Afer your marriage ends, do you and
your spouse each get half of what you
own? Are you also each responsible for
paying half of your debts? Not necessarily.
Te Family Law Act came into play in
BC on March 18, 2013. It empowers the
court to order an unequal division of fam-
ily property (and debts) if splitting them
50-50 would be signifcantly unfair. A
recent case illustrates this.
Jack and Jenny (names changed) mar-
ried in 1997 and had four children. Tey
separated in 2009. In early 2013, Jenny got
an order for sole custody of the kids, and
Jack was ordered to pay child support of
$754 a month.
Jenny applied to the court in July, 2013
to deal with the division of the money
from the sale of their house. (Jenny was
also granted a divorce.)
Te court looks at several things to de-
cide if an equal split of family property
would be signifcantly unfair, including,
but not limited to the following:
the length of your relationship
any agreements youve made with each
other
contributions made by you to the
others career
As well, the court can look at any other
factor that may lead to signifcant un-
fairness. Tats what the court did here.
Early in 2010, Jack and Jenny agreed
between themselves that Jack would keep
about $100,000 worth of business equip-
ment and vehicles, and Jenny would get
the house instead of child support. Jenny
aferwards paid the mortgage on the house
with help from her family, but despite the
agreement (and a later one where Jack
gifed the house to her if she paid of
their family loans to buy the house), the
house was never transferred to her.
So in August, 2013, Jenny got a court
order to sell the house. Te sale resulted in
net proceeds of about $70,000.
Explaining why splitting the house sale
proceeds in half would be signifcantly
unfair here, the court said: there are
elements to this case that clearly militate
against dividing up the proceeds of sale
equally between the parties. [Jack] in-
tended [Jenny] to have the equity from the
matrimonial home in lieu of child support.
While that might have made sense to the
parties at the time, it refects a view that
all of the [other] matrimonial property, in-
cluding the equipment and vehicles worth
approximately $100,000, belonged to [Jack]
to dispose of as he saw ft without regard
to [Jennys] interests... If the proceeds from
the sale of the matrimonial home were di-
vided equally , [Jack] would be receiving
a double beneft giving [Jenny] the home
in lieu of child support and then efectively
clawing half of it back, while still retaining
the equipment and vehicles.
Te court decided Jenny should get all
the house sale money. Tis would take
care of Jacks outstanding child support
obligations from the time of their separa-
tion to March 1, 2014 (over $35,000). He
could keep the roughly $100,000 worth of
business equipment and vehicles that he
got in 2010.
In addition to an unequal split in some
cases, certain property may be excluded
altogether from the division of family
property.

Global Day Of Action
People concerned about climate change and a clean
energy future can join in local events for the global action,
the Peoples Climate March, on Sunday, September 21.
We will be rallying at Nelson City Hall at 4:30 pm for
speeches. Ten we march to Nelson United Church which
is hosting a potluck dinner. Following the dinner there will
be a showing of the documentary flm Disruption about
this giant global climate action.
People in the Kootenays are active-
ly working to move to a clean energy
future. We naturally want to partici-
pate in this world-wide mobilization
to show its time to get serious about
climate change, says David Reid,
executive director of the West Koote-
nay EcoSociety.
Peoples climate marches will be
taking place around the planet in cit-
ies like Delhi, Jakarta, London, Rio
de Janeiro, Johannesburg, Berlin and
Paris. A huge coalition of over 1,000
environmental organizations, faith
groups, unions and others has come
together worldwide to create the
movement. A huge rally is being or-
ganized in New York. An historic cli-
mate summit hosted by UN Secretary
General Ban Ki-moon will take place
in NYC just a few days later.
Fossil fuel generated climate
change is the biggest threat facing
humanity, says Keith Wiley of Koo-
tenays for a Pipeline-Free BC. Only
a massive public movement will push
governments to cut back on oil, gas
and coal and move to a life-sustain-
ing clean energy future. Tis global
action helps us get going, he says.

bring signs, banners, voices, drums

Passed away August 29, 2014
Born on July 14, 1936.
As a child, Anna lived in the Pend DOreille Valley;
she moved to Fruitvale in her teens. She passed
away peacefully with her family by her side af-
ter suffering a stroke and a battle with cancer.
Anna was a very strong and hardworking
woman who cared for her family very much.
She was always loading up the grandkids
into the motorhome and taking the kids to
Fort Steele or Rock Creek Fair or somewhere
else. Anna enjoyed curling, horseback riding,
slo-pitch and mostly her children and grandchil-
dren. She looked after the family business, NDB
Trucking, until her health declined.
Anna is survived by her husband Neil; sons Ron
of Fruitvale, Len (Donna) of Fruitvale; daughter Shelley (Sid) of Salmo; sis-
ters Irene (Don) Hill of Robson, Kathy (Jack) Seville of Robson; brothers Gary
(Diane) Buckley of Camrose AB, Hugh (Shirley) Buckley of Pend DOreille
Valley; Fred (Janice) Buckley of Pend DOreille Valley; 8 grandchildren,
7 great-grandchildren and many nieces and nephews.
There will be no service at her request. A family gathering will be
set at a later date. She will be missed by all who knew her.
In lieu of owers, donations can be made to the
Canadian Cancer Society.
