FOREWORD


1. PURPOSE : This Staff Instruction has been prepared to guide and
assist all Directorate of Airworthiness and Aircraft
Operation, in properly discharging their responsibilities
and efficiently accomplishing their assigned tasks,
regarding to the Irrevocable Deregistration and Export
Request Authorisation (IDERA).

2. REFERENCE : This Staff Instruction should be used in accordance with
the applicable regulations.

3. CANCELLATION : -


4. REVISION : Revision of this Staff Instruction will be approved by the
Director General of Civil Aviation.

47.1 Regulatory references

a. Republic of Indonesia has ratified the Convention on International Interest in
Mobile Equipment and the Protocol to the Convention on International Interests
in Mobile Equipment on Matters Specific to Aircraft Equipment, by Presidential
Decree No. 8 year 2007, date 20

February 2007.
b. Article 71 of the Indonesia Aviation Act No. 1 year 2009 governing an aircraft
could be treated by international interest pursuant to a security agreement, title
reservation agreement, or leasing agreement.
c. Article 74 (1) of the Indonesia Aviation Act No. 1 year 2009 governing the
debtor may issue to creditor an Irrevocable Deregistration and Export Request
Authorisation (IDERA) for aircraft which have obtained an Indonesian
registration and nationality marking.
d. Article 74 (2) of the Indonesia Aviation Act No.1 year 2009 governing
Irrevocable Deregistration and Export Request Authorisation (IDERA) as
mentioned in article 74 (1) must be acknowledged and recorded by the Minister
of Transport and cannot be revoked without concurrent of the creditor.

47.3 Definitions

In this part the following terms shall have the meanings as follows :
a. Agreement means a security agreement, a title reservation agreement, or a
leasing agreement,
b. Aircraft means aircraft as defined on the Aviation Act No.1, 2009,
c. Aircraft objects means airframe, aircraft engines and helicopters,
d. Aircraft engines means aircraft engines (other than those used in military,
customs or police services) powered by jet propulsion or turbine or piston
technology and:
(i) in the case of jet propulsion aircraft engines, have at least 1750 lb of thrust
or its equivalent, and
(ii) in the case of turbine-powered or piston-powered aircraft engines, have at
least 550 rated take-off shaft horsepower or its equivalent,
together with all modules and other installed, incorporated or attached
accessories, parts and equipment, and all data, manuals and records relating
thereto,
e. Airframes means airframes (other than those used in military, customs or police
services) that, when appropriate aircraft engines are installed thereon, are type
certified by the competent aviation authority to transport:

(i) at least eight (8) persons including crew, or
(ii) goods in excess of 2750 kilograms,
together with all installed, incorporated or attached accessories, parts and
equipment (other than aircraft engines), and all data, manuals and records
relating thereto,
f. Attorney in fact means an individual person or legal entity who is appointed and
authorised in writing to act in the place or stead of the person granting such
power,
g. Authorised party means the party referred to in Article XIII (3) of the Protocol to
the Convention on International Interests in Mobile Equipment on Matters
Specific to Aircraft Equipment,
h. Convention means Convention on International Interest in Mobile Equipment,
i. Creditor means a chargee under security agreement, a conditional seller under
a title reservation or a lessor under a leasing agreement,
j. Debtor means a chargor under a security agreement, a conditional buyer under
a title reservation agreement or a lessee under a leasing agreement or a person
whose interest in an object is burdened by a registrable non-consensual right or
interest,
k. Deregistration means deletion or removal of the registration of the aircraft from
the Indonesian Civil Aircraft Register,
l. Helicopter means heavier-than-air machines (other than those used in military,
customs or police services) supported in flight chiefly by the reactions of the air
on one or more power-driven rotors on substantially vertical axes and which are
type certified by the competent aviation authority to transport:
(i) at least five (5) persons including crew, or
(ii) goods in excess of 450 kilograms,
together with all installed, incorporated or attached accessories, parts and
equipment (including rotors), and all data, manuals and records relating thereto,
IDERA means Irrevocable Deregistration and Export Request Authorisation,
m. Leasing agreement means an agreement whereby the lessor gives his/her
rights to the lessee to possess an aircraft object (with or without an option to
purchase) with a rent or any other payment as the compensation,
n. Person means individual person or legal entity,
o. Protocol means Protocol to the Convention on International Interests in Mobile
Equipment on Matters Specific to Aircraft Equipment,
p. Security agreement means an agreement whereby the chargor gives or agrees
to give to the chargee of security agreement an interest (including the interest of
ownership/title) of an aircraft object to guarantee delivery of obligations incurred
or to be incurred from the chargor or a third party,
q. Title reservation agreement means a sale agreement on an aircraft object with a
provision that ownership/title shall not be transferred until all requirements
under the agreement have been met.

47.5 Responsibilities
Director of Airworthiness and Aircraft Operation is responsible to record the IDERA.

47.7 Application
Registered operator or owner may issue an IDERA to the person in whose favour
the authorisation has been issued (the authorised party) or its certified designee.
The authorised party or its certified designee shall be the sole person entitled to
exercise the remedies specified in Article IX (1) of the Protocol, and may do so only
in accordance with the authorisation. Such authorisation may not be revoked by the
debtor without the consent in writing of the authorised party.

An IDERA can be recorded when at the time of the conclusion of the agreement
creating or providing for the international interest, the debtor is situated in a
Contracting State of the Convention.

Registered operator or owner shall complete DAAO Form 47-03, Form of
Irrevocable Deregistration and Export Request Authorisation (IDERA) and submit
to the Director General with the following required documents:
a. Copy of the valid certificate of registration (C of R),
b. Copy of agreement creating or providing for the international interest:
1. Aircraft leasing agreement, in case the registered operator is a lessee; or
2. Aircraft security agreement, in case the registered owner is a chargor; or
3. Title reservation agreement, in case the registered operator is a conditional
buyer.

DAAO Form 47-03 shall be signed in ink by registered operator or owner
(applicant).

47.9 Review the application of IDERA
Directorate of Airworthiness and Aircraft Operation shall be responsible to process
the IDERA.

Upon receipt of DAAO Form 47-03, Form of Irrevocable Deregistration and Export
Request Authorisation (IDERA) and the required documents:
a. Review the DAAO Form 47-03, containing the information related to:
1. Aircraft object of IDERA (aircraft type, serial number, registration mark and
registration number),
2. Registered owner or operator (debtor) who give the authorisation (name
and address),
3. Authorised party or its certified designee (creditor) who receive the
authorisation (name and address), and
4. Agreement (leasing agreement, or security agreement, or title reservation
agreement).

DAAO Form 47-03 must be filled out in complete and correct manner and
signed in ink by the registered operator or owner.
b. Review the aircraft registration status
Aircraft registration status shall be checked against Indonesia Civil Aircraft
Register that it is currently registered in the Indonesia Civil Aircraft Register.
If the aircraft is not currently registered in the Indonesia Civil Aircraft Register
the IDERA cannot be recorded according to the Aviation Act no. 1 Year 2009
Article 74 (1), and notification shall be made to the applicant.
c. Review the previous record of IDERA
IDERA can not be recorded when it has a previous record of IDERA, as agreed
upon by parties.
d. Check when the debtor is situated in contracting state of Convention on
International Interest in Mobile Equipment. Current status of contracting state
may be check at http://www.unidroit.org/english/implement/i-2001-convention.
pdf.
e. Check when aircraft object meet the requirements described in paragraph 47.3.
f. Review the agreement
IDERA may be raised from a situation where two or more parties are involved in
an aircraft leasing agreement, aircraft security agreement, or aircraft title
reservation agreement.
1. Leasing agreement shall be evaluated to determine:
a. The agreement is the same agreement used in the aircraft registration
process and it is still valid.
b. The debtor who gives the authorisation is the party who act as lessee,
the name and its address are the same as appear on the DAAO Form
47-03 Form of IDERA.
c. The creditor as the authorised party who received the authorisation
from the debtor is the lessor, the name and its address are the same as
appear on the DAAO Form 47-03, Form of IDERA.
2. Security agreement shall be evaluated to determine:
a. The debtor who gives the authorisation is the party who act as the
chargor, the name and its address are the same as appear on the
DAAO Form 47-03 Form of IDERA.
b. The creditor as the authorised party who received the authorisation is
the chargee, the name and its address are the same as appear on the
DAAO Form 47-03, Form of IDERA.

3. Title reservation agreement shall be evaluated to determine:
a. The debtor who gives the authorisation is the conditional buyer, the
name and its address are the same as appear on the DAAO Form 47-
03, Form of IDERA.
b. The creditor as the authorised party who received the authorisation is
the conditional seller, the name and its address are the same as appear
on the DAAO Form 47-03, Form of IDERA.

The DAAO Form 47-03, Form of IDERA will be dated and signed by Director of

Airworthiness and Aircraft Operation on behalf of the Director General of Civil
Aviation when it has fulfilled the requirements on paragraph 47.7 and 47.9.

Non compliant IDERA will not be processed but will be returned to the registered
operator or owner (applicant) at their risk.

Where the Form of IDERA, DAAO Form 47-03 is submitted by an attorney in fact
acting for the registered owner or operator (applicant), the correspondence will
normally be directed to the attorney in fact.

47.11 Distribution and record retention
Directorate of Airworthiness and Aircraft Operations is responsible for the record
and retention of IDERA data:

a. DAAO Form 47-03, Form of IDERA signed by Director of Airworthiness and
Aircraft Operation will be sent to the applicant.
b. IDERA records, consist of copy of DAAO Form 47-03 Form of IDERA,
agreement, power of attorney if applicable, will be filed with Directorate of
Airworthiness and Aircraft Operation.
c. IDERA logbook is used to control the record and deletion of IDERA. Information
regarding the IDERA must be recorded on the IDERA logbook.
d. DAAO Form 47-2B Aircraft Registration Card, is also used to partially control
the information regarding individual record of IDERA for each airframe and
helicopter. Information shall contain the name and address of debtor, the name
and address of authorised party, agreement, date of lodging the DAAO Form
47-03, Form of IDERA.
e. IDERA records will be filed as long as the aircraft object has a valid aircraft
registration and there is no request to revoke the authorisation from the
authorised party.

47.13 Revocation of IDERA

The IDERA that is recorded by the Director of Airworthiness and Aircraft Operations
may only be revoked at the request of the authorised party in whose favour the
IDERA has been made.

Director of Airworthiness and Aircraft Operations will process aplication to revoke
IDERA as required by the Protocol.

The registered operator or owner of an aircraft against which an IDERA is recorded
by the Director of Airworthiness and Aircraft Operations must arrange for the IDERA
to be revoked.

IDERA revocation requests should be submitted in a letter acceptable to the
Director of Airworthiness and Aircraft Operations. The letter should be submitted
and signed by the authorised party whose contact details should be included: name
in full, address in full, e-mail, fax and phone numbers.

A letter of revocation of IDERA will be issued to authorised party when the
application considered appropriate.
Where the revocation request is submitted by an attorney in fact acting for the
authorised party, all correspondence will normally be directed to the attorney in fact.
Revocation of IDERA will be filed with Directorate of Airworthiness and Aircraft
Operations and record of revocation shall be made on the IDERA Logbook and
such record shall also be made on DAAO Form 47-2B, Aircraft Registration Card as
necessary.

procure the deregistration of the aircraft from the Indonesia Civil Aircraft Register
maintained by Director General of Civil Aviation for the purposes of Chapter III of the
Convention on International Civil Aviation, signed at Chicago, on 7 December 1944, and
(b) meminta ekspor dan pengalihan fisik pesawat udara dari Republik Indonesia, dan
procure the export and physical transfer of the aircraft from Republic of Indonesia, and
(ii) konfirmasi bahwa pihak yang diberi kuasa atau orang yang ditunjuknya secara sah
dapat melakukan hal sesuai yang tercantum pada ketentuan (i) diatas dengan
permintaan tertulis tanpa persetujuan dari yang bertandatangan dan bahwa, sesuai
dengan permintaan, Direktur J enderal Perhubungan Udara wajib bekerja sama dengan
pihak yang diberi kuasa dalam mempercepat pemenuhan hal tersebut.
