REMOVAL ELECTION PETITION

QUESTIONS AND ANSWERS


Q. How is the recall going?
A. Before answering this question it is important to clarify the language and explain the steps required by NRS
116.31036 to remove a member of a board in a Community Association. Nevada Law provides that a removal
election may be called by unit owners. The first step is that property owners must submit a petition calling for a
removal election. The petition must be signed by at least 10 percent of the total number of voting members in the
Community Association. After receiving a petition calling for a removal election an association must send in not
less than 15 days or more than 60 days secret written ballots for a removal election.

Q. Clarified/Rephrased question. How is the petition for a recall election going?
A. It is going great! Petitions continue to come in those returned to date nearly double the number of owner
signatures that are required. Thanks to those helping to send another strong message that Mesquite Owners are
unhappy with the existing board and management. There is no doubt that when it is determined time to submit the
petition it will qualify and require that a removal election be scheduled.

Q. How soon could a change occur?
A. This is a good and a difficult question. The Steering Committee and those Concerned Citizens that attended
our meeting August 6 th participated in a pro and con discussion pertaining to submittal of the petition. Submittal
of the petition would require the association to set dates that comply with the statute for sending, receiving, and
counting ballots. The discussion resulted in the 18 in attendance unanimously recommending to the steering
committee that the petition submittal be delayed until after the November Mesquite Vistas Owners Meeting.
Statements and comments during this discussion included:
Having a removal election and a board election at, or nearly at, the same time will be confusing.
Incurring costs for postage and supplies for a removal election that may not be needed after the board
election is not a good business decision.
A better use of our time is putting our efforts toward electing owner friendly people to the board.

Q. What happens now?
A. We recommend that friends and neighbors that havent signed the petition do so. That everyone bring in a
new member to the MVCC group or at least encourage they sign up on our email list so that updates etc can be
distributed rapidly.
