THE ITALIAN HIGHWAY CONCESSION SYSTEM

The italian highways network today consists mostly of roads made between the sixties and
seventies. Thanks to the use of concessions in those years Italy had an infrastructure
system largely superior with respect to the other European countries. However the stop in
the realization of new routes established by the Law no. 492 of 16.10.1975, the italian
Highways network has been expanded only through special laws related to some
particular events such as the soccer World Cup.
Until the 2000 works to the Italian highways network have been addressed mainly to
increase quality and safety standards while the other European countries have
implemented signicant investments in order to have a more advanced highway network.


Only with the Law no. 443 of 21.12.2001 (Legge Obiettivo) several measures have been
taken in order to reduce the infrastructure gap with respect to the other European
countries. Since the institution of the concession is characterized by the use of resources
generated in auto nancing of public transfers, it made possible to make signicant
investments. On the other hand other works nanced exclusively with public funds have
experienced greater difculties in nancing. In this sense the highways concession system
is a strategic factor for the countrys economy thanks to the high investment capacity.

NATIONAL HIGHWAY NETWORK
The italian highway network is given under concession to companies with different
providers. The rst is the Ministry of Infrastructures and Transport, the successor to Anas
S.p.A in this role starting from the 1 October 2012. So the Ministry which operates through
the Structure of Supervision over the Highways Concessionaires established by the
Ministerial Decree no. 341 of 1 October 2012, controls most of the network in concession.

Then there is Anas S.p.A, a public company subject to the supervision of the Ministry of
Infrastructures, which manages some routes directly while for others plays indirectly the
role of grantor by participating in the 50% of the shares in regional companies.

There are also some regional companies that act exclusively as grantor of infrastructures
in the Region to which they refer.

INFRASTRUCTURES AND TRANSPORT
The toll motorway concession given by the Ministry of Infrastructure is handled by 24
companies with 25 existing concessions. The entire network covers 5821.5 Km and it's all
operational.

In addition to motorways under concession, the national motorway network is made of
routes managed directly by ANAS S.p.A, amounting to a total of 953.8 km.

of grantor of new motorways routes, even if none of these routes is operational.

Finally there are other grantor companies that operate for the construction of regional
highways with the Region as grantor. None of these routes is operational.

THE CONCESSION
The relationship between the Grantor (formerly ANAS) and the concessionaires, was
regulated, up to 2007, by conventional acts stipulated in accordance with a standard
model prepared between 1997 and 1998 by the Ministry of Public Works, with the
favorable opinion of the State Council.
These agreements and the correlated nancial plans dene how the investment for the
improvement of the routes in concession has to be made. According to the existing
concession agreements, motorway concessions
have different end dates. The duration of licenses can be found in the conventional acts
indicated in the tables below together with the state periodic updating of the nancial
plans.
