Life Insurance - Asset or
Protection

Growing wealth for retirement, protecting ones family,
and creating a legacy are very common financial
goals. One tool that tends to be introduced to that
conversation is life insurance and there can be some
debate over whether it is truly used to accumulate
assets or merely a way to provide a death benefit. The
incredible thing about life insurance is it can truly do
both.

If you are contemplating using life insurance as an
accumulation vehicle and your estate is approaching the
estate tax limits (in excess of $5.34 million per person
for 2014) you may want to consider a strategy called
the Survivorship Standby Trust. This article is not meant
to get into the debate of whether life insurance is a
protection tool and/or accumulation vehicle but rather
to educate on a very advantageous way to own the life
insurance when ones estate is in excess or approaching
$10,000,000 range. Of course youll want to consult
your tax and legal professionals about this decision.

One of the primary benefits of using life insurance as an
accumulation vehicle/tool is that the equity/cash value
build up is tax deferred and can be accessed income tax
free if done properly (assuming the contract is not a
MEC). The downside or quandary to using life insurance
in this fashion is that the death benefit is considered
inclusive in ones estate when doing so. Example, if you
have an estate of say $10,000,000 and you purchase
some form of permanent/cash value life insurance and
it has $2,000,000 death benefit then for estate tax
purposes the $2 million is added to calculate any
potential taxes not the equity/cash value. This means
your gross taxable estate is $12,000,000 not
$10,000,000. Now even though your next estate after
estate tax is larger you still owe a larger estate tax
bill. Ideally, you wouldnt have to pay estate tax on that
additional $2,000,000 of death benefit.

So, how does one have their cake and eat it too?

There is no easy answer or silver bullet here. One
strategy to consider is the Survivorship Standby Trust.

What is it? & Why to consider it? First, the type of cash
value/permanent policy used is a Survivorship or second
to die policy. This is where you are insuring typically a
couple and the death benefit is not paid until the
second person passes. The advantage here from an
accumulation standpoint is that if structured correctly
(assuming the contract is not a MEC) it will provide ten
to fifteen percent more cash value in the policy than if
you were insuring only one person using the same
premium and style policy. The second advantage is that
youll have two owners; a primary owner who is also
the applicant and then a contingent owner. This where
the Survivorship Standby Trust (SST) comes into
play. The primary owner is typically the spouse who is
mostly likely to die first and the SST becomes the
contingent owner and beneficiary. While both spouses
are living the primary owner has unbridled access to the
policys cash value. However when the primary owner
dies then the policys cash value is included in their
estate. The estate tax impact can then be reduced or
eliminated by using their unified credit.

If the non-owner spouse passes first then the policy
owner can transfer the policy to an ILIT or to a third
party. The living spouse (the policy owner) can look at
several options estate planning in such as using their
annual exclusion or unified credit.

Since the non-owner spouse has no incidents of
ownership in the policy and is generally excluded as an
SST beneficiary, neither the cash value nor death
benefit is included in his or her estate, regardless of the
order of deaths.

As a result, upon the survivors death, the SST receives
an income tax and estate tax free benefit, which can be
used to provide estate liquidity, ensure estate
equalization, and create a family legacy or even a
wealth replacement bequest in coordination with a
charitable bequest.

Backdoor Roth IRAs: A Potential Way for High Income Earners to
Participate

The traditional contribution (front door) for Roth IRAs is currently not available for higher income earners. Married
couples earning $191,000 or more and singles earning $129,000 or more in 2014 are still barred from contributing
directly to Roth IRAs.
In 2010, Congress changed the rules and since then anyone can convert a traditional IRA to a Roth IRA. However, higher
income earners are still ineligible to contribute to a Roth IRA.

A Backdoor Roth IRA is a strategy for some higher income earners to participate in Roth IRAs. It is a way for higher
income earners to put money into a traditional IRA and then roll that into a Roth IRA, getting all the benefits. While this
strategy sounds simple, there are several rules that you must know and follow to make sure you do not incur
unintended tax consequences. This is where working with a knowledgeable financial or tax professional can provide
some great guidance and value.

One of the primary benefits of a Roth IRA is that any money contributed grows tax-free and is withdrawn without any
further income taxation. In addition, unlike a traditional IRA, Roth IRAs have no required lifetime minimum distributions.
Another benefit of a Roth IRA is it can be passed on to your heirs income tax free. This allows your funds to grow and
compound tax free over many years.

The backdoor Roth conversion consists of two simple steps:

1) You make a nondeductible contribution to your traditional IRA.
2) Within a couple of days you convert this IRA into a Roth IRA (potentially paying little to no taxes on the conversion).

Theres one big caveat: This strategy works best tax-wise for people who dont already have money in traditional IRAs.
Thats because in conversions, earnings and previously untaxed contributions in traditional IRAs are taxedand that tax
is figured based on all your traditional IRAs, even ones you arent converting.

For an investor who doesnt already hold any traditional IRAs, creating one and then quickly converting it into a Roth IRA
will incur little or no tax, because after a short holding period theres likely to be little or no appreciation or interest
earned in the account. However, if you already have money in traditional deductible IRAs, you could face a far higher
tax bill on the conversion.

If you choose to, you can contribute to a non-deductible IRA for 2014 (the maximum is $5,500 or $6,500 for those age 50
or older). Remember, you must contribute to your IRAs prior to the April 15 2015 tax deadline. This non-deductible IRA
can then be used for your backdoor Roth IRA conversion (please call us prior to doing so because the rules for Roth
conversions can be complicated).

Example of a Backdoor Roth IRA

Bill, a high income physician decides on January 2nd to put $5,500 into a traditional IRA for himself and another $5,500
into a traditional IRA for his wife Mary. Bills income is too high to be able to deduct these contributions from his taxes.
So the next day, he converts the traditional IRAs to Roth IRAs completely tax-free. His income is too high for him to
make a direct contribution into a Roth IRA, but theres no income limit on conversions!

Since Bill and Mary couldnt deduct the contribution anyway, they might as well get the advantage of never paying taxes
on that money again available through the Roth IRA.



Beware of the Pro Rata Rule for Roth Conversions

What is the Pro Rata rule for Roth conversions?

The Pro Rata rule for Roth conversions states that if you have any other deductible IRAs (i.e. a previous 401k that youve
rolled over), the conversion of any contributions becomes a taxable event that youll need to pay taxes on upfront.

The Pro Rata rule for Roth conversions determines whether or not your conversion will be taxable! For taxation
purposes, the IRS will look at your entire IRA holdings (even if they are in different accounts), not just the traditional IRA
you are converting to a Roth IRA, and will determine what your tax bill will be based upon a ratio of IRA assets that have
already been taxed to those IRA assets in total.

The IRS determines the tax on this conversion based on the value of all of your IRA assets. For example Jane, a high
income earner, already has $94,500 in an IRA account, all of which has never been taxed. She decides on January 2nd to
put $5,500 into a new traditional IRA. The next day she converts the new traditional non-deductible IRA to a Roth
IRA. Janes income is too high for her to make a direct contribution into a Roth IRA, but theres no income limit on
conversions. Unlike Bill she has $94,500 in other IRAs (previously non-taxed), so her total IRA assets are now $100,000.
When she converts $5,500 to a Roth IRA, the IRS pro-rates her tax basis on the previous taxation of her total IRA assets,
therefore making this conversion 94.5% taxable ($94,500/100,000 = 94.5%).

So if you plan on using this backdoor IRA strategy, you want to be clear as to whether or not you have any other IRAs. As
you can see, this can be a confusing area and this is where we can help. If you are a high income earner we would be
happy to review your situation to determine if this strategy is in your best interest.

Financial Emergency Preparedness Kit

I recently experienced another earthquake in Los Angeles, a fairly common
occurrence for Angelenos. The earthquake was a reminder for my wife and me to
check our emergency preparedness kit to ensure our spare batteries work,
medicines are up-to-date, food supplies are fresh, the kids clothes are the correct
sizes, and that all of our contact information is current. As a medical professional,
you undoubtedly understand the importance of being prepared to survive in the
aftermath of an emergency. Equally important to preparing a physical emergency kit is establishing and maintaining a
financial emergency preparedness kit. What is a financial preparedness kit?

List of Accounts:
What if something were to happen to you that would prevent you from arranging your financial affairs for your
dependents and loved ones? Is there someone who knows where your bank accounts are held, which credit cards you
have, or whether you own/rent your house? In many marriages, one of the spouses often takes on the role of household
Chief Financial Officer while the other spouse is left uninformed. To prevent confusion and additional stress should
something happen to your household Chief Financial Officer, maintain and update a master list of all your accounts:
banks, credit cards, mortgages, etc. The list should also include whose name the account is in and the type of account.
One effective method to catalog such items is by preparing a net worth statement. Ensure that both spouses are aware
of where this information is held and how to proceed in the case of a family emergency.

Net Worth Statement:
A net worth statement is an individuals equivalent of a company balance sheet. A net worth statement lists all of your
assets, liabilities, and net worth; your net worth is your assets minus your liabilities. Your net worth statement should
list the name of each account, the account number, the value of that account on a given date (to be updated
periodically), who the account belongs to, and whether a beneficiary is designated on the account. A well-crafted net
worth statement is essential to see how your assets grow over time. It will also allow you to run ratios to determine your
debt to income, debt to assets, and debt to equity all measures of ones financial health.

Just as a natural disaster can cause catastrophic physical damages, an unexpected death can leave spouses and loved
ones in the dark about your financial matters. Dont let a financial earthquake happen to alert you about the importance
of creating and maintaining a financial plan.

Tips and Talk from the Inside

If you are a resident or fellow getting ready to plunge into the interview season, here is an
approach that you wont hear from your colleagues and professors. I like to call it walk-a-mile
in their shoes.

Yes it is important to properly format your CV and yes a good cover letter is essential in getting the interview. You
definitely want to dress for success. But if you want to really prep yourself for the coming interview(s) you may want to
spend some time in the shoes of the interviewer. Here are a few techniques to consider:

If you go online you can find a virtual encyclopedia of articles and blog posts on the art of acing the interview. And these
are a great resource. But change your key search words to conducting an effective interview and you will find an
equally massive body of advice that interviewers study. Find out what the interviewer has been trained to look for and
make sure you have what they are looking for.

Study the top 20 questions that interviewers are trained to ask and study the answers that they want to hear. And dont
avoid the tough ones in the hope that they wont be asked. Be prepared to discuss everything that makes you
uncomfortable in the clear and certain knowledge that you will be asked.

Ask about the structure of the interview and with whom you will be meeting. These are fair questions and you have the
right to expect honest answers. If you are going to be facing the senior partners of the practice DO SOME RESEARCH.
Find out where they got their medical training. What would you want to know about them if you were considering them
for a position in your practice.

You will certainly be encouraged to role play for the interview. And again, this is good advice. Articulating answers to
anticipated questions in a simulated interview can give you confidence when it comes time for the real thing. But here is
a twist that will give you some unique insight. Play the role of the interviewer and pair up with a colleague. Grill him or
her with the toughest questions you can imagine. Toss every curve ball you have. And then evaluate how your
colleague handled the interview. Share ideas of how things could have gone better.

Arrive on time, wearing your best threads, carrying your sparkling Curriculum Vitae and armed with the confidence that
you have spent some time inside the head of the interviewers. Know thy enemy may be a bit over the top. But at the
very least know thy interviewer.

Tips & Tools for Todays Physician

As a physician the one thing you dont lack for is advice. Your family, friends,
colleagues and purveyors are blessed with an abundance of juicy tips. Medical
journals that are best when they stick to medicine are often ripe with articles
about personal finance. Other than the charlatans and shysters, all are well
meaning but often inept.

One must keep in mind that as a physician you have invested years of your early life in training and hundreds of
thousands of dollars to pay for your expertise. And then one day, generally at the age of around 30, you suddenly find
yourself with a six figure salary and a not insignificant chunk of free cash flow at the end of the year. Unfortunately you
have received little if any training on the fine art of keeping your money in your pocket and off of the sticky fingers of
others. After all, if you can cure the sick how heal the lame how hard can it be to manage a portfolio?

And the temptations begin the moment you get that first big paycheck. For years as a medical student, resident and
fellow you have lived a life of deprivation and sacrifice. You have mountains of medical education debt, your car is
falling apart and your personal possessions can usually be packed in a U-Hall trailer with room to spare.

Now you are a new physician with needs. And it would seem by the way that sales personnel flock to your side that you
have the means to start meeting those needs. Lets dump the ride-a-wreck and lease a set of wheels in keeping with
your new status. And if you are wise you will see to your spouses transportation needs as well. And of course you need
an appropriately spacious garage attached to trophy house with enough bedrooms and baths to sleep and bath in a new
venue each day of the week and twice on Sunday. And finding financing is NO PROBLEM.

And there is always cash flow that must be put to work. And again the advisors are lined up to help you find
employment for your dollars. Stop and take a deep cleansing breath. Sit down with your spouse and a clean sheet of
paper. Draw line down the middle. Gaze into each others eyes and pledge to be as objective as you can. Now down
the left side list all of the things that you have been putting off and would really like to reward yourself with. Down the
other side list those things that you really need to live modestly but happily.

You may be shocked at how different the two lists may be. And the difference is directly proportional to the degree of
honesty you bring to bear. Now ask you most financially successful colleague to recommend their financial advisor.

Take your list to the advisor and ask for some advice. Keep these things in mind as you plan for the future:

You have started your career much later in life than other professionals.
You will therefore have a much shorter time compounding your savings for retirement.
No one is going to help you pay off your medical education debt.
No one is going to help you with the education bills for your kids.
The government is going to do all that it can to separate you from your earnings through taxes.
You will always be two or three bad investment decisions away from disaster.

With these things in mind, forge a financial plan that is as conservative as the medicine you practice. Then live long and
prosper.

There is a TV ad that made the rounds not too long ago. To be honest, I cant remember
precisely what they were pitching but it showed a guy on the phone with his surgeon
holding a scalpel. The surgeon was instructing him where to make the first incision. His
response was, shouldnt you be doing this?

You have invested years of your life training to be a qualified physician with the skills and knowledge to serve your
patients well. In the same way you would not expect them to be successful in practicing medicine you should ask
yourself what makes you think you are qualified to make complex investing decisions regarding real estate?

The average physician lives one bad real estate deal away from disaster. And the deals are being pitched to you on an
almost daily basis. These tips come from friends, colleagues, salesmen and the occasional online pitchman. Every one
of these sources shares one thing in common, they dont make their living in the real estate arena and none of them
have gotten rich taking their own advice. Why in the world would you think your results would be any better?

In many respects, investing in real estate is as complex and demanding as preparing for a complicated surgical
procedure. Your skill sets though impressive are simply do not prepare your for evaluating all of the factors involved in a
real estate deal. The down stroke on most investments pales in comparison to the ongoing costs including taxes,
maintenance, repairs and utilities. And although prices in some areas have recovered there are other areas where
prices will remain depressed or actually drop further for years to come.

Many doctors have the enviable problem of being flush with cash. This can create a reckless disregard of risk. And
doctors might just as well being wearing a bulls eye on their back. They attract every crook and shyster in the market
place. And they are just as smooth and skilled at what they do as a physician is in his own craft. You simply dont know
what you dont know.

Investing in real estate is not a bad strategy. It can be a very sound part of a long term investment plan. Just be sure
that the plan is created and executed with the advice and direction of those who make their living in real estate and
financial planning. If you insist on investing in real estate relying on only your own expertise and judgment, start out
with real estate index funds such as VGSIX or DFITX. And never lose sight of your limitations.
