Right to Information is a fundamental right that


every citizen has. Basically, the RTI gives the citizen
all the information that the citizen want about the Government and what they are doing with the tax money.
Right to Information fights corruption by opening
governance to public participation and scrutiny. RTI
addresses corruption at the national and local levels.
Its a silent revolution in checking corruption across
the country. The RTI act has made the inner working
of the Government transparent. When the average
citizen learns to use this act, he can change the country. The RTI Act has given lot of power that the citizen
can and must use. For example, if a citizen asks for a
phone line or a water connection, if he uses the RTI
Act, he can get his work done quickly. The citizen will
not have to make 15 trips to the Government offices
and bribe and beg the officials to get his work done.
RTI has changed all that. Even if the roads outside the
house terrible or a problem of un-hygiene in the area,
RTI will help the citizen solve the problem. Generally,
if a citizen go into a Government office and demands
why his work has not been done, they will not entertain
him or might even throw him out. RTI being a law, it
becomes harder to do this. If they do not give the citizen the information he want, they have broken a law
and can be punished for it.
Who will give information that is sought for?
One or more officers in every Government Department have been made Public Information Officers (PIO) under section.5 of the RTI Act. If the citizen
wants some information, he needs to file an application with the PIO. The PIOs are responsible for collecting information wanted by the citizen and provide
that information to him. Also, several officers have
been appointed as Assistant Public Information Officers (APIOs). Their job is only to accept applications
from the public and forward it to the right PIO.
Can the PIO refuse to give me information?
A PIO can refuse information on certain subjects
which is provided in Sec.8 of RTI Act. These include
information received in confidence from foreign governments, information prejudicial to security, strategic,
scientific or economic interests of the country, breach
of privilege of legislatures, etc. For an average citizen
the information he will be looking mostly will not come
under these categories, so the PIO cannot refuse to
give information. Every application that is received by
the PIO will be duly acknowledged.
For getting information, the citizen has to pay
charges per page of information provided by the Department. The charges mostly are Rs.1.50 or Rs.2/per page. It is different for different states. Similarly,

there is a fee for inspection of documents.
The citizen can deposit fee in cash or
through a DD or bankers cheque or postal
order. The citizen can then deposit their application either by post or by hand.
What should be done when PIO does
not accept the application?
According to Sec.9 of RTI Act, PIO may
reject a request for information, where such
information would involve an infringement of
copyright subsisting in a person other than
State. Such a rejection can only be done by
assigning valid reason on application being
received. So PIO cannot refuse to accept
the application, but only can refuse information with valid reason.
The citizen should also make a formal
complaint to the respective Information
Commission. The Information Commissioner has the power to impose a penalty
of Rs.25,000/- on the concerned PIO who
refused to accept your application. The PIO
cannot refuse to accept your application
for information under any circumstances.
Even if the information does not pertain to
his/her department/jurisdiction, she/he has
to accept it. If the application does not pertain to that PIO, he would have to transfer it
to the right PIO within 5 days.
Is there an application form to be filled?
Generally there is no form. The citizen
should apply on a plain sheet of paper like
an ordinary application. However, many
states and some ministries and departments have prescribed formats.
What if I cannot locate PIO or APIO?
In case the citizen has problems locating the PIO/APIO the citizen can address
his RTI application to the PIO C/o Head of
Department and send it to the concerned
department with the requisite application
fee. The Head of Department will have to
forward to appropriate PIO.
Is there a time limit to receiving information?
According, to Section.7 of RTI Act, if the
citizen files an application with the PIO, the
citizen must receive information within 30
days. In case the citizen has filed the application with Assistant PIO then information
has to be made available within 35 days.
The Citizen need not give reason why he
needs particular information other than your
contact details (i.e., Name, Address, and
Phone No.)
Often a lot of things start falling in place
just by asking for information. For instance,
the citizen would get the passport or a ration

plication. In many cases, roads got repaired


as soon as the money spent on repairs
was asked. So, seeking information and
questioning the government is an important
step, which in itself is complete in many
cases. But suppose the citizen expose
some corruption or wrongdoing using RTI.
Then, the citizen can complain to vigilance
agencies, CBI or even file an FIR. But one
thing is certain. Seeking information like this
and exposing the corruption does improve
the future. The officials get a clear message
that the people of that area have become
alert and any wrongdoings in future would
not remain hidden as they were in the past.
So, their risks of getting caught increase.
Generally, when the citizen goes to a
Government office to get some work done,
the situation is quite pathetic. The Government employees will either not listen to the
citizen or they will give the citizen a vague
response or they will raise some irrelevant
objection.
This is generally done because the employees are fishing for a bribe. They are
hoping that the citizen will get frustrated and
give them a bribe to move things faster. Do
not give the bribe to them. Use the RTI Act
and get your work done. Just as an example, let us assume that the citizen applied
for a new water connection about a year
back, but still nothing has happened about
it. What the citizen should do is, write an application and send it to the PIO of the Government department the citizen are dealing
with.
The application the citizen write can be
on these lines:
I had applied for a new water connection about a year back, but have not received the same. Copy of the receipt of the
same is enclosed for your reference. Please
provide the following information with respect to the same:
Please provide the daily progress report made on my application.

Normally, it becomes difficult for the
officials to reply to these questions. If they
do reply to all the above questions, this will
lead to them taking action against the officers who have not been performing their
duties. The general experience is that the
moment the citizen file such an application,
the work is done.
The Government has given to us this
great tool that makes us in control of everything that is done around us. Use this tool.
Do not let corruption prevail. But, what is
more important; let us make sure that the
RTI Act remains. Whether the citizen use
the act or not, we need the Act so that others may use the act and keep a watch over
the Government.
Unfortunately, since the law exposes all
the corruption taking place within the Government departments, the officials in the
Government departments are opposing this
law. All the politicians whom sit on the tax
payers money are feeling the crunch. They
too are opposing he law. There are now
talks going on about the diluting the law.
The law in its diluted form will be useless.
People will lose the power that they have to
expose the truth about the Government organizations. The citizen must help save this
law. Whether or not the citizen use the law is
another thing. Help save the RTI Act so that
other may make use of it and help improve
our nation. There are many RTI activists
who everyday exposing Government frauds
and forcing the Government to improve. Let
us make uncorrupt India and endeavor for
development and growth.

ADMINISTRATION OF
HINDU TEMPLES
Hindu places of worship. called temples. are founded by Hindu
Kings., Rajahs, Great saint, and religious minded god worshippers
during the last seven centuries. Most of the temples in TamilNadu
were built thousand of years ago and the kalassams on the top of the
temple gopuram is made of valuable metals/ These metals are now are
valued crores of rupees. The temple so founded in ancient times were
gifted with substantial properties/ To manage these properties and to

of time. constant invasion of our land by foreigners and with politics
taking root in these areas. temple properties were slowly eaten by third
parties and there was need to seek money even to maintain the temple
poojas. It was the time when there was united Madras province and
Madras province consisted of THE PRESENT Tamil Nadu, Andra,
Orrisa, Kannada and Kerala States.
Therefore for the first time it was thought that an enactment is
required to protect the temple properties / When the Panama Raja administration came to office under the 1919 Government of Indian Act.
s comprehensive law was enabled and a Hindu Religious Endowments
Board was constituted under the Hindu Religious Endowment Act
1927. Presidents were appointed as President of the Hindu Religious
Endowments Act. Government gave repayable grants to the Board to
carry on the religious functions in temples and the advances made by

Hindu Religious Endowments Act was the result of R.V.Krishnan Ayyar
who was then the Secretary of the Madras Legislative Council. When

thought there should be some sort of state central of the administration of the religious institutions. It was a time when there was British

best the administration can be brought under
the control of the Government. The Madras
Government then appointed R.V.Krishnan
Ayyar was the special Officer to examine the
issue . It was in 1941, R.V.Krishnan Ayyar
recommended that there can be a direct
control over the administration of Hindu
Religious Institution and there should be a
Area Committee to be constituted to select
the Trustees for the temple and to manage
the temples. The Government accepted the
report of R.V.Krishna Ayyar and constituted
a committee with Sir P.Venkatrama Rao,
former judge of the Madras High Court,
Rajah Sir Muthia Chettiar as member and
R.V.KrishnaAyyar as Member Secretary. The
then President of the Religious Endowments
Board. T.M.ChenniaPillai was directed to coordinate with the committees. It was the time
C.Raajagopalachari Ministry resigned in the
wake of the Congress Resolution asking the
Constars Ministry to resign and the Congress
refused to co-operate with the British in the
Second World war with the British Government. Madras Province was then under the
Governors rule. The government passed order
some time in 1945 converting the Religious
Endowments Board into an Hindu Religious
administration department and appointed
T.M.Chenniah Pillai as the Commissioner
of the Hindu Religious endowments department.
After India became independent ,Hindu
Religious endowments department, was
enlarged and made into an Hindu Religious
Endowments and Charitable administration
Department. Thus charitable institutions who
are not religious in character was brought
under the control of this administration Department. After the congress faced reverse in
the elections and other parties came to power,
Hereditary Trustees were removed and the
government took power to appointment he
Chair Person for the trustees. With political
power taking over the administration of the
Hindu Religious and Charitable endowments,
persons not religiously inclines were made
Chairperson and members of these temples.
Thus a division was made between the administration of the funds of the temples and the
administrate on of the rituals in the temple.
But slowly, interventions and interfearances
has crept ion the temple administration. The
temple administration has now become an
income earning department. as any other department of government. Under this act all the
religious institutions come under the control

of the department and if any one seeks that


the temple is his family one, he should file an
application to the HRCE administration and
get an judicial order to it> the is a judicial
commissioner functioning under the ant as
part of the HRCE administration. One should
get an order that a particular temple is outside
the scope of the HRCE Act.
Of that person who have no belief and
who have no faith in God are being appointed
as the Trustees of the temples. This is totally
wrong. Only Hindus who have faith in god
should be asked to trustees of temples. Only
those people will do the duty with devotion
to god. Of late I am told that J.Jayalalitha
amma Government has issued orders that
only those who have faith in God should be
made trustees of temples. This is correct.
The Hindu Religious Endowments Act
has abolished the Devadasi system,-when
girls are made to dance before idols when
they are taken out. But now the temples are
accommodating not only music but dances
also. Such performance inside the temple
makes it difficult to worshippers and the
crowds which come to attend these music
and dance performances disturb the worshippers.
Religious institutions are divided into
regular religious institutions where any person can worship and there are denominational
institutions which is managed by only those
denomination group. In these temples visitors
may be regulated. But still they are answerable to the department.
In English History, Martin Luther opposed the Roman Church during the time
when Henry the Eight was the King of
England It was he time when Thomas Wolcy
was the Prime Minister for Henry the Eight.
Wolcy wrote a book strongly criticising
other and praising the Roman Church. Wolsy
published the book in the name of the King
of England Henry the Eidth The Roman
Church was impressed about the publication and thus conferred on Henry the Edith
the title of DEFENDER OF THE FAITH.
This title is hereditary and even to day the
British Queen so referred to as, Queens of
England Defender of the Faith. Thus it was
R.V.Krishna Ayyar who conceived the idea of
a legislation to protect the properties of Hindu
temples .Who as special officer examined
the Hindu Religious Endowments act and
wanted steps to be taken to safeguard the
properties of temples and thus R.V.Krisna
Ayyar should be considered as the Defender
of the Hindu Faith.
