rejected to favour one particular company. Gettinge is the world leader in Washer
Disinfector and Franke is also leading supplierofwasher disinfectors andNBS UK has
FrankesystemsbeingusedinSUBSTANTIALnumbers.

tender and two firms had been technically shortlisted for openin$ of price
bids, the enclosed note of Store Purchase Selection Committee Iindicates
that six firms had submitted their offer against the AIIMS's aldvertised
tender, of which five bidders had been rejected. Moreover, t e model
numbers in the report of AIIMS for the purpose of price comp ison are
different from the model mentioned in the complaint.

meeting ofthe Commission with Secretary, Health held on 10.9.09 (the minutes
may be seen at 'X' on P.IOS/C). Para 2 ofthe Mlo HFW's letter dt. 8.9.2010
(P.120/C) has also mentionedabout the same. The issuewas alsofollowed up by
the Commission vide letters dt. 2S.12.2010 (P.l22/C), OS.2.2011(P.125/C) and
26.4.2011 (P.127/C).
Now, vide FR(P.132/C),ithasbeeninformedthatSh. SanjeevChaturvedi,

2. FR-I (p.135/C) is a letter from Sh. Sanjiv Chaturvedi, AIIMS which had been
addressed to Dr. R.S. Shukla, JS & cva,M/o Health & Family Welfare (HFW) and only a
copy has been endorsed to the Commission. Since, the Commission has sought some
clarifications from M/o HFW vide letter of even no. dated 03.09.12 (p.134/C), we may wait
till a formal reply in this regard is received from the Ministry.
3. FR-lII (p.161/C) is a letter from Sh. Sanjiv Chaturvedi to Dr. R.S. Shukla. In view
of para I above, we may wait for formal reply from the Mlo HFW.
4. FR-IV (p.162/C) is a communication from Sh. Sanjiv Chaturvedi to the
Commission regarding correction of address of cva,AIIMS. As the issue of appointment
of cvahas not been finalized the matter regarding correction of address is a secondary
issue to be dealt with at the moment.
5. FR-II (p.159/C) is a letter from Sh. Vineet Choudhary, Dy. Dir. (Admn.), AIIMS
n addressed to the Commission. He has informed that directions received from CVC were
placed before Director, AIIMS and he has taken a view that since the communication of the
CVC is addressed to M/o HFW, no action is required to be taken by AIIMS till any
instructions are given by the Ministry. He has further mentioned that Government of
Haryana is contemplating disciplinary proceedings against Sh. Chaturvedi and also a
criminal case is being registered against him at Jhajjar Police Station. Accordingly, we
may write to Environment anQ Forest for getting detailed information from
the State government in this regard.

stated that DD(Admn) has always been functioning as CVO at AlIMS from he very
inception. On the suggestion of the Commission to have an independent CVO it AllMS
and to delink him from procurement and administration work, a proposal for cr ation of
full-lime evo at the level of DS/Director was considered by AflMS, ith the
upgradation of the post of DO (Admn) from DSlDirector level to .IS level andtcreation
of an additional post of DS/Director, it \Va; felt to assign the work or 'VO to
DS/Director and in this process. 8hri Sanjeev C'haturvedi was appointed a' evo,
AIfM8. It has also been mentioned that AIIM8 is not in the list of institution' which
require mandatory approval of evc prior to appointment of CVO. As far as
appropriateness of level of DSlDirector for appointment of CVO in AIIMS is
concerned, it has been mentioned that as per evc m1nual (Clause 1 ,JA(t)) a ofl:h:er
drawing grade pay of Rs. 8700 can be assigned the charge of CVO in auto OOlOUS
bodies.

A proposal for creation of one post of ChiefVigilance Officer lO be filled on


deputation basisfrom Central StaffingScheme atthe AIIMS ha been placed
beforethe Standing Finance Committeeofthe Institute in its metingheld on
20.7.2010. After considering the proposal, the Standing Finan eCommittee
decidedasunder:- I
"The Committeewas ofthe viewthata full time CVO wasInotneeded.
Instead, withthe upgradatioQ ofthe postofDD(A) to JS and with
the increase ofadministrative workload on accountof
ofthe Moily Committee recommendations and the secon" campus at
Jhajjar, an additional post at Dy. Secretary/Director leve) should be
created. TheworkofCVO could be assignedtosuchan o,ficer. Itwas
also suggested that the post of DD(A) should be as Add\.
Director in view of the fact that the post was now JS equivalent. It was
agreed to examine whether such re-designation would need in the
Actor Rules" (Annexure-I). !

After approval ofthe competent authority, the undersigned in

the SFC, issued Memorandum No.F.9-40/2010-Estt.(RCT) dated 7.7.2012

Vigilance Officer of the Institute, In addition to his duties and
responsibilities as CVO, the work ofcertain branches were alsO; allocated to
him..Itis clarified that as perpastpractice,the Director, AIIMS has been
allocating the work of CVO and thereafter information to effect is
being given to the CVC (Annexure-III). There has been any
objectionfromCVC orMinistryoverthis. Itisalsoclarified that,as
perVol. IofVigilance Manual, name ofAIIMS does not intothe
list of organizations, for which approval of CVC is In
appointingCVO(AnnexureIV). l

2. From the above letteritis seen thatShri Sanjiv Chaturveli, DeputySecretary,
MHFW has been appointed as CVO in AIIMS without the approval;ofthe Commission
which is required to be obtained before such appointment as laid down in Vigilance
Manual. In this connection, it may be clarified whether Deputy Secretary is the
appropriate forappointmentasCVO inAIIMS. TheCommissionhasdesiredtoknow
the past practice for appOintmentofCVO in AIIMS and whyapproved was not taken for
suchappOintment. ' .
3. Further,theCommissionthrough itsearlierlettershasbeeninsistingon havinga
full-time CVO in AIIMS. But Ministry has not responded to this requirement of the
Commission.Therefore,a panelofofficersofappropriatelyseniorlevelmaybeforwarded,
totheCommissionforappointmentofCVO inAIIMS.

Afterdue deliberationoverthe issue ofthe CVO in the Institute,in theSFC, thedecision regarding
parttimecvoofDy.Secretary/Directorrankwas approvedbytheMinistryand consequently,aftera
very cumbersome exercise involving DoPT, Ministry of Health & Family Welfare, Ministry of
Environment& Forest, and GovernmentofHaryana, in which the undersigned was selected from a
panel ofthreeofficerssentby DOPTtotheMinistry.The nameoftheundersigned was approved by
Hon'bleHealth& FamilyWelfareMinisterhimselffromapanelofthreeofficers,forthesaid position.
Therefore, it is clear that the said exercise, ofthe selection ofthe officerfor assigning the job of
Vigilance mattersin the Institutewas already completed undertheapprovalofthe Ministry,froma
panelofthreeappropriatelyseniorlevelofficers.
Moreover, as per Chapter II ofthe Vigilance Manual, CVO can be an Officer ofsufficier)tly higher
level,inwhichrankofDeputySecretaryisverymuchincludedbytheVigilanceManualitself.
Finally,as persection8(1)(h)ofCVCAct,2003,whichreadsasunder:-
"exercise superintendence over the vigilance administration oj the various Ministries oj the Central
Government or corporations established by or under any Central Act, Government companies, societIes and
local authorities ov.,ned or controlled by that Government:
ProvIded that nothing contaIned In this clause shall be deemed to authorise the to exercIse
superintendence over the VIgilance administration In amanner not consistent with the directions :relatlng to
vigilance matters Issued by the Government and to conJer power upon the Commission toIssue: directions
relating to any policy matters",
Thus, the Institute does notcome under any ofthe above mentioned categories, as itis neithera
Ministrynoracorporation/company/society. As perthe preambleand Section 13 & 14oftheAIIMS
Act,1956, it is basically a research and educational institution, and that is why SFC and Central
Government took a considered decision to have a part time CVO only, of the Deputy
Secretary/Director rank and therefore, as per the second partofSection 8 (l)(h)ofevcAct, 2003,
the evc was not authorised at all to issue such imposing directions as was issued in the
communicationdated3.9.2012.
In viewofthe facts mentioned above, therefore, now no issue remains unaddressed regarding the
allocationofworksofCVOtotheunderSigned. Thisisforyourkindinformation.

I am directed to refer to CVC's reference No. OV-CVO-
87/186415 dated 3.9.2012 on the subject mentioned above seeking
clarification on the appointment of Shri Sanjiv Chaturvedi, Deputy
Secretary as CVO, AIIMS without approval ofCVC; the pastpractice
for appointment of CVO in AIIMS; whether the Deputy Secretary is
appropriatelevel for appointmentasCVO inAIIMS. Further, theCVC
hasalsosoughtresponsetotheirearlierlettersinsistingopa full-time
CVO in AIIMS along with a panel of officers of appropriately senior
level.
DD(Admn) has always been functioning as CVO at.AIIMS from
the very inception. In a meeting held in February, 20Q9, the CVC
suggested to have an independent CVO in AIIMS and to.dr,;link him
from procurement and administration works. Keeping in view this
suggestion, a proposal for creation of a full time CVO atthe level of
DS/Director was considered by AIIMS. However, it was felt that
considering the actual work load, a full time CV 0 would not be
necessary atAIIMS. To cope with the increased administrative work
load on account of Moily Committee report and second campus at
Jhajjar, it was decided to upgrade the post of DD(Admn) from
DS/Director level to JS level and creation of an additional post of
DS/Director. Itwas felt thatthe workofCVO canbeassigned to the
officeratDS/Directorlevel. .
Accordingly, onemorepostofDS/Directorwas to assist
the DD(Admn). Thereafter, ShriSanjeevChaturvediwasappointedas
DS in AIIMS under the Central Staffing Scheme. When he joined
AIIMS on29.06.2012,hewasassignedtheworkofCVO sin,ce decision
was earlier taken to entrust the charge of CVO to the DS/Director
whensomeonejoinsthepost.

Inthepast, past, priorconcurrenceofCVC wasnotobtainedby
theDirector, AIIMS for appointmentofanofficer asCVO intheAIIMS.
Further, AIIMS is not in the list of institutions which require
mandatoryapproval ofCVC priortoappointmentofevo. As regards
the appropriatenessoflevel ofDSjDirectorfor appointmentofCVO in
AIIMS, the CVC manual ( Clause 1.3.4 (f) ) prescribed thatan officer
drawingGrade PayofRs. 8700andabove canbeassignedthe charge
of CVO in autonomous bodies. In fact the post of DD (Admn) was
earlieratthelevel ofDirectorandtheDD(Admn) waslookingafterthe
Vigilancework.
It may be pointed out that in other institutions of national
importance like JIPMER, PGIMER, NIMHANS etc. there are no full
time CVO and one of the regular officers is assigned the additional
chargeofCVO.
Since the evc has asked a panel of officers of appropriately
senior level, the following panel is sent to the Commission for being
considered to be appointed as evo in AIIMS, New Delhi in the
followingorderofpreference:
1. DD(Admn),AIIMS, New Delhi
2. JointSecretary& evo, MOHFW
3. OneoftheregularDirectorandDSinMOHFW
4. Continue Shri Sanjeev Chaturvedi, DS, MOHFW, as CVO in
AIIMS

2. The matterhas been examined in the Commission. It is pertinenttomention thatas per
para 2.2 of Vigilance Manual (Copy enclosed), the Chief Vigilance Officer in all
Dapartments/organization are appointed after prior consultation with the Central Vigilance
Commission and no person whoseappointmentin thatCapacityisobjected to by the Commission
maybesoappointed.
3. Furtherasperpara2.6.1 of theVigilance Manual (copye!lc1osed), in'espectiveofthe fact
whether the post ofa CVO in an autonomous organization is on full-time basis oron part-time
basis, such organizations would forward, through theiradministrative Ministries/Departments a
panel of names ofthree officers ofsufficiently higher level, who can report'direct to the Chief
Executive in vigilancerelatedmatter,arrangedinorderofpreference,alongwiththeirbio-dataand

4. In viewoftheabove,the panelsentby the MinistryofHealth& Familywelfareis notin
accordancewiththeprovisionof thevigilancemanualasitdoesnotcontainthenameandvigilance

'Nodal' CPIO on basis ofinputs provided by various CPIO's at CVC summarised to decline
information on all the points vide a consolidated response No. CVC/RTII13/410/217091 dated
24.06.2013 under various excuses some ofwhich indeed reflect allergy to basic spirit towards
transparency-ActofconcernedonesatCVC.
Learned CPIO declinedinformationto query(1) that processofappointing CVI atAIIMS is in
progress, and assuchinformationcannot be providedas exemptedundersection8(1)(h) ofRTI
Act. Unfortunately an anti-transparency spiritofCPIO has made him quote the saidexemption
which applies to impeding process of investigation and not process of appointment. Even
exemptionundersection8(l)(h)canbe appliedonly ifinformationis likelyto impededprocess
ofinvestigation. Otherwisealso Ihave sought informationonall appointmentsmadefrom from
the period 01.06.2012 and not only the present appointment-process. Information sought under
query-numbers(2), (3) and(7) areofquitedifferentbutspecificinnature, andclpbbingtheseto
decline informationonflimsy grounds claimingexemptionunder section7(9) ofRTI Actagain
quotingCIC-verdictirrelevanttoqueriesofmyRTI furtherrevealstheusualtendencyat
CVC to decline information. Learned CPIO has again clubbed query-numbers (4) and (6) to
declineinformationonqueriesofveryspecificnature.

may approach the organization concerned for obtaining the information relating
to para (5) of the Application.

The file noting of this RTI application consists of 02 pages for which the fees as
prescribed in Para (3) below may be deposited with this Public Authority. .

3. A fee of Rs.2/- for each page (in A-4 or A-3 size paper) qas been prescribedJor
.providing the information under the Right to Information (Regulation of Fee and Cost)
Rules, 2005. Since the documents required by you, would require photocopy of 02 pages,
an amount of Rs. 04/- (Rs. Four Only) may please be deposited in cash against proper
receipt; or by demand draft or cheque or Indian postal payable to the
Section Officer, Centtal Vigilance Commission at New Delhi, for the supply of
documents. "
3. The Appellant has now preferred an Ap,peal before this Appellate Authority, which being
tpo lengthy is not being reproduced here, butis enclosed as Annexure-'B' to these orders.
4. After receipt of Appeal from the Appellant, the CPIO concerned, vide his letter No.
CVCIRTIIAPPIl3/1311221326 dated 30.07.2013 had informed the Applicant that "Copies offile
noting/correspondence relating to the appointment ofCVO in AIIMS since 01.06.2012 till date."

Decision
5. As regards para (1) of th.e Application, I have gone through the relevant records and find
that the CPIO concerned, that is, Shri Prabhat Kumar, Director has, vide his letter No.
dated 30.07.2013 has already providea copies of relevant
documents to the Appellant and hence, the Appellant's request has already been accepted by the
CPIO concerned. No further action is required in the matter .
6. As regards para (2) of !he Application; I find that the Commission maintains its data as
per the names and designation of the officials concerned, against Whom cases have been
received, belong and not in the. format in which it has been sought by him. Hence, in the
absence of the name, designation of the officials, it is not possible to provide any information as
requested for by the Appellant, as no such infdrmation, as defined under Section,2(f) of the RTI
Act, is available with this Commission. Under the provisions contained in S@ction 2m of the
RTI Act, the Public Authority concerned can only be asked to provide the infotmation 'held by
it'. However, information as asked for by him may be available in the individual files of the
Commission and culling and compiling of information from all the case files from 01.06.2012
onwards, as requested by him, would involves deployment of additional manpower and would
disproportionately divert the limited human resource available with this Public Authority.
Hence, the information cannot be provided keeping in view the provi.sionscontained under
Section 7(9) of RTI Act. This view has been upheld by the Central Information Commission
(CIC) in its decision in case No. CIC/SMlAl2011/002070 in respect of Shri Natra; Saha Vs
Central Vigilance Commission in which the CIC held "The CVC cannot be compelled to produce
information in a certain format if they do npt maintain it in that manner . ..1t would be like -
creating new information. While a citizen has every right to get the aV(Jilable information, he
cannot get dny information which does not exist and has to be created II Moreover, the
information sought by the Appellant pertains to vigilance/disciplinary cases against third parties,
which is exempt from disclosure under the contained in Section 8(1)0) of the RTI
Act. This view has been upheld by the High Court of Delhi at New Delhi, in its decision in
L.P.A. No. 6180(2012 in the case of Union Public Service Commission Vs. Sari R.K. Jain. in
which the Court has stated that "The disciplinary orders and the documents in the course of
disciplinary proceedings are personal information within the meaning ofSection 8(1)0) and the
disclosure of which normally has no relationship to any public activities or public interest and
disclosure ofwhich would cause unwarranted invasion ofthe privacy ofan individual. " Hence,
the Appellant's request is not acceptable.
7. 'As regards para (3) of the Application, I find that the Appellant has sOl!lght information
against third party, which is exempt from disclosure under Section 8(1)0) of the RTI Act, as
upheld by CIC in its decision in case No. CIC/SMlAl2013/000058 in respect of Shri Mano; Ana
Vs. Cabinet Secretariat, in which CIC held that "The entire information sought by the Appel/ant'
revolves aroijnd the complainls made against an officer of the government and any possible
action the authorities might havlf taken on those complaints. The Appellate Authority was very
right in deciding that this entire class of information was qualified as personal information
within the meaning ofthe provisions ofSection 8 (i) 0) ofthe RTI Act. In this connection, it is
very pertinent to cite the decision of the Supreme Court of India in the SLP(C) No. 27734 of
2012 (Girish R Deshpande vs CIC and others) in which it has held that "the performance ofan
employee/Officer in an organisation is primarily a matter between the employee and the
employer and normally those aspects are governed by the service rules whichfall under the

expression personal information, the disclosure of which has no relationship to any public
activity or public interest. On the other hand, the disclosure of which could cause unwarranted
invasion of the privacy of that individual." The Supreme Court further held that such
information could be disclosed only if it woulq serve a larger public interest. The information
sought by the Appellant in this case is about some complaints made against a government
official and any possible action the authorities might have taken on those' complaints. It is, thus,
clearly the kind ofinformation which is envisaged in the above Supreme Court order. Therefore,
the information is completely exempted from disclosure under the provisions of the RTI Act."
Hence,theAppellant'srequestis notacceptable. .

8. As regards para (4) of the Application, '1 find that the information sought by the
Appellantis inthe form ageneralquerywithoutprovidinganyspecificnameetc. and hence, in
theabsenceof specificinformationlikethenameof theofficialsetc.,itisnotpossibletoprovide
anyinformationasrequestedforbyhim,asno'Suchinformation,asdefinedunderSection2(f)of
the RTI Act, is available with this Commission. Under the provisions contained'in Section2m
ofthe RTI Act. the Public Authority concerned can only be asked to provide the information
'held by it'.However, informationas asked for by himmaybeavailablein the individualfiles
ofthe Commission and culling and compiling ofinformation from individuals files, would
involves deployment ofadditional manpower and would disproportionately divert the limited

within5daysofthereceiptoftheseorders. .
iO. As regards para (6) of the Application, 1 find that the information sought by the
Appellantpertainedto differentPublicAuthoritiesandnosuchinformationismaintainedbythis
CommissionintheformatinwhichithasbeensoughtbytheAppellant. Hence,itisnotpossible
to provide any information as requested for by him, as no such information, as defmed under
Section2(f) ofthe RTI Act, is available withthis Commission. Underthe provisions contained
in Section2m ofthe RTI Act, the PublicAuthorityconcernedcanonly be askedto providethe
information 'held by it'. However, information as asked for by him may be available in the
individual files ofthe Commission and culling and compiling ofinformation from individuals

bytheAppellantandhence,no ftptllercommentsarerequired.

12. As regards para (8) ofthe Applicant, find that the Appellant's RTI Application was
received in the Commission on 29.05.2013 and a reply was provided to him, vide letter No.
CVCIRTII13/410/217091 dated 24.06.2013, that is, on the 26

Application.. Hence, the demand offees was within the time frame as prescribed under Section
7(1)oftheRTIAct. TheinformationsoughtbytheAppellantpertainedto variousissues, which

had to be collected from different sections aIld CPIOs ofthis Commission. The collection of
information from different sections takes time. the reply waS sent to the Appellant

citizenitwasalso the dutyofthe Appellantto depositthefees. whichwas demandedas perthe
provisions ofRTI Act. The Appellant couldhave sent the fees alongwith his Appeal, showing
respect for the rules, instead offinding ways not to deposit the small amount ofRs. 4/-.
However, as amatter ofconvenience and keeping inview the spirit ofthe RTI Act, copies of
two pages ofnotings relating to para (8) ofthe Application are enclosed, alongwith these

send deinandietter at S0me early date so that information-seeker may have sufficient time to
deposit cOP: ing-charges so as to received copied documents within 30 days of receipt of petition by
26.06.2013' for
-CPIO, which evidently could not be possible when a demand-letter dated 24.06.2013 was mailed on
an RTf petition dated 27.05.2013. I appeal that enquiry may kindly be o,rdered how'
concerned CPIO did not take cognizance of the referred DoPT circular, and necessary directions may
kindly be given to all concerned at CVC to raise demand for copying-charges at some reasonably early
date in view of enclosed DoPT circular F.No.12f3112013-IR dated 11.02.2013.
Also a recent ClC-verdict dated 30.05.2013 in appeal-number CIC/SMIAl2013/000781 requires CPfOs to
apply presence of mind for not demanding such petty copying charges which may cost much more
heavily in terms of postal-charges and man-hours in re-handling of RTf petition. 1 appeal CP[O may
kind Iy be directed to provide copy of file-notings as demanded under query (12) of RTI petition also free-
of-cost. It is prayed accordingly .
. Many public-authorities have conducted workshops for their officers for educating them to handle Rl1
petitions. J appeal and request that some such similar RTf workshop may be organised for officers at
eve to make this public-authority restore to its earlier glory for being m o n g s ~ best-rated public-

concerned CPIO did not take cognizance ofthe referred DoPT circular, and necessary directions may
kindly be given to all concerned atCVC to raise demand for copying-charges at some reasonably early
datein viewofenclosed DoPTcircularF.No.12/3112013-IR dated 11.02.2013.
AlsoarecentCIC-verdictdated30.05.2013 in appeal-numberCIC/SM/A!2013/000781 requiresCPIOsto

The CPIO concerned, that is, Shri Prabhat Kumar, Director, has statedthat the
selectionprocess forappointmentofCVOinAIIMS isunderactiveconsiderationofthe
Commissionatthemoment, afinal viewin thematterhasnotbeentakenandfinal order
hasnotbeen issued. You may 'note'thatthecaseswheretheauthorityconcerned have
notyettaken afinal view in the matterand have not yet issuedfinal orders, that is, the
cases have still not reached their logical conclusion, are to be considered as 'under
investigation' as upheld by the Central InfOrmation Commission (CIC) in the case of
Shri Shankar Sharma and other Vs Income Tax Department in case No.
CICIATIAI2007100007110111 where CIC stated that "investigation would mean all
actionoflawenforcement, disciplinaryproceedings, enquiries, adjudicationsandsoon.
Logically, no investigation couldbe saidto be complete unless it has_reachedapoint
where the final decision on the basis ofthat investigation is taken". Hence, the
information has beendefined by the CPIO concernedunderSection 8(1)(h) ofthe RTI
Act,2005. .

TheCPIO concerned, that is, Smt. LilaChandran, Deputy Seaetary, has stated
that no such information as sought by you in these paras is being maintained in the
format in which it has been sought from this Commission. However, information as
asked for may be available in the individual files ofthe Commission and culling and
compilinginformationfrom individualfilesasrequestedbyyou involvesdeploymentof
additional manpower and would disproportionately divert the resources ofthis Public
Authority. Hence, the information cannot be provided to you,.keeping in view the
provisionscontained underSection 7(9) oftheRTI Act. Thisview has been upheld by
