ORDINANCE
to provide for the Constitution of a separate Police-force for the Dhaka Metropolitan Area and for the
regulation thereof.

1. Ac) , o 1-61 no) )o a..%& .- The police Act#14&1 (5 of 14&1) shall not appl! to the
Dhaka Metropolitan Area

<ot2ithstanding an!thing contained in the Code# the Dhaka Metropolitan Area shall not# unless other2ise
provided "! or under this ordinance# "e under the charge of an! District Magistrate for an! of the purposes
of this Ordinance.
CHAPTER II
Con")i)1)ion and Or2ani4a)ion o )(e D(a5a Me)ro.o%i)an Po%ice
6. Con")i)1)ion o )(e 7orce. (1) There shall "e a separate police-force for the Dhaka Metropolitan Area to
"e called the Dhaka Metropolitan Police.
(') The force shall consist of such nu"er of officers in the several ranks and shall "e constituted in such
anner and shall have such organi-ations as the ,overnent a!# fro tie to tie# direct.
6. '1.erin)endence o )(e 7orce.8 The superintendence of the 8orce shall vest in the ,overnent.
7. Po%ice Co##i""ioner, Addi)iona% Po%ice Co##i""ioner", De.1)& Po%ice Co##i""ioner" and
A""i")an) Po%ice Co##i""ioner". (1) The ,overnent shall appointent a Police Coissioner 2ho shall#
su"/ect to the control of the (nspector-,eneral# e)ercise such po2ers and perfor such duties as are or a!
provided "! or under this Ordinance.
(') The ,overnent a! appoint one or ore Additional police Coissioners# Deput! Police
Coissioners and Assistant Police Coissioners 2ho shall assist the police Coissioner in the
e)ercise of his po2ers and perforance of his duties and shall e)ercise such of the po2ers and perfor such
of the duties of the Police Coissioner as a! "e delegated to the "! the Police Coissioner "!

Coissioner and the appointent of all other su"ordinate officers shall "e ade "! such superior officer
not "elo2 the rank of Deput! Police Coissioner as the Police Coissioner a!# "! order in 2riting#
specif! in this "ehalf.
(') The appointent of su"ordinate officers shall "e ade in such anner and on such ters and conditions
as a! "e prescri"ed.
(+) >ver! su"ordinate officer shall# on appointent# receive a certificate in the for set out in 7chedule ((
under the seal and signature of the Police Coissioner or of the superior officer aking the appointent.
(?) A certificate of appointent shall "e cancelled 2henever the person naed therein ceases to "elong to
the 8orce and shall reain inoperative during the period of his suspension fro the 8orce.
9. Tran"er9 <ot2ithstanding an!thing contained in this Ordinance or in the Police Act# 14&1 (5 of 14&1)#
or in an! other la2 for the tie "eing in force# the ,overnent or the (nspector ,eneral a! transfer a
police-officer appointed under this Ordinance to the police-force constituted under the Police Act# 14&1 (5
of 14&1)# and a police-officer appointed under the Police Act# 14&1 ( 5 of 14&1)# to the police- force
constituted under this Ordinance *and on such transfer such police-officer shall# for all purposes# "e deeed
to "e a police-officer appointed under the la2 under 2hich the police-force to 2hich he is transferred is
constituted..
1:. A1*i%iar& .o%ice8oicer9 (1) The Police Coissioner a! appoint an! person to "e an au)iliar!
police-officer to assist the 8orce on an! occasion 2hen he is of opinion that the 8orce is in need of such
assistance.

CHAPTER III Ad#ini")ra)ion o )(e 7orce
11. Po;er o Po%ice Co##i""ioner )o #a5e order" or ad#ini")ra)ion o )(e 7orce9 The Police
Coissioner a!# fro tie to tie# ake such orders# not inconsistent 2ith an! provision of this
Ordinance# as he dees e)pedient relating to-
(a) the inspection of the 8orce3
(")the collection and counication "! police-officers of inforation and intelligence3
(c)the description and :uantit! of ars# accoutreents# clothing and other necessaries to "e supplied to the
8orce3
(d)the places of residence of e"ers of the 8orce3
(e)the institution# anageent and regulation of an! fund for an! purpose connected 2ith adinistration
and 2elfare of the 8orce3
(f) the duties to "e perfored "! police-officers of different ranks and the anner in 2hich and the
conditions su"/ect to 2hich police-officers shall e)ercise their po2ers and perfor their duties3
(g) efficienc! and discipline of the 8orce.
(h) prevention of a"use of po2ers and neglect of duties "! police-officers.

(') The Police Coissioner# or an! other superior officer authori-ed "! hi in this "ehalf# a! place under
suspension an! su"ordinate officer against 2ho action under su"-section !1$ is re:uired to "e taken or
against 2ho an! en:uir! is re:uired to "e ade.
(+) <othing in su"- section (1) shall affect an! officerAs lia"ilit! to a criinal prosecution or an! offence
2ith 2hich he a! "e charged.
1<. Po%ice8oicer" )o 3e dee#ed a%;a&" on d1)&- (1) >ver! police officer not on leave or under suspension
shall "e deeed to "e al2a!s on dut!.
(') <ot2ithstanding contained in this Ordinance# ever! police officer a!# if the (nspector ,eneral so
directs# at an! tie# "e eplo!ed on police dut! in an! place outside the Metropolitan Area.
1=. Re"i2na)ion o "13ordina)e oicer"- <o su"ordinate officer shall resign his office or 2ithdra2 hiself
fro the duties thereof e)cept 2ith the 2ritten perission of the Police Coissioner.
CHAPTER I, Po;er" and d1)ie" o .o%ice8 oicer"
16. >enera% d1)ie" o .o%ice8oicer"9 (t shall "e the dut! of ever! police officer--
(a) proptl! to serve ever! suons and o"e! and e)ecute ever! 2ritten or other order la2full! issued to
hi "! copetent authorit!# and to endeavor "! all la2ful eans to give effect to the la2ful coands of
his superiors3
(") to the "est of his a"ilit! to o"tain intelligence concerning the coission of cogni-a"le offences or
designs to coit such offences# and to la! such inforation and to take such other steps# consistent 2ith
la2 and the orders of his superiors# as are "est calculated to "ring offenders to /ustice or to prevent the
coission of cogni-a"le offences# or the coission of non-cogni-a"le offences 2ithin his vie23
(c) to the "est of his a"ilit! prevent the coission of pu"lic nuisances3
(d) to apprehend 2ithout unreasona"le dela! all persons 2ho he is legall! authori-ed to apprehend and for
2hose apprehension there is sufficient reason6
(e) to aid another police-officer# 2hen called on "! hi or in case of need in the discharge of his dut!# in
such 2a!s as 2ould "e la2ful and reasona"le on the part of the officer aided.
(f) to discharge such duties as are iposed upon hi "! an! la2 for the tie "eing in force.
16. D1)ie" o .o%ice-officers to2ards the pu"lic and arrested persons6 (t shall "e the dut! of ever! police
officer--
(a) to afford ever! assistance 2ithin his po2er to disa"led or helpless persons in the streets# and to take
charge of into)icated persons and lunatics at large 2ho appears to "e dangerous or incapa"le of raking care
of theselves
(") to take propt easures to procure necessar! help for an! person under arrest or in custod! 2ho is
2ounded or sick# and# 2hile guarding or conducting or conducting an! such person# to have due regard to
his condition
(c) to arrange for the proper sustenance and shelter of ever! person 2ho is under arrest or in custod!
(d) in conducting searches# to refrain fro needless rudeness and the causing of unnecessar! anno!ance
(e) in dealing 2ith 2oen and children# to act 2ith strict regard to decenc! and 2ith reasona"le gentleness
(f) to use his "est endeavors to prevent an! loss or daage "! fire
(g) to use his endeavors to avert an accident or danger to the pu"lic.
17. D1)ie" o .o%ice oicer" )o 5ee. order in ")ree)" e)c. 9 (t shall "e the dut! of ever! police officer-
(a) to regulate and control the traffic in the streets
(") to prevent constructions in the streets
(c) to the "est of his a"ilit! to prevent the infraction of an! rule# regulation or order ade under this
Ordinance or an! other la2 for the tie "eing in force for o"servance "! the pu"lic in or near the streets
(d) to keep order in the streets# and at and 2ithin pu"lic "athing# 2ashing and landing places# fairs and all
other places of pu"lic resort# and in the neigh"orhood of places of pu"lic 2orship during the tie of pu"lic
2orship.
(e) to regulate resort to pu"lic "athing# 2ashing and landing places# to prevent overcro2ding thereat and in
pu"lic ferr!-"oats and# to the "est of his a"ilit!# to prevent the infraction of an! rule regulation or order
la2full! ade for o"servance "! the pu"lic at an! such place or on an! such "oat.

"ound to confor to the reasona"le directions of a police-officer given in fulfillent of an! of his duties
under this Ordinance .
19. Po;er o .o%ice8oicer )o enorce )(eir direc)i?e9 A police officer a! restrain or reove an! person
resisting or refusing or oitting to confor to an! direction referred to in section 14 and a! either take
such person "efore a Magistrate or in trivial cases release hi 2hen the occasion is past.
[9A. .o;er o .o%ice8oicer" )o %a& inor#a)ion e)c - A police officer ! la! inforation "efore a
Magistrate and appl! for an! legal process as a! "! la2 issue against an! person coitting an offence..
/:. .o;er o .o%ice8oicer" )o "earc( "1".ec)ed .er"on" in ")ree)" e)c.8 Bhen in street or a place of
pu"lic resort a person has possession or apparent possession of an! article 2hich a police-officer in goof
faith suspects to "e stolen propert!# such police officer ! search for and e)aine the sae and a! re:uire
an account there of and# should the account given "! the possessor "e anifestl! false or suspicious# a!
detain such article and report the facts to a Magistrate# 2ho shall thereon proceed according to sections @'+
and @'@ of the Code.

acting or a"out to act contrar! thereto to desist or to a"stain fro so doing# and# in case of refusal or

sei-ed shall "e disposed of according to the order of the Magistrate.
//. C(ar2e o 1nc%ai#ed .ro.er)& and di".o"a% )(ereo.8 (1) (t shall "e the dut! of ever! police officer to
take teporar! charge-
(a) of all unclaied propert! found "!# or ade over to hi3 and
(") of all propert! found l!ing in an! pu"lic or street# if the o2ner or person in charge of such
propert!# on "eing directed to reove the sae# refuses or oits to do so.
(') A police-officer taking charge of an! propert! under su"-section (1) shall hand over the propert! to the
officer-in-charge of the police station concerned and report the atter to the Police Coissioner forth2ith.
(+) (f such propert! appears to have "een left "! a person 2ho has died intestate, and not to "e under five
thousand Taka in value# the Police Coissioner shall counicate 2ith the Adinistrator ,eneral# 2ith a
vie2 to its "eing dealt 2ith under the Adinistrator ,eneralAs Act# 1$1+ (((( of 1$1+)# or an! other la2 for
the tie "eing in force.
(?) (n ever! other case# the Police Coissioner shall issue a proclaation specif!ing the articles of 2hich
such propert! consists# and re:uiring an! person 2ho a! have a clai thereto to appear "efore hi or
soe other officer 2ho h2 appoints in this "ehalf and esta"lish his clai 2ithin three onths fro the
date of such proclaation.
(@) (f the propert!# or an! part thereof# is su"/ect to speed! and natural deca!# or consists of livestock# or if
the propert! appears to "e of a value of less than five hundred Taka# it a! forth2ith "e sold "! auction
under the orders of the Police Coissioner and the net proceeds of such sale shall "e dealt 2ith in the
sae anner as is hereinafter provided for the disposal of the said propert!.
(&) The Police Coissioner shall# on "eing satisfied of the title of the claiant to the possession of an!
propert! referred to in su"-section (?)# order the sae to "e delivered to hi# after deduction or pa!ent of
the e)penses properl! incurred "! the police in the sei-ure and detention thereof.
(%) The Police Coissioner a! at his discretion# "efore aking an! order under su"-section (&)# take
such securit! as he a! think proper fro the person to 2ho the said propert! is to "e delivered3 and
nothing herein"efore contained shall affect the right of an! person to recover the 2hole or an! part of such
propert! fro the person to 2ho it a! have "een delivered pursuant to such order.
(4) (f no person esta"lishes his clai to such propert! 2ithin the period prescri"ed in su"-section (?)# it shall
"e at the disposal of the ,overnent and the propert!# or such part thereof as has not alread! "een sold
under su"-section (@)# a! "e sold "! auction under orders of the Police Coissioner.
/<. I#.o1ndin2 o ca))%e.8 (t shall "e the dut! of ever! police-officer to sei-e and take to an! pu"lic pound
for confineent therein an! cattle found stra!ing in an! street or trespassing upon an! pu"lic propert!.
/=. Po;er" a" )o in".ec)ion, "earc( and "ei41re o a%"e ;ei2()" and #ea"1re".8 (1) <ot2ithstanding
an!thing contained in section 1@+ of the Code# an! police officer generall! or speciall! authori-ed "! the
Police Coissioner in this "ehalf a! 2ithout 2arrant enter an! shop or preises for the purpose of
inspecting or searching for an! 2eights or easures or instruents for 2eighing or easuring used or kept
therein.
(') (f such police officer finds in such shop or preises 2eights# easures or instruents for 2eighing or
easuring 2hich he has reason to "elieve are false# he a! sei-e the sae and shall forth-2ith give
inforation of such sei-ure to the Police Coissioner# and if such 2eights# easures or instruents are
found "! the Police Coissioner to "e false# the! shall "e destro!ed.
(+) Beights and easures purporting to "e of the sae denoination as 2eights and easures# the standards
2hereof are kept under an! la2 for the tie "eing in force# shall# if the! do not correspond 2ith the said
standards# "e deeed to "e false 2ithin the eaning of this section.
CHAPTER ,
Po%ice Re21%a)ion"
/6. Po;er o Po%ice Co##i""ioner )o #a5e re21%a)ion".- (1) The Police Coissioner a! ake
regulations# not inconsistent 2ith an! provision of this Ordinance# for-
(a) licensing and controlling persons offering theselves for eplo!ent at /etties# rail2a! stations
and landing places for the carriage of passengersA "aggage# and fi)ing and providing for the
enforceent of a scale of charges for the la"or of such persons 2hen so eplo!ed3
(") regulating traffic of all kinds in streets and pu"lic places# and the use of streets and pu"lic places
"! persons riding# driving# c!cling# 2alking or leading or accopan!ing cattle# so as to prevent
danger# o"struction or inconvenience to the pu"lic3
(c) regulation the conditions under 2hich vehicles a! reain standing in streets and pu"lic places#
and the use of streets as halting places for vehicles or cattle3
(d) prescri"ing the nu"er and position of lights to "e used on vehicles in streets and the hours
"et2een 2hich such lights shall "e used3
(e) prescri"ing certain hours of the da! during 2hich cattle shall not "e driven along the streets# or
along certain specified streets# e)cept su"/ect to such conditions as he a! specif! in that "ehalf3
(f) regulating and controlling the anner and ode of conve!ing ti"er# scaffold poles# ladders# iron
girders# "eas# "ars# "oilers or other un2ield! articles through the streets# and the route and hours for
such conve!ance3
(g) licensing# controlling or in order to prevent the o"struction# inconvenience or anno!ance to the
residents or passengers in the vicinit!# prohi"iting the pla!ing of usic# the "eating of drus or other
instruents and the "lo2ing or sounding of horns or other nois! instruents in or near streets of
pu"lic places3
(h) regulating the conduct# "ehavior or action of persons constituting asse"lies and processions on or
along the streets and prescri"ing# in the case of processions# the routes "! 2hich# the order in 2hich
and the tie at 2hich the sae a! pass3
(i) prohi"iting the hanging or placing of an! cord or pole across a street or the aking of a pro/ection
or structure so as to o"struct traffic or the free access of light and air3
(/) prohi"iting or controlling the placing of "uilding aterials or other articles or the fastening or
detention of an! anial in an! street or pu"lic place3
(k) licensing# controlling or# in order to prevent o"struction# inconvenience or anno!ance to the
residents or passengers in the vicinit!# prohi"iting-
(C) the illuination of streets and pu"lic places and the e)teriors of "uildings a"utting thereon
"! persons other than eplo!ees of ,overnent or of a local authorit! dul! authori-ed in
that "ehalf3

of a loudspeaker in or near an! pu"lic place or in an! place of pu"lic entertainent3

(p) regulating the eans of entrance and e)it at places of pu"lic auseent# entertainent or
asse"l!# and providing for the aintenance of pu"lic safet! and the prevention of distur"ance
thereat3
(:) licensing or controlling the usical# dancing# ietic# theatrical or other perforances for pu"lic
auseent# and regulating# in the interest of pu"lic order# decenc! or oralit!# the eplo!ent of
artist and the conduct of the artists and audience at such perforances and the hours during 2hich

(r) regulating or prohi"iting the sale of an! ticket or issue of an! pass for adission to a place of

(s) fi)ing the fees to "e charged for an! license or perission re:uired under this ordinance.
(') The po2er of aking regulations under this section shall "e su"/ect to the condition of the regulations

<6. '1erin2 or 1ni) ani#a%" )o 3e de")ro&ed. An! police officer 2ho in an! street or pu"lic place finds
an! anial so diseased# or so serenel! in/ured# and in such a ph!sical condition# that# is his opinion# it should
"e destro!ed# shall# if the o2ner is a"sent or refuses to consent to he destruction of the anial at once
suon the veterinar! officer in charge of the area in 2hich the anial is found and# if the veterinar!
officer certifies that the anial is so diseased or so serenel! in/ured# or in such a ph!sical condition# that it is
cruel to keep it alive# the police officer a!# 2ithout the consent of the o2ner# destro! the anial or cause it
to "e destro!ed 6
Provided that if in the opinion of the veterinar! officer the anial can "e reoved fro the place 2here it is
found 2ithout casing it great suffering# he a! direct the police officer to reove the anial "efore it is
destro!ed fro the place 2here it is found t such other place as he a! think fit6
Provided further that 2hen the anial is destro!ed in an! street or pu"lic place it shall# as far as possi"le# "e
screened fro the pu"lic ga-e 2hile it is "eing destro!ed.
CHAPTER ,I
'.ecia% #ea"1re" or #ain)enance o P13%ic 'ae)& and Order
<6. E#.%o&#en) o addi)iona% .o%ice on a..%ica)ion. (1) The Police Coissioner a!# on the
application of an! person# depute an! additional nu"er of police to keep the peace# preserve order or
enforce an! of the provisions of this ordinance or an! other la2 in respect or an! particular class or classes
of offences or to perfor an! other police duties at an! place.
(') 7uch additional police shall "e eplo!ed at the cost of the person aking the application# "ut shall "e
su"/ect to the orders of the Police Coissioner and shall "e eplo!ed fro such period as the Police
Coissioner a! think necessar!.
(+) (f the person upon 2hose application such additional police are eplo!ed akes# at an! tie# a 2ritten
re:uest to the Police Coissioner for their 2ithdra2al# he shall "e relieved fro the close thereof at the
e)piration of such period not e)ceeding one 2eek fro the date of such re:uest as the Police Coissioner
a! deterine.
<7. E#.%o&#en) o addi)iona% .o%ice a) cer)ain .%ace". (1) 2hen it appears to the Police Coissioner
that the "ehaviour of the persons eplo!ed on an! pu"lic 2ork or in an! industrial or coercial concern
under construction or in operation at an! place necessitates the eplo!ent of additional police at such
place# he a! depute such additional police to such place as he thinks fit and keep such police to such place
as he thinks fit and keep such police eplo!ed at such place for so long as such necessit! continues.
(') The Police Coissioner a! ake order# fro tie to tie# directing the person "! 2ho the 2ork or
concern is "eing constructed or carried on to pa! such aount as cost of eplo!ent of such additional

la2ful order or direction that a! "e given to hi for the perforance of his duties shall "e punisha"le 2ith

along the street# 2ithout sufficient reason fails to keep on the left side of such street and 2hen passing an!
other vehicle proceeding on the sae direction fails to keep on the right side of such vehicle or collates an!
traffic regulation ade "! the Police Coissioner shall "e punisha"le 2ith fine 2hich a! e)tend to t2o
hundred Taka.
66. Pena%)& or ;ron2 .ar5in2. Bhoever leaches or parks an! vehicle in an! part of a street or pu"lic
