matter would
be reviewed again in March 2012.
Numerous discussions and emails were exchanged in the next few months pertaining to the
failure of Terra West to meet its commitments; including leaving the one size fits all form
letters in Las Vegas.
The Copper Bluffs Board continued to insist that customer service be improved, and that
management staff treat owners as persons not as a unit number.
As planned in September 2011 a Terra West performance review was held on March 27, 2012.
The review indicated that management services had declined further, homeowner complaints
had increased, and the manager continued to object to performing the previously agreed to
services.
As the Board President I recommended to the board that we give notice to Terra West that we
were going to send out requests for management proposals and that any further discussion
with Terra West occur during interviews of those companies being considered for a new one or
two year management agreement. The board concurred.
Michael Baca, the Chief Operating Officer for Terra West sent an email to me on March 28,
2012. He stated that we were promised things that were above and beyond those in normal
Terra West contracts.
Included in this email was:
I hate to lose your business because of a personality which we can easily correct.
My recommendation is to change your manager.
There is no sense on submitting you a proposal when we already have the account.
The Chief Operating Officers proposal to change the manager and to meet with the Copper
Bluffs Board instead of submitting a new proposal to be compared with other proposals was
rejected and Mr. Baca was informed that in the interest of fulfilling our fiduciary responsibilities
we were moving forward with seeking management proposals.
A letter dated March 29, 2012, just one day after the correspondence with Mr. Baca, was
received from Moana Vineyard, part time Mesquite Community Manager which stated: we will
be terminating the existing month to month status of services to Copper Bluffs Owners
Association effective April 30, 2012.
This notice referring to as a termination or firing by Terra West was dated the day following
the notice to Mr. Baca that Copper Bluffs had rejected their last proposal and was seeking
management proposals. This document also was apparently the termination and firing referred
to by the Mesquite Vistas President and Vice President.
This concludes the rest of the Copper Bluffs/Terra West story. Hopefully it will help Mesquite
Vistas and Copper Bluffs Owners understand the actual sequence of matters leading to the
claims and allegations made by Mr. Shepherd and Mr. Hyland.
