NARRATIVE:
The undersigned has probable cause to believe the above-named defendant on the of

At approximately 0043hrs. on the above date 911 dispatchers received a call in reference to a white male, "waving a gun around" in front of
the Vixen Bar at 118 S. Orange Ave. Downtown bike officers were dispatched with Ofc. Eduardo Sanguino and Jeff Angel arriving one minute
later. Once they arrived the officers were alerted by a citizen standing across Orange Ave. from Vixen Bar to the suspect who was standing at
the front door. The officers walked towards the suspect, later identified as Kody Roach, and began giving loud verbal commands to come
away from the building and get down on the ground. The suspect was wearing a baggy shirt that concealed his waistband and had his hands
at his sides. No weapon was seen at this time by the officers. Due to the nature of the call indicating the suspect was recklessly displaying a
firearm inside a crowded bar the officers gave several more loud verbal commands with the suspect refusing to comply. At this point, Ofc.
Angel deployed his Taser striking the suspect in the chest. The Taser made a loud arcing noise which is indicative of the prongs not
properly imbedding themselves. The desired effect of the Taser was therefore not achieved instead causing the suspect to turn clockwise but
stay on his feet. As the suspect turned clockwise away from Ofc. Angel he lifted the front of his shirt and began reaching towards his
waistband. Ofc. Sanguino then fired his department-issued firearm nine times at the suspect striking him several times. This caused the
suspect to drop to the ground with a .40 cal. Ruger falling from the suspect's person. The weapon was immediately secured with suspect
being secured by Ofc. William Weaver who had just arrived on scene. The suspect was treated by OFD and transported to ORMC for further
treatment by ER personnel.
During the subsequent investigation it was determined that the suspect had entered the Vixen Bar at approximately 0015 hrs. on the above
date already intoxicated. The suspect was becomming increasingly belligerant repeatedly bumping into patrons. An unknown patron also
notified security that the suspect had a handgun concealed in his waistband leading Vixen doorman, Nambiar Neal Rajan to escort the
suspect out and lock the lone entry point behind him. Once locked out of the bar the suspect removed the firearm from his waistband and
used it to bang on the wooden door. The impacts caused distinct depressions that were later matched to the underside of the muzzle.
Following the shooting the weapon was determined to be stolen out of Orange County, FL with Roach being named as the primary
suspect(see OCSO 14-072708). It was further determined that the weapon was unloaded with no ammunition in the magazine or in the
chamber. The weapon did appear to function properly with the slide moving freely and the trigger mechanism to be operational. The firearm
was secured by the Crime Scene Unit and will be submitted to FDLE for lab analysis. A check with teletype showed that the suspect does not
have a concealed carry permit in the State of Florida nor any other state. Based on the above facts it appears the suspect did willfully conceal
a functioning firearm in his waistband prior to entering the Vixen Bar in violation of FSS 790.01.
