suing McCarthy for
draining her deceased
partner (Faye
Jensens) bank
account.


Defendants name is
McCarthy. McCarthy
claims that she didnt
know the money was
coming from Jensens
account. The accounts
got mixed up by
mistake as a result of a
Mountain America
Credit Union merger.


Judgment for the plaintiff in the amount of $8,092. Damages to the
plaintiff include compensation for the money that was misplaced
and a bank service fee. Judge explained that since no criminal
charges had been brought against McCarthy it was not necessary
for her to prove her innocence in small claims proceedings;
however, McCarthy did use and benefit from the money. This
judgment aligns with what we learned in class because the plaintiff
was injured by the defendant who benefitted at the expense of the
plaintiff. The judge awarded compensatory damages to try and put
the plaintiff back in the position that she was in financially before
She was injured by the defendants actions.
