A brief visual inspection of the above named premises was carried out on the 30 th of
November, 2009. During the inspection, a number of fire safety deficiencies were
observed that require immediate attention.

In particular:

1. The drawings submitted to this Office do not fully represent the current floor plan.
Please submit revised scaled layout plans that clearly indicate:
- the use of each area/room
- the dimensions of the building
- the clear exit width of all doors
- the opening direction of all doors.

2. The following areas shall be deemed to be separate fire compartments. The walls and
floors separating these areas from each other and the remainder of the premises shall
be compartment walls and floors:
a) The bar area
b) The residential part of the premises.

3. Compartment walls and floors shall achieve a minimum of 60 minutes fire resistance
when tested to BS 476: Part 21. This shall be certified by a competent person.

4. The residential part of the premises was not inspected during this visit, however it
shall comply with the Code of Practice for ‘Fire Safety in Flats’ produced by
Department of the Environment, 1994. This part of the premises shall not be used
until such time as it achieves at minimum, compliance with the requirements of this
code of practice.

5. An automatic fire detection and alarm system shall be designed and installed in
accordance with the requirements of IS 3218, 2009. The system shall be a minimum
type L3 M X system and shall be designed to incorporate the residential part of the
premises. An installation certificate shall be completed by a competent person and
submitted to this Office.

6. An emergency lighting system (internal and external) shall be designed and installed
in accordance with the requirements of IS 3217, 2008. The system shall cover both
defined and undefined escape routes. An installation certificate shall be completed by
a competent person and submitted to this Office.

7. Doors on escape routes shall be fitted with push bars or shall be free from fastenings.
All other doors shall be fitted with simple fastenings that operate without the use of a
key.
8. The plastic covering over the rear escape route shall be removed. Any covering over
escape routes shall have an inherent “Class 0” spread of flame when tested to BS 476:
Part 6.

9. The external exit door from the cold room and the external exit door from the kitchen
shall be a minimum of 30 minutes fire resisting doorsets complete with self closing
devices (use of rooms as indicated on Drawing No. 01 submitted to this Office on the 01st of
July, 2009).

10. Glazing along the rear escape route shall be replaced with glazing affording a
minimum of 30 minutes fire resistance in terms of integrity and insulation. This
glazing shall be fixed shut in a hardwood frame. Alternatively, the windows may be
blocked up using construction affording a minimum of 60 minutes fire resistance
when tested to BS 476, Parts 20-24.

11. Any store room shall be fully enclosed in materials affording a minimum of 30
minutes fire resistance when tested to BS 476: Parts 21-24. The doors to these stores
shall be 30 minute fire resisting doorsets complete with self closing devices and
intumescent and ambient smoke (brush) seals.

12. Fire safety signs shall indicate escape routes, including any doorways or exits. Such
signs shall be provided in accordance with BS 5499: Part 5, 2002 and SI 132, 1995.
Exit signs shall be in a maintained mode of operation in accordance with IS 3217,
2008 (the lamps are in operation at all material times).

Fire safety signs shall also be provided to indicate the position of fire-fighting
equipment and fire alarm call points.

13. Escape routes shall be kept clear and unobstructed at all times.

14. For the purpose of restriction of spread of flame on surfaces of walls and ceilings, the
addition of timber linings is not permitted.

15. Doors on escape routes should be hung so that they open in the direction of escape. In
certain limited situations it may be appropriate to consider the provision of doors
which are held in the open position. It should not be possible for such doors to be
released and closed when the building is in use.

16. Fire doors shall be marked (at about eye level) with the appropriate fire safety sign
complying with BS 5499: Part 5: 2002. Fire doors to cupboards and to service ducts
should be marked on the outside; all other fire doors on both sides.

17. An adequate number of fire extinguishers, suitable to the risk of the building shall be
provided in accordance with IS EN 3: Parts 1-6, 1995. The selection, installation and
 maintenance of these extinguishers shall be in accordance with IS 291, l986. A test
certificate shall be completed by a competent person and submitted to this Office.

18. The electrical wiring installation shall be tested to comply with the ‘National Rules
for Electrical Installations’ of the Electro-Technical Council of Ireland for such type
of occupancy and ESB regulations or the current edition of the Institute of Electrical
Engineers ‘Wiring Regulations’. Certification showing compliance with the above
regulations shall be completed by a competent person and submitted to this Office.

19. Oil fired equipment, boiler house enclosure and oil storage (if any) shall comply with
the requirements of BS 5410: Part 1: 1997 (incorporating amendments 11022 and
13155) for installations up to 45 kW or BS 5410: Part 2: 1978 (incorporating
amendments 3638 and 13229) for installations of 45 kW and above output capacity.

20. Gas installation (if any) shall be tested in accordance with IS 820, “Non–Domestic
Gas Installations” and IS 3216: Part 1, “Code of Practice for the Bulk Storage of
Liquefied Petroleum Gas”. Certification showing compliance with the above
regulations shall be completed by a competent person and submitted to this Office.

21. Furnishings and fittings in the premises shall be in accordance with the “Code of
Practice for Fire Safety of Furnishings and Fittings in Places of Assembly”
(March, l989) published by the Department of the Environment, which covers:
a) Seating to IS 419, 1988 and IS 254, 1983.
b) Curtains, drapes and blinds to BS 5867: Part 2, 1980, BS 5651, 1978 and BS 312,
1959.
c) Floor coverings to BS 5287, 1976 (and BS 4790, 1987).
d) Scenery and properties to BS 5651, 1978 and BS 3120, 1959.
e) Miscellaneous fittings, temporary decorations, etc., to BS 5651, 1978 and BS
3120, 1959.

Test certificates for any new furnishings and fittings shall be obtained by the
owner/occupier. A copy of these certificates shall be submitted to this Fire Authority.

The management of the premises shall be in accordance with the “Code of Practice of
Management of Fire Safety in Places of Assembly”. You should familiarize yourself with
all aspects of this code and take the necessary actions to ensure compliance with it. This
code is available from the Government Publications Sales Office or at the Department of
the Environment website.

22. A Fire Safety Register is a requirement under the code of practice mentioned above.
This register must be kept up to date and available to the Fire Officer for inspection.

This Fire Authority would recommend that you appoint a technical advisor in complying
with the above provisions.
If the fire safety precautions described above are not substantially completed before the
Court date, this Fire Authority may object to the licence application. Therefore, it will be
necessary to give this Authority at least two week’s notice to facilitate a further
inspection. In addition, this Fire Authority requires two weeks written notice of any
adjournments in relation to the above licence application.

You are also advised that for any new works, material alterations or extension to
which Part ΙΙ and Part ΙΙΙ of the Building Control Regulations, 1997 and 2009
applies, a Commencement Notice and a Fire Safety Certificate is required.
