Romney-is-fighting-the-tea-party-again, recalling his having been endorsed by the

This week, the Senate is likely to consider the Energy Savings and Industrial
Competitiveness Act of 2013 (S. 2262). Senate Majority Leader, Harry Reid continues to
demand Shaheen-Portman be tied to any vote on the Keystone Pipeline. Introduced by
Sen. Jeanne Shaheen (D-NH) and Sen. Rob Portman (R-OH), the bill claims to promote
energy savings in industrial and commercial buildings. However, by providing federal
incentives (i.e. taxpayer dollars) to make building and manufacturing processes more
efficient, the bill would burden taxpayers and consumers alike while producing no
tangible benefits. Like most government-initiated efficiency programs, this one is fatally

An important update on Representative Jeff Denhams (R-CA) Encourage New Legalized

stalling for efforts to attach it to the annual defense authorization bill (NDAA); instead, it

battery of military benefits, c) lawful permanent resident status in the U.S., and d) a
back-door promise of instant citizenship.

(CO), Carper (DE), Casey (PA), Coons (DE), Donnelly (IN), Hagan (NC), Heitkamp (ND),
Johnson (SD), Landrieu (LA), Manchin (WV), McCaskill (MO), Nelson (FL), Pryor (AR), and
Tester (MT) are on record supporting the pipeline. It is important to note these
Senators have done almost nothing to push the issue in the 13 months since. Heritage
Action will key vote the issue in the Senate and encourages all Sentinels to support the

Export-Import Bank
Attempting to rally support for its reauthorization in September, defenders of Ex-Im
have begun to cling to the argument that the bank returns a profit to the Treasury. As
explained last week, Ex-Im is only able to produce returns off of the capital it took from
the Treasury in the first place. Moreover, these returns pale in comparison to ultimate
risk exposure. Even if a lawmaker takes comfort in that weak talking point, the Banks
partisan cronyism is much harder to defend. Over the weekend, the Washington
Examiner found the third biggest donor to Democrats this election cycle is the owner
of a company that also happens to be the No. 2 recipient of insurance issued by the
Export-Import Bank.

Leftist Propaganda on National Mall
Today, the House may take up a vote on H.R. 863, a bill that would establish a
commission to study the construction of a National Womens History Museum
(NWHM) on the National Mall. While the idea of honoring the great female leaders of
American History is noble and shared by all, many conservatives are concerned that the
museum will soon become a platform to promote liberal propaganda. NWHMs website
disproportionately endorses questionable figures the progressive and feminist agendas
(Margaret Sanger, Victoria Woodhull, etc.), and it is likely that taxpayers will eventually
be called upon to help finance the site and support this damaging historical
narrative. Despite being opposed by Concerned Women for America and Susan B.
Anthony List, and being controversial for the past 16 years, this bill is also on the House
suspension calendar.

Although Guzzardi isnt challenging the flawed-decision of the PA-Supremes, Guzzardi will join Corbett
on some GOP primary ballots as the Dems conduct Pennsylvanias Nasty Democratic Civil War;
meanwhile, it does not appear the State Stores are going to be sold any time soon [PA GOP's wine-to-go
plan blasted], as other agenda-items have surfaced [ONLINE GAMBLING COULD GET A LOOK IN PA, PA

citations. The focus of this first blast e-mail is BHO himself, elaborating on his autocratic background

Rep. Mike Vereb, R-Montgomery County, who is a House GOP leader, predicted no

incompetence [in addition to elevating people such as Lois Lerner] is his proclivity to
appoint ambassadors to reward politically [Max Baucus was not Exactly Prepared to be
Ambassador to China] or as acknowledgements of campaign contributions [Obama's

is to Enact 'Energy Transformation Agenda' Through Executive Action] and others, such as Mark Levin,
feel he is Executing a Quiet Coup and cannot stomach bipartisanship that could support tyranny. In
reaction, although dana-milbank falsely claims republicans are flip-flopping on-judicial-activism, House
Judiciary Committee Chairman Bob Goodlatte (R-Va.) called on the courts to check the presidents
overreach, and he complained that the federal courts have read their own powers much more
narrowly than they should.

Guns, Suicide, and Homicide

TO THE EDITOR: Because public health research predictably guides a generation of
public policy, it is necessary to scrutinize the political science underlying the paired
systematic review (1) and editorial (2) on gun control. Challenges are detected to
fundamental standards that may compromise an otherwise sound meta-analysis of
available literature. The last sentences of each are revelatory, for Anglemyer and
colleagues review finds restricting *access to a firearm in the home+ may effectively
prevent injury (1) and Hemenways accompanying editorial concludes that obtaining a
firearm not only endangers those living in the home but also imposes substantial costs
on the community (2). Notwithstanding unaddressed Second Amendment constraints,
the authors of both unabashedly campaign to restrict the right to bear arms, thereby
ignoring, for example, the human compulsion to manifest reasonable self-defense.

The intuitive deduction that the availability of a firearm will increase the risk that
momentary depression will yield suicide is consistent with modern lay culture (recalling
the 1945 movie Spellbound) and medical scholarship (recalling an essay published last
year in Annals [3]). Yet, it is undermined by the editorialist, who has argued that the
widespread ownership of firearms in private hands in the United States promotes the
spread of the disease of gun violence (4). He invoked a generalized reference to his
book when claiming There is no association between gun ownership levels and suicide
by means other than guns. These studies have controlled for depression *and+ suicidal


ideation. If true, this assertion would undermine efforts to include scrutiny of mental
health data during any mandated background checks; alas, it is untrue, because profiles
of psychiatric patients at high risk for suicide have been generated (5).

The study by Brent and colleagues was among the articles cited in Anglemyer and
colleagues review (article 26), prompting confusion because it was among 3 articles
cited in the online Appendix that purports to show the disposition of studies excluded
after full-text review along with 2 others (articles 32 and 60) because the study
populations were contained in previously published data included in this review (1).
Noting there are 59 print references and 97 online references, merely counting the
number of citations associated with a particular reason for exclusion yields the
observation that there is an admixture of articles that were included and articles that
were excluded (that is, some were among the references published in print and at least
1 was among those published online only). The authors should have provided a
crosswalk pairing of how one set of data was subsuming another set of myriad peer-
reviewed studies, precluding concern that any undue selectivity existed.

Therefore, author biasseeking the ability to generate the above preordained
outcomecould have clouded how subsidiary observations were drawn regarding, for
example, the allegation of enhanced risk for homicide by a household member.
Adopting a purely academic approach could have yielded insights as to the type of
mental health diagnoses that might predispose to criminal gun use. Indeed, this entire
body of work could then have been compared/contrasted with fatal violence committed
via nonhousehold, unregistered firearms, yielding far more useful insights as to what
societal interventions might be optimal.

Dear Reader (and those of you who took the red pill),

Last June, when the mainstream media collectively swooned over Wendy Davis and her
shoes, I was overcome with Fremdschmen. The only problem is that I didn't know what
Fremdschmen was back then.

But now I do! It's a floor wax and a dessert topping! No, that's not right. It's my new
favorite German word. What is amazing, to me at least, is that I am only just now
learning of this word, despite having a soft spot (right below my elbow) for fun foreign
words ("I myself am overcome with Backpfeifengesicht right now"). Even more
surprising is that we live in the Golden Age of Fremdschmen,so you'd think more
people would be using it.

So what does it mean? It means feeling embarrassed for someone else. But more than
that, it means feeling embarrassed for someone else because that someone else doesn't
realize he should be embarrassed.

"Fremdschmen describes the almost-horror you feel when you notice that somebody is
oblivious to how embarrassing they truly are," writes Daniel Hawes in Psychology Today.
"Fremdscham [the noun] occurs when someone who should feel embarrassed for
themselves simply is not, and you start feeling embarrassment in their place."

As Hawes notes, this feeling is the whole conceit behind "mockumentaries" like The
Office and the oeuvres of Larry David and Ricky Gervais. Also, the auditions for American
Idol and all of the related rip-offs are Fremdschmen factories, churning out
Fremdscham like kids in a Brazilian sweatshop cranking out Guy Fawkes masks for rich
white Occupy kids to use in their protests against economic exploitation. (Next time you
see an Urban Outfitter Bolshevik wearing one, you too can experience Fremdschmen).

But the Golden Age of Fremdschmen extends further than that. How many reality
shows are driven by the guilty pleasures that lay in the borderlands between
schadenfreude and Fremdschmen? Watch five minutes of Here Comes Honey Boo Boo
and you've watched four minutes and 55 seconds too much. But you will have watched
more than enough to recognize in yourself that weird form of American snobbery that


manifests itself as embarrassment for the lumpen proletariat's refusal to be
embarrassed by its own gaucheness.

Meanwhile, a big part of the reason why carbon-based humanoids like Miley Cyrus and
Lady Gaga generate so much buzz is that they are simply missing the gene that allows
them to be embarrassed for themselves. Of course, Cyrus's fans aren't embarrassed for
her, they love her "incredibly brave" (translation: utterly manufactured and banal)
taboo-breaking. But the fans still feed off Fremdschmen all the same. That's because
people like me are embarrassed for her or, more likely, her fans or her parents. And the
fans misinterpret the good sense of people like me (and many of you) as if it proves just
how rebellious Cyrus is. It's the same with teenagers who put staples through various
parts of their face and dress like they're auditioning to be a vampire's thrall; they think
my pity is proof of their daring social transgression.

Kids have been doing this for millennia. Parents say, "She should be mortified. I feel
horrible for her parents." The kid responds, "You just don't get it!" as if there's a deep
and rich complexity to wearing painted-on clothes and shaking your hindquarters like a
gibbon in heat. It is an eternal story of children insisting they're revolutionaries and
parents insisting, no you're idiots. And what the kids can't grok is that we recognize the
idiocy because we were idiots once too ("Once?" The Couch).

Clinton's Bequest

And then there's politics. I think one of the reasons why people hate politicians so much
these days is that the politicians are outsourcing their embarrassment to us. It's a kind
of passive aggression. A politician does something that in an earlier era would have him
searching his desk for his pearl-handled revolver or, at the very least, calling around to
various monastic orders to see where he could do penance. He lies about it for a while.

Then he is forced to confess. He's embarrassed, but only in the way a character in a
movie should be embarrassed at the end of Act Two. You know Act Three is coming, and
during that part of the story the politician is a changed man who's grateful for his
mistakes because they've helped him grow. Then, all of a sudden, the bad guy is anyone
who can't celebrate the politician's newfound humanity and generosity of spirit.

It all started in earnest with Bill Clinton, of course. The good news is that few politicians
have managed to replicate his performance. (His political performance! I'm quite sure
plenty of politicians have mimicked some of his other performances.) Anthony Weiner,
for instance, tried a comeback recently (as did Eliot Spitzer), but I think there was a
palpable sense of resentment from voters that their public displays of embarrassment
and contrition were of the check-the-box variety. Mea culpa? Check! File to get my
name on the ballot? Check. Now vote for me. The response from a lot of people was,
"You should be more embarrassed for yourself than we are for you. How dare you
expect us to carry the lion's share of your shame?"

How did I get on all this? Oh right, Wendy Davis.


Last June, when the media was largely ignoring Kermit Gosnell's abattoir, it was fawning
over Wendy Davis with a lack of self-awareness that fired up my Fremdschmen glands
more than watching the infamous lost episode of The Office where Michael Scott
auditions to be a gay porn star. The idiocy about Davis's sneakers alone reached the
point where I was expecting some Dana Bash type to rush onto the set during a
broadcast and scream, "Screw that noise, Wolf! I've got a piece of the One True Shoe!"

It wasn't just the juxtaposition with the media's scandalous reluctance to touch the
Gosnell story. It was full spectrum obliviousness. You could simply feel their confidence
that everyone should love this plucky hero from Texas. Even more palpable was their
certainty that everyone they know feels the same way. MSNBC was a veritable 24-hour
groupthink-cam in which we got to watch bunkered, insular, and smug MSMers assume
everyone shares their pieties and preferences. "Isn't she just fantastic! Who couldn't
love such a pretty lady who's a spiffy dresser in sensible shoes? She went to Harvard!
She's a mom! And what a mom! She's fighting to make sure that women can have their
unborn babies dismembered in utero right up until the minute before delivery! Why, it's
the feel-good story of the year!"

Of course, that's not how they characterized her agenda. They made it all about
"women's health" and their right to make their own medical choices. But as I ranted
about here a while back, these are euphemisms for exactly one -- okay one and a half --
things: abortion and birth control. (Birth control is half a thing because no one on the
right is trying to ban non-abortifacient birth control. Some of us don't want to pay for it,
but I don't want to pay for lots of things I don't want banned. I don't want to pay for
your Blu-ray copy of The Oogieloves, but that doesn't mean I want it outlawed.)

Moreover, these euphemisms are staggeringly hypocritical given the fact they are
spouted by the very same party that is determined to take more and more health-care
decisions away from women and their doctors. From that rant:

"You've got a state legislature up here that sometimes acts like it knows better than
women when it comes to women's own health-care decisions," the president said at a
typical rally in New Hampshire during the last campaign. "You know, my opponent's got
the same approach."

How odd from the eponymous father of Obamacare, which will mandate that women
(and men) pay for insurance coverage they don't need. It will cause many women (and
men) to lose their existing health-care plans. It will empower bureaucrats to decide
what treatments for women (and men) the government will reimburse and which it
won't. Under Obamacare, women who smoke or are overweight can be charged 30
percent to 50 percent more for their health insurance.

These features are defensible from a liberal or statist point of view, but not if you
actually believe that women have a special and unique right to make "health-care
decisions" for themselves wholly unfettered by the government.

A Girl Like Wendy


So it should be no surprise that when I heard the news this week that Wendy Davis isn't
the person the media thought she was, my Fremdschmen gave way to schadenfreude.
How to spin Davis's embellishments is not my problem. It is a problem for the MSM
which for some reason calls to mind The Sound of Music:

How do you catch a cloud and pin it down?
How do you find a word that means Maria Wendy?
A flibbertijibbet! A will-o'-the wisp! A clown!

The funny thing is that the liberal press egged on by their research department at
groups like ThinkProgress was so convinced that its own infatuation was universal it
never occurred to them that a) she might not be as awesome as they thought, b) that
running for governor in Texas on a plank of "late term abortions for everyone!" is really
pretty stupid, and c) that she's not a great politician just because you like her.

The best evidence for this is the fact that she said the one thing the one thing! you
shouldn't say about your wheelchair-bound opponent: "He hasn't walked a day in my

It's just a shame she can't run against Helen Keller. "My opponent needs to see the

Still, I never quite understood how her now-moot version of her life story
complemented her fight for late-term abortions. I mean her old tale was about how she
was a single mom who managed to go to Harvard Law School, blah blah blah. Right? So
the lesson was that having kids didn't hold her back. So why would her life story give
moral support for the idea that women need to have late-term abortions? Something
doesn't track there.

But now it turns out that her story is as operative as Anthony Weiner's "My Twitter
account was hacked" tale. The funny thing is the new, more accurate, version of her life
story is more helpful to the pro-choice side. It turns out that it was only because she had
a generous and successful husband that she was able to go to Harvard. And it looks like
she went to Harvard instead of, say, Texas A&M because she was more eager to go
to Harvard than she was to be there for her kids (for the full, devastating, version of her
story see Ann Coulter's column. Mona Charen has a slightly more charitable take).

The honest version of the pro-choice position is that young women shouldn't be, in
Obama's words, "punished with a baby" simply because they make a mistake. Abortion
supporters are absolutely right that having a child is a huge responsibility that can
require enormous sacrifices and can make it particularly hard for single mothers to
advance their careers. The fact that Davis needed a husband to take care of her kids and
send her to law school proves that point. The old story made it sound like being a single


mom is no hindrance to accomplishing all of your life goals which is an argument
you'd expect to hear from a pro-lifer.

Julia Hearts Huckabee

Yesterday Mike Huckabee said something that had the "Wendy Davis for Pope!" crowd
grasping for their fainting couches:

I think it's time for Republicans to no longer accept listening to
Democrats talk about a war on women. Because the fact is, the
Republicans don't have a war on women. They have a war FOR women.
For them to be empowered; to be something other than victims of their
gender. Women I know are outraged that Democrats think that women
are nothing more than helpless and hopeless creatures whose only goal
in life is to have a government provide for them birth control
medication. Women I know are smart, educated, intelligent, capable of
doing anything anyone else can do. Our party stands for the recognition
of the equality of women and the capacity of women. That's not a war
ON them, it's a war FOR them. And if the Democrats want to insult the
women of America by making them believe that they are helpless
without Uncle Sugar coming in and providing for them a prescription
each month for birth control because they cannot control their libido or
their reproductive system without the help of the government, then so
be it, let's take that discussion all across America because women are
far more than Democrats have made them to be. And women across
America have to stand up and say, Enough of that nonsense.

Now, I'll leave it to others to debate whether this was the best way to make this
argument. But I certainly think the shrieks of protest are a sign that it hit pretty close to
the mark. After all, what was the worldview behind the Obama campaign's "Julia"
slideshow other than one in which future Wendy Davises will no longer need a wealthy
husband to provide for them because the government will do it instead?

By the Power of the Constitution, I Cast Thee Out!

My column today is a little different. I originally intended it as a Burke-quote-heavy
philosophical discussion. But I figured that would turn people off. So instead I tried to
make the same point by noting that the Constitution offers little help in the fight against

The underlying point however is a very serious one that I think conservatives need to
noodle. On the right these days the one guaranteed way to win any argument is to be
even more absolute about "core principles" than the other guy. The interesting thing
about the phrase "core principles" is that it suggests our principles lie at the core of
something. Cores only exist in the presence of stuff outside the core, that's how the
core gets its definition. While there's a lot to like about the return to core principles, it's
worth considering that it is a kind of retreat, a fall-back position because our frontier
and intermediary defenses have been overrun. Core principles are all we've got left.


Edmund Burke had principles, but he didn't think principles were the most important
thing. Customs, traditions, wisdom i.e. the subtle ability to recognize the trade-offs
between competing goods and, yes, competing principles were far more important.
The deeper point of my column is that we've lost the ability to draw on that social
capital of custom and wisdom in ways that connect with the whole country. The moral
and cultural consensus has disintegrated, leaving our core exposed. I think something
very similar is happening on the left. More and more they talk about how America can
be run like a 1950s Scandinavian country, even though we have nothing like the social
cohesion and consensus of even contemporary Sweden (which has been moving away
from the Swedish model for years). The resort to universal principles is in many ways a
last resort. I still love conservative principles and I'm glad we're clinging to them, I just
wish we had more things to cling to as well.

persistence of the covert variety not only illustrates the profundity of the US/Israel

unjustly-cornered yet still-ferocious feline, BHO [and Kerry] could transform ambient
levels of personal frustration and dangerous uncertainty [stemming from unambiguous
exposure of paradigm-flaws and consequent ego-damage] into heightened bombast
that would necessitate [inter alia] rebellion by Congressional-Dems to restrain his

I have amply proven that it is simply impossible to drive a wedge between BHOs actions and the
underlying philosophy of Dems/Libs regarding domestic/social policies; now, compounding these fatal-
flaws are multiple articles depicting BHOs vacuousness *obamas-foreign-policy to nowhere, great-
dismal-swamp of us-foreign-policy+, Kerrys aloofness amidst growing recognition that the emperor
wears no clothes *strange-moral-calculus-of-john-kerry] and, with regard to the Middle East, Martin
Indyks consequent blind-spots and tactical failures. All of these damages are derived from a fatally-
flawed world-view that BHOs minions incessantly reformulate [ la input of progressives such as
Podesta]Progressive Bloggers who are Doing White House's Job, for this administration enjoys an
unprecedented advantage, a partisan media that has its back, minute-by-minuteand, thus, it is
necessary to probe and to articulate all that his stubbornness has wrought, in as much of an

Recalling that Presser-Carney repeatedly said *initially/throughout+ that there was NO evidence of
anything other than the video, ponder how he will evade recognition of an explosive intelligence report
concluding that officials knew it was a terrorist attack that killed four Americans on September 11, 2012,
that they knew right away, and that the lapse in security was preventable, based on intelligence the U.S.
already had about the area. ,My training in having been a Watergate-freak prompts me to conclude
as have many othersthat this set of scandals [and their ripple-effects] will be found to be is far worse
[in terms of fanciful-ideology; malice-aforethought, and relentless-implementation.] In lieu of being able
to hear Oval-Office Tapes, an e-mail paper-trail will be buttressed by testimony from any of the dozens
of CIA-agents who were @ the Annex [and whom BHO has scattered around the globe to minimize the

Certainly, uncertainties persist [Is the fact that Schumer logged into the White House at
5:30 p.m. on the evening of Sept. 11, 2012 and logged out at 11:59 p.m. indicative of the
possibility BHO was AWOL because he was engaged in debate-prep?+, but its clear that
BHO has relentlessly rewarded [Victoria Nuland Confirmed as Chief U.S. Envoy for
Europe Without GOP Objection] those who have helped him engage in the cover-up [the
video], the cover-up of the cover-up [the delayed release of the Rhodes memo] and the
cover-up of the cover-up of the cover-up [per Eileen, the necessary existence of more
suppressed e-mails].

The complacent/compliant media have also been impugned by Peggy Noonan ['Voxsplains' Media's
Motives for Joining Obama's Benghazi Cover-Up], to wit: Now the media is in a deep dark hole and as
desperate to protect themselves as they are Obama and Hillary. The fabricated two-year myth that
pretends Benghazi and the ensuing White House cover-up are all part of a partisan nothingburger, must
survive. So much is at stake for the media: their need to lie to themselves, the hope of another Clinton
presidency, and the legacy of Obama, who they assured us was up for the job.

Exemplifying efforts of the media to rehab themselves is this essay [Seven
lessons Tommy Vietor taught us] based on the unbelievably enlightening interview he
inexplicably provided to FNCwhich merits repeat-viewing, if only because of the overt-
conflicts between simple-declarative-sentences therein and sworn testimony of others.

In any case, when Tommy *who recalls Eddie Haskell of Leave it to Beaver fame+ said that they were
able to invoke the videos impact on worldwide demonstrations due to newspaper reports, he was
both ignoring intelligence and perhaps presaging what was published subsequently; note the content
and import, for example, of this mis-step by BHOs Grey Lady *c/o Caroline Glick, annotated]:

The New York Times just delivered a mortal blow to the Obama administration and its
Middle East policy.

Call it fratricide. It was clearly unintentional. Indeed, is far from clear that the paper
even realizes what it has done.


Last Saturday the Times published an 8,000 word account by David Kirkpatrick detailing
the terrorist strike against the US consulate and the CIA annex in Benghazi, Libya on
September 11, 2012. In it, Kirkpatrick tore to shreds the foundations of President Barack
Obamas counter-terrorism strategy and his overall policy in the Middle East.

Obama first enunciated those foundations in his June 4, 2009 speech to the Muslim
world at Cairo University. Ever since, they have been the rationale behind US counter-
terror strategy and US Middle East policy.

Obamas first assertion is that radical Islam is not inherently hostile to the US. As a
consequence, America can appease radical Islamists. Moreover, once radical Muslims
are appeased, they will become US allies, (replacing the allies the US abandons to
appease the radical Muslims).

Obamas second strategic guidepost is his claim that the only Islamic group that is a
bona fide terrorist organization is the faction of al Qaida directly subordinate to Osama
bin Ladens successor Ayman al-Zawahiri. Only this group cannot be appeased and must
be destroyed through force.

The administration has dubbed the Zawahiri faction of al Qaida core al Qaida. And
anyone who operates in the name of al Qaida, or any other group, that does not have
courtroom certified operational links to Zawahiri, is not really al Qaida, and therefore,
not really a terrorist group or a US enemy.

These foundations have led the US to negotiate with the Taliban in Afghanistan. They
are the rationale for the USs embrace of the Muslim Brotherhood worldwide. They are
the basis for Obamas allegiance to Turkeys Islamist government, and his early support
for the Muslim Brotherhood dominated Syrian opposition.

They are the basis for the administrations kneejerk support for the PLO against Israel.

Obamas insistent bid to appease Iran, and so enable the mullocracy to complete its
nuclear weapons program is similarly a product of his strategic assumptions. So too, the
USs current diplomatic engagement of Hezbollah in Lebanon owes to the
administrations conviction that any terror group not directly connected to Zawahiri is a
potential US ally.

From the outset of the 2011 revolt against the regime of Muammar Qaddafi in Libya,
it was clear that a significant part of the opposition was comprised of jihadists aligned
if not affiliated with al Qaida. Benghazi was specifically identified by documents seized
by US forces in Iraq as a hotbed of al Qaida recruitment.

Obama and his advisors dismissed and ignored the evidence. The core of al Qaida,
they claimed was not involved in the anti-Qaddafi revolt. And to the extent jihadists
were fighting Qaddafi, they were doing so as allies of the US.


In other words, the two core foundations of Obamas understanding of terrorism and
of the Muslim world were central to US support for the overthrow of Muammar
Qaddafi. With Kirkpatricks report, the Times exposed the utter falsity of both.

Kirkpatrick showed the mindset of the US-supported rebels and through it, the
ridiculousness of the administrations belief that you cant be a terrorist if you arent
directly subordinate to Zawahiri.

One US-supported Islamist militia commander recalled to him that at the outset of the
anti-Qaddafi rebellion, Teenagers came running around*asking+ Sheikh, sheikh, did
you know al Qaida? Did you know Osama bin Laden? How do we fight?

In the days and weeks following the September 11, 2012 attack on the US installations
in Benghazi in which US Ambassador to Libya Christopher Stevens and four {three} other
Americans were killed, the administration claimed that the attacks were not carried out
by terrorists. Rather they were the unfortunate consequence of a spontaneous protest
of otherwise innocent Libyans.

According to the administrations version of events, these guileless, otherwise friendly
demonstrators, who killed the US ambassador and four {three} other Americans, were
simply angered by a YouTube video of a movie trailer which jihadist clerics in Egypt
had proclaimed was blasphemous.

In an attempt to appease the mob after the fact, Obama and then secretary of state
Hillary Clinton were filmed in commercials run on Pakistani television apologizing for the
video and siding with the mob against the movie maker, who to date is the only person
the US has imprisoned following the attack. Then ambassador to the UN and current
National Security Advisor Susan Rice gave multiple television interviews placing the
blame for the attacks on the video.

According to Kirkpatricks account of the assault against the US installations in
Benghazi on September 11, 2012, the administrations description of the assaults was
a fabrication. Far from spontaneous political protests spurred by rage at a YouTube
video, the attack was premeditated. US officials spotted Libyans conducting
surveillance of the consulate nearly 15 hours before the attack began.

Libyan militia warned US officials of rising threats against Americans from extremists
in Benghazi, two days before the attack.

From his account, the initial attack in which the consulate was first stormed was
carried out not by a mob, but by a few dozen fighters. They were armed with assault
rifles. They acted in a coordinated, professional manner with apparent awareness of
US security procedures.

During the initial assault, the attackers shot down the lights around the compound,
stormed the gates, and then swarmed around the security personnel that ran to get
their weapons, making it impossible for them to defend the ambassador and other
personnel trapped inside.


According to Kirkpatrick, after the initial attack, the organizers spurred popular rage
and incited a mob assault on the consulate by spreading the rumor that the Americans
had killed a local. Others members of the secondary mob, Kirkpatrick claimed were
motivated by reports of the video.

This mob assault, which followed the initial attack and apparent takeover of the
consulate, was part of the predetermined plan. The organizers wanted to produce
chaos. As Kirkpatrick explained, The attackers had posted sentries at Venezia Road,
adjacent to the [consulate] compound, to guard their rear flank, but they let pass
anyone trying to join the mayhem.

According to Kirkpatrick, the attack was perpetrated by local terrorist groups that
were part of the US-backed anti-Qaddafi coalition. The people who were conducting
the surveillance of the consulate 15 hours before the attack were uniformed security
forces who escaped in an official car. Members of the militia tasked with defending
the compound participated in the attack.

Ambassador Stevens himself, who had served as the administrations emissary to the
rebels during the insurrection against Qaddafi knew personally many of the terrorists
who orchestrated the attack. And until the very end, he was himself taken in by the
administrations core belief that it was possible to appease al Qaida-sympathizing
Islamic jihadists who were not directly affiliated with Zawahiri.

As Kirkpatrick noted, Stevens helped shape the Obama administrations conviction that
it could world with the rebels, even those previously hostile to the West, to build a
friendly, democratic government.

The entire US view that local militias, regardless of their anti-American, jihadist
ideologies could become US allies was predicated not merely on the belief that they
could be appeased, but that they werent terrorists because they werent al Qaida

As Kirkpatrick notes, American intelligence efforts in Libya concentrated on the
agendas of the biggest militia leaders and the handful of Libyans with suspected ties to
al Qaida. The fixation on al Qaida might have distracted experts from more imminent

But again, the only reason that the intelligence failed to notice the threats emanating
from local US-supported terrorists is because the US counter-terrorist strategy, like its
overall Middle East strategy is to seek to appease all US enemies other than the parts
of al Qaida directly commanded by Ayman al-Zawahiri.

Distressingly, most of the discussion spurred by Kirkpatricks article has ignored the
devastating blow he visited on the intellectual foundations of Obamas foreign policy.
Instead, the discussion has focused on his claim that there is no evidence that al Qaida
or other international terrorist group had any role in the assault, and on his assertion
that the YouTube video did spur to action some of the participants in the assault.


Kirkpatricks claim that al Qaida played no role in the attack was refuted by
theTimes own reporting six weeks after the attack. It has also been refuted by
Congressional and State Department investigations, by the UN and by a raft of other

His claim that the YouTube video did spur some of the attackers to action was
categorically rejected last spring in sworn Congressional testimony by then deputy chief
of the US mission to Libya Gregory Hicks.

Last May Hicks stated, The YouTube video was a non-event in Libya. The video was
not instigative of anything that was going on in Libya. We saw no demonstrators
related to the video anywhere in Libya.

The reason the Kirkpatricks larger message that the reasoning behind Obamas entire
counter-terrorist strategy and his overall Middle East policy is totally wrong, and deeply
destructive has been missed is because his article was written and published to
whitewash the administrations deliberate mischaracterization of the events in
Benghazi, not to discredit the rationale behind its Middle East policy and counter-
terrorism strategy. This is why he claimed that al Qaida wasnt involved in the attack.
And this is why he claimed that the YouTube video was a cause for the attack.

Now, after this episode we can understand former Secretary of Defense Robert Gates'

memoir, Duty. Gates has been unfairly maligned by the liberal media megaphones for

Polarization and Incivility.'] I started listing the categorization of impeachable-offences,
which he interrupted by claiming I was symptomatic of all that he was condemning,

discount anything that I said, thereby reflecting the problems faced by BHO and Dems.

yesterday. It is possible that at friendly amendment will emerge, meshing the positive
views of most everyone involved in this lobbying effort (which has mushroomed).

[2]Combat BHOs Ongoing Assault upon Classical American [Judeo-Christiian] Values
via Liberal Fascism by recognizing how insidious are the efforts of his minions.

[3]The Benghazi-Gate House-Investigation is causing the Dems to experience angst;
educational efforts must be maximized to impress upon the electorate how profoundly
BHO has abused-power *beyond any potential discretionary rationalization+.

Islamist Abuse in this one country; again, educational efforts must be maximized to help

fashionin orderwere MERS, California needs rain, Magic Johnson responds to Sterling, driver hit a
store [no injuries], and Nigeria [American drones are being used, per stock-video.

Is there any wonder why CBS-News hasnt covered BHOs Scandal-Sheet, why CBS' 'The
Mentalist' Depicts Murderer of Women as Friend of George W. Bush; why a Major Dem

poor districts; over the same period, wealthy race-horse owners received $1.5 billion in

Federation of Teachers blames on Gov. Corbett were actually a decrease in federal
funding when President Barack Obamas 2009 stimulus spending came to an end+.

In any case, recognizing the fact that Holocaust Education varies from state-to-state [Jewish Exponent,

have I] that the Benghazi Scandal constitutes the Biggest Cover-up Since Watergate; Brit Hume added
that the Geithner Revelations Make White Houses Benghazi Claim 'Inconceivable.'

The benghazi-investigation is already-tearing-apart-the-democratic-party, as the dems
have-become-benghazi-deniers, quoting Harry Reid [using both his and the Obama
regimes classic Marxist, class-warfare rhetoric, while slipping in another Koch Brothers
attack], Charlie Rangel [Americans Wont Lose Any Sleep Over Benghazi], and Michael
Bloomberg [defending Hillary, he wonders, 'What'd You Expect Her to Do in Benghazi?'
and calls criticizing Hillary "cheap politics." Perhaps taking-the-cake is the claim that U.S.
Ambassador Christopher Stevens wasnt murdered the night of the Benghazi attacks,

That Remain Unanswered About Benghazi:

1. Why was the State Department unwilling to provide the requested level of security to
Benghazi in the summer of 2012?

2. Did President Obamas daily intelligence briefings in the run-up to September 11, 2012
support the assertion that there was no credible threat of a coordinated terrorist attack
on Benghazi during this time? And if so, why does the White House not declassify and
release the briefings, as President George Bush did his pre-September 11, 2001

3. Why did we not anticipate the need to have military assets at the ready in the region on
the anniversary of September 11, of all days?

4. Did President Obama sleep the night of September 11, 2012? Did Secretary Clinton?
When was President Obama told about the murder of our ambassador?

5. If the secretary of defense thought there was no question this was a coordinated
terrorist attack, why did Ambassador Susan Rice, Secretary Clinton, and President
Obama all tell the American people that the cause was a spontaneous demonstration
about an internet video?

6. Why did former deputy CIA director Mike Morell edit the intelligence community talking

revenge for an establishment candidates victory last week in North Carolina. But Sasse
has been quite good at running for Senate. His tea-party backed counterpart in North

Mississippi, Georgia, Kansas and certainly in McConnells own Kentucky. Conversely,
base-buoying candidates are doing just fine in places like Oklahoma, Iowa and Michigan.

Chickens counted, not hatched - So who cares which very conservative candidate wins a
Nebraska primary in which fewer than 200,000 votes may be cast? The seat is safely
Republican and either Sasse or the frontrunner he supplanted, former state Treasurer
Shane Osborn, would have a nearly identical voting record in the Senate. The only ones
who really care are those who are already counting votes for leadership posts in an
imagined Republican majority next year. McConnell is all but certain to retain his
position atop the heap if he survives a stiff Democratic challenge this fall, but when it
comes to other posts in the leadership team and, more importantly, deciding which
strategies the party would pursue, loyalties count. Sasse, supported by Sen. Ted Cruz, R-
Texas, and Sen. Mike Lee, R-Utah, would not go along to get along. Osborn, who has
paid his dues in the party and is backed by McConnell loyalists, would likely be a reliable
vote for Team Mitch. This jockeying for future Senate scrimmages has no doubt made
the race uglier and far more expensive than necessary, but hey, politics is a tough
business. Sometimes you husk, sometimes you get husked.

Discerning - All this effort for drafting fantasy teams for the 114
Congress is fine for the
political junkie set and for those looking to lobby or otherwise pull the strings of the
Senate. But what about the decent people? What seems to be happening is that
Republicans are embracing the old William F. Buckley rule of backing the most
conservative candidate who can win. The long-running feud between McConnell and
his foe, former South Carolina Sen. Jim DeMint, who now leads the Heritage
Foundation, is great for Beltway smack-talkers but not of much consequence to regular
folks. The mistakes Republicans made in 2010 and 2012 related to placing these kinds of
allegiances ahead of practical considerations, like, you know, actually getting into the
Senate. Some establishmentarians will win this year, some may lose. The same goes for
the outsiders. But in the end, these races will all come down to Republican voters taking
the measure of their options. Sasse has run well and made few mistakes. Osborns
campaign faltered on a couple of occasions. Voters may have concluded that Sasse is the
steadier choice. Making overbroad interpretations about national trends from that
would be dangerous. But one thing is showing through so far this year: Republican
voters are showing a degree of discernment we didnt see from them in the previous
two cycles.

Campaign Carl wants to know if all the outside money and negative attacks in
Nebraskas Republican U.S. Senate primary could backfire on the two frontrunners,
Midland University President Ben Sasse, with support from tea party groups and outside
super PACs had inched into a slight lead in the polls over former state treasurer and
establishment favorite Shane Osborn. But heading into the final stretch, three national
super PACs backing Sasse unleashed attacks on a third candidate, banker Sid Dinsdale,


who ran no attack ads in his campaign and won the endorsement of the states largest
newspaper all of which suggests Dinsdale is worth very much watching tonight, too.

In West Virginia, seven-term Rep. Shelley Moore Capito is expected to easily win the
Republican primary. On the Democrat side, Secretary of State Natalie Tennant is bound
to secure her partys nomination. Capito is widely favored to win the seat currently held
by Sen. Jay Rockefeller, D-W.Va., with even Sen. Joe Manchin, D-W.Va., praising
Capitos candidacy. When Democrats recruited Tennant, the party had hoped
Republican infighting and resistance to moderate Capitos nomination would present an
opportunity. But, West Virginia will almost certainly move deeper into the loss column
for the blue team after tonight. Fine, but what about the states House races? There are
trends to be seen.

Rahall has rough ride ahead - Rep. Nick Joe Rahall, D-W.Va., faces a tough battle to
keep the seat he has held since 1977. Already considered one of the most vulnerable
incumbents, Rahall has drawn a testy primary challenge from retired Army Maj. Richard
Ojeda. While Rahall should cruise to victory, a strong showing even in defeat by the
underfunded Ojeda would be a key indicator that Rahall is toast. That would lead
national Democrats to write off Rahall, who is expected to face his toughest general-
election fight yet with state Sen. Evan Jenkins, a Democrat-turned-Republican. The
National Republican Congressional Committee named Jenkins to its Young Guns list
and the scant polling indicates Rahall will be start the general election cycle well behind
his challenger. Sixty-five percent of voters in the district backed Mitt Romney in 2012.

Two steps forward, one step back for GOP? - The test of how red West Virginia has
become will be in the 2
Congressional District, represented by Capito since 2001.
Democrats have drawn a strong contender in former state party Chairman Nick Casey,
but Republicans have been in an expensive, unpleasant four-way fight for the
nomination. (Read the Charleston Daily Mails take here.) A Democratic win in the fall
would encourage the national party to keep West Virginia on its map for the future.

NYT has the story of how ObamaCare is resulting in fewer choices for American health-
care consumers. As insurance costs go up, choices for care go down. But, according to
the Times and the companies selling limited-option plans as part of the law, maybe
thats a good thing. Instead of people getting all mixed up deciding how highly to
prioritize cost or coverage, the government just tells companies what to sell and then
people dont have to choose. This rationale results in the following quote from a
purveyor of narrow plans: We have to break people away from the choice habit that
everyone has, said Marcus Merz, the chief executive of PreferredOne, an insurer in
Golden Valley, Minn., that is owned by two health systems and a physician group.

Cant call it a win bonus - Daily Caller: The CEO of Colorados Obamacare exchange
was given a $14,000 bonus and a 2.5 percent cost of living raise on Monday, even as the
exchange struggles for ways to pay its bills in the coming years. Patty Fontneau is now
the third-highest paid director of a state-run Obamacare exchange, earning more than
$195,300, according to Health News Colorado. She raised hackles after her request for
the raise and bonus came to light in October, when the exchange was performing
miserably and not hitting even its worst-case scenario goals for enrollment.

While Republicans have set their sights on getting to the bottom of the Benghazi and
the IRS controversies, another scandal has been brewing that threatens to overtake the
administration sooner as in right now. Americans have been horrified to hear
allegations of fraud, faked documents, shoddy healthcare and deadly delays at Veterans
Affairs hospitals. It is unimaginable to most that those who have served our country
could be treated so poorly by the government that owes them so much. What started in
Arizona has now spread to other facilities around the country. And they just keep
coming. Last night, the agency revealed new reports about potential wrongdoing at a
North Carolina veterans hospital. If the scandal continues to snowball, two things will
likely happen: 1) President Obama will be forced to address the subject in greater
detail. 2) Secretary Eric Shinseki will have to step down. This doesnt feel like an
instance where the administration can do what it has attempted in other scandals and
ride it out or try to convince reporters it has already dealt with. But, in Washington,
anything can happen. Bret Baier.

Report: vets cancer tests delayed, denied - Patients of a southeast Texas Department
of Veterans Affairs facility had life-saving cancer tests delayed or denied as a cost-
cutting measure, a whistleblower told the Washington Examiner. Dr. Richard Krugman,
former associate chief of staff at the Veterans Affairs health care system based in
Harlingen, Texas, said his boss implemented a policy in 2010 that colonoscopies would
only be approved if the patient tested positive in three successive screenings for bloody
stools. By the time that you do the colonoscopies on these patients, you went from a

Boehner gives a nudge - Washington Examiner: House Speaker John Boehner said he is

to take up immigration reform legislation in small pieces, starting first with border
security. Boehner made the remarks at the San Antonio Chamber of Commerce during a
question-and-answer session with the editor of Texas Monthly. Boehner, when asked
whether the House would take up immigration reform this year, said it would depend
on whether he can bring my members along, and he acknowledged that one group of
GOP lawmakers has no interest in taking up the issue during an election year. There are


some members of my party that just do not want to deal with this," Boehner said. Its
no secret. But I do believe the vast majority of members of our party do want to deal
with this, and they want to deal with this honestly, openly and fairlyHe said it was
way too early to pick a top GOP presidential candidate. Weve got a lot of good

Rep. Tom Cottons campaign is hitting back against an NBC News/Marist College poll
that shows the Arkansas Republican trailing Sen. Mark Pryor, D-Ark., by 11 points. A poll
conducted for the campaign by GOP firm onMessage and provided to Fox News Fist
shows Cotton leading 42 percent to 40 percent. Among independents, Cotton leads 36
percent to 33 percent. Another 23 percent of independents are undecided, good news
for a challenger in a race with a longtime incumbent. Cottons camp argues that the NBC
News/Marist poll is unreliable, pointing out that it is not screened for likely voters and
that its sample includes just 23 percent registered Republicans in a state that has grown
increasingly red in recent elections.

The Atlantics Clare Foran explains why the growing influence of environmentalist and
billionaire Democratic bundler Tom Steyer is scaring some Democrats: Steyer, a hedge-
fund-manager-turned-green-evangelist, says he plans to raise up to $100 million during

from Sept. 23 through Election Day. The full size of the buy is about $3.5 million,
according to one source. Democratic Sen. Mark Begichs reelection campaign in Alaska
is expected to be one of the hardest-fought Senate races in the country this year. He will
face one of three Republican challengers: former state Attorney General Dan Sullivan,
the favored candidate of D.C. Republicans; Lt. Gov. Mead Treadwell; or conservative

Sullivan celebrates service in new ad - Roll Call: Alaska Republican Dan Sullivan
released his latest TV ad on Monday, a 30-second spot highlighting his military service


and pushing the message that the state needs a fighter again. The 30-second spot,
running on broadcast stations, never mentions Democratic Sen. Mark Begich. But the
incumbents photo is briefly plastered on screen alongside President Barack Obama. As
a Marine, I learned that talk is cheap and results are what matter. But thats not how
they operate in Washington, Sullivan says as the two Democrats photos appear.

The Hill: Sen. Lindsey Graham (R-S.C.) is touting his energy chops in statewide TV and
radio ads released Monday. The ads, boasting Grahams push for the Keystone XL
pipeline and drilling, come with less than one month left before Graham faces off with
six Tea Party-affiliated Republican candidates in South Carolinas primary election. In
the 30-second video ad, Pipeline, former U.S. Ambassador David Wilkins praises
Graham for being the first U.S. senator to visit the oil sands in Canada. Every drop of oil
we get from Canada is one less drop we have to get from countries in the Middle East,
countries that dont like us. Lindsey Graham understood that before most people
understood it, Wilkins, a former South Carolina state House Speaker, says in the TV ad.
The 60-second radio ad, also released on Monday, opens to the sound of gunfire in a
war zone as the narrator asserts that terrorism is on the rebound. The voice goes on to
state that despite the increase in terrorism, the U.S. continues to import nearly $400
billion a year in foreign oil.

The Hill: Sen. Jeanne Shaheens (D-N.H.) new campaign ad features a small-business
owner touting the senators work for companies like hers in New Hampshire. In the ad,
Adria Bagshaw, the vice president of a New Hampshire steel company, declares of the
senator: What really impresses me about Jeanne Shaheen is, if we bring a problem to
her she cares and shes going to listen. Bagshaw says Shaheen is working to help small
businesses export products, access credit and train high-skill workers. I think Jeanne
Shaheen really makes a difference for New Hampshire, Bagshaw concludes, as a shot of
Shaheen appearing with the plants workers appears on the screen. The ad will begin
airing Tuesday, as National Small Business Week launches in cities across the nation.

The stakes are high for Democrats come November as they need to limit Republican
gains in the Senate to five or fewer in order to retain control of the upper chamber. If

This column is beyond a pay-wall [Bret Stephens: Iran Doesn't Want a Deal] and, thus, is
being reprinted in-toto; it captures the past/present/future succinctly, profoundly:

John Kerry began the year trying to bring representatives of the Assad regime together
with rebel leaders in Geneva to end the civil war in Syria.

It was bound to fail. It failed. Strike one.

Next, the secretary of state worked tirelessly to create a framework agreement between
Israelis and Palestinians, with a view to settling their differences once and for all.

It was bound to fail. It failed. Strike two.

This week, U.S. negotiators and their counterparts from the P5+1the five permanent
members of the Security Council, plus Germanywill meet in Vienna with Iranian
negotiators to work out the details of a final nuclear agreement.

You know where this is going.

There's been a buzz about these negotiations, with Western diplomats extolling the
unfussy way their Iranian counterparts have approached the talks. Positions are said to
be converging; technical solutions on subjects like the plutonium reactor in Arak are
being discussed. Last month Iranian Foreign Minister Mohamad Javad Zarif said there
was "50 to 60 percent agreement."

All this is supposed to bode well for a deal to be concluded by the July deadline. If the
Iranians are wise, they'll take whatever is on the table and give Mr. Kerry the diplomatic
win he so desperately wants. Time is on Tehran's side. It can sweeten the terms of the
agreement later onincluding the further lifting of sanctionsthrough the usual two-
step of provocation and negotiation.


The only thing Iran has to fear is an Israeli military strike. For that to happen, Jerusalem
needs (or believes it needs) conditions that are both militarily and diplomatically
permissive. By agreeing to a deal, the Iranians further restrict Israel's options without
permanently restricting their own.

But Iran is not wise. It is merely cunning. And fanatical. Also greedy, thanks to a long
history of being deceitful and obstreperous and still getting its way without having to
pay a serious price. So it will allow this round of negotiations to fail and bargain instead
for an extension of the current interim agreement. It will get the extension and then
play for time again. There will never be a final deal.

Why am I so confident? Listen to the man with the last word first: "They expect us to
limit our missile program while they constantly threaten Iran with military action,"
Supreme Leader Ali Khamenei said Sunday. "So this is a stupid, idiotic expectation. The
Revolutionary Guards should definitely carry out their program and not be satisfied with
the present level. They should mass produce."

Ballistic missiles are lousy weapons for anything except the rapid delivery of chemical or
nuclear warheads. (The 39 Iraqi Scuds that hit Israel in 1991 killed two people.) But
limiting the number and range of ballistic missiles is central to any agreement that aims
to prevent Iran from having a rapid nuclear-breakout capability. Mr. Khamenei's public
call to mass produce missiles is not exactly an indication of seriousness about a final

Also a sign of non-seriousness was last month's call by Ali Akbar Salehi, head of Iran's
Atomic Energy Organization, to add an additional 30,000 centrifuges to Iran's existing
19,000. "So far we have produced seven to eight tons of enriched uranium," he said. But
he wants Iran to produce 30 tons, ostensibly to fuel the civilian nuclear plant at Bushehr.
And that's 30 tons a year. A single ton of civilian-grade uranium suffices, with further
enrichment, for a single atomic bomb.

Still not getting the drift? "Iran will not retreat one step in the field of nuclear
technology," said one prominent Iranian over the weekend. "We have nothing to put on
the table and offer to them but transparency. That's it. Our nuclear technology is not up
for negotiation."

That's Iranian President Hasan Rouhani speaking. For good measure, he added that Iran
would go back to producing 20% enriched uraniumwhich is close to weapon-grade
"whenever necessary." And he's the moderate. Even the Obama administration cannot
accept a deal that allows Iran to expand its centrifuge capabilities or enrich uranium to

The hardening of Tehran's negotiating position is another reminder of the blunder the
administration made when it agreed to the interim deal and then turned on Congress to
prevent automatic sanctions in the event Iran failed to make a final deal. "Show that you
are strong, and you will see results"such was the advice Mr. Rouhani confidentially


offered an Israeli agent posing as a U.S. official in 1986 on how to deal with the
Ayatollah Khomeini. The advice is still sound.

In the meantime, the administration needs to think about what it will do when Mr. Kerry
strikes out. Is there a Plan B, other than the president's now trademark mix of hollow
threats and soliloquies on the limits of presidential power? I doubt it. Goethe wrote
that nothing is worse than aggressive stupidity, which is true. But pompous impotence
surely comes in second place, and this administration combines aspects of both.

The Israelis may sit still through all this. But Mr. Kerry shouldn't count on it.

This morning you're seeing some folks celebrating this result as a win for the Tea Party

President Bush appointed him as Assistant Secretary of the U.S. Department of Health
and Human Services.

It's good news for conservatives and it's very good news for National Review. Sasse ran

heavy favorite in November, Sasse is very much a health policy wonk, who will have
something to say on Obamacare beyond "repeal it, it stinks."

Agitation to Bestow Amnesty on Undocumented/Illegal Aliens/Immigrants

Although forever in the background, noise for reform has enhanced recently, as the threat to certain
incumbents [Fitzpatrick] abates, due to quiet passage of primary-election deadlines. In many respects,
the agitation has been sparked by the GOPparticularly Boehner and Republicans who look to loosen
penalties on illegalsrecognizing that this represents only a minority of the GOP; because Boehner has
demonstrated a propensity to violate the Hastert Rule to attain passage of legislation *adding some Rs
to unanimous Dems+, what is threatened is a reconciliation bill *generated either piecemeal or in a
unitary fashion] with the Senate version [which passed] that would become law despite opposition from
a majority of the House Caucus. The overall forces at-play reflect the ongoing conflict between the
Establishment *Wall St./K St.+ and the base *Main St.+, as per the thrust of this essay:

Boehners Crocodile Tears for Amnesty


Such a weird little battle over meaningless and known outcomes. Conservatives, aware
from press reports and congressional leaks, knew what would be in the Paul Ryan
drafted budget plan. The conservative groups released statements in opposition to the
plan based on what they had been told. But there was never any doubt about the Ryan
plan passing.

After the plan was publicly unveiled by the Republicans at six oclock on a Tuesday night,
conservative fears were realized. Those things they knew would be in the plan were, in
fact, in the plan. The plan funded Obamacare. The plan raised taxes. The plan broke the
sequestration spending limits that only a month before Republican leaders had said
would never be broken.

Speaker Boehner then did something curious. He held two press conferences wherein
he lashed out at conservative groups. He denounced them for making up their minds
before the plan was publicly unveiled. Never mind that everyone knew what would be in
the plan. Never mind that he only gave the public thirty-six hours to explore the text of
the plan a violation of a campaign promise to give at least seventy-two hours of
examination. Speaker Boehners statement sounded like former Speaker Pelosi claiming
we had to pass the Ryan plan to find out what was in the Ryan plan.

Superficially, it is a very odd fight. But Speaker Boehners crocodile tears in his attacks
and cries against the conservative movement are really about the next fight. Speaker
Boehner intends to pursue immigration reform, with an amnesty component. Before he
gets there, he needs to shape battle lines.

These hyperlinks are provided in a fashion that captures both the major components of this controversy
and certain nuances that have otherwise not been noted. Know at the onset that the total number of

and effort to become naturalized citizens in pursuit of personal freedom

borders. Immigration reform cannot happen without this necessary first

The resulting task for conservatives is akin to whack-a-mole, in that each argument

economics]. Numerous interest-groups [immigration-officers-union: end-political-

this task, and this is how one might envision how-amnesty-goes-away.

The Supreme Court upheld a lower Federal court ruling that allows local governments to
pass ordinances requiring verification to keep illegal aliens out of jobs and out of
apartments, if written like the two in Fremont, Nebraska.

underemployed residents by requiring businesses to only hire legal workers and
blocking their ability to rent a house or apartment.

The "Show Me" state has again shown us how it should be done. There needs to

In 2007, Missouri placed on the ballot a proposed constitutional amendment
designating English as the official language of Missouri. In November, 2008,
nearly 90% voted in favor! Thus, English became the official language for ALL
governmental activity in Missouri. No individual has the right to demand
government services in a language OTHER than English.

In 2008, a measure was passed that required the Missouri Highway Patrol and
other law enforcement officials to verify the immigration status of any person
arrested, and inform federal authorities if the person is found to be in Missouri
illegally. Missouri law enforcement officers receive specific training with respect
to enforcement of federal immigration laws.

In Missouri, illegal immigrants do NOT have access to taxpayer benefits such as
food stamps or health care through Missouri Health NET.

In 2009, a measure was passed that ensures Missouri 's public institutions of
higher education do NOT award financial aid to individuals who are illegally in
the United States. In Missouri, all post-secondary institutions of higher
education to annually certify to the Missouri Dept. Of Higher Education that
they have NOT knowingly awarded financial aid to students who are unlawfully
present in the United States.

So, while Arizona has made national news for its new law, it is important to
remember, Missouri has been far more proactive in addressing this horrific


problem. Missouri has made it clear that illegal immigrants are NOT welcome in
the state and they will certainly NOT receive public benefits at the expense of
Missouri taxpayers.

The National Defense Authorization Act of 2015 was passed by the House Armed
Services Committee without any amendments that would have granted amnesty to
certain illegal aliens. But, the fight simply moves now to a different venue.

The Committee's markup wasn't void of some drama, though The Ranking
Member, Rep. Adam Smith (D-Wash.), did offer Rep. Jeff Denham's (R-Calif.)
ENLIST Act as an amendment, but withdrew it after not taking the required
steps to offer such a significant amendment.

Within the next few weeks, House Leaders will bring the bill before the entire
House, but not before going through the Rules Committee, which will establish
the rules for debate. The Committee can pass a closed rule (no amendments can
be offered), a restricted rule (only certain amendments can be offered), or an
open or modified-open rule (any amendment can be offered - with a few
requirements if it's modified).


The best case scenario would be for a closed rule, but if last year is any
indication, it'll be a modified-open rule. That's why we've already asked our
activists who have Congressmen on the Rules Committee to send faxes, urging
its Members not to allow a vote on the ENLIST Act or Rep. Mike Coffman's (R-
Colo.) Military Enlistment Act. Both bills would grant amnesty to illegal aliens
who enlist in the military.

Anticipating an open rule, we've already posted faxes on your Action Board
asking all House Members to oppose any amnesty amendment to the NDAA.
The bill is opposed by the nation's largest veterans group, the American Legion,
and, this week, 16 former military officers signed a letter opposing the bill.

Cold Realities Lie Ahead On ObamaCares Costs

The White House is trying to manufacture good news about ObamaCare, but cold
realities lie ahead that will reveal the truth about the laws success or failure. All we
have to do is follow the money.

Who has paid? This is crucial to determining how many of the eight million that the
president says enrolled in federal and state exchanges actually completed the
purchasing contract by paying the premium. If the news were good, wed assume the
administration would have released it.

A McKinsey survey estimated that only 53% of previously uninsured enrollees had paid
their premiums, while 86% of previously insured enrollees had paid.

Georgia Insurance Commissioner Ralph Hudgens said that insurance companies
participating in the ACA exchanges in his state have received payment from only about
half of those who applied for coverage. Georgia insurers received more than 220,000
applications for health coverage, but premiums had been paid for only 107,581 of those
policies by the end of March.

The number of paying customers may be higher in other states. But how many who do
pay the first months premium will pay the second, third, and fourth month, especially
after they learn of the limited benefits and high deductibles the policies carry?


Big premium increases: The Obama administration has touted a Congressional Budget
Office report that says the health law will cost about $5 billion less than originally
projected this year and $104 billion less over 10 years. Thats partly because the
Supreme Court made Medicaid expansion optional for the states and because the
Obama administration has made (mostly illegal) changes to the law that give more
people escape hatches.

CBO numbers are one thing, but pocketbook costs are another. Avik Roy writes in
Forbes that individual-market premiums this year are 41% higher on average than last
year and, in some states, more than 100% higher.

Lower spending for the government doesnt mean lower costs for people. Sticker shock
is coming for next years rates, according to insurance company executives. While
companies are trying to keep premiums low to keep and attract enrollees, analysts
expect premiums to triple in some states. People will begin to learn just how high the
new prices will be this fall before the next enrollment period begins in November.

One reason premiums will increase next year is because the exchanges have not
succeeded in enrolling enough healthy young people to pay more than their share of
premiums, partly because young people up to age 26 were allowed even encouraged
to stay on their parents plans. Another factor: After strong blowback from people
angry their plans had been cancelled, the administration is letting states allow people to
keep their old health plans instead of forcing them into the new exchanges. This
worked against the administrations goal of attracting a normal risk pool in the

Sicker enrollment mix: Pharmaceutical benefit manager Express Scripts found that
enrollees in the ObamaCare exchanges are likely to be more expensive than patients in
commercial risk pools. Its new study shows that enrollees in federal and state
exchanges have a 47% higher use of specialty medications than in commercial plans in
general. The rate for HIV medications in ObamaCare exchange plans is four times
higher, and the proportion of pain medication prescribed was 35% higher than
commercial plans.

While it was to be expected that those with more health needs would have a greater
incentive to sign up for coverage, their higher costs will not be offset by the 40% of
healthy younger people who the administration needed to enroll and pay
disproportionately higher rates for their insurance. Only 28% of enrollees were in the
coveted 18-34 age group.

All of this is likely to add to the sticker shock to come.

Payback: While the penalties for not having compliant health insurance are relatively
modest the first year, the bigger financial burden for some exchange enrollees could be
paying back extra subsidies they may receive. People who make more money in 2014
than they estimated on the ObamaCare enrollment form will likely receive a larger
subsidy than they were eligible for. They will have to pay back the difference, or some


part of it, to the federal government when they file their tax returns next year. This
could be an unexpected hit of several thousand dollars for some people.

Paying through rationing of providers: Millions of Americans are facing much higher
health insurance costs as a result of the laws mandates, and many more are finding it
difficult to find a doctor to see them because of the tiny networks in the ObamaCare
health plans. This is especially vexing for patients with chronic illnesses who are losing
their doctors and who are seeing treatments interrupted or even stopped.

Washington State has decided to create more bureaucracy to try to fix the problems
caused by having too much bureaucracy. Insurance Commissioner Mike Kreidler is
expected to approve new rules this week that would make it harder for health insurance
companies to offer narrow networks in order to keep premiums down. Consumers
shouldnt have to drive too far or wait too long for care and should be able to find
specialists who will see them, he insists, adding that he doesnt believe prices will
increase as a result.

This is called the Affordable Care Act, not the Accessible Care Act, said Bill Hinkle, a
former state legislator. According to Seattles KPLU radio:

Companies in the private marketplace compete vigorously to provide American
consumers with the best value for their money. But thats not how ObamaCare works.
Instead, companies are forced to jump through an endless array of regulatory hoops to
appease government bureaucrats.

The result is high deductibles, high premiums even after subsidies, and limited choices
of doctors and hospitals, jeopardizing health coverage for those who get insurance at
work when the employer mandate is reactivated.

Taxpayers are footing the bill.

Regarding Fannie and Freddie, reform will get more difficult. Shifting leadership dynamics underscore
why supporters pushed so hard for this year's proposal, which probably wont be voted upon in 14 due
to opposition by some Dems. The Senate Banking Committee approved legislation that would get rid of
Fannie Mae and Freddie Mac and overhaul the mortgage finance market.

on the idea that businesses and families will act irrationally unless the government

Export-Import Bank
As the battle over Ex-Im continues to threaten deep pockets of special interests across
the country, many are the feeling the heat of the banks likely demise. While this is a
clear victory for American taxpayers, some DC powerbrokers will go to great lengths to
avoid dissolving the corporate slush fund. To this end you will notice many in the
political class seeking Ex-Im reforms in place of termination. Behind the faade of
compromise, these advocates know they are protecting status quo protection of big-
business interests. Half-measures and superficial improvements cannot guarantee
taxpayer safety any more than they can put a stop to the cronyism that results from
bureaucrats taking the place of bankers. The only way to reform Ex-Im is to end it.


Tax Extenders
This week, Senate Democrats plan to bring to the floor an $85 billion grab-bag of tax
promises extending current policy. This tax extenders package is a sad display of the
well-connected special interests finding preference in our nations tax code. Congress
should allow the extenders that do not move us toward a pro-growth, neutral tax code
to expire and return to the drawing board to develop fair policy that brings an end to
the influence of well-fed lobbyists. As Heritage Action CEO Mike Needham has pointed
out, Wind-energy, NASCAR, and the horse racing industry have no business using our
nations laws to give themselves a leg up on the rest of us. Heritage Action will be key
voting against the package.

Last week, the House passed the Electrify Africa Act which sneakily included a three-
year reauthorization of the Overseas Private Investment Corporation, a similar agency
to Ex-Im that provides corporate welfare, subsidizes risk and causes flagrant harm. The
vote was yet another violation of the Hastert Rule (House Leaderships sixth), which
states that if a certain bill does not have the support of a majority of the majority party,
it should not be brought to the floor for a vote. In spite of its passage, 117
representatives voted against this corporate welfare fund after being made aware of the
hidden OPIC language by an aggressive grassroots push from conservatives on the
ground. If these same members continue to oppose political favoritism and corporate
handouts in all forms, with the help of devoted and informed activists they can defeat
the Export-Import Bank this fall.

Representative Jeff Denhams (R-CA) Encourage New Legalized Immigrants to Start
Training, or ENLIST, Act (H.R. 2377) continues to stall in the House. The ENLIST Act
would allow DREAMersunlawful immigrants brought to the U.S. as minorsto acquire
lawful permanent resident (LPR) status in exchange for military service. Essentially, by
allowing illegal immigrants to sign up for the armed forces, the government would grant
them, a) pardon for violating the law, b) the full battery of military benefits, c) lawful
permanent resident status in the U.S., and d) a back-door promise of instant
citizenship. As Heritage Actions Wade Miller has stated:

charges are possible; in an atmosphere where investigations are perpetuated, the va-chief said he
would withhold-information-from-congress by citing-ongoing-investigation. [This recalls the advice that
Congress should mirror what Judicial Watch has done, namely, rather than issuing subpoenas, it should
file FOIA-requests.] Meanwhile, predictably, Defense chief Hagel says he supports VA's Shinseki, but
wants accountability, and the consensus-view on FNC this-p.m. was that Fixing the VA Requires More

standing order for them to avoid violent encounters.

New-documents-show-irs-targeting-came-directly-from-washington-dc. Thus, even if The Hill correctly

the IRS regulating political activity at all? He attributes IRS regulation to Democratic
politicians and progressive activists when, in fact, the IRS has long limited the extent to
which many types of tax-exempt entities can engage in electoral politics. The IRS is
doing its jobor more accuratelycontemplating doing its job after years of
dereliction. Mr. Smith attributes three myths to the Campaign Legal Center, but it is
he whos ginned up myths.

Regarding Myth No. 1, the Legal Center knows that 501(4)s arent charities and
does not refer to them as such. Indeed, the Legal Center itself is tax exempt as a
501(3), the tax code section covering charities, religious and educational


Regarding Myth No. 2, despite Mr. Smiths claims, Section 501(4) of the tax code
does require organizations claiming tax exemption to be operated exclusively for the
promotion of social welfare. IRS regulations state explicitly: The promotion of social
welfare does not include direct or indirect participation or intervention in political
campaigns on behalf of or in opposition to any candidate for public office.

Finally, regarding Myth No. 3, all tax-exempt organizations enjoy a tax breakthey
are not required to pay federal income tax for funds raised and spent to advance their
exempt purpose. Even candidate and party committees get a tax break, but under
Section 527 of the tax code, which requires disclosure of donors. By contrast, 501(4)s
arent required to disclose their donors publicly.

Whats really at stake here is disclosure of money spent by tax-exempt groups on
candidate-related election activity. There are no limits on how much these groups can
spend on election activity. The question is whether such groups are subject to donor
disclosure. The Legal Center sides with the Supreme Court that voters are entitled to
know whose money is being spent to influence their votes. Mr. Smiths Center for
Competitive Politics believes in denying voters this crucial information, allowing special
interests to dominate our electoral discourse by hiding behind 501(4) tax status.

Mr. Smith rightly criticizes proposed IRS rules limiting political speech by nonprofit
501(4) groups. Those rules restrict even truthful, nonpartisan criticism of IRS and
bureaucratic wrongdoing by classifying it as candidate-related political activity.

For example, if an IRS official subjects citizens to incredibly burdensome demands for
irrelevant information just to harass them for their political or religious beliefs, no
501(4) group could later criticize that officials nomination to be IRS commissioner,
without engaging in restricted activity. Thats because the IRSs proposed regulation
defines even unelected government officials, like agency heads and judges, as
candidates if they have been nominated for a position requiring Senate confirmation.
The IRSs proposed rules are an attack on the First Amendment that will make it easier
for the government to get away with harassing political dissenters and whistleblowers in
the future.
