Procedure Relating to the Selection Process by the Recommendation Committee Constituted

to Recommend Officials for the Commission on Investigation of Disappeared Persons and


Truth and Reconciliation Commission
2014 (2071 B.S.)

The Recommendation Committee constituted pursuant to Section 3(3) of the Investigation of the
Disappeared Persons, Truth and Reconciliation Commission Act 2071 has drafted the following
Procedure exercising the power conferred by the Section 3(5) of the Act in order to recommend the
names of the chairperson and the members of the Commission of the Investigation of the
Disappeared Persons and Truth and Reconciliation Commission.

Chapter-1
Preliminary

1. Short Title and Commencement:
(1) The name of this Procedure is Procedure Relating to the Selection Process of Chairperson and
the Members for the Commission of Investigation of the Disappeared Persons and Truth and
Reconciliation Commission - 2014 (2071 B.S.)
(2) This Procedure shall come into force from the day it is endorsed by the Recommendation
Committee.

2. Definition: Unless the subject or context otherwise requires, in this Procedure:
(a) Act means the Investigation of Disappeared Persons, Truth and Reconciliation
Commission Act 2071.
(b) Commission means the Commission of Investigation of the Disappeared Persons and
Truth and Reconciliation Commission established pursuant to Section 3 of the Act.
(c) Chairperson means the Chairperson of the Recommendation Committee.
(d) Committee means the Recommendation Committee established pursuant to Section
3(3) of the Investigation of the Disappeared Persons, Truth and Reconciliation
Commission Act 2071.
(e) Ministry means the Ministry of Peace and Reconstruction.
(f) "Office" means the office of the Committee or any other the office prescribed by the
Committee.


Chapter-2
Procedure of the Committee
3. Meeting of the Committee:
(1) The meeting of the Committee shall be held as per necessity.
(2) The Meeting of the Committee shall take place in the place, date and time as prescribed by
the Chairperson.
(3) Presence of more than fifty percent of the total members of the Committee shall constitute
the quorum for the meeting.
(4) The President shall preside over the meetings of the Committee and in the absence of the
President, the senior member among the members shall preside over the meeting.
(5) The decision of the Committee shall be held unanimously. Decision shall be taken by
majority votes in case of no unanimous decision and the President shall have the final vote in
case of equal votes.
(6) The President shall certify the decisions of the meetings of the Committee.
(7) The Committee, if considers it necessary, may invite experts on the issues relating to its
work in the meetings.
(8) Other procedures related to the meeting of the Committee shall be as determined by the
Committee itself.
4: Budget and Staffs of the Committee:
(1) Ministry shall provide the required budget and staffs to the Committee.

5. Office of the Committee:
(1) The Office of the Committee shall be located at the Ministry of Peace and Reconstruction.

Selection Procedures relating to Recommendations of the chairperson and members of the
Commission

6. Prepare the list of potential candidates:
The Committee shall, in order to recommend chairperson and members for the Commissions
pursuant to Section 5, prepare a list of qualifying potential qualifying candidates pursuant to
Clause 4.
7. Public Notice / Call for Application: While preparing the list pursuant to Clause 6, the notice
to submit the form pursuant to Annex-1 at the Committees office within ten days for the persons
interested to be recommended to be appointed for the positions shall be published in the national
daily for at least two times. Such information can also be broadcasted through radio and television.
8. Submission of Form:1. After the publication of the notice pursuant to Clause 7, the persons
interested in the position of chairperson or members of the Commission should submit the form
pursuant to Annex-11 and the relevant documents to the Committees office within the given
deadline.
2. The committee shall list out the names of the chairperson and the members of the commission as
potential candidates from the persons who have submitted pursuant of Sub Clause 1 who qualify
pursuant to Clause 4 and also not non qualifying pursuant to Clause 5.
9. The Committee can list out the names in the recommendations of other individuals or
organization or on its own: Notwithstanding anything written in Clause 8, the Committee shall
list out the names of persons as potential candidates who qualify pursuant to Clause 4 and also are
not non-qualifying pursuant Clause 5 in the following circumstances:
a. If any individual or organization submits the recommendation of names of people who
qualify pursuant to Clause 4 and are not disqualifying pursuant to Clause 5, to be appointed
as the chairperson or members of the Commission before the Committee.
b. If it is deemed necessary to list the name of a person who qualifies pursuant to Clause 4 and
is not disqualifying pursuant to Clause 5 even if s/he has not submitted the Form pursuant
to Clause 8, sub clause (2) and has not been recommended pursuant based on his/her
special abilities and experience, after consulting such person.
10. Publication of the Name list: The Committee shall make the list prepared to recommend
the names for chairperson and members of the Commission pursuant to Clause 8 and 9,
public.
11. Can provide reaction/comment: 1. If anyone has any comment or reaction about the
persons who have been listed pursuant to Clause 10, s/he can submit his/her reaction at the
Committees office within 5 days of the publication of the notice.
2. The Committee should seriously study and internalize the comments/reaction submitted
pursuant Sub clause 1 while recommending the names for chairperson and members of the
commission.
12. Recommend Names: 1. The Committee shall recommend for the appointment of chairperson
and members of the Commission from the persons listed pursuant to Clause 8 and 0 in the numbers
determined pursuant to Clause 3 (2) of the Act.
2. The recommendation pursuant to sub clause 1 should be made keeping into consideration the
contributions the person can make to the Commission based on his/her qualification and
experience.

13. Can hold Consultations: Before recommending names for the chairperson and members of
the Commission, the Committee can carry out interactions and consultations with the experts in
the area, victims community, international community, human rights defenders and the
representatives of the civil society as per the necessity.
