TOPIC: HEALTH

TITLE
"An act mandating seminars for nurses in the just and humane treatment of patients
in their medical profession."

PREAMBLE

WHEREAS, a mandatory seminar is needed to remind our professional nurses to
avoid malpractices which seems to be inevitable; to give an equitable health service
to every Filipino patients against discrepancy for health concerns;

WHEREAS, it is an obligation of nursing practitioners as stated in Art. 1 Sec.2 and 3
of Board Resolution No. 220 Series of 2004 also known as Code of Ethics for
Registered Nurses to promote a humane treatment to their patient;

WHEREAS, mandatory seminars pursuant to the Board resolution No. 200 series of
2004 of the Professional regulation Commission known as the Code of Ethics for
registered nurses implies an equitable health service to every Filipino patients to
avoid further fragmentation and distinction for health concerns;

WHEREAS, this policy provides, a required participation of nurses to seminars that
will address the issues of injustice of health care to thus influence the discipline of
nurses and protect the patients stability towards favorable treatment regardless of
incapacity to pay;

WHEREAS, the obligatory seminars eliminates social implications as such unfair and
unjust services in the health care system therewith;

NOW, THEREFORE, there is a need to enact the mandatory seminar for nurses to
ensure the quality of health status that is efficient and reminding of an appropriate
nursing care in an equal and humane treatment towards patients whether in public or
private hospitals and clinics.






























Any nurses in failure to attend is declared to be unlawful in the preceding section or who violates the
provisions of the following section on mandatory seminar in Philippines shall be punished:
1. By penalty of P 500.00, if such failure to attend in the first time;
2. By penalty of 1000. 00, if such failure to attend in the second time;
3. By penalty of P 2000. 00, if such failure to attend in the third time.


Unless such failure is due to reasonable cause and not to willful neglect. For the purpose, failure to
report each nurse is punishable but not to exceed P2,000.


Repealing clause - All laws inconsistent with the provisions of this Act are hereby repealed or

Effectivity clause - This Act shall take effect upon its approval

TRANSITORY PROVISIONS

Section 1. Date of seminars for the whole year will be scheduled on January 1 of the
same year.

Topics to be discussed during the seminar will be decided on the same day. Unless
it is peremptory it can be decided on the second day of the year or a month before
the day of the seminar until they are finalized.

The venue of the seminars will be announced a month before the day of the seminar.

Section 2. Number of the seminars will depend upon the need to conduct such.

Section 3. All seminars will be a 3-day seminar unless otherwise noted in the
schedule made on January 1.

Section 4. Seminars will be held in the morning and afternoon discussing the same
topic.

Unless otherwise provided, the morning schedule shall start at 7:30-12:30am. The
afternoon schedule shall start at 1:30-6:30pm.

Section 5.

SEPARABILITY CLAUSE

(a) If a court of competent jurisdiction should hold any section or part of this
Charter invalid, such holding shall not affect the remainder of this Charter nor
the context in which such section or part so held invalid may appear, except to
the extent that another part of the Charter may be inseparably connected in
meaning and effect with that section or part.

(b) If a court of competent jurisdiction holds a part of this Charter invalid, or if a
change in the State Constitution or law renders a part of this Charter invalid or
inapplicable, the Council by ordinance may take such appropriate action as may
be necessary or desirable because of such holding or change.
EFFECTIVITY CLAUSE

Effectivity - This law shall take effect on January 21, 2015.
