Te Standard Tender Document
These guidance notes have been prepared by the CPTU to assist a Procuring ntity in the
preparation! using this "tandard Tender #ocument ("T#)! for the procurement of $orks and
Physical services having estimated cost up to Tk #$ million% The Procuring ntity should
also refer to the Public Procurement %ct 200& (%ct 'o 2( of 200&) and the Public
Procurement )ules! 200*! issued to supplement the %ct available on CPTU+s ,ebsite-
http-..,,,.cptu.gov.bd.. %ll concerned are advised to refer to the aforementioned %ct and
)ules ,hile participating in any Tendering process.
The use of "T# (P$2) applies ,hen a Procuring ntity intends to select a Tenderer (a
Contractor) for the Procurement of $orks and physical services under /imited Tendering
0ethod (/T0) and 1pen Tendering 0ethod (1T0) ,hile the contract a,ard is being
determined on the basis of lo,est evaluated responsive Tender.
STD (PW#) is intended as a model for admeasurements contracts (unit prices or unit
rates in a &ill of 'uantities) and te main te(t refers to admeasurements )ontracts.
2uidance notes in brackets and italics are provided for both the Procuring ntity and the
Tenderer and as such the Procuring ntity should carefully decide ,hat notes need to
remain and ,hat other guidance notes might be re3uired to assist the Tenderer in preparing
its Tender "ubmission4 so as to minimise the inept Tendering Process. The *n+itation for
Tenders (*FT) is provided in this Tender #ocument for information only.
"T# (P$2) has 5 "ections! of ,hich Section ,- *nstruction to Tenderer and Section .-
!eneral )onditions of )ontract must not be altered or modified under any circumstances.
The follo,ing briefly describes the "ections of "T# (P$2) and ho, a Procuring ntity
should use these ,hen preparing a particular Tender #ocument.
Section ,% *nstructions to Tenderers (*TT)
The 6nstruction to Tenderer (6TT) specifies the instructions and procedures
that govern the tendering process. This "ection also contains the criteria to
be used by the Procuring ntity to determine the lo,est evaluated Tender and
the 3ualifications of the Tenderer to perform the Contract. The 6nstructions to
Tenderer (6TT) are therefore not a part of the Contract.
Section #% Tender Data Seet (TDS)
The Procuring ntity shall specify in the T#" only the information that the 6TT
instructs to be specified in the T#". To facilitate the preparation of the T#"!
its Clause 'umbers are numbered ,ith the same numbers of the
corresponding 6TT Clauses.
Section .% !eneral )onditions of )ontract (!)))
This "ection provides the 2eneral Conditions of Contract that ,ill apply to the
Contract for ,hich the Tender document is issued.
Section /% Particular )onditions of )ontract (P)))
This "ection provides clauses specific to the particular Contract that modify or
supplement Section .- !eneral )onditions of )ontract% The Procuring
ntity should include at the time of issuing the Tender #ocuments all

A. General
,% Scope of Tender 8.8 The Procuring ntity! as indicated in the Tender #ata "heet (TDS)
issues this Tender #ocument for the procurement of $orks and
associated "ervices incidental thereto as specified in the TDS and as
detailed in Section 7- &ill of 'uantities. The name of the Tender and
the number and identification of its constituent lot(s) are stated in the
TDS%

2.8 The 2overnment re3uires that Procuring ntities! as ,ell as Tenderers
and "uppliers shall! during the Procurement proceedings and the
e;ecution of Contracts under public funds! ensure<
(a) strict compliance ,ith the provisions of "ection &( of the
Public Procurement %ct 200& (%ct 2( of 200&)4
9b: abiding by the code of ethics as mentioned in the )ule827 of
the Public Procurement )ules! 200*4
9c: that neither it+s any officer nor any staff or any other agents or
intermediaries ,orking on its behalf engages in any practice
as detailed in the )ule 827.
2.2 6f corrupt! fraudulent! collusive or coercive practices of any kind
determined by the Procuring ntity against any Tenderer alleged to
have carried out such practices! the Procuring ntity shall 3
(a) e;clude the concerned Tenderer from further participation in
the particular Procurement proceeding4 or
(b) re9ect any recommendation for a,ard that had been proposed
for that concerned Tenderer4
or
(c) declare! at its discretion! the concerned Tenderer to be
ineligible to participate in further Procurement proceedings!
either indefinitely or for a specific period of time.

are eligible to participate in the Tender under
Limited Tendering Metod.

all potential Tenderers.
=.= The Tenderer shall have the legal capacity to enter into the Contract.
=.( Tenderers and all parties constituting the Tenderer shall not have a

of its Persons in different names! shall not be under a declaration of
ineligibility for corrupt! fraudulent! collusive or coercive practices as
stated under 6TT Clause 2 .
=.& The Tenderer is solvent! e.g. the Tenderer is financially capable to
perform the contract for the proposed Procurement.
=.7 The Tenderer shall have fulfilled its obligations to pay ta;es under the
provisions of la,s and regulations of ?angladesh.

C. Qualification Criteria
7% !eneral ..) Tenderer to be 3ualified by meeting predefined! precise minimum
re3uirements! ,hich entails setting pass.fail criteria! ,hich if not met by

..* To 3ualify for a multiple number of lots in a package for ,hich Tenders
are invited in the invitationfor Tenders! the Tenderers shall demonstrate
having resource and e;perience sufficient to meet the aggregate of the
3ualifying criteria for individual lots.

/.) The Tenderer shall have the construction e;perience of
satisfactory completion of similar ,orks of a minimum value under a
single or multiple numbers of contracts over a period! as specified in
the TDS.
9% Financial )riteria
*.8 The Tenderer shall have the follo,ing minimum level of financial
capacity to 3ualify for the performance of the $orks under the Contract.
(a) the average annual construction turnover as specified in the
TDS during the period specified in the TDS
(b) availability of minimum li3uid assets or ,orking capital or
credit facilities from a ?ank! as specified in the TDS%

5.8 The successful Tenderer shall under no circumstances assign the
$orks or any part of it to the "ubcontractor(s).

D. Tender Preparation

80.8 The Tenderer ,ho submits or participates in more than one (8) Tender
in one (8) lot ,ill cause all the Tenders of that particular Tenderer to be

and documents relating to the Tender may be ,ritten in nglish or

82.8 The Tender prepared by the Tenderer shall comprise the follo,ing-

completed ,ithout any alterations to its format! filling in all blank
spaces ,ith the information re3uested! failing ,hich the Tender
may be considered as non<responsive as being incomplete4

(c) The priced ?ill of @uantities using the form(s) furnished in
Section 7- &ill of 'uantitiesD

)+.) The Tenderer shall fill in unit rates or prices for all items of the
$orks both in figures and in ,ords as described in the &O'. The price
to be 3uoted in the Tender "ubmission /etter shall be the total price of
the Tender.
)+.* %ll applicable ta;es! custom duties! A%T and other levies payable by
the Contractor under the Contract shall be included in the unit rates!
prices and the total Tender price submitted by the Tenderer.
)+.+ The items 3uantified in the &O' for ,hich no unit rates or prices have
been 3uoted by the Tenderer ,ill not be paid for! by the Procuring ntity
,hen e;ecuted and shall be deemed covered by the amounts of other
rates or prices in the ?1@ and! it shall not be a reason to change the
Tender price.
8=.( The price of a Contract shall be fi;ed in ,hich case the unit rates or
prices may not be modified in response to changes in economic or
commercial conditions.

nature and siBe on case<by<case procurement proceedings
performed for each of the last years along ,ith the sums!
dates and recipients4 public or private as stated under 6TT
clause 7.
(b) details of average annual construction turnover for a period as
stated under 6TT "ub Clause *.8(a)4
(c) details of ade3uacy of ,orking capital for this Contract i.e.
access to line(s) of credit and availability of other financial
resources as stated under 6TT "ub Clause *.8(b)4
(d) details of Procuring ntities ,ho may be contacted! if
necessary! by this Procuring ntity4 and
(e) authority to seek references from the Tenderer+s bankers or
any other sources.

)..) Tenders shall remain valid for the period specified in the TDS after the
date of Tender submission deadline prescribed by the Procuring ntity.

form of a bank draft or pay order.

guarantee issued by a scheduled ?ank of ?angladesh! in the format
(Form PW#3.) furnished in "ection >- Tender and Contract :orms.
8*.= The Tender "ecurity shall remain valid for at least t,enty eight (2*)
days beyond the e;piry date of the Tender Aalidity.
8*.( Tender not accompanied by a valid Tender "ecurity shall be considered
as non<responsive.

85.8 The Tender security pursuant to )ule 2> of the Public Procurement
)ules!200* may be forfeited if a Tenderer-
(a) ,ithdra,s its Tender after opening of Tenders but ,ithin the
validity of the Tender4 or
(b) refuses to accept a 'otification of %,ard 4 or
(c) fails to furnish performance security4 or
(d) refuses to sign the Contract 4 or
(e) does not accept the correction of the Tender price follo,ing the
correction of arithmetic errors

comprising the Tender as described in 6TT Clause 82 and clearly mark

services at the address(s) as specified in the TDS and no later than the

F. Tender Opening E!aluation

2&.8 Tenders shall be opened pursuant to )ule 57 follo,ing steps in Part #
of "chedule 6A of the Public Procurement )ules! 200*.

of Tenders at the primary place as specified in the TDS but no later
than ON; =O"< after e;piry of the submission deadline at the same
primary place.

Tenders
*/.) The Tender valuation Committee (TC) may consider a Tender as
responsive in the valuation! only if it is submitted in compliance ,ith
the mandatory re3uirements set out in the Tender #ocument. The
evaluation process should begin immediately after tender opening
follo,ing four broad steps-
(a) Preliminary e;amination
(b) Technical e;amination and responsiveness
(c) :inancial evaluation and price comparison
(d) Post<3ualification of the lo,est evaluated responsive Tender.

,orks in accordance ,ith standard methods determined by the

)..* 6f the Pro9ect 0anager instructs the Contractor to carry out a test not
specified in the "pecification to check ,hether any ,ork has a
#efect and the test sho,s that it does! the Contractor shall pay for
the test and any samples.
,8% <eCection of Works 87.8 6f! as a result of an e;amination! inspection! measurement or
testing! of $orks it is found to be defective or other,ise not in
accordance ,ith the Contract! the Pro9ect 0anager may re9ect the
$orks by giving notice to the Contractor! ,ith reasons. The
Contractor shall then promptly make good the defect and ensure
that the re9ected $orks subse3uently complies ,ith the Contract.

=2.8 The Pro9ect 0anager shall! ,ithin fourteen (8() days after receiving
the Contractor+s application stated under 2CC "ub Clause =8.84
(a) issue the Completion Certificate to the Contractor! stating

completed in accordance ,ith the Contract! e;cept for any
minor outstanding ,ork and defects ,hich may not
substantially affect the use of the $orks or part thereof
for their intended purpose (either until or ,hilst this ,ork

(b) re9ect the application! giving reasons and specifying the

The ob9ectives of the ?ill of @uantities (?1@) are4
(a) to provide sufficient information on the 3uantities of $orks to be performed to
enable Tenders to be prepared efficiently and accurately4 and
(b) ,hen a Contract has been entered into! to provide a priced ?1@ for
use in the periodic valuation of $orks e;ecuted.
(c) a separate item for tests that may be re3uired to be carried out to ensure the
3uality of materials and ,orks.

6n order to attain these ob9ectives! the items in the ?ill of @uantities should be grouped into
sections to distinguish bet,een those parts of the $orks that by nature! location! access!
timing! or any other special characteristics may give rise to different methods of
construction! phasing of the $orks! or considerations of cost. 2eneral items common to all
parts of the $orks may be grouped as a separate section in the ?ill of @uantities.
Consistent ,ith these re3uirements! the layout and content of the ?1@ should be as
simple and brief as possible. @uantities should be computed net from the #ra,ings!
unless directed other,ise in the Contract! and no allo,ance should be made for bulking!
shrinkage! or ,aste. @uantities should be rounded up or do,n ,here appropriate and
spurious accuracy should be avoided.
The 3uantities given in the ?ill of @uantities are estimated and provisional! and are given
to provide a common basis for Tendering. The basis of payment ,ill be the actual
3uantities of ,ork ordered and carried out! as measured by the Contractor and verified by
the Pro9ect 0anager and valued at the rates or prices 3uoted in the priced ?ill of
@uantities! ,here applicable! and other,ise at such rates or prices as the Pro9ect 0anager
may fi; ,ithin the terms and conditions of the Contract.
The method of measurements of completed ,orks for payment shall be based on metric
system unless other,ise unavoidable.

6f in preparing ?ill of @uantities of its Tender! the Tenderer has made errors in the unit rates
or prices or the total price! and ,ishes to correct such errors prior to submission of its
Tender! it may do so! but shall ensure that each correction of error is properly initialled by

Notes on Specifications
% set of precise and clear specifications is a prere3uisite for Tenderers to respond realistically and
competitively to the re3uirements of the Procuring ntity ,ithout introducing deviations or
conditionalities in their Tenders. 6n the conte;t of national competitive Tendering! the specifications must
be drafted to permit the ,idest possible competition and! at the same time! present a clear statement of
the re3uired standards of ,orkmanship! materials! and performance of the ,orks to be procured. 1nly
if this is done ,ill the ob9ectives of economy! efficiency! and fairness in procurement be realiBed!
responsiveness of Tenders be ensured! and the subse3uent task of Tender evaluation facilitated. The
specifications should re3uire that all goods and materials to be incorporated in the $orks be ne,!
unused! of the most recent or current models! and incorporate all recent improvements in design and
materials! unless provided other,ise in the Contract.
"amples of specifications from previous similar pro9ects are useful in this respect. 0ost specifications
are normally ,ritten specially by the Procuring ntity or Pro9ect 0anager to suit the Contract $orks in
hand. There is no standard set of "pecifications for universal application in all sectors! but there are
established principles and practices! ,hich are reflected in these documents.
There are considerable advantages in standardiBing 2eneral "pecifications for repetitive $orks in
recogniBed public sectors! such as high,ays! ports! rail,ays! urban housing! flood control! drainage
and irrigation! and ,ater supply! ,here similar conditions prevail. The 2eneral "pecifications should
cover all classes of ,orkmanship! materials! and e3uipment commonly used in construction! although
not necessarily to be used in a particular $orks Contract. #eletions or addenda should then adapt the
2eneral "pecifications to the particular $orks. "uch 2eneral "pecifications are those issued by the
specialised ministries.professional bodies in ?angladesh and.or those of the 6nternational "tandards

Care must be taken in drafting specifications to ensure that they are not restrictive. 6n the specification
of standards for goods! materials! and ,orkmanship! recogniBed national standards should be used as
much as possible. $here other particular standards are used the specifications should state that
goods! materials! and ,orkmanship that meet other authoritative standards! and ,hich ensure
substantially e3ual or higher 3uality than the standards mentioned! ,ill also be acceptable.
Provision as such be kept that ,herever reference is made in the Contract to specific standards and
codes to be met by the goods and materials to be furnished! and ,ork performed or tested! the
provisions of the latest current edition or revision of the relevant standards and codes in effect shall
