Health and Safety Executive (CLDP036a) would like all major hazard installations and MAHPs consultation zones marked on a map in the LDP as an effective way to identify the development proposals that could encroach on consultation zones, and the extent of any encroachment that could occur. Suggest the proposals maps may be suitable for presenting this information.
Health and Safety Executive (CLDP036) conclude that there is the potential for 18 sites allocated in the LDP to encroach on consultation zones. The potential for encroachment is being brought to your attention at an early stage so that you can assess the actual extent of any incompatibility on future developments. All planning authorities should have an authorised administrator who can access the HSEs Planning Advice for Developments near Hazardous Installations Information Package (PADHI+) on the extranet; further information is available on the HSE website: http://www.hse.gov.uk/landuseplanning/padhi.htm.

Health and Safety Executive (CLDP036a) Recommend that sites, pipelines and their associated consultation zones are identified on a Local Development Plan map.
Health and Safety Executive (CLDP036) The HSE do not suggest any modifications resulting from their list of sites which could encroach on consultation zones, but state that when sufficient information on the location and use class of sites becomes available at the pre-planning stages of the local plan, the use of PADHI+ could assist in making informed planning decisions about development compatibility. They also recommend that for Page 3 of 4 speculative testing of advice that the PADHI+ training database is used.
Summary of responses (including reasons) by Planning Authority:
Health and Safety Executive (CLDP036a) Major Hazard Consultation Zones are identified on the 'Designated Sites' map in the LDP. It was considered preferable for ease of understanding and clarity to identify all of the Designations on one base map and all of the Proposals and Opportunities on other maps. No changes are therefore sought to the LDP.
Health and Safety Executive (CLDP036) The Council were aware of the consultation zones when allocating sites through the LDP, and carrying sites through from previously adopted development plans. It is recognised that a PADHI+ assessment will need to be carried out for sites where the consultation zones are still in place (the development of some sites would first require the cessation of the major hazard use which resulted in the consultation area, and therefore they would no longer be relevant). It is considered that this assessment is best carried out when there is sufficient information available on how the site might be developed and that this would be provided during pre-application discussions rather than at the LDP stage. It is not considered that any of the sites allocated are so constrained by the consultation zones that they could not be developed. Detailed responses on the sites listed by HSE is given below: H03 - Carsebridge Road North, Alloa H04 - Carsebridge, Alloa These two sites would only be developed if the bonded warehouses on the sites were relocated, thus removing the subject of the consultation zone. H07 - Earlsfield 1, Alloa Our records show the outer edge of the pipeline consultation zone in this vicinity to be over 25 metres from the proposed housing site (CD080). S02 - Carsebridge, Alloa B03 - Carsebridge South These two sites would only be developed if the bonded warehouses on the sites were relocated, thus removing the subject of the consultation zone. B06 - Hilton Road/Clackmannan Road, Alloa Planning permission granted for the development of a hotel and restaurant (10/00232/PPP). Restaurant element completed (12/00007/FULL). B08 - Dumyat Business Park The southernmost part of the southern site lies within the consultation zone therefore PADHI+ would be carried out. B09 - Station Road, Cambus The site lies within the consultation zone therefore PADHI+ would be carried out. B11 - Kilbagie A gas pipeline serves this site and terminates within it, although there is a relatively small consultation zone around it. PADHI+ would be carried out for any development likely to affect it. B12 - Garvel Farm, Blackgrange B13 - Midtown The northernmost parts of these sites lie within the consultation zone Page 4 of 4 therefore PADHI+ would be carried out. B15 - Meadowend Our records show the outer edge of the pipeline consultation zone in this vicinity to be over 60 metres from the proposed business site (CD081). H49 - Forestmill Planning permission granted in July 2011 for the development of a village, comprising houses, school, business units, shops, hotel, golf course, leisure and community facilities with associated roads, footpaths, other infrastructure, open space and landscaping. There are two Transco pipelines within or adjacent to the site which have significant consultation distances. It is understood that the applicants have confirmed on-going discussions with Scottish Gas Networks to resolve this matter. Their Environmental Statement indicates two possible scenarios, either the diversion or one or both pipelines or some form of protective armouring. The most recent submission from the applicant sets out the principles upon which the development proposal would be based, assuming protection of the gas pipeline. The Council have received confirmation from Scottish Gas Networks that the applicants proposals are generally acceptable. These will inform a finalised masterplan, and will be controlled by a Section 75 Agreement. H50 - Solsgirth A small part of the northwest part of the site lies within the consultation zone and consented applications have been through the PADHI+ assessment. S15 - Forestmill - new primary school S16 - Forestmill golf course and hotel Developers are aware of the consultation zone running through the site as part of their work on the Forestmill development to the north. PADHI+ would be carried out. B21 - Bridge Business Park Only a very small part of the southeast corner of the site is affected by the very outer edge of the consultation zone, however PADHI+ would be carried out if necessary. E02 - Meadowhill opencast restoration Proposal of Application Notice 13/00149/PAN approved for the restoration of the Meadowhill Opencast Quarry site. No changes are therefore sought to the LDP.
